महाराष्ट्र महानगरपालिका अधिनियम.

क्रमांक एमसीओ-२०२१/प्र.क्र.१ ९ २ / नवि-१४. ज्याअर्थी , महाराष्ट्र महानगरपालिका ( सुधारणा ) अध्यादेश, २०२१ ( सन २०२१ चा महा . ४ ) , दिनांक ३० सप्टेंबर , २०२१ अन्वये महाराष्ट्र महानगरपालिका अधिनियम ( १ ९ ४ ९ चा महा. ५ ९ ) यामध्ये सुधारणा करण्यात आली असून त्याद्वारे महानगरपालिकेतील प्रत्येक प्रभागांमध्ये शक्य तेथवर तीन मात्र, दोनपेक्षा कमी नाहीत आणि चारपेक्षा अधिक होणार नाहीत इतके पालिका सदस्य निवडून देण्यात येतील अशी तरतूद करण्यात आलेली आहे ;

आणि ज्याअर्थी, उक्त तरतुदी अंमलात आणण्याच्या उद्देशाने महिलांकरिता तसेच अनुसूचित जाती , अनुसूचित जमाती, नागरिकांचा मागासवर्ग प्रवर्ग यातील उमेदवाराकरिता महानगरपालिकेमधील प्रभागांमध्ये पालिका सदस्यांच्या राखीव जागांचे वाटप करण्याच्या आणि त्या चक्रानुक्रमे फिरविण्याच्या संबंधात नियम करणे इष्ट वाटते ;

आणि ज्याअर्थी , याबाबत तात्काळ कार्यवाही करण्यासाठी या नियमांची पूर्वप्रसिध्दीची शर्त काढून टाकणे , जीमुळे आवश्यक व्हावे अशी परिस्थिती अस्तित्वात असल्याबद्दल महाराष्ट्र शासनाची खात्री पटली आहे .

त्याअर्थी , आता महाराष्ट्र महानगरपालिका अधिनियम ( १ ९ ४ ९ चा महा . ५ ९ ) कलम ५ अ आणि कलम ४५६ - अ द्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि यासंदर्भात त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून तसेच यासंदर्भात अगोदर काढलेल्या इतर सर्व अधिसूचना, आदेश , नियम , इत्यादींचे अधिक्रमण करून , महाराष्ट्र शासन, राज्य निवडणूक आयुक्तांशी विचार विनिमय केल्यानंतर, याद्वारे पुढील नियम करीत आहे , ते असे :-

१. संक्षिप्त नाव:-या नियमांना महाराष्ट्र महानगरपालिका ( प्रभागांमध्ये राखीव जागांचे वाटप करणे आणि त्या जागा चक्रानुक्रमे फिरविण्याची पध्दत ) नियम , २०२१ असे म्हणण्यात येईल .

भाग एक-- अ-(म.उ.वि. ) - ८२-१ २

महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग , डिसेंबर १५ , २०२१ / अग्रहायण २४ , शके १ ९ ४३ २. व्याख्या: - ( एक) या नियमांमध्ये संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर ;

(अ) " अधिनयम " याचा अर्थ, महाराष्ट्र महानगरपालिका अधिनियम (१ ९ ४ ९ चा महा. ५ ९ ) असा आहे ;

(ब) " प्रभाग " याचा अर्थ , पालिका सदस्यांना निवडून देण्याच्या प्रयोजनार्थ, महानगरपालिकेचे क्षेत्र ज्या प्रादेशिक मतदार संघांमध्ये विभागलेले असेल त्यांच्यापैकी प्रादेशिक मतदार संघ, असा आहे.

(दोन ) या नियमांमध्ये वापरलेले , परंतु या अगोदर व्याख्या न केलेले शब्द व शब्द प्रयोग यांना अधिनियमामध्ये जो अर्थ नेमून दिलेला असेल तोच अर्थ असेल.

