ज्याअर्थी, महाराष्ट्र झोपडपट्टी (सुधारणा, निमर्ूलन आणि पुर्नविकास) अधिनियम, १९७१ चे कलम ३(क) उप कलम (१) अनुसार " झोपडपट्टी पुनर्वसन क्षेत्र " घोषित करण्याचे अधिकार मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण यांना आहेत.
त्याअर्थी, उक्त कलम ३(क) चे उप कलम (१) मधील शक्तीचा वापर करून मी, खालीलप्रमाणे अनुसूचीमध्ये दर्शविलेले क्षेत्र " झोपडपट्टी पुनर्वसन क्षेत्र " म्हणून याद्वारे घोषित करीत आहे. सदरचे क्षेत्र बृहन्मुंबई विकास नियंत्रण व प्रोत्साहन नियमावली, २०३४ चे नियम ३३(१०) अन्वये झोपडपट्टी पुनर्वसन योजना दाखल करण्यास पात्र आहे :----

SLUM REHABILITATION AUTHORITY

Whereas, the Slum Rehabilitation Authority has formed Slum Rehabilitation Scheme under the provision of section 3B (3) of Maharashtra Slum Area (Improvement, Clearance and Redevelopment) Act, 1971 and published in Gazette on 9th April 1998 ;
Whereas, in view of the provision of Section 3C (1) of the Maharashtra Slum Area (Improvement, Clearance and Redevelopment) Act, 1971 the Chief Executive Officer, Slum Rehabilitation Authority is empowered to declare any area as " Slum Rehabilitation Area ".
Therefore in view of the said provision of section 3C (1) of the Maharashtra Slum Area (Improvement, Clearance and Redevelopment) Act, 1971. I, undersigned is hereby declare the area shown in schedule as " Slum Rehabilitation Area ". Now the said area is open to submit scheme of slum rehabilitation as per regulation 33 (10) of Development Control and Promotion Regulation, 2034 of Greater Mumbai.

याद्वारे जनतेस सूचित करण्यात येते की, उक्त कसूरदार मूल्यर्वधित कर अधिनियमाखालील निर्धारित कर, व्याज व शास्तीची रक्कम रु. ३७,००,१३,२३० (अक्षरी : सदतीस कोटी तेरा हजार दोनशे तीस फक्त) शासकीय कोषागारात भरणा करण्यात कसूर केल्याने मे. भंबानी शिपिंग लिमिटेड तसेच इतर सर्व व्यक्ती की ज्यांना या सोबत जोडलेल्या अनुसूचीत नमूद मालमत्ता खरेदी करण्यास रस आहे. त्यांच्यासाठी महाराष्ट्र जमीन महसूल संहिता, १९६६ व महाराष्ट्र जमीन महसूल परिपूर्ती नियम, १९६७ सह मूल्यर्वधित कर अधिनियमाच्या कलम ३२(५) व ३४ च्या तरतुदीनुसार उक्त थकीत रकमेच्या वसुलीसाठी सदर नोटीस ही जमीन महसूल थकबाकीसाठीची नोटीस असल्याचे मानण्यात येईल.
याद्वारे सर्व जनतेस व इतर इच्छुक व्यक्तीसाठी नोटीस देण्यात येत आहे की, मूल्यर्वधित कर अधिनियमाच्या कलम ३७ च्या तरतुदीनुसार या जाहीर नोटीसीला जोडलेल्या मालमत्तेवर ""प्रथम भार"" वस्तू व सेवा कर विभागाचा असेल. तसेच असा प्रथम भार हा याला जोडलेला अनुसूचीमध्ये वर्णन केलेल्या उक्त मालमत्तेच्या संबंधात संरक्षित धनको व इतर सर्व व्यक्तीच्या विरुद्ध असेल. याद्वारे असे सुद्धा घोषित करण्यात येते की, मालमत्ता हस्तांतरण अधिनियम, १९८२ च्या कलम १०० च्या प्रयोजनार्थ ही जाहीर सूचना अशा प्रथम भाराची नोटीस मानण्यात येईल.
मूल्यर्वधित कर अधिनियमाच्या कलम ३८ च्या तरतुदीसुद्धा सर्वसामान्यांच्या लक्षात आणून देण्यात येत आहे की, उक्त कसूरदाराकडे वर नमूद केल्याप्रमाणे मूल्यर्वधित कर अधिनियमानुसार देय रकमेची थकबाकी आहे. सबब, उक्त कसूरदाराने या पुढे याला जोडलेल्या अनुसूचीमध्ये नमूद केलेल्या कोणत्याही मतेवर भार निर्माण केला किंवा विक्री, तारण, भेट किंवा अदला बदल या सह कोणत्याही हस्तांतरणाच्या द्वारे ताबा दिल्यास, योग्य त्या प्राधिकरणाद्वारे अशाप्रकारे निर्माण केलेला भार किंवा विक्री, तारण, भेट किंवा अदला बदल या सह कोणत्याही हस्तांतरणाच्या द्वारे ताबा दिल्यास तो रद्द ठरविण्याची जोखीम असेल.

