आिण (cid:249)याअथ(cid:559), उ(cid:242)त अिधिनयमा(cid:247)या कलम ३१ (१) नुसार (cid:332)ा(cid:544)प िवकास योजनेतील (cid:332)(cid:274)तावासंदभा(cid:593)त शासनाने यो(cid:244)य ती चौकशी क(cid:577)(cid:269)यानंतर आिण संचालक, नगररचना, महारा(cid:273)(cid:322) रा(cid:249)य, पुणे यां(cid:247)याशी िवचार िविनमय क(cid:544)न शासन, नगर िवकास िवभागाने अिधसूचना (cid:312). टीपीएस-१२१५/२४५/(cid:332). (cid:312). ३३२/२०१५/एसएम/निव - १२, िदनांक २७ एि(cid:332)ल २०१७अ(cid:261)वये उ(cid:242)त (cid:332)ािधकरणाची उ(cid:242)त (cid:550)े(cid:327)ातील २३ गावांसाठी (cid:332)ा(cid:544)प अंत(cid:555)रम िवकास योजना भागश: मंजूर क(cid:577)लेली आहे आिण िदनांक २७ मे २०१९ पासून अंमलात आली आहे. तसेच अिधसूचना (cid:312). टीपीएस-१७१७/ स.(cid:312). २७५०/(cid:332). (cid:312). ९१/२०१९/निव -१२, िदनांक १६ स(cid:262)ट(cid:608)बर २०१९ अ(cid:261)वये उ(cid:242)त (cid:332)ािधकरणाची उ(cid:242)त (cid:550)े(cid:327)ातील १५२ गावांसाठी (cid:332)ा(cid:544)प िवकास योजना भागश: मंजूर क(cid:577)लेली आहे. आिण िदनांक १६ ऑ(cid:242)टोबर २०१९ पासून अंमलात आली आहे ;
आिण (cid:249)या अथ(cid:559) महारा(cid:273)(cid:322) (cid:332)ादेिशक िनयोजन व नगररचना अिधिनयमाचे कलम १५४ अ(cid:261)वये नगर िवकास िवभागाने प(cid:327) (cid:312).टीपीएस /१७१७/२७५०/(cid:332).(cid:312) ९१/नवी-१२, िदनांक ६ जानेवारी २०२० रोजी(cid:247)या िनद(cid:616)शानुसार १५२ गावांक(cid:555)रता मंजूर असलेली िवकास िनयं(cid:327)ण व (cid:332)ो(cid:257)साहन िनयमावली ही उ(cid:242)त अिधसूिचत (cid:550)े(cid:327)ातील २३ गावे अंत(cid:555)रम िवकास योजनेस लागू कर(cid:256)यात आली आहे. जेणेक(cid:543)न संपूण(cid:593) नैना (cid:550)े(cid:327)ास एकच िवकास िनयं(cid:327)ण िनयमावली असेल.

भाग दोन-३१–१२ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग दोन, माच(cid:593) २, २०२२/फा(cid:269)गुन ११, शक(cid:577) १९४३ आिण (cid:249)याअथ(cid:559) िसडको(cid:247)या नैना (cid:550)े(cid:327)ासभोवताल असणारे (cid:332)ािधकरण (cid:249)यात नवी मु ंबई, पनवेल महानगर पािलका, ठाणे महानगरपािलका, महारा(cid:273)(cid:322) रा(cid:249)य र(cid:274)ते िवकास महामंडळास शासनाने एका(cid:556)(cid:257)मक िवकास (cid:332)ो(cid:257)साहनाथ(cid:593) िनयमावली लागू क(cid:577)ली. (cid:257)यामुळ(cid:578) नैना (cid:550)े(cid:327)ातील िवकासकांनी ह(cid:274)तांतरणीय िवकास अिधकार (Transfer Of Development Rights) तरतूदी िवषयक एका(cid:556)(cid:257)मक िवकास (cid:332)ो(cid:257)साहनाथ(cid:593) िनयमावली (cid:332)माणे ह(cid:274)तांतरणीय िवकास अिधकार (TDR) नैना(cid:247)या कोण(cid:257)याही (cid:550)े(cid:327)ात चटई (cid:550)े(cid:327) िनद(cid:616)शांका(cid:247)या (cid:274)व(cid:543)पात जा(cid:274)तीत जा(cid:274)त वापरता यावा यासाठी महामंडळास िवनंती कर(cid:256)यात आली. ह(cid:274)तांतरणीय िवकास अिधकार (cid:266)हणजे चटई (cid:550)े(cid:327) िनद(cid:616)शांका(cid:247)या (cid:274)व(cid:543)पात भरपाई यामुळ(cid:578) िनयोजन (cid:332)ािधकरणास िवकास आराखडयातील आरि(cid:550)त जागा भूसंपादन न करता (cid:332)दान करता येतात.
(cid:266)हणून (cid:271)यापक जनिहत ल(cid:550)ात घेता मंजूर िनयमावलीतील ह(cid:274)तांतरणीय िवकास अिधकारा(cid:247)या तरतुदीत सुधारणा करणे आव(cid:272)यक वाट(cid:269)यामुळ(cid:578) यासंदभा(cid:593)त (cid:332)(cid:274)ताव सादर क(cid:577)ला असता िसडको महामंडळाने िदनांक १९ फ(cid:577)(cid:334)ुवारी २०२२ (cid:247)या ठराव (cid:312)मांक १२५३२ अ(cid:261)वये संदिभ(cid:593)त (cid:332)(cid:274)ताव सादर क(cid:577)ला.