३. अनुसूचित जातींसाठी राखून ठेवलेल्या जागांचे वाटप करण्याची व त्या चक्रानुक्रमे फिरविण्याची पध्दत:

( १ ) अनुसूचित जातींच्या उमेदवारांसाठी महानगरपालिका सदस्यांच्या जागा राखून ठेवण्याकरिता , प्रथम प्रभागांची मांडणी ही , ज्या प्रभागातील अनुसूचित जातीच्या लोकसंख्येची टक्केवारी त्या प्रभागातील एकूण लोकसंख्येच्या तुलनेत सर्वाधिक असेल अशा प्रभागापासून सुरुवात करुन , उतरत्या क्रमाने करण्यात येईल ;

( २ ) जेथे अनुसूचित जातीच्या उमेदवारांसाठी राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागांची संख्या , महानगरपालिकेतील प्रभागांच्या संख्येइतकी किंवा कमी असेल तेथे, प्रत्येक प्रभागातील एक जागा ही , अनुसूचित जातींच्या लोकसंख्येची टक्केवारी सर्वाधिक असलेल्या प्रभागापासून सुरुवात करुन उतरत्या क्रमाने अनुसूचित जातींसाठी नेमून देण्यात येईल ;

परंतु, महानगरपालिकेच्या सर्व प्रभागांमध्ये असे आरक्षण चक्रानुक्रमे फिरविले जाईपर्यंत , ज्या प्रभागात अनुसूचित जातींसाठी अशी कोणतीही जागा यापूर्वी राखून ठेवलेली नव्हती अशा प्रभागांकरिता , महानगरपालिकेच्या पुढील निवडणुकांमध्ये , शक्य होईल तेथवर , या पोट-नियमाखाली राखून ठेवलेल्या जागा चक्रानुक्रमे फिरविण्यात येतील ;

( ३ ) जेथे अनुसूचित जातीच्या उमेदवारांसाठी राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागांची संख्या ही महानगरपालिकेतील प्रभागांच्या संख्येपेक्षा जास्त असेल तेथे ,-

(अ ) प्रथम , प्रत्येक प्रभागातील एक जागा अनुसूचित जातींसाठी नेमून देण्यात येईल ; आणि

(ब) त्यानंतर, राखीव जागा नेमून देण्याच्या प्रयोजनासाठी , अनुसूचित जातींसाठी राखून ठेवावयाच्या सर्व जागा नेमून दिल्या जाईपर्यंत , अनुसूचित जातींच्या लोकसंख्येची टक्केवारी सर्वाधिक असलेल्या प्रभागांपासून सुरुवात करुन उतरत्याक्रमाने प्रभागातील एक जागा, अनुसूचित जातीसाठी नेमून देण्यात येईल:

परंतु महानगरपालिकेच्या सर्व प्रभागांमध्ये , असे आरक्षण चक्रानुक्रमे फिरविले जाईपर्यंत , ज्या प्रभागात अनुसूचित जातींसाठी केवळ एकच जागा यापूर्वी राखून ठेवलेली होती अशा प्रभागांकरिता , महानगरपालिकेच्या पुढील निवडणुकांमध्ये , शक्य होईल तेथवर, या पोट- नियमाखाली राखून ठेवलेल्या जागा चक्रानुक्रमे फिरविण्यात येतील.

४. अनुसूचित जमातीसाठी राखून ठेवलेल्या जागांचे वाटप करण्याची व त्या चक्रानुक्रमे फिरविण्याची पध्दत: - (१ ) अनुसूचित जमातीच्या उमेदवारांसाठी महानगरपालिका सदस्यांच्या जागा राखून ठेवण्याकरिता , प्रथम प्रभागांची मांडणी ही , ज्या प्रभागातील अनुसूचित जमातींच्या लोकसंख्येची टक्केवारी त्या प्रभागातील एकूण लोकसंख्येच्या तुलनेत सर्वाधिक असेल अशा प्रभागापासून सुरुवात करुन, उतरत्या क्रमाने करण्यात येईल ;

( २ ) जेथे अनुसूचित जमातीच्या उमेदवारांसाठी राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागांची संख्या, महानगरपालिकेतील प्रभागांच्या संख्येइतकी किंवा कमी असेल तेथे , प्रत्येक प्रभागातील एक जागा ही , अनुसूचित जमातींच्या लोकसंख्येची टक्केवारी सर्वाधिक असलेल्या प्रभागापासून सुरुवात करुन उतरत्या क्रमाने अनुसूचित जमातींसाठी नेमून देण्यात येईल ;

परंतु महानगरपालिकेच्या सर्व प्रभागांमध्ये असे आरक्षण चक्रानुक्रमे फिरविले जाईपर्यंत , ज्या प्रभागात अनुसूचित जमातींसाठी अशी कोणतीही जागा यापूर्वी राखून ठेवलेली नव्हती अशा प्रभागांकरिता , महानगरपालिकेच्या पुढील निवडणुकांमध्ये, शक्य होईल तेथवर , या पोट-नियमाखाली राखून ठेवलेल्या जागा चक्रानुक्रमे फिरविण्यात येतील .

