In pursuance of clause ( 3 ) of article 348 of the Constitution of India , the following translation in English of the Maharashtra Shops and Establishments ( Regulation of Employment and Conditions of Service ) (Amendment ) Bill , 2022 ( L. A. Bill No. I of 2022 ) , introduced in the Maharashtra Legislative Assembly on the 4th March 2022 is hereby published under the authority of the Governor .

A BILL
to amend the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 .

WHEREAS it is expedient to amend the Maharashtra Shops and of Establishments ( Regulation of Employment and Conditions of Service ) Act , 2017 , for the purposes hereinafter appearing ; it is hereby enacted in the Seventy - third Year of the Republic of India as follows : -
1. This Act may be called the Maharashtra Shops and Establishments Short title . (Regulation of Employment and Conditions of Service) (Amendment ) Act , 2022 .
Mah . 2. In section 1 of the Maharashtra Shops and Establishments Amendment LXI of (Regulation of Employment and Conditions of Service ) Act , 2017 ( hereinafter of section 1 of 2017. referred to as " the principal Act " ) , for sub - section ( 3 ) , the following Mah.I sub - section shall be substituted , namely :- Mah . " (3) ( a ) The provisions of this Act , except section 7 , shall apply to the establishments employing ten or more workers .
( b ) The provisions of sections 7 and 36A shall apply to the establishments employing less than ten workers . " .
3. In section 17 of the principal Act , clause (g ) shall be deleted.
Amendment of section 17 ofMah . LXI of2017 .
4. After section 36 of the principal Act , the following section shall be inserted , namely : -
Insertion of new section 36A in Mah . LXI of 2017 .
Name Board to be in Marathi.
" 36A. ( 1) The Name Board of every establishment registered under section 6 , or of every establishment to which section 7 apply , shall be in Marathi language in Devnagari script :
Provided that , the employer of such establishment may also have the Name Board in any other language and script in addition to Marathi in Devnagari script :
Provided further that , lettering in Marathi language shall essentially be written in the beginning on the Name Board and the font size of the letters in Marathi Language shall not be smaller than the font size of the letters in any other language .
( 2 ) No establishment where liquor is served or sold shall have a Name Board in the name of legends or forts ." .

STATEMENT OF OBJECTS AND REASONS
The Maharashtra Shops and Establishments ( Regulation of Employment and Conditions of Service) Act , 2017 (Mah . LXI of 2017 ) (hereinafter referred to as " the said Act " ) , which provides for regulation of conditions of employment and other conditions of service of workers employed in shops and other establishments , is applicable to the establishments employing ten or more workers .
2. Rule 35 of the Maharashtra Shops and Establishments ( Regulation of Employment and Conditions of Service) Rules , 2018 , made under the said Act , mandates every establishment to display the name board in Marathi in Devnagari script .
It has been brought to the notice of the Government by various associations that some establishments having less than ten workers do not display name boards in Marathi due to the reason that the provisions of the said Act , except section 7, are not applicable to them . Therefore, there has been consistent demand from various associations to mandate every establishment , whether employing ten or more workers or less than ten workers , to display their name boards in Marathi .
The Government , therefore , considers it expedient to amend the said Act suitably by inserting a new section 36A therein with a view to provide that , every establishment registered under section 6 and every establishment to whom section 7 of the said Act apply shall display their name boards in Marathi in Devnagari script . It is also proposed to provide that the employer of establishment may also have the name board in any other language and script in addition to Marathi in Devnagari script however , lettering in Marathi language shall essentially be written in the beginning on the name board and the font size of the letters in Marathi language shall not be smaller than the font size of the letters in any other language.
3. Clause ( g) of section 17 of the said Act provides for containing of Aadhaar Card Number on identity card of every worker . Upon request of Unique Identification Authority of India , the Government considers it expedient to delete the said clause in view of the provisions of sub - section (4) of section 29 of the Aadhaar ( Targeted Delivery of Financial and Other Subsidies , Benefits and Services) Act , 2016 ( 18 of 2016 ) and regulation 6 of the Aadhaar ( Sharing of Information ) Regulation , 2016 made thereunder .
4. The Bill seeks to achieve the above objectives .
