क्रमांक रावनआ /रापनों-२०२१/प्र.क्र.५०/का. ११.—ज्ाअर्थी, भारती् संविधानाच्ा अनुच्छेद २४३-के ि २४३-झेि ए अनि्े तसेच राज्ातील सर्ावनक सिराज् संसर्ांच्ा संबंवधत का्द्ातील तरतुदींनि्े अशा सर्ावनक सिराज् संसर्ांच्ा सि्ग वनिणुकांचे अवधक्षण, संचालन ि वन्ंत्रण ्ाबाबतचे अवधकार राज् वनिणूक आ्ोगास प्रापत झाले आहेत ;

आवण ज्ाअर्थी, सर्ावनक सिराज् संसर्ांच्ा वनिणुकांचे पावित्र्य राखणे ि अशा वनिणुका मुकत, वन:पक्षपातीपणे, प्रभािीपणे ि का्गक्षमतेने पार पािण्ाच्ा दृष्ीने राजकी् पक्षांची नोंदणी ि संबंवधत बाबींची तरतूद त्ात करणे गरजेचे आवण आिश्क असल्ाने राज् वनिणूक आ्ोगाद्ारे क्र. एसईसी/एमसी २००९/सी आर-४९/िी.११, वदनांक ३१ माच्ग, २००९, च्ा अवधसूचनेवदारे, राजकी् पक्षांची नोंदणी आदेश, २००९ आवण महाराषट्र वनिणूक वचनह (आरक्षण ि िा्प) आदेश, २००९ काढण्ात आला आहे ;

आवण ज्ाअर्थी, राजकी् पक्षाच्ा आधारािर राज्ातील सर्ावनक सिराज् संसर्ांच्ा घेतल्ा जाणाऱ्ा सि्ग वनिणुकांकररता उकत आदेश लागू असून केिळ ग्ामपंचा्तींच्ा वनिणुकांना, जेर्े पक्षविरवहत वनिणुका घेतल्ा जातात तेर्े हे आदेश लागू नाहीत ;

आवण ज्ाअर्थी, राज् वनिणूक आ्ोगास उकत आदेशाप्रमाणे राजकी् पक्षाची नोंदणी करण्ापूिथी महाराष्ट्र शासन राजपत्रात पक्षाचे नाि आवण पत्ा, त्ाचे अध्क्ष ि त्ांना जर वचनह देण्ात ्ेणार असेल तर ते वचनह ्ांचा अंतभा्गि असलेली सूचना प्रवसधद करुन सि्गसाधारण जनतेकिून अशा नोंदणीबाबत हरकती मागविणे आिश्क आहे ;

आवण ज्ाअर्थी, महाराष्ट्र शासन राजपत्रात उपरोकत प्रमाणे अवधसूचना प्रवसधद केलेल्ा वदनांकापासून ३० वदिसांच्ा आत कोणतीही हरकत प्रापत न झाल्ास राज् वनिणूक आ्ोग अवधसूचनेत प्रसतावित केल्ाप्रमाणे राजकी् पक्षाची नोंदणी करण्ाकररता सक्षम राहील ;

आवण ज्ाअर्थी, उकत आदेशाप्रमाणे कोणतीही हरकत प्रापत झाली, तर वतचा राज् वनिणूक आ्ोग विचार करेल ि ती शुललक आढळल्ास, फे्ाळण्ात ्ेईल ि राजकी् पक्षाची नोंदणी करण्ात ्ेईल. त्ाचप्रमाणे राज् वनिणूक आ्ोगास अशा हरकतीत (१)