( ३ ) जेथे अनुसूचित जमातीच्या उमेदवारांसाठी राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागांची संख्या ही महानगरपालिकेतील प्रभागांच्या संख्येपेक्षा जास्त असेल तेथे,- महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग , डिसेंबर १५ , २०२१ / अग्रहायण २४ , शके १ ९ ४३ ३ ( अ) प्रथम , प्रत्येक प्रभागातील एक जागा अनुसूचित जमातींसाठी नेमून देण्यात येईल; आणि

(ब) त्यानंतर , राखीव जागा नेमून देण्याच्या प्रयोजनासाठी , अनुसूचित जमातींसाठी राखून ठेवावयाच्या सर्व जागा नेमून दिल्या जाईपर्यंत , अनुसूचित जमातींच्या लोकसंख्येची टक्केवारी सर्वाधिक असलेल्या प्रभागांपासून सुरुवात करुन उतरत्याक्रमाने प्रभागातील एक जागा , अनुसूचित जमातीसाठी नेमून देण्यात येईल :

परंतु महानगरपालिकेच्या सर्व प्रभागांमध्ये, असे आरक्षण चक्रानुक्रमे फिरविले जाईपर्यंत, ज्या प्रभागात अनुसूचित जमातींसाठी केवळ एकच जागा यापूर्वी राखून ठेवलेली होती अशा प्रभागांकरिता , महानगरपालिकेच्या पुढील निवडणुकांमध्ये, शक्य होईल तेथवर , या पोट- नियमाखाली राखून ठेवलेल्या जागा चक्रानुक्रमे फिरविण्यात येतील.

५. एकाच प्रभागामध्ये अनुसूचित जाती व अनुसूचित जमाती या दोन्हींसाठी जागा आरक्षित होत असल्यास, अशा आरक्षित जागा वाटपाची पद्धत:- अनुसूचित जाती किंवा अनुसूचित जमातीकरिता राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागा नेमून देतेवेळी अनुसूचित जातीच्या आणि अनुसूचित जमातीच्या लोकसंख्येच्या टक्केवारीच्या आधारे जर , एकाच प्रभागामध्ये अनुसूचित जाती व अनुसूचित जमातीच्या जागा आरक्षित होत असतील तर -

(i) तीन अथवा चार सदस्यांच्या प्रभागात या दोन्ही प्रवर्गाच्या जागा देता येतील .

( ii ) मात्र दोन सदस्यांच्या प्रभागातील एक जागा ही , अनुसूचित जाती व अनुसूचित जमाती या दोन प्रवर्गापैकी ज्या प्रवर्गाच्या लोकसंख्येची टक्केवारी अधिक असेल त्या प्रवर्गाकरिता राखून ठेवण्यात येईल.

६. नागरिकांच्या मागासवर्ग प्रवर्गाकरिता जागांचे वाटप करण्याची पद्धत :- ( १ ) नागरिकांच्या मागासवर्ग प्रवर्गातील उमेदवारांकरिता राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागा पुढे दिलेल्या पद्धतीने प्रभागांमध्ये नेमून देण्यात येतील , ती अशी, (अ ) नागरिकांच्या मागासवर्ग प्रवर्गातील उमेदवारांकरिता राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागांची संख्या ही , अनुसूचित जाती व अनुसूचित जमाती यांच्याकरिता जागा राखून ठेवलेले प्रभाग वगळून उर्वरित प्रभागांच्या संख्येइतकी अथवा कमी असेल तर ,

( i) प्रथम जर त्या ठिकाणी चार सदस्यांचा प्रभाग असेल आणि त्या प्रभागातील जास्तीत जास्त एक जागा अनुसूचित जाती किंवा अनुसूचित जमातीकरिता राखून ठेवण्यात आली असेल तर त्या प्रभागामधील एक जागा नागरिकांच्या मागासवर्ग प्रवर्गाकरिता थेट नेमून देण्यात यावी .