PUBLIC NOTICE
M/s. Bhambhani Shipping Limited (hereinafter referred to as the "said defaulter") is a company incorporated as per the provisions of the Companies Act, 2013 and holds the Tax Identification Number (TIN) 27570689062V under the Maharashtra Value Added Tax Act, 2002 (hereinafter referred to as "MVAT Act, 2002"). The said defaulter is having the place of business situated at Plot No.205/206, Meera Hari Niwas, Opp. Dhanlaxmi Building, Near Telephone Exchange, SVP Nagar, MHADA Colony, Andheri (West), Mumbai 400 053.
Notice is hereby given to the public in general, M/s. Bhambhani Shipping Limited in particular and all other persons who may be interested in the purchase of the properties more particularly described in the Schedule appended hereto that the said defaulter has failed to make the payment into Government Treasury of the tax, interest and penalty assessed under the MVAT Act, 2002 at Rs. 37,00,13,230/- (In words Rs. Thirty Seven Crore Thirteen Thousand Two Hundred Thirty Only ). Also the Notice is given to the effect that the said recovery of the outstanding amount within the scope of section 32(5) and 34 of the MVAT Act, 2002 read with Maharashtra Land Revenue Code, 1966 and Maharashtra Realization of Land Revenue Rules, 1967 shall, be deemed to be arrears of Land Revenue.
Notice is also given hereby to the public in general and all other interested persons that as per the provisions of operation of section 37 of the MVAT Act, 2002 the "First Charge" has been created on property as described in the Schedule appended to this Public Notice. This "First Charge" shall be against all other persons that may be secured creditor or may have charge or interest in respect of the said property as described in the Schedule appended hereto. It is hereby also declared that for the purposes of section 100 of the Transfer of Property Act, 1882 this Public Notice shall be deemed to be Notice of such First Charge.
Further, the provisions of section 38 of the MVAT Act, 2002 are also brought to the Notice of the general public that the said defaulter is in arrears of the MVAT dues as stated herein above and therefore, in case the said defaulter hereafter creates a charge on, or parts with the possession by any mode of transfer whatsoever, including sale, mortgage, gift or exchange of any of the assets as stated in the Schedule appended hereto, is at the risk of declaring by the appropriate authority, the aforesaid acts as void and this Public Notice shall be deemed to be a notice of the pendency of the proceeding.

As per the requirements of Rule 18 of Securities Contracts (Regulations) Rules, 1957, the proposed amendments to the Bye-laws of the National Stock Exchange of India Limited (NSEIL) as given hereunder are published for criticism in accordance with the provisions of Section 23 of General Clauses Act, 1897 in the Gazette of State of Maharashtra. Any person having any observations on the proposed amendments to Bye-laws can send the same in writing to the undersigned at Exchange Plaza, Sixth Floor, 'A' wing, Plot C-1, Block G, Bandra-Kurla Complex, Bandra (East), Mumbai 400 051 within fifteen days from the date of this publication in the Gazette. The observations received after the aforementioned date will not be considered when the proposed amendments will be taken for consideration.
1. In Bye-law 13A of Chapter XI of the NSE Bye-laws, the clauses (ii) and (iii) shall be substituted as :
(13A)
i. ...
ii. In case the arbitration award is in favour of the Constituent in the matter as mentioned in Clause (i) above or Arbitration Award passed in favour of the Constituent is not more than Rupees Twenty Lakhs in the matter directly filed for arbitration and the member conveys his Intention of preferring appeal against such arbitral award or filing petition in court u/s. 34 of the Arbitration and Conciliation Act, 1996, to set aside such arbitral award, within 7 days from the date of receipt of the award, then a positive difference of 50% of the award amount or Rs. 3.00 lakhs, whichever is less and the amount already released to the client at clause (i) above, shall be released to the constituent from the IPF of the Exchange.
iii. In case the appellate arbitration award is in favour of the constituent and the trading member conveys his intention of filing petition in court to set aside the Appellate arbitration award u/s. 34 of the Arbitration and Conciliation Act, 1996 within 7 days from the receipt of the Appellate Arbitration Award, then a positive difference of 75% of the amount determined in the appellate arbitration award or Rs. 5.00 lakhs (Rs. Five Lakhs), whichever is less and the amount already released to the constituent at clause (i) and (ii) above, shall be released to the constituent from IPF of the Exchange.
2. In Chapter XIII Clause (4) of the NSE Bye-laws, the Sub Clauses (ii) and (iii) shall be substituted as :
(4) The Trust shall have the power to utilise amounts out of the IPF, subject to maximum permissible limits for each Constituent, in cases mentioned below :
(i) .....
(ii) In case the arbitration award is in favour of the consitituent in the matter as mentioned in clause (i) above or Arbitration award in favour of the constituent is not more than Rupees Twenty Lakhs in the matter directly filed for arbitration and the Member conveys has intention of preferring appeal against such arbitral award or filing petition In Court to set aside such arbitral award, within 7 days from the date of receipt of the award, then a positive difference of 50% of the award amount or Rs. 3.00 lakhs, whichever is less, and the amount already released to the constituent at clause (i) above shall be released to the constituent from the IPF of the Exchange.

(3) The amount that may be paid under this Part to a claimant shall not exceed such amount as may be decided by the Trust from time to time, The Trust shall disburse the compensation to the claimants as and when claims have been crystallised against the defaulter and admitted for payment by the Trust based on the recommendations, if any, of the Relevant Committee and such compensation shall not be more than the maximum amount fixed for a single claim. In case the claim amount is more than the coverage limit under IPF or the amount sanctioned and ratified by the Relevant Committee is less than the claim amount then the investor will be at liberty to prefer for arbitration outside the exchange mechanism / any other legal forum outside the exchange mechanism for claim of the balance amount.
