क्रमांक सीएसएल २०१६/प्र.क्र . ३५ / १३ स.- महाराष्ट्र सहकारी संस्था अधिनियम , १ ९६० ( १ ९ ६१ चा महा . २४ ) याच्या कलम १६५ च्या पोट-कलम ( १ ) व ( २ ) द्वारे प्रदान केलेल्या अधिकारांचा आणि त्याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र सहकारी संस्था ( समितीची निवडणूक) नियम , २०१४ यामध्ये आणखी सुधारणा करण्यासाठी, महाराष्ट्र शासनाने सुधारणा करण्याचे प्रस्तावित केलेल्या नियमांचे पुढील प्रारूप, त्यामुळे बाधा पोहोचण्याचा संभव असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम १६५ च्या पोट- कलम ( ३ ) द्वारे आवश्यक असल्याप्रमाणे , याद्वारे , प्रसिद्ध करण्यात येत आहे; आणि याद्वारे अशी नोटीस देण्यात येत आहे की , उक्त प्रारूप, महाराष्ट्र शासनाकडून दिनांक ३१ डिसेंबर , २०२१ रोजी किंवा त्यानंतर विचारात घेण्यात येईल.
२. उपरोक्त दिनांकापूर्वी , उक्त मसुद्याच्या बाबतीत , कोणत्याही व्यक्तीकडून प्रधान सचिव , सहकार, पणन व वस्त्रोद्योग विभाग , मादाम कामा मार्ग , हुतात्मा राजगुरू चौक , मंत्रालय , विस्तार, मुंबई ४०० ०३२ यांच्याकडे ज्या कोणत्याही हरकती किंवा सूचना प्राप्त होतील त्या शासनाकडून विचारात घेण्यात येतील .

क्रमांक सीएसएल -२०१६ /प्र.क्र.३५/१३ स.-महाराष्ट्र सहकारी संस्था अधिनियम , १ ९ ६० ( १ ९ ६१ चा महा . २४ ) याच्या कलम १६५ च्या पोट-कलम ( १ ) व ( २) द्वारे प्रदान केलेल्या अधिकारांचा आणि त्याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन , महाराष्ट्र शासन राजपत्रात, असाधारण, भाग चार- ब , दिनांक **** २०२१ यामध्ये प्रसिद्ध केलेली शासकीय अधिसूचना , सहकार, पणन व वस्त्रोद्योग विभाग , क्रमांक **** दिनांक **** २०२१ अनुसार , हरकती व सूचना विचारात घेतल्यानंतर , याद्वारे , महाराष्ट्र सहकारी संस्था (समितीची निवडणूक) नियम , २०१४ यामध्ये आणखी सुधारणा करण्यासाठी पुढील नियम करीत आहे : -

१. या नियमांस , महाराष्ट्र सहकारी संस्था ( समितीची निवडणूक) ( तिसरी सुधारणा ) नियम , २०२१ असे म्हणावे.
२. महाराष्ट्र सहकारी संस्था ( समितीची निवडणूक) नियम , २०१४ याच्या नियम ७४ ऐवजी पुढील नियम दाखल करण्यात येईल: -
" ७४. नैमित्तिक रिक्त पदे: ( १ ) संस्थेच्या निवडून आलेल्या समिती सदस्याचा मृत्यू, राजीनामा , अनर्हता , किंवा पदावरून काढून टाकणे यामुळे अथवा असा सदस्य त्याचा पदावधी संपण्यापूर्वी किंवा अन्यथा कामकाज करण्यास अक्षम ठरल्यामुळे पद रिक्त झाले असेल तर , संस्थेची समिती , अशी रिक्त पदे झाल्याबद्दल , तात्काळ राज्य सहकारी निवडणूक प्राधिकरणास व जिल्हा सहकारी निवडणूक अधिकाऱ्यास कळवील आणि असे रिक्त पद, समितीकडून सोईस्कर असेल तितक्या लवकर , ज्या सदस्यांच्या प्रवर्गामधील पद रिक्त झाले असेल त्याच प्रवर्गातील उर्वरित पात्र सदस्यांच्या नामनिर्देशनाद्वारे , राज्य सहकारी निवडणूक प्राधिकरणाने प्राधिकृत केलेल्या अधिकाऱ्याच्या अध्यक्षतेखालील समितीच्या उर्वरित सदस्यांच्या बैठकीत भरण्यात येईल:
परंतु , समितीच्या पदावधीमध्ये कोणत्याही परिस्थितीत , समितीच्या एकूण सदस्य संख्येच्या एक तृतीयांश पेक्षा अधिक सदस्य नामनिर्देशित केले जाणार नाहीत.
(२ ) पोट- नियम (१ ) अन्वये अशाप्रकारे निवडून आलेला किंवा नामनिर्देशित केलेला सदस्य, जर पद रिक्त झाले नसते तर , समितीचा सदस्य म्हणून ज्या सदस्याच्या जागी तो निवडून आला असेल त्या सदस्याने ज्या कालावधीपर्यंत पद धारण केले असते केवळ तेवढ्याच पदावधीपर्यंत पद धारण करील . "