( ii ) त्यानंतर वरील प्रभाग व उपरोक्त उल्लेखित चार सदस्यांचे प्रभाग व अनुसूचित जाती किंवा अनुसूचित जमाती यांच्याकरिता जागा राखून ठेवलेले प्रभाग वगळून उर्वरित प्रभागांमधून सोडत काढून नागरिकांच्या मागासवर्ग प्रवर्गातील एक जागा वाटण्यात यावी.

(ब) नागरिकांच्या मागासवर्ग प्रवर्गातील उमेदवारांकरिता राखून ठेवावयाच्या महानगरपालिका सदस्यांच्या जागेची संख्या ही , अनुसूचित जाती व अनुसूचित जमाती यांच्याकरिता जागा राखून ठेवलेले प्रभाग वगळून उर्वरित प्रभागांच्या संख्येपेक्षा जास्त असेल तर ,

( i ) प्रथम जर त्या ठिकाणी चार सदस्यांचा प्रभाग असेल आणि त्या प्रभागातील जास्तीत जास्त एक जागा अनुसूचित जाती किंवा अनुसूचित जमातीकरिता राखून ठेवण्यात आली असेल तर त्या प्रभागामधील एक जागा नागरिकांच्या मागासवर्ग प्रवर्गाकरिता थेट नेमून देण्यात यावी.

( ii ) त्यानंतर अनुसूचित जाती किंवा अनुसूचित जमाती यांच्याकरिता जागा राखून ठेवलेले प्रभाग वगळून उर्वरित प्रभागातील एक जागा नागरिकांच्या मागासवर्ग प्रवर्गाकरिता थेट नेमून देण्यात येईल;

( iii ) त्यानंतर नागरिकांच्या मागासवर्ग प्रवर्गाकरिता राखून ठेवावयाच्या उर्वरित जागा , कोणत्याही असतील तर, ज्या प्रभागांमध्ये एक जागा अनुसूचित जाती किंवा अनुसूचित जमातीकरिता राखून ठेवलेली असेल अशा तीन सदस्यीय प्रभागांपैकी जेथे किमान दोन जागा अराखीव आहेत त्यामधून सोडतीने नेमून देण्यात येईल;

भाग एक-- अ-(म.उ.वि. )-८२-२ ४

महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग , डिसेंबर १५ , २०२१ / अग्रहायण २४ , शके १ ९ ४३ (२ ) नागरिकांच्या मागासवर्ग प्रवर्गाकरिता अशाप्रकारे राखून ठेवलेल्या जागा, शक्य तेथवर, ज्या प्रभागांमध्ये अगोदरच्या निवडणुकांमध्ये नागरिकांच्या मागासवर्ग प्रवर्गाकरिता जागा राखून ठेवण्यात आली नव्हती , अशा प्रभागांमध्ये , जोपर्यंत असे आरक्षण चक्रानुक्रमे फिरविले जात नाही तोपर्यंत महानगरपालिकेच्या त्यानंतरच्या निवडणुकांमध्ये राखून ठेवण्यात येतील .

१ ) एखाद्या प्रभागात महिलांसाठी राखून ठेवावयाच्या महानगरपालिका ७. महिलांसाठी जागा नेमून देण्याची पद्धत : - (

सदस्यांच्या जागांची संख्या ही खालीलप्रमाणे असेल

(अ ) दोन जागा असलेल्या प्रभागातील एक जागा ही महिलांसाठी राखून ठेवण्यात येईल.

(ब) तीन जागा असलेल्या प्रभागातील यथास्थिती एक किंवा दोन जागा या, महिलांसाठी राखून ठेवण्यात येतील.

(क) चार जागा असलेल्या प्रभागातील दोन जागा या महिलांसाठी राखून ठेवण्यात येतील.

