राजकीय प(cid:550)ाची न(cid:635)दणी आदेश, २००९ (पुन:सुधा(cid:555)रत २०२२) (cid:312). रािनआ/रापन(cid:635)-२०२२/(cid:332).(cid:312).२०/का.११.—(cid:249)याअथ(cid:559), संिवधाना(cid:247)या अनु(cid:247)छ(cid:578)द २४३ क(cid:577) व २४३ झेडए तसेच रा(cid:249)यातील (cid:274)थािनक (cid:274)वरा(cid:249)य सं(cid:274)थां(cid:247)या संबंिधत काय(cid:464)ातील तरतुद(cid:558)(cid:261)वये सव(cid:593) (cid:274)थािनक (cid:274)वरा(cid:249)य सं(cid:274)थां(cid:247)या िनवडणुकांचे अिध(cid:550)ण, संचालन व िनयं(cid:327)ण याबाबतचे अिधकार रा(cid:249)य िनवडणूक आयोगास (cid:332)ा(cid:262)त आहेत.

२. आिण (cid:249)याअथ(cid:559), राजकीय प(cid:550)ां(cid:247)या आधारावर लढिव(cid:269)या जाणा(cid:311)या (cid:274)थािनक (cid:274)वरा(cid:249)य सं(cid:274)थां(cid:247)या िनवडणुकांम(cid:260)ये (महानगरपािलका, नगरप(cid:555)रषदा / नगरपंचायती, िज(cid:269)हाप(cid:555)रषदा व पंचायत सिम(cid:257)या) राजकीय प(cid:550)ांना (cid:257)यांची मह(cid:346)वाची भूिमका अदा करणे श(cid:242)य (cid:271)हावे यासाठी रा(cid:249)य िनवडणूक आयोगाने न(cid:635)दणी, िच(cid:261)ह वाटप इ(cid:257)यादी बाब(cid:558)साठी खालील(cid:332)माणे आदेश पा(cid:555)रत क(cid:577)लेले आहेत :—

(i) राजकीय प(cid:550)ाची न(cid:635)दणी आदेश, २००४ ( याम(cid:260)ये वेळोवेळी सुधारणा कर(cid:256)यात आली असून स(cid:260)या िद. ३१ माच(cid:593), २००९ हा आदेश अ(cid:556)(cid:274)त(cid:257)वात आहे. ) व

(ii) महारा(cid:273)(cid:322) िनवडणूक िच(cid:261)ह (आर(cid:550)ण व वाटप) आदेश, २००९

(iii) राजकीय प(cid:550)ांची न(cid:635)दणी आदेश,२००९ (सुधा(cid:555)रत २०१८) िद. २५ जुलै २०१८.

३. आिण (cid:249)याअथ(cid:559), िविवध राजकीय प(cid:550)ांकड(cid:564)न (cid:332)ा(cid:262)त होणारी िनवेदने व अहवाल यांचे अवलोकन क(cid:577)(cid:269)यावर उ(cid:242)त आदेशातील भाग दोन ३. (१०) (अ) म(cid:260)ये राजकीय प(cid:550) (cid:266)हणून न(cid:635)दणी कर(cid:256)यात आ(cid:269)यानंतर (cid:257)या प(cid:550)ा(cid:247)या नावाम(cid:260)ये, मु(cid:243)य काया(cid:593)लया(cid:247)या प(cid:346)याम(cid:260)ये कर(cid:256)यात येणा(cid:311)या बदलांबाबत एकसमान काय(cid:593)प(cid:460)ती राबिव(cid:256)या(cid:247)या दृ(cid:273)टीने िनकष िन(cid:556)(cid:272)चत करणे गरजेचे आहे,असे आयोगाचे मत झाले आहे,