भाग एक-अ (म.उ.वि.)-८४–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ (म.उ.वि.), विसेंबर १७, २०२१/अग्रहा्यण २६, शके १९४३ प्र्मदश्गनी सत् िा्ले, तर ती अज्गदारास कळविण्ात ्ेईल आवण त्ािर त्ाचे अवभप्रा् मागविण्ात ्ेतील आवण अवभप्रा् प्रापत झाल्ािर, आ्ोग उपलबध अवभलेखाच्ा आधारािरील गुणित्ेिर वनण्ग् घेईल वकंिा संबंवधत पक्षांचे महणणे ऐकून त्ानंतर वनण्ग् घेईल ि राज् वनिणूक आ्ोगाचा असा वनण्ग् अंवतम राहील ;

आवण ज्ाअर्थी, श्ी. सुवनल हररशचंद्र काकिछे, ्ांच्ा अध्क्ष, प्रसतावित "उसमानाबाद शहर विकास आघािी" पक्षाचा मुख् का्ा्गल्ाचा पत्ा-राजेबाग, ्त्रपती वशिाजी महाराज चौक, उसमानाबाद, घर क्र.२२/६७, निीन घर क्र.२६/५८, वजलहा उसमानाबाद वपन ४१३ ५०१,्ांनी राज् वनिणूक आ्ोगाकिछे,"उसमानाबाद शहर विकास आघािी", अशा नािाने राजकी् पक्ष नोंदणीसाठी अज्ग केला आहे ;

आवण ज्ाअर्थी, उपरोलललवखत पक्ष हा मान्ता प्रापत राषट्री् वकंिा मान्ता प्रापत राज्सतरी् पक्ष नसल्ाने अशा पक्षासाठी कोणतेही वचनह राखून ठछेिणे आिश्क नाही;

आवण ज्ाअर्थी, राज्ातील सर्ावनक सिराज् संसर्ाच्ा कोणत्ाही वनिणुकीत मान्ताप्रापत राजकी् पक्ष ्ांनी उभ्ा केलेल्ा उमेदिाराव्वतररकत उभ्ा रावहलेल्ा कोणत्ाही उमेदिारास उपरोलललवखत आदेशाप्रमाणे आ्ोगावदारे मुकत वचनहे महणून विवनवद्गष् केलेल्ा वचनहांपैकी एका वचनहाची वनि करता ्ेईल ि त्ाचे िा्प करता ्ेईल अशी तरतूद आहे ;

आवण ज्ाअर्थी, मुकत वचनहापैकी एकाच वचनहाची वनि अनेक उमेदिारांनी केली असेल ि अशा अनेक उमेदिारांपैकी केिळ एक उमेदिार नोंदणीकृत राजकी् पक्षावदारे उभा केला असेल आवण उि्गररत अपक्ष उमेदिार असल्ास, वनिणूक वनण्ग् अवधकारी ते मुकत वचनह त्ा नोंदणीकृत राजकी् पक्षाच्ा उमेदिारास देईल आवण इतर कोणासही नाही, आवण जर ्ा अनेक उमेदिारांपैकी दोन वकंिा अवधक नोंदणीकृत राजकी् पक्षांचे उमेदिार असतील आवण उि्गररत अपक्ष उमेदिार असल्ास वनिणूक वनण्ग् अवधकारी वचठ्ठा ्ाकून कोणत्ा नोंदणीकृत राजकी् पक्षाच्ा उमेदिारास ते मुकत वचनह द्ा्चे ते ठरिील आवण ज्ा उमेदिाराची वचठ्ी ्ेईल, त्ा उमेदिारास त्ा मुकत वचनहाचे िा्प करेल आवण इतर कोणासही नाही ;

आवण ज्ाअर्थी, राज् वनिणूक आ्ोगाने उपरोकत पक्षास राजकी् पक्ष महणून नोंदणी करणेपूिथी सदर नोंदणीबाबत सि्गसाधारण जनतेकिून हरकती मागविणे आिश्क आहे ;

आता त्ाअर्थी, राज् वनिणूक आ्ोग, महाराषट्र सदर अवधसूचना महाराष्ट्र शासन राजपत्रात प्रवसधद झाल्ाच्ा वदनांकापासून २० वदिसांचे आत सदर नोंदणीबाबत सि्गसाधारण जनतेकिून कोणतीही हरकत असल्ास, ती परसपर आ्ोगाच्ा का्ा्गल्ाकिछे दाखल करािी असे जाहीर करीत आहे.