( २ ) अनुसूचित जाती किंवा अनुसूचित जमातीच्या महिलांसाठी राखून ठेवावयाच्या जागा पुढीलप्रकारे राखून ठेवण्यात येतील :-

(अ) अनुसूचित जाती महिला प्रथम , अनुसूचित जातीतील महिलांसाठी राखून ठेवावयाच्या जागा या अनुसूचित जातीसाठी राखीव असलेल्या प्रभागांमधून सोडतीने नेमून देण्यात येतील .

(ब ) अनुसूचित जमाती महिला -

( i) प्रथम ज्या प्रभागात अनुसूचित जाती व अनुसूचित जमाती दोन्ही जागा आरक्षित असतील आणि जर अशा प्रभागातील अनुसूचित जातीची जागा त्या प्रवर्गातील महिलांकरिता आरक्षित न झाल्यास , अनुसूचित जमातीची जागा अनुसूचित जमातीच्या महिलांकरिता थेट आरक्षित करण्यात येईल .

( ii ) त्यानंतर , अनुसूचित जमातीतील महिलांसाठी राखून ठेवावयाच्या उर्वरित जागा या अनुसूचित जमातीसाठी राखीव असलेल्या प्रभागांमधून सोडतीने नेमून देण्यात येतील.

( ३ ) नागरिकांच्या मागासवर्ग प्रवर्गातील महिला नागरिकांच्या मागासवर्ग प्रवर्गाकरिता आरक्षित जागांमधून नागरिकांच्या मागासवर्ग प्रवर्गातील महिलांकरिता पुढीलप्रमाणे जागा राखून ठेवण्यात येतील : -

(i ) नागरिकांच्या मागासवर्ग प्रवर्गातील महिलांसाठी राखून ठेवावयाच्या जागा देतांना प्रथम अशा प्रभागांपैकी जे प्रभाग अनुसूचित जाती किंवा अनुसूचित जमातीकरिता आरक्षित झालेले आहेत , मात्र त्या प्रवर्गातील महिलांसाठी राखीव झालेले नाहीत त्या प्रभागातील जागा नागरिकांच्या मागासवर्ग प्रवर्गातील महिलांसाठी थेट नेमून देण्यात येईल.

( ii) जर चार सदस्यांच्या प्रभागात नागरिकांच्या मागासवर्ग प्रवर्गाकरिता दोन जागा आरक्षित होत असल्यास त्यामधील एक जागा नागरिकांच्या मागासवर्ग प्रवर्गातील महिलांसाठी थेट नेमून देण्यात येईल.

( iii ) त्यानंतर नागरिकांच्या मागासवर्ग प्रवर्गातील महिलांकरिता आरक्षित करावयाच्या उर्वरित जागा असल्यास , त्या जागा ज्या प्रभागांमध्ये कोणत्याही प्रवर्गातील महिलांचे आरक्षण दिलेले नाही अशा नागरिकांच्या मागासवर्ग प्रवर्गाच्या उर्वरित प्रभागांतून सोडतीने देण्यात येतील .

( ४ ) एकदा अनुसूचित जाती, अनुसूचित जमाती व नागरिकांचा मागासवर्ग प्रवर्गातील महिलांकरिता समुचित प्रभागांमध्ये जागा राखून ठेवण्यात आल्यानंतर महिलांकरिता राखीव जागा पुढीलप्रमाणे नेमून देण्यात येतील:-

(अ) ज्या प्रभागामध्ये कोणत्याही प्रवर्गातील महिलांकरिता एकही जागा आरक्षित नाही अशा प्रभागात महिलांची एक जागा थेट नेमून देण्यात येईल .

(ब) त्यानंतर ज्या प्रभागामध्ये किमान दोन अराखीव जागा असतील त्या प्रभागात या नियमाच्या पोट- नियम ( १ ) च्या अधीन राहून सर्वसाधारण महिलांची एक जागा थेट अथवा सोडतीने देण्यात येईल .

(क) त्यानंतर ज्या प्रभागांमध्ये वरील पोट- नियम ( अ) व ( ब) नुसार महिला आरक्षण दिलेले नाही अशा प्रभागांमध्ये या नियमाच्या पोट- नियम (१ ) च्या अधीन राहून आवश्यकतेनुसार सोडतीने सर्वसाधारण महिलांची एक जागा देण्यात येईल.