(१)२ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग एक-अ–म(cid:260)य उप-िवभाग, फ(cid:577)(cid:334)ुवारी १५, २०२२/माघ २६ शक(cid:577) १९४३ ४. आिण (cid:249)याअथ(cid:559), असे िनकष िन(cid:556)(cid:272)चत क(cid:577)(cid:269)यामुळ(cid:578) राजकीय प(cid:550)ां(cid:247)या कामकाजात अिधक पारदश(cid:593)कपणा येईल अशी आयोगाची धारणा आहे,

५. (cid:257)याअथ(cid:559), रा(cid:249)य िनवडणूक आयोग, राजकीय प(cid:550)ांची न(cid:635)दणी आदेश, २००९ मधील भाग दोन ३. (१०) (अ) म(cid:260)ये सुधारणा क(cid:544)न खालील(cid:332)माणे काय(cid:593)प(cid:460)ती िन(cid:556)(cid:272)चत कर(cid:256)यात येत अस(cid:269)याबाबतचे आदेश िनग(cid:593)िमत करीत आहे :—

आदेश

(i) राजकीय प(cid:550)ाने नाव बदलाबाबत आयोगाकड(cid:578) (cid:332)(cid:274)ताव सादर करताना (cid:257)यासोबत प(cid:550) काय(cid:593)कारणी(cid:247)या बैठकीत सदर नाव बदल(cid:256)याबाबत मंजूर झाले(cid:269)या ठरावाची नोटरी(cid:465)ारे (cid:332)मािणत क(cid:577)लेली (cid:332)त जोडणे आव(cid:272)यक राहील.

(ii) परंतु,असे नाव आयोगाकड(cid:564)न न(cid:635)दणी क(cid:577)ले(cid:269)या तसेच न(cid:635)दणी र(cid:459) झाले(cid:269)या प(cid:550)ां(cid:247)या नावाशी साध(cid:266)य(cid:593) असलेले असू नये.

(iii) प(cid:550)ाकड(cid:564)न असा (cid:332)(cid:274)ताव (cid:332)ा(cid:262)त झा(cid:269)यावर (cid:257)या(cid:247)या नावातील बदलाबाबत सव(cid:593)साधारण जनतेकड(cid:564)न ३० िदवसां(cid:247)या मुदतीत हरकती मागिव(cid:256)याबाबत अिधसूचना राजप(cid:327)ात (cid:332)िस(cid:460) कर(cid:256)यात येईल. या कालावधीत हरकती (cid:332)ा(cid:262)त झा(cid:269)यास (cid:257)याची शहािनशा क(cid:544)न रा(cid:249)य िनवडणूक आयोग प(cid:550)ा(cid:247)या नाव बदलास परवानगी दे(cid:256)याबाबत िनण(cid:593)य घेईल.

(iv) राजकीय प(cid:550)ांना (cid:257)यां(cid:247)या न(cid:635)दणीनंतर असे नाव बदल(cid:256)याबाबत आयोगाकड(cid:564)न परवानगी फ(cid:242)त एकदाच दे(cid:256)यात येईल.

(v) राजकीय प(cid:550)ांनी (cid:257)यां(cid:247)या मु(cid:243)य काया(cid:593)लया(cid:247)या प(cid:346)यात बदल क(cid:577)(cid:269)यास (cid:257)याबाबत आयोगास सूिचत करताना संबंिधत (cid:274)थािनक (cid:274)वरा(cid:249)य सं(cid:274)थेकड(cid:564)न ( उदा. (cid:314)ामपंचायत / नगरप(cid:555)रषद / नगरपंचायत / महानगरपािलका ) मु(cid:243)य काया(cid:593)लया(cid:247)या बदलले(cid:269)या प(cid:346)यासंदभा(cid:593)त ना-हरकत (cid:332)माणप(cid:327) आयोगास सादर करणे अिनवाय(cid:593) असेल.

