Notification u/s 20(4) of Maharashtra Regional and Town Planning Act, 1966.–-

Whereas, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-1505-CR-273- 96-UD-9, dated the 6th May, 2000 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as "the said Act") and came into force with effect from the 15th July, 2000;

Whereas, the Government vide Resolution No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015 issued directives u/s 154 of the said Act regarding the procedure to be followed under Section 20 of the said Act for making changes in the use of land in the areas of sanctioned Regional Plans under the said Act and isssued order to follow revised procedure related to above directive vide Govt. Resolutions No. TPS-1815-CR-49-15-UD-13, Dated 04th January 2016;and in exercise of the powers conferred by sub-section (1) of Section 151, of the said Act, the Government, vide its Notification No. TPS-1815-CR-49-15-UD-13; Dated 06th May 2015, delegated the powers exerciseable by it under the provisions of Section 20 (3) & 20 (4) of the Act, (subject to conditions mentioned therein) to the Divisional Joint Director of Town Planning for Nagpur Administrative Division;

And whereas, land admeasuring approx. 11.12 hectare bearing Survey No. 66 admeasuring area 2.72 Ha., Survey No. 92/1 & 92/2 admeasuring area 3.14 Ha, Survey No. 101/1 & 101/2 admeasuring area 2.94 Ha., Survey No. 104 admeasuring area 2.32 Ha., of Mouza-Bhojapur, Tal. Ramtek, District-Nagpur total land admeasuring approx 11.12 hectare (herein after referred to as "the said Area") is included in 'Agriculture Zone' in the sanctioned Regional Plan of Nagpur;

And whereas, the "Proposal Scrutiny & Sanctioning Committee" established under the above mentioned Govern- ment Resolution, is of the opinion that the said area should be deleted from "Agriculture Zone & Included in Residential Zone" in accordance with the provision of sub-section (2) of Section 20 of said Act subject to compliance of conditions laid down in the above said Government Resolution and payment of requisite premium;

And whereas, after making necessary enquires and consulting the Director of Town Planning, Maharashtra State, Pune, the "Proposal Scrutiny and Sanctioning Committee" is of opinion that proposed modification should be sanc- tioned with some conditions,

And whereas, in pursuant to the above, a notice bearing No. R.P. Nagpur-Mouja Bhojapur-Tal. Ramtek-Kh. No. 66, 92/1, 92/2, 101/1, 101/2 & 104-Section 20 (3)-JDTP-814; Dated-09th August 2021 regarding the proposed modification under sub-section (3) of the Section 20 of the said Act, was published by Joint Director of Twon Planning , Nagpur Division, Nagpur which appeared in the Maharashtra Government Official Gazette, Part-1A Nagpur Division August 2021 dated, 12-18, on page No. 1, 2 & 3, for inviting suggestions and/or objections from the general public and the Assistant Director of Town Planning, Nagpur Branch, Nagpur, was appointed as an 'Officer' (herein after referred to as the "said Officer") to hear suggestions and/or objections and submit his report to the undersigned;

And whereas, no suggestions and/or objections are received within prescribed time limit as per the report submit- ted by the said Officer, to the "Proposal Scrutiny and Sanctioning Committee" is of the opinion that the said lands, should be deleted from "Agriculture Zone"' and be included in "Residential Zone" subject to certain conditions;

And whereas, the owner of land bearing 11.12 hectare bearing Survey No. 66 admeasuring area 2.72 Ha., Survey No. 92/1 & 92/2 admeasuring area 3.14 Ha., Survey No. 101/1 & 101/2 admeasuring area 2.94 Ha., Survey No. 104 admeasuring area 2.32 Ha., of Mouza-Bhojapur, Tal. Ramtek, District-Nagpur has deposited necessary premium in the Government Treasury date 24th December 2021 in this regard;

Now, therefore, in exercise of the powers under sub-section (4) of Section 20 of the said Act, delegated to him Joint Director of Town Planning, Nagpur Division, Nagpur hereby sanctions the proposed modification and for that purpose directs that in the Schedule of Modifications appended to the Notification dated the 6th May, 2000 sanctioning the said Regional Plan, after the last entry, the following new entry shall be added;

The allocation of land bearing Survey No. 66 admeasuring area 2.72., Survey No. 92/1 &92/2 admeasuring area 3.14 Ha., Survey No. 101/1 & 101/2 admeasuring area 2.94 Ha., Survey No. 104 admeasuring area 2.32 Ha., of Mouza-Bhojapur, Tal. Ramtek, District-Nagpur Total area admeasuring 11.12 Ha., changed from 'Agriculture Zone' to 'Residential Zone' more specifically shown on Plan, subject to the following conditions:—

Condition No. 1. It shall be the responsibility of the concerned Land Owner/Developer to provide basic infrastructure and civic amenities, like drinking water supply, sewerage network, roads, solid waste management, waste water treatment plant etc. in the said lands under modification.

Condition No. 2. The sale of plots/ tenements shall be permissible as per the conditions given in undertaking in pursuance of aforesaid Government resolution dated 06th May 2015 and also all conditions mentioned in the said resolution as modified time to time, shall be binding.

If Group Housing Scheme is proposed in the layout then the occupancy certificate shall not be given unless civic amenties specified by the Collector are fully developed.

In case breach of any of the above conditions, layout approval and non agiculture permission shall be liable to be cancelled.

The copy of part plan showing the above sanctioned modification shall be kept open for inspection by general public during office hours on all working days for a period of one month at the following offices;

(2) The Joint Director of Town Planning, Nagpur Division, Nagpur.

(3) The Assistant Director of Town Planning, Nagpur Branch, Nagpur.

In exercise of the powers conferred on me by Order No.MNP-2004-CR-34-W-06 dated 17 th September 2004 of the State Election Commissioner, Maharashtra, the Draft Order fixing the number of seats to be elected and the extent of the wards into which the said Municipal area of the Municipal Councils to be divided and wards to be reserved for Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women's (including Women belonging to Scheduled Castes, Scheduled Tribes and Backward Class of Citizens) as the case may be as shown in the Schedule to the Draft Order bearing D-12MNU-1CR-418- 2021-dated 18th November, 2021 was published as required by the proviso to sub-section (1) of the Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 for information of the residents of the Hingna Nagar Panchayat.

After carefully considering the objections received by me in respect of the said Draft Order. I, R. Vimala, Collector of Nagpur District in exercise of the powers conferred on me by sub-section (1) of Section 10 of the said Act, hereby make the following order namely :

In exercise of the powers conferred on me by Order No. MNP-2004-CN-34-O-6, dated 17th September, 2004 of the State Election Commissioner, Maharashtra, the draft order fixing the number of seats to be elected and the extent of the wards into which the said Municipal area of the Municipal Councils to be divided and wards to be reserved for Scheduled Castes, Scheduled Tribes, Backward Class of Citizens and Women (including Women belonging to the Scheduled Castes, Scheduled Tribes and the Backward Class of the Citizens) as the case may be, as shown in the Scheduled to the draft Order bearing ॅ-१२- द्धा--१-ॅह्यम्-४१८-२०२१, ह्यहॅ १८ म्दन्, २०२१ was published as required by the proviso to sub-section (1) of the Section 10 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 for information of the residents of the Kuhi Nagar Panchayat.

After carefully considering the objections are received by me in respect of the said draft order. I, R. Vimala, Collector of Nagpur district in exercise of the powers conferred on me by sub-section (1) of Section 10 of the said Act, hereby make the follwoing order namely :- .