५ महाराष्ट्र शासन राजपत्र असाधारण भाग एक- अ मध्य उप- विभाग , डिसेंबर १५ , २०२१ /अग्रहायण २४ , शके १ ९ ४३ (५ ) सर्व प्रभागांमध्ये असे आरक्षण चक्रानुक्रमे फिरविले जाईपर्यंत , महानगरपालिकेच्या यापूर्वीच्या निवडणुकांमध्ये एखाद्या विशिष्ट प्रवर्गातील महिलांसाठी जेथे अशी कोणतीही जागा नेमून देण्यात आली नव्हती त्या प्रभागांसाठी, या नियमांच्या प्रारंभानंतरच्या महानगरपालिकेच्या पुढील निवडणुकीमध्ये, शक्य असेल तेथवर , त्या प्रवर्गातील महिलांसाठी राखीव जागा चक्रानुक्रमे फिरविण्यात येतील.

८. शंका निरसन :-ह्या नियमांनुसार चक्रानुक्रमाच्या प्रयोजनांसाठी, या नियमांच्या प्रारंभानंतर घेतलेल्या सार्वत्रिक निवडणुका ह्या, पहिली निवडणूक असल्याचे मानण्यात येईल .

महाराष्ट्राच्या राज्यपालांच्या आदेशाने व नावाने,

No. - MCO - 2021/C.R.192 /UD -14.-Whereas , by the Maharashtra Municipal Corporations (Amendment ) Ordinance , 2021 ( Maharashtra Ordinance No. IV of 2021 ) , the Maharashtra Municipal Corporations Act ( LIX of 1949 ) , has been amended to provide that each of the wards in the Corporation shall elect , as far as possible , three Councillors but not less than two and not more than four Councillors ;

And Whereas , to give effect to the said provisions , it is considered expedient to frame the rules regarding the manner of allotment and rotation of reservation of seats of Councillors in wards in the Corporation for Women and the candidates belonging to the Scheduled Castes , Scheduled Tribes and Backward Class of Citizens ;

And Whereas , the Government of Maharashtra is satisfied that circumstances exist which render it necessary to take immediate action in this behalf, by dispensing with the condition of previous publication of these rules .

Now , therefore , in exercise of the powers conferred by section 5A read with section 456A of the Maharashtra Municipal Corporations Act ( LIX of 1949 ) , and of all other powers enabling it in that behalf, and in supersession of all earlier notifications , orders , rules , etc. issued in this behalf, the Government of Maharashtra , after consultation with the State Election Commissioner , hereby makes the following rules , namely :-

1. Short title . These rules may be called the Maharashtra Municipal Corporations (Manner of Allotment and Rotation of Reservation of Seats of Councillors in Wards ) Rules , 2021 .

2. Definitions . - ( 1 ) In these rules , unless the context otherwise requires ,

( a) "Act" means the Maharashtra Municipal Corporations Act ( LIX of 1949 ) ;

(b) " ward" means the territorial constituencies into which the area of the Corporation is divided for the purpose of election of Councillors .

(2) Words and expressions used in these rules but not defined hereinabove shall have the same meanings as respectively assigned to them in the Act .

3. Manner of allotment and rotation of seats reserved for the Scheduled Castes.- ( 1) For reserving seats of Councillors for the candidates belonging to the Scheduled Castes , the wards shall be first arranged in descending order , beginning with a ward where the percentage of ७ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग, डिसेंबर १५ , २०२१/ अग्रहायण २४ , शके १ ९ ४३ population of the Scheduled Castes with regard to the total population of such ward is the highest.

(2 ) Where the number of seats of Councillors to be reserved for the candidates belonging to the Scheduled Castes is equal to or less than the number of wards in a Corporation , one seat in each ward shall be allotted to the Scheduled Castes , beginning in the descending order , with the ward having the highest percentage of population of the Scheduled Castes :

Provided that , the seats reserved under this sub - rule shall be rotated , as far as possible , in the subsequent elections to the Corporation to such wards in which no such seat had been previously reserved for the Scheduled Castes until such reservation is provided by rotation in each of the wards in the Corporation.

