क्रमांक एदिएल २०२१/प्र.क्र. ५८/गृदनभू.—जयाअर्थी महाराष्ट्र शासन, गृहदनमा्गण व दवशेष सहायय दवभाग यांनी महाराष्ट्र गृहदनमा्गण व क्ेत्दवकास प्रादिकरण, १९७६ (१९७७ चा महा. २८) मिील कलम (४१) मिील पोट-कलम (१) द्ारे प्रदान करणयात आलेलया अदिकारांचा वापर करून, क्रमांक एदिएल ४१७९/६४८५७/दि.एकस.ए., ददनांक २ एदप्रल १९८५ या अदिसुचनेद्ारे (यापुढे "सदर अदिसूचना" असे वाचावे) तयासोबत जोिलेलया पररदशष्टातील मौ. अमळनेर, ता. अंमळनेर, दज. जळगाव येर्ील जमीन आदर्गकदृष्ट्ा दुब्गल, मधय व अलप उतपनन गट आदण क्ेत्दवकास योजनेसाठी (यापुढे "सदर योजना" असे वाचावे) नादशक गृहदनमा्गण आदण क्ेत्दवकास मंिळ यांचयामाफ्फत संपादीत करणयाचा दनण्गय घेतला होता ;

आदण जयाअर्थी, महाराष्ट्र गृहदनमा्गण व क्ेत्दवकास प्रादिकरणाने मुखय अदिकारी, नादशक गृहदनमा्गण व क्ेत्दवकास मंिळ यांचया अहवालानुसार सदर जदमनीवर सदर योजना आदर्गकदृष्ट्ा वि्गनक्म होत नसलयाने अंमळनेर, दज. जळगाव येर्ील अंदतम भुखंि क्र. २०७ एकूण क्ेत् २२७३ चौ.मी. सदर जमीन (यापुढे "सदर जमीन" असे वाचावे) सदर योजनेसाठी आवशयक नसलयाचे अदभप्राय ददले आहेत. आदण तयाअर्थी, सदर योजनेसाठी सदर जमीन आवशयक नाही ;

आदण जयाअर्थी, मुळ मालक व भूखंिाशी संबंदित इच्छुक वयकतींना सदर अदिसूचना रद्द करणयाचया अनुषंगाने सुनावणीची संिी देणयात आली आहे ;

आदण जयाअर्थी, महाराष्ट्र गृहदनमा्गण व क्ेत्दवकास प्रादिकरणास सदर जदमनीची आवशयकता नसलयाने सदर अदिसूचनेतील सदर जदमनीबाबतची अदिसूचना रद्द करणे महाराष्ट्र शासनास योगय वाटते.

भाग चार-ब-५८–१M-6 ( Part IV-B Ext 58) २ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, फेब्ुवारी १६, २०२२/माघ २७, शके १९४३ आता, तयाअर्थी, महाराष्ट्र शासन, महाराष्ट्र गृहदनमा्गण व क्ेत्दवकास प्रादिकरण, १९७६ (१९७७ चा महा. २८) मिील कलम (४१) मिील पोट-कलम (१) व द जनरल कलाॅजेस अॅकट, १९८१ मिील कलम २१ मिील कललॉजेस अॅकट (१/१९०४) द्ारे प्रदान करणयात आलेलया अदिकारांचा वापर करून सदर अदिसूचना सदर जदमनीचया अनुषंगाने याद्ारे अंशत: रद्द (Rescind) करीत आहे.

NOTIFICATION

Maharashtra housing and area developMent act, 1976.

No. ADL-2021/C.R.58/Grunibhu .—Whereas the Government of Maharashtra has, vide Government Notification, Housing and Special Assistance Department, No. ADL-4179/64857/D.X.A., dated the 2nd April 1985 (hereinafter referred to as "the said Notification"), issued in exercise of the powers conferred by sub-section (1) of section 41 of the Maharashtra Housing and Area Development Act, 1976 (Mah. XXVIII of 1977), decided to acquire certain land situated in Village/Town Amalner, Taluka Amalner, District Jalgaon specified in the Schedule appended thereto, for the purpose of construction of tenements under Economical Weaker Section, Low Income Group, Middle Income Group and for execution of the Area Development Scheme at Amalner, District Jalgaon (hereinafter referred to as "the said Schemes"), by the Nashik Housing and Area Development Board, Nashik ;

And whereas the Maharashtra Housing and Area Development Authority, after receiving report of the Chief Officer, Nashik Housing and Area Development Board, is of the opinion that it is not viable to implement the said Schemes on the land bearing Plot No. 207 admeasuring 2273 sq. mtr. situated in village/Town Amalner, Taluka Amalner, District Jalgaon (hereinafter referred to as "the said land") and therefore the said land is no more required for the purposes of the said Schemes ;

And whereas, the owners and persons interested in the said land have been given an apportunity of being heard in respect of the proposal to partially rescind the said notification in respect of the said land ;

And whereas, the Government of Maharashtra considers it expedient to partially rescind the said notification so far as it relates to the said land as the said land is not required by the Maharashtra Housing and Area Development Authority for the purposes of the said Schemes.

Now, therefore, the Government of Maharashtra, in exercise of the powers conferred by sub-section (1) of section 41 of the Maharashtra Housing and Area Development Act, 1976 (Mah. XXVIII of 1977) read with section 21 of the Maharashtra General Clauses Act (1 of 1904), hereby partially rescinds the said notification so far as it relates to the said land.
