क्रमांक रानिआ/ रापनों-२०१६/प्र.क्र.२४ /का-११ .- ज्याअर्थी , भारतीय संविधानाच्या अनुच्छेद २४३ -के व २४३ -झेड ए अन्वये तसेच राज्यातील स्थानिक स्वराज्य संस्थांच्या संबंधित कायद्यातील तरतुदींन्वये अशा स्थानिक स्वराज्य संस्थांच्या सर्व निवडणुकांचे अधिक्षण , संचालन व नियंत्रण याबाबतचे अधिकार राज्य निवडणूक आयोगास प्राप्त झाले आहेत ;
आणि ज्याअर्थी , स्थानिक स्वराज्य संस्थांच्या निवडणुकांचे पावित्र्य राखणे व अशा निवडणुका मुक्त, निःपक्षपातीपणे , प्रभावीपणे व कार्यक्षमतेने पार पाडण्याच्या दृष्टीने राजकीय पक्षांची नोंदणी व संबंधित बाबींची तरतूद त्यात करणे गरजेचे आणि आवश्यक असल्याने राज्य निवडणूक आयोगाद्वारे क्र. एसईसी / एमसी २०० ९ / सी आर -४ ९ /डी -११ , दिनांक ३१ मार्च २०० ९ च्या अधिसूचनेद्वारे , राजकीय पक्षांची नोंदणी आदेश , २०० ९ आणि महाराष्ट्र निवडणूक चिन्ह ( आरक्षण व वाटप ) आदेश , २०० ९ काढण्यात आला आहे ;
आणि ज्याअर्थी, उक्त आदेशातील भाग दोन ३. ( १० ) ( अ) मधील तरतुदींमध्ये राजकीय पक्षांचे नोंदणी आदेश , २०० ९ (पुनःसुधारित २०२२ ) दिनांक १५ फेब्रुवारी २०२२ अन्वये सुधारणा करण्यात आलेली असून राजकीय पक्षांचे नाव बदलण्याबाबत निकष निश्चित करण्यात आलेला आहे ;
आणि ज्याअर्थी, या आदेशातील तरतुदींनुसार श्री . बळीराम चोपणे यांच्या अध्यक्षतेखाली डॉ. सौ. विमलताई मुंदडा विकास आघाडी, अंबेजोगाई , जि. बीड या राजकीय पक्षांची नोंदणी अमान्यताप्राप्त पक्ष म्हणून क्रमांक रानिआ/ रापनों -२०१६ /प्र.क्र.२४ /का-११ , दिनांक १५ ऑक्टोबर २०१६ च्या पत्रान्वये करण्यात आलेली आहे .

भाग एक- अ-(म.उ.वि. ) -१७-१ २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक - अ-मध्य उप- विभाग, फेब्रुवारी १७ , २०२२/ माघ २८ , शके १ ९ ४३ आणि ज्याअर्थी, श्री . बळीराम चोपणे , अध्यक्ष डॉ . सौ. विमलताई मुंदडा विकास आघाडी , यांनी पक्षाच्या कार्यकारणीच्या दिनांक २० डिसेंबर २०२१ च्या सर्वसाधारण बैठकीत पारित झालेल्या ठरावानुसार दिनांक ३० जानेवारी २०२२ तसेच दिनांक १५ फेब्रुवारी २०२२ च्या पत्रांद्वारे राज्य निवडणूक आयोगास उक्त आदेशातील भाग दोन ३. ( १० ) ( अ) नुसार सदर पक्षाचे नाव "डॉ. सौ . विमलताई मुंदडा विकास आघाडी" ऐवजी "अंबाजोगाई शहर परिवर्तन जनविकास आघाडी " असे बदलण्याबाबत विनंती केली आहे ;
आणि ज्याअर्थी , या पक्षाचा नावातील बदल करण्यापूर्वी महाराष्ट्र शासन राजपत्रात पक्षाचे प्रस्तावित बदल केल्यानंतरचे नाव आणि पत्ता , त्याचे अध्यक्ष अंतर्भाव असलेली सूचना प्रसिद्ध करून सर्वसाधारण जनेतेकडून अशा नाव बदलाबाबत हरकती मागविणे आवश्यक आहे ;
आणि ज्याअर्थी , महाराष्ट्र शासन राजपत्रात उपरोक्तप्रमाणे अधिसूचना प्रसिद्ध केलेल्या दिनांकापासून ३० दिवसांच्या आत कोणतीही हरकत प्राप्त न झाल्यास राज्य निवडणूक आयोग अधिसूचनेत प्रस्तावित केल्याप्रमाणे सदर राजकीय पक्षाच्या नावामध्ये बदल करण्याकरिता सक्षम राहील ;
आणि ज्याअर्थी, उक्त आदेशाप्रमाणे कोणतीही हरकत प्राप्त झाली , तर तिचा राज्य निवडणूक आयोग विचार करेल व ती क्षुल्लक आढळल्यास , फेटाळण्यात येईल व या राजकीय पक्षाचे नाव बदलण्यास मान्यता देईल . त्याचप्रमाणे राज्य निवडणूक आयोगास अशा हरकतीत प्रथमदर्शनी सत्य वाटले , तर ती संबंधित पक्ष प्रतिनिधीस कळविण्यात येईल आणि त्यावर त्याचे अभिप्राय मागविण्यात येतील आणि अभिप्राय प्राप्त झाल्यावर , आयोग उपलब्ध अभिलेखाच्या आधारावरील गुणवत्तेवर निर्णय घेईल किंवा , संबंधित पक्षांचे म्हणणे ऐकून त्यानंतर निर्णय घेईल व राज्य निवडणूक आयोगाचा असा निर्णय अंतिम राहील ;
आणि ज्याअर्थी , श्री. बळीराम चोपणे, अध्यक्ष, " डॉ. सौ. विमलताई मुंदडा विकास आघाडी " कार्यालयीन पत्ताः- गंगा निवास, शिवाजी नगर , रिंग रोड , अंबाजोगाई, जि. बीड, पीन ४१३ ५१७ यांच्या विनंतीनुसार सदर पक्षाचे नाव " डॉ. सौ. विमलताई मुंदडा विकास आघाडी " ऐवजी " अंबाजोगाई शहर परिवर्तन जनविकास आघाडी" असे बदलण्याबाबत राज्य निवडणूक आयोगाकडे अर्ज केला आहे ;
आणि ज्याअर्थी, उक्त आदेशातील भाग दोन ३. ( १० ) ( अ ) मधील तरतुदींमध्ये राजकीय पक्षांचे नोंदणी आदेश , २०० ९ ( पुनःसुधारित २०२२ ) दिनांक १५ फेब्रुवारी २०२२ अन्वये करण्यात आलेल्या सुधारणेनुसार राज्य निवडणूक आयोगाने उपरोक्त पक्षाचे नाव बदलण्यापूर्वी सदर बदलाबाबत सर्वसाधारण जनतेकडून हरकती मागविणे आवश्यक आहे.
आता त्याअर्थी , राज्य निवडणूक आयोग , महाराष्ट्र सदर अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून ३० दिवसांच्या आत उक्त पक्षाच्या नावातील प्रस्तावित बदलाबाबत सर्वसाधारण जनतेकडून कोणतीही हरकत असल्यास , ती परस्पर आयोगाच्या कार्यालयाकडे दाखल करावी, असे जाहीर करीत आहे .