NOTIFICATION
MAHARASHTRA CO - OPERATIVE SOCIETIES ACT , 1960.
No. CSL - 2016/C.R. 35/ 13- C . The following draft of rules further to amend the Maharashtra Co-operative Societies ( Election to Committee ) Rules , 2014 , which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub - sections (1) and (2) of section 165 of the Maharashtra Co - operative Societies Act , 1960 ( Mah . XXIV of 1961 ) , and of all other powers enabling it in that behalf, is hereby published , as required by sub - section (3) of section 165 of the said Act , for the information of all the persons likely to be affected thereby ; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after the 31st December 2021 .
2. Any objections or Suggestions , which may be received by the Principal Secretary (Co-operation & Marketing ) , Co - operation , Marketing and Textile Department , Madam Cama Marg , Hutatma Rajguru Chowk , Mantralaya , Annex , Mumbai 400 032 , from any person with respect to the said draft before the aforesaid date , will be considered by the Government .
DRAFT RULES
MAHARASHTRA CO - OPERATIVE Societies Act , 1960 .
No. CSL - 2016/C.R. 35/13- C . - In exercise of the powers conferred by sub - section (1) and (2) of section 165 of the Maharashtra Co - operative Societies Act , 1960 ( Mah . XXIV of 1961 ) , and of all other powers enabling it that behalf, the Government of Maharashtra hereby , after considering objections and suggestions , pursuant to the Government Notification , Co - operation , Marketing and Textiles Department , No . **** , dated the **** of **** 2021 , published in the Maharashtra Government Gazette , Extraordinary , Part IV - B , dated the *** 2021 , makes the following rules further to amend to the Maharashtra Co - operative Societies (Election to Committee ) Rules , 2014 , namely :-
1. These rules may be called the Maharashtra Co - operative Societies ( Election to Committee) ( Third Amendment ) Rules , 2021 .
2. For rule 74 of the Maharashtra Co - operative Societies ( Election to Committee ) Rules , 2014 , the following rule shall be substituted , namely :-
" 74. Casual vacancies . ( 1) In the event of the vacancy occurring on account of death , resignation , disqualification or removal of an elected committee member of a society or through such a member becoming incapable of acting , prior to the expiry of his term of office or otherwise , the committee of the society shall forthwith communicate the occurrence of such vacancies to the State Co - operation Election Authority and District Co- operation Election Officer and the vacancy shall be filled as soon as conveniently by the committee , by way of the nomination of eligible members out of the same class of the members in respect of which casual vacancy has arisen, in the meeting of the remaining members of the committee , which shall be presided over by an officer authorized by State Co - operation Election Authority :

Provided that , at any instance during the tenure of a committee , there shall not be nominated members of the committee exceeding one third of the total strength of the committee .
(2) The member so elected or nominated under sub - rule (1) shall hold office so long only as the member of the committee in whose place he is elected would have held it , if the vacancy had not occurred . "