(cid:257)यामुळ(cid:578), आता कलम ३७ (cid:247)या उप-कलम (१) नुसार महामंडळातफ(cid:617) सदर िवकास िनयं(cid:327)ण आिण (cid:332)ो(cid:257)साहन िनयमावलीम(cid:260)ये सोबत जोडले(cid:269)या सूची नुसार फ(cid:577)रबदल कर(cid:256)यासाठी सूचना जारी कर(cid:256)यात येत आहे.
उ(cid:242)त अिधिनयमां(cid:247)या कलम ३७, उप-कलम (१) अनुषंगाने महारा(cid:273)(cid:322) शासना(cid:247)या राजप(cid:327)ात नोटीस (cid:332)कािशत कर(cid:256)या(cid:247)या तारखेपासून १ मिह(cid:261)यापे(cid:550)ा अिधक नसेल अशा कालावधीत कोण(cid:257)याही (cid:271)य(cid:556)(cid:242)तकड(cid:564)न (cid:332)(cid:274)तािवत फ(cid:577)रबदलाबाबतीत आ(cid:550)ेप व सूचना मागिव(cid:256)यासाठी िसडको महामंडळ सूचना (cid:332)कािशत करत आहे. या सुचनेसंबंधी आ(cid:550)ेप व सूचना महामंडळा(cid:247)या मु(cid:243)य िनयोजनकार, टॉवर नं. १०, ८ वा मजला, िनयोजन िवभाग, बेलापूर रे(cid:269)वे(cid:274)थानक संक(cid:561)ल, सीबीडी बेलापूर, नवी मु ंबई ४०० ६१४ यां(cid:247)याकड(cid:578) पाठवा(cid:271)यात.

WHEREAS, the Government of Maharashtra in exercise of powers conferred under clause (b) of sub-section (1) of the Section 40 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") declared by Notification, No. TPS. 1712/475/CR-98/12/UD- 12: dated 10th January, 2013 (hereinafter referred to as "the said Notification") City and Industrial Development Corporation of Maharashtra Limited (being a company owned and controlled by the Government of Maharashtra) (hereinafter referred to as "the said Corporation") as Special Planning Authority (hereinafter referred to as "the SPA") for Navi Mumbai Airport Influence Notified Area (NAINA) (hereinafter referred to as "the said notified area") as specified therein ;
And whereas, in accordance with sub-section (1) of section 31 of the said Act, the Government, after making necessary enquiry and consulting the Director of Town Planning, Maharashtra State, Pune, has sanctioned Part of the draft Development Plan of 23 villages of said notified area of the said Corporation vide Urban Development Department, Notification No. TPS-1215/245/CR-332/2016/SM/ UD-12, dated 27th April 2017 which has come into force with effect from 27th May 2017. And vide Notification No. TPS.1717/MIS 2750/ C.R. 91/2019/UD 12, dated 16th September 2019 sanctioned part of the Draft Development Plan of 152 villages of said notified area which has come into force with effect from 16th October 2019 ;
And whereas, the Government of Maharashtra in the Urban Development, in exercise of the powers conferred under Section 154 of the said Act vide Notification No. TPS -1717/2750/C.R. 91/19/ UD-12, dated 6th January 2020, directed that the sanctioned Development Control and Promotion Regulations (hereinafter referred to as " the said DCPR") of 152 villages that are proposed to be modified and published under section 37(1AA) on 6th January 2020 be made applicable along with above modifications to the Interim Development Plan of 23 villages published in the Maharashtra Government. Gazette dated 27th May 2017, so that there is a single "DCPR" for the entire NAINA area ;
And whereas, NAINA area is surrounded by Navi Mumbai, Panvel Municipal Corporation, Thane Municipal Corporation, MSRDC, where recently Government approved UDCPR is made applicable. There is request from stakeholders for modification in Transfer of Development Rights (TDR) provisions of sanctioned DCPR in line with UDCPR for maximum utilization of TDR in any zone of NAINA area. Transferable Development Rights (TDR) is compensation in the form of Floor Space Index (FSI). This mechanism can have used by planning authorities when land under reservation for public purpose is to be acquired by the authority instead of going through land acquisition procedure.
And whereas, thus in the larger public interest and to initiate necessary action the said Corporation considers it necessary to make modifications to certain TDR regulations of sanctioned DCPR of NAINA, and accordingly approved the proposal vide Board Resolution No. 12532 dated 19th February 2022.
Now, therefore, under Sub-Section (1) of the Section 37 of the said Act, the Corporation hereby issues and publishes notice declaring its intention to carry out the modifications to the said DCPR as specified in the Schedule attached :
In pursuance of Sub-Section (1) of the Section 37 of the said Act, the Corporation invites objections and suggestions from any person with respect to the proposed modifications to the said DCPR not later than one month from the date of the publication of this Notice in the Maharashtra Government. Gazette.