NOTIFICATION
No.SEC /RPP - 2016/CR - 24/D - 11.- Whereas , the superintendence , direction and control of all elections to the Panchayats and Municipalities in the State are vested in the State Election Commission, Maharashtra by virtue of Article 243 - K and 243 - ZA of the Constitution of India , and the provisions of the relevant State law as applicable to such Panchayats and Municipalities ;
And whereas , with a view to provide , in the interest of sanctity of elections to the local bodies , and in the interest of conduct of such elections , in a free , fair , effective and efficient manner , for the registration of Political Parties and for matters connected therewith; the Registration of Political Parties Order , 2009 and Maharashtra Election Symbols ( Reservation and Allotment ) Order , 2009 has been made by the State Election Commission , Maharashtra vide the State Election Commission , Maharashtra , Notification No. SEC/MC - 2009/CR- 49/D - 11 , dated 31st March , 2009 ;
And whereas , as per the Political Parties Registration Order, 2009 ( Re - revised 2022 ) published on 15th February , 2022 , criteria for changing name of a Political Party has been fixed by amending Part Two 3. (10) (A) of the above said Order ;
And whereas , as per the provisions of the said Order , a political party bearing the name as Dr. Sau . Vimaltai Mundada Vikas Aaghadi , Ambajogai , Dist . Beed and having Mr. Baliram Chopane as its President has been registered as an unrecognised Political Party vide letter No. SEC/RPP- 2016/CR - 24/D- 11 , dated 15th October 2016 by the State Election Commission , Maharashtra ;
And whereas , according to the provision under Part Two 3. ( 10) ( A) of the above said Order , Mr. Baliram Chopane , President , Dr. Sau . Vimaltai Mundada Vikas Aaghadi , Ambajogai has requested this Commission vide its letters Dated 30/01/2022 and 15/02/2022 , to change the name of the said political party from " Dr. Sau . Vimaltai Mundada Vikas Aaghadi , " to " Ambajogai Shahar Parivartan Janvikas Aaghadi " as per the resolution passed by its Working Committee on 20th December 2021 ;
And whereas , before changing the name of a political party under this Order , it is necessary to publish a notice in the Maharashtra Government Gazette indicating therein , the name and address of the political party , its President and calling for objections , if any , for such change of name from the general public ;
And whereas , as per the said Order , if no objection is received within 30 days from the date of publication of such notification in the Maharashtra Government Gazette , it shall be competent for the State Election Commission to change the name of said political party , as proposed in the notification;
And whereas , if any objection is so received , the State Election Commission may consider the same and in case it is found to be without substance , it may reject the same and change the name of said political party . If on the other hand , the State Election Commission considers that the objection is prima facie genuine , then the same shall be communicated to the concerned office bearer of the said party and his remarks shall be called for . After receipt of the remarks , the Commission may either decide the matter on merits on the basis of the records available or it may give personal hearing to the parties concerned and take a decision thereafter . The decision of the State Election Commission shall be final ;
And whereas , Shri . Baliram Chopane , President of "Dr. Sau . Vimaltai Mundada Vikas Aaghadi , " party having main office address- Ganga Nivas , Shivaji Nagar , Ambajogai , Dist . Beed , Pin - 413 517 has applied to the State Election Commission for the change of name from "Dr. Sau . Vimaltai Mundada Vikas Aaghadi , " to " Ambajogai Shahar Parivartan Janvikas Aaghadi " as a political party;

( 10) ( a) of the above said Order vide notification published on 15th February 2022 [ Political Parties Registration Order , 2009 (Re- revised 2022 )] it is necessary for the State Election Commission to call for objections , if any , from the general public with respect to the change in the name of above said political party .
Now , therefore , the State Election Commission , Maharashtra , hereby calls for objections , if any , for such change in the name of said political party from the general public which are to be submitted directly to the Commission within 30 days from the date of publication of this notification in Maharashtra Government Gazette .