( 3) Where the number of seats of Councillors to be reserved for the candidates belonging to the Scheduled Castes , is more than the number of wards in a Corporation , then ,-

( a) firstly, one seat in each ward shall be allotted for the Scheduled Castes ; and ( b ) thereafter , for the purpose of allotting the remaining reserved seats , beginning in the descending order with the ward having the highest percentage of population of the Scheduled Castes , one seat in the ward , shall be allotted to the Scheduled Castes till all the seats to be reserved for the Scheduled Castes are allotted :

Provided that , the seats reserved under this clause shall be rotated , as far as possible , in the subsequent elections to the Corporation to such wards in which only one seat had been previously reserved for the Scheduled Castes until such reservation is provided by rotation in each of the wards in the Corporation .

4. Manner of allotment and rotation of seats reserved for the Scheduled Tribes.- ( 1 ) For reserving seats of Councillors for the candidates belonging to the Scheduled Tribes , the wards shall be first arranged in descending order , beginning with a ward where the percentage of population of the Scheduled Tribes with regard to the total population of such ward is the highest .

(2) Where the number of seats of Councillors to be reserved for the candidates belonging to the Scheduled Tribes is equal to or less than the number of wards in a Corporation , one seat in each ward shall be allotted to the Scheduled Tribes , beginning in the descending order with the ward having the highest percentage of population of the Scheduled Tribes :

Provided that , the seats reserved under this sub - rule shall be rotated , as far as possible , in the subsequent elections to the Corporation to such wards in which no such seat had been previously reserved for the Scheduled Tribes until such reservation is provided in all the wards in the Corporation by rotation.

(3) Where the number of seats of Councillors to be reserved for the candidates belonging to the Scheduled Tribes is more than the number of wards in a Corporation , then ,- ८

महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग, डिसेंबर १५ , २०२१/ अग्रहायण २४ , शके १ ९ ४३ (a) firstly, one seat in each ward shall be allotted for the Scheduled Tribes ; and (b) thereafter , for the purpose of allotting the remaining reserved seats , beginning in the descending order with the ward having the highest percentage of population of the Scheduled Tribes , one seat in the ward , shall be allotted to the Scheduled Tribes till all the seats to be reserved for the Scheduled Tribes are allotted :

Provided that , the seats reserved under this clause shall be rotated , as far as possible , in the subsequent elections to the Corporation to such wards in which only one seat had been previously reserved for Scheduled Tribes until such reservation is provided in all the wards in the Corporation by rotation .

5. Manner of reservation , where the seat in the ward may be allotted to both , Scheduled Castes and Scheduled Tribes . While allotting the seats of Councillors to be reserved for the Scheduled Castes or the Scheduled Tribes , if on the basis of the percentage of population of the Scheduled Castes and the Scheduled Tribes , the same ward qualifies for reservation of seats for both the Scheduled Castes and the Scheduled Tribes then ,-

( i) in the wards of three members or four members , seats shall be reserved for both of these two categories ,

(ii) in the wards of two members , a seat shall be reserved for either of these two categories depending on whose percentage of population is higher in that ward.

6. Manner of allotment and rotation of seats for Backward Class of Citizens .-( 1 ) The seats of Councillors to be reserved for the candidates belonging to the Backward Class of Citizens shall be allotted to the wards in the following manner , namely :

( a ) Where the number of seats of Councillors to be reserved for the candidates belonging to the Backward Class of Citizens is equal or less than the number of wards remaining after excluding the wards having seats reserved for the Scheduled Castes and Scheduled Tribes , then,-

(i) firstly , if there is a ward with four seats and maximum one seat is reserved for the Scheduled Castes or the Scheduled Tribes , then one seat for the Backward Class of Citizens shall be allotted directly to that ward ;

(ii) thereafter , one seat shall be allotted to the Backward Class of Citizens in every ward selected by draw of lots from amongst the remaining wards excluding the above mentioned four members wards and wards having seats reserved for the Scheduled Caste and the Scheduled Tribes .