राज् वनिणूक आ्ुकत ्ांचे आदेशानुसार,

STATE ELECTION COMMISSION, MAHARASHTRA

NOTIFICATION

No.SEC/RPP-2021/CR-50/D-11.–Whereas, the superintendence, direction and control of all elections to the Panchayats and Municipalities in the State are vested in the State Election Commission, Maharashtra by virtue of Article 243-K and 243-ZA of the Constitution of India, and the provisions of the relevant State law as applicable to such Panchayats and Municipalities ;

And Whereas, with a view to provide, in the interest of sanctity of elections to the local bodies, and in the interest of conduct of such elections, in a free, fair, effective and efficient manner, for the registration of political parties and for matters connected therewith; the Registration of political Parties Order, 2009 and Maharashtra Election Symbols (Reservation and Allotment ) Order, 2009 has been made by the State Election Commission, Maharashtra vide the State Election Commission, Maharashtra, Notification No. SEC/MC-2009/CR-49/D-11, dated 31st March 2009;

And Whereas, the said Order applies to all elections held to local bodies in the State on party basis except elections to Village Panchayats where elections are held on partyless basis;

And Whereas, before registering a political party under this Order, it is necessary to publish a notice in the Maharashtra Government Gazette indicating therein , the name and address of the political party, its President and the symbol proposed to be allotted, if any, and calling for objections, if any, for such registration from the general public;

And Whereas, as per the said order , if no objection is received within 30 days from the date of publication of such notification in the Maharashtra Government Gazette, it shall be competent for the State Election Commission to register the political party , as proposed in the notification;

And Whereas, if any objection is so received, the State Election Commission may consider the same and in case it is found to be without substance, it may reject the same and register the political party. If on the other hand, the State Election Commission considers that the objection is prima-facie genuine, then the same shall be communicated to the applicant and his remarks shall be called for.

After receipt of the remarks, the Commission may either decide the matter on merits on the basis of the records available or it may give personal hearing to the parties concerned and take a decision thereafter. The decision of the State Election Commission shall be final;

And Whereas, Shri Sunil Harischandra Kakde, President of proposed "Osmanabad Shahar Vikas Aaghadi" party having main office address -Rajebag, Chhatrapati Shivaji Maharaj Chowk, Osmanabad, House No.22/67, New House No.26/58, Osmanabad, Dist.Osmanabad, Pin-413 501 has applied to the State Election Commission for registering " Osmanabad Shahar Vikas Aaghadi" as a political party;

And Whereas, the said party being neither a recognised National Party nor a State Party, it is not imperative to reserve symbol to it from the list of free symbols;

And Whereas, as per the aforesaid Order a candidate at an election to local bodies in the State, other than a candidate setup by a recognised political party shall choose and shall be allotted one of the symbols specified as free symbols by the Commission;

And Whereas, as per the said Order if the same free symbol has been chosen by several candidates at such election, then, if of those several candidates only one is a candidate setup by registered political party and all the rest are independent candidates, the returning officer shall allot that free symbol to the candidate setup by the registered political party and to no one else, and if of those several candidates two or more candidates are setup by different registered political parties and the rest are independent candidates, the returning officer shall decide by lot to which of the two or more candidates setup by the different registered political parties that free symbol shall be allotted and allot that symbol to the candidate on whom the lot falls and to no one else;

And Whereas, it is necessary for the State Election Commission to call for objections, if any, from the general public for registration of the said party as a political party;

Now, Therefore, the State Election Commission, Maharashtra, hereby calls for objections, if any, for such registration of the said party from the general public which are to be submitted directly to the Commission within 30 days from the date of publication of this notification in Maharashtra Government Gazette.