(vi) राजकीय प(cid:550)ांनी (cid:257)यां(cid:247)या काय(cid:593)कारणीत पदािधका(cid:311)याचे िनधन, राजीनामा, िनवडणूक इ. कारणांमुळ(cid:578) वेळोवेळी कर(cid:256)यात आले(cid:269)या बदलाबाबत (cid:257)या प(cid:550)ा(cid:247)या अिधक(cid:565)त वेबसाइटवर (cid:332)िस(cid:260)दी दे(cid:256)याबरोबरच याबाबत आयोगास िवनािवलंब कळिवणे आव(cid:272)यक असेल. आयोगास असा अहवाल सादर करताना प(cid:550)ा(cid:247)या सव(cid:593)साधारण सभेम(cid:260)ये पा(cid:555)रत झाले(cid:269)या संबंिधत ठरावाची (सव(cid:593) उप(cid:556)(cid:274)थत सद(cid:274)यां(cid:247)या (cid:274)वा(cid:550)र(cid:558)ची) नोटरी(cid:465)ारे (cid:332)मािणत क(cid:577)लेली (cid:332)त जोडणे अिनवाय(cid:593) असेल.

NOTIFICATION

POLITICAL PARTIES REGISTRATION ORDER, 2009 (RE-REVISED 2022).

(1) Criteria for the change in the name of a Political Party.

(2) Documents to be submitted after making change in-address and working committee

of a Party.

The Registration of Political Parties Order, 2009 (Re-revised 2022) No.SEC/RPP2022/ CR.20/D-11.—Whereas, as per the Articles 243K and 243ZA of the Constitution and also under the provisions of the relevant laws on local bodies in the state, the powers of superintendence, direction and conduct of all elections to the local bodies vest in the State Election Commission,

And whereas, in order to enable political parties to play their vital role in the party-based elections to the local bodies (Municipalities, Municipal Councils / Nagar Panchayats, Zilla Parishads and Panchayat Samiti), the State Election Commission has passed the following orders in the past for registration, distribution of symbols, etc.:—

(i) The Registration of Political Party Order, 2004 (This has been amended from time to time and currently, Order dated 31st March, 2009 is in force.)

(ii) Maharashtra Election Symbols (Reservation and Distribution) Order, 2009

(iii) Registration of Political Parties Order, 2009 (Revised 2018) dated July 25, 2018.

3. And whereas, after reviewing reports and applications received from various political parties, this Commission has arrived at the opinion about necessity to amend PART II 3. (10) (a) of the said order, so as to fix certain criteria for making changes in respect of its name , head office address and working committee,

4. And whereas, the Commission is of the view that setting such criteria will lead to greater transparency in the functioning of political parties.

5. Now therefore, State Election Commission, hereby issues the following Order with respect to the amendment in the Part Two 3. (10) (a) of the Registration of Political Parties Order, 2009

Order

(i) Any political party desirous of changing its name shall submit a proposal to the Commission. It will be necessary to attach a notarised copy of the resolution approved in the meeting of the Party Working Committee.

(ii) Such name shall not closely resemble with the name of any other political party either earlier registered or de-registered by this Commission.

(iii) Upon receipt of such a proposal from the party, a notification will be published in the official Gazette seeking objections from the general public within 30 days. If any objection is received during this period, the State Election Commission will take a decision on whether to allow the change in the name of that party.

(iv) After its registration, a political party will be allowed to change its name only once.

(v) In case of change in the address of head office of a political party, it will be mandatory for the Parties to furnish, No-Objection Certificate from the concerned local body (e.g. Village Panchayat / Nagar Parishad / Nagar Panchayat / Municipal Corporation) regarding the changed address of its head office, to this Commission.

(vi) In case of change in the Party's Working Committee on account of death, resignation etc. of office bearer/s , or on account of routine election , or due to any other reason, it will be mandatory for the party to publish such changes on Party's official website besides promptly informing this to the Commission. It is mandatory for that party to submit such report along with a copy of the resolution passed in its general body meeting (with signatures of every member present) duly attested by a Notary.