(b) Where the number of seats of Councillors to be reserved for the candidates belonging to the Backward Class of Citizens is more than the number of wards remaining after excluding the wards having seats reserved for the Scheduled Castes and the Scheduled Tribes , then ,- ९ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग, डिसेंबर १५ , २०२१/ अग्रहायण २४ , शके १ ९ ४३ (i ) firstly , if there is a ward with four seats and maximum one seat is reserved for the Scheduled Castes or the Scheduled Tribes , then one seat in that ward shall be allotted directly to the Backward Class of Citizens ;

(ii ) thereafter , one seat shall be allotted to the Backward Class of Citizens in remaining wards excluding the wards having seats reserved for the Scheduled Caste and the Scheduled Tribes ;

( iii ) thereafter , if there are still some more seats to be allotted for the Backward Class of Citizens , then seats shall be allotted by drawing of lots from amongst those wards with three seats , where one seat is reserved for the Scheduled Caste or the Scheduled Tribes and at least two seats are remained unreserved .

(2) The seats so reserved for the Backward Class of Citizens shall be rotated , as far as possible , in the subsequent elections to the Corporation to such wards in which no seat had been reserved in the previous elections for the Backward Class of Citizens , until such reservation is provided by rotation in each of the ward in the Corporation .

7. Manner of allotment and rotation of seats for women . ( 1 ) The number of seats of Councillors to be reserved for women in a ward shall be as under

(a) In a ward having two seats , one seat shall be reserved for women .

( b ) In a ward having three seats , one or two seats , as the case may be , shall be reserved for women.

(2 ) The seats to be reserved for women belonging to the Scheduled Castes and Scheduled Tribes shall be reserved , in the following manner :-

( a ) Scheduled Castes women firstly , the seats to be reserved for women belonging to the Scheduled Castes shall be allotted by drawing lots from amongst the wards having the seats reserved for the Scheduled Castes ;

(b) Scheduled Tribes women

(i ) firstly, in a ward where the seats are reserved for both Scheduled Castes and Scheduled Tribes , but if the seat does not get reserved for Scheduled Castes women in that wards then , the seat reserved for Scheduled Tribes shall be directly allotted to Scheduled Tribes women .

(ii ) thereafter , the seats to be reserved for women belonging to the Scheduled Tribes shall be allotted by drawing lots from amongst the wards having the seats reserved for the Scheduled Tribes .

( 3) The seats to be reserved for women belonging to the Backward Class of Citizens shall be reserved , in the following manner , namely:-

महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ मध्य उप- विभाग , डिसेंबर १५ , २०२१ / अग्रहायण २४ , शके १ ९ ४३ ( i ) firstly in a ward , where seats reserved for either the Scheduled Castes or the Scheduled Tribes but not reserved for women belonging to that category , then , the seat reserved for the Backward Class of Citizens in such ward shall be reserved directly to Backward Class of Citizens women ;

( ii ) thereafter , in four member wards where two seats are reserved for Backward Class of Citizens then one seat shall be directly allotted to women of Backward Class of Citizens ;

( iii) after the seats are so allotted , if any seats remained to be reserved for women belonging to the Backward Class of Citizens , then such seats shall be allotted by drawing of lots from amongst the remaining wards reserved for Backward Class of Citizens , in which none of the seat is reserved for women of any category .

(4) Once the seats are reserved in the appropriate wards for the woman belonging to the Scheduled Castes , the Scheduled Tribes and the Backward Class of Citizens , then the remaining seats to be reserved for women shall be reserved , in the following manner , namely :-

(a) in the wards where none of the seat is reserved for women belonging to any category , then in such ward one seat shall be directly allotted to the women .

(b) thereafter , in wards where minimum two seats are unreserved then in such wards , one seat is directly or by draw of lots shall be allotted to the women in limits prescribed in sub rule ( 1) .

(c) thereafter , in the wards where none of the seat is reserved for women as per clauses ( a ) and (b ) , then in such ward one seat shall be allotted to the women if necessary , by drawing of lots in limits prescribed in sub rule (1 ) .

(5) The seats reserved for the women in a particular category shall be allotted by rotation , as far as possible , in the subsequent elections to the Corporation to the wards where no such seat was allotted to women in that category in the previous elections of the Corporation till all the wards are allotted such reservation by rotation .

8. Removal of doubt.- For the purposes of rotation of seats under these rules , the general elections held after the commencement of these rules shall be considered as the first election .
