NOTIFICATION
MAHARASHTRA UNAIDED PRIVATE PROFESSIONAL EDUCATIONAL INSTITUTIONS ( REGULATION OF ADMISSIONS AND FEES ) ACT , 2015 .
No.MED - 1020/C.R.44/20/Edu- 2.-In exercise of the powers conferred by section 23 of the Maharashtra Unaided Private Professional Educational Institutions ( Regulation of Admissions and Fees ) Act , 2015 (Mah . XXVIII of 2015 ) , the Government of Maharashtra hereby makes the following rules to amend the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Undergraduate Ayurved , Unani , Homeopathy , Physiotherapy , Occupational Therapy , Speech Therapy , Prosthetic and Orthotics and B.Sc. Nursing Courses ) Rules , 2016 , regulating the admissions to the First Year of the Full Time Professional undergraduate Ayurved , Unani , Homeopathy , Physiotherapy , Occupational Therapy , Speech Therapy , Prosthetic and Orthotics and B.Sc. Nursing Courses in the Unaided Private Professional Educational Institutions in the State of Maharashtra , namely :-
1. These rules may be called the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Undergraduate Ayurved , Unani , Homeopathy , Physiotherapy , Occupational Therapy , Speech Therapy , Prosthetics and Orthotics and B.Sc. Nursing Courses ) (Amendment ) Rules , 2020 .

For rule 9 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Undergraduate Ayurved , Unani , Homeopathy , Physiotherapy , Occupational Therapy , Speech Therapy , Prosthetics and Orthotics and B.Sc. Nursing Courses) Rules , 2016 ( hereinafter referred to as " the principal Rules" ) , the following shall be substituted , namely :-
" 9. Distribution of Seats . The Distribution of seats shall be allotted by the Competent Authority.
(i) All the seats at the disposal of Competent Authority , shall be made available for all the candidates from the State and these seats shall be filled in on the basis of NEET merit list . There shall be constitutional and female reservation in these seats as per the prevailing rules in this behalf ;
( ii ) Selection to these courses at the Private Unaided institutions through CAP shall be subject to permission or approval or affiliation from , ( 1 ) Government of India ; (2 ) Central Council ; ( 3 ) Government of Maharashtra ; and ( 4 ) MUHS . The " intake capacity " at a particular college shall be the ' minimum number of seats' permitted by the above said authorities ;
( iii ) As per the Maharashtra Private Professional Educational Institutions ( Reservation of seats for admission for SC , ST , Denotified Tribes -Vimukta Jatis , NT and OBC ) Act , 2006 (Mah . XXX of 2006 ) , 25 percent seats of the total intake capacity of Unaided Private Professional Educational Institutions shall be allotted to the Constitutional reservation category candidates ; " .
3. In rule 12 of the principal Rules , in sub - rule ( 1) , for clause (f) the following clause shall be substituted , namely " :-
(f) 30 percent seats at the disposal of the Competent Authority shall be reserved for female candidates in all the courses . If requisite numbers of female candidates are not available , then these seats shall be offered to male candidates of respective category . " .
4. In rule 13 of the principal Rules , clause ( i) shall be deleted .
