भारताचे संविधान.
क्रमांक सेप्रनि-३०१९/प्र.क्र.३/वैसेवा-३.----भारतीय संविधानाच्या अनुच्छेद ३०९ खालील परंतुकान्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करुन महाराष्ट्राचे राज्यपाल याद्वारे महाराष्ट्र शासनाच्या वैद्यकीय शिक्षण व औषधी द्रव्ये विभागाच्या नियंत्रणाखालील वैद्यकीय शिक्षण व संशोधन संचालनालयांतर्गत येणाया शासकीय वैद्यकीय महाविद्यालये व संलग्नित रुग्णालयांतील वैद्यकीय अधिकारी, गट-ब (राजपत्रित) या पदावरील सेवाप्रवेशाचे विनियमन करण्यासाठी पुढील नियम करीत आहेत, जसे :----
१. या नियमांना, वैद्यकीय शिक्षण व संशोधन संचालनालयांतर्गत शासकीय वैद्यकीय महाविद्यालये व संलग्नित रुग्णालयांतील '' वैद्यकीय अधिकारी, गट-ब (राजपत्रित) (सेवाप्रवेश) नियम, २०२१," असे संबोधण्यात यावे.
२. या नियमांत संदर्भानुसार दुसरा अर्थ अभिप्रेत नसेल तर,----
(क) '' आयोग " याचा अर्थ महाराष्ट्र लोकसेवा आयोग असा आहे ;
(ख) '' पदवी " याचा अर्थ सांविधिक विद्यापीठाची पदवी असा आहे ;
(ग) '' संचालनालय " याचा अर्थ शासनाच्या वैद्यकीय शिक्षण व औषधीद्रव्ये विभागांतर्गत येणारे वैद्यकीय शिक्षण व संशोधन संचालनालय असा आहे ;
(घ) '' शासन " याचा अर्थ महाराष्ट्र शासन असा आहे ;
(ङ) '' सांविधिक विद्यापीठ " याचा अर्थ अस्तिवात असलेल्या कायद्यानुसार स्थापित केलेले विद्यापीठ असा आहे.
३. शासकीय वैद्यकीय महाविद्यालये व संलग्नित रुग्णालयांतील वैद्यकीय अधिकारी, गट-ब या पदावरील नियुक्ती आयोगाने शिफारस केलेल्या पुढील उमेदवारांमधून नामनिर्देशनाने,----
(एक) एकोणीस वषार्ंपेक्षा कमी वय नसलेल्या आणि खुल्या वर्गातील व्यक्तींंसाठी अडतीस वषार्ंपेक्षा जास्त वय नसलेल्या आणि मागासवर्गीय व्यक्तींसाठी त्रेचाळीस वषार्ंपेक्षा जास्त वय नसलेल्या ; आणि
(१)
भाग चार-अ-३९----१M-12 २ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ७, २०२२/फाल्गुन १६, शके १९४३ (दोन) ज्यांनी सांविधिक विद्यापीठाची एमबीबीएस पदवी किंवा राष्ट्रीय वैद्यकीय आयोग अधिनियम, २०१९ (२०१९ चा ३०) अन्वये विहित केलेली अन्य कोणतीही अर्हता धारण केली आहे; आणि
(तीन) ज्यांनी महाराष्ट्र वैद्यकीय परिषद अधिनियम, १९६५ च्या तरतूदीनुसार त्यांच्या नावाची नोंदणी केली आहे अथवा या अधिनियमानुसार ठेवल्या जाणाया नोंदवहीत ज्यांची नावे नोंदणीकृत झाली आहेत.
४. नियम क्रमांक ३ मध्ये नमूद केलेल्या पदावर नियुक्त केलेली व्यक्ती दोन वषार्ंच्या कालावधीसाठी परिविक्षाधीन असेल. त्यानंतर परिविक्षा कालावधी एका वर्षापयर्ंत वाढविता येईल. संबंधित व्यक्तीस विहित केलेला परिविक्षा कालावधी समाधानकारकरीत्या पूर्ण करणे आवश्यक असेल. जर त्या व्यक्तीने विहित केलेला परिविक्षा कालावधी समाधानकारकरीत्या पूर्ण केला नाही किंवा ती त्या पदासाठी अयोग्य असल्याचे आढळले तर ती सेवा समाप्त केली जाण्यास पात्र असेल.
५. नियम ३ येथे नमूद पदावर नियुक्त होणाया व्यक्तीने हिंदी भाषा परीक्षा व मराठी भाषा परीक्षा नियक्तीपुर्वी उत्तीर्ण केलेल्या नसतील अथवा उत्तीर्ण होण्यापासून तिला सूट मिळाली नसेल तर, त्या व्यक्तीस नियक्तीनंतर या संदर्भात शासनाने वेळोवेळी केलेल्या नियमानुसार विहित मुदतीत सदर दोन्ही भाषा परीक्षा उत्तीर्ण होणे आवश्यक राहील अन्यथा विहित मुदतीनंतर परीक्षा उत्तीर्ण होईपयर्ंत तिला वर्ाषिक वेतनवाढ किंवा वरिष्ठ पदावर पदोन्नती अनुज्ञेय राहणार नाही.
६. नियम ३ येथे नमूद पदावर नियक्त होणाया व्यक्तीने संगणक हाताळणी ज्ञान प्रमाणपत्र नियुक्तीपुर्वी धारण केलेले नसेल तर अथवा धारण करण्यापासून तिला सूट मिळाली नसेल तर, त्या व्यक्तीस नियुक्तीनंतर या संदर्भात शासनाने वेळोवेळी केलेल्या नियमानुसार विहित मुदतीत सदर प्रमाणपत्र धारण करणे आवश्यक राहील अन्यथा विहित मुदतीनंतर प्रमाणपत्र धारण करेपयर्ंत तिला वर्ाषिक वेतनवाढ किंवा वरिष्ठ पदावर पदोन्नती अनुज्ञेय राहणार नाही.
७. (१) नियम ३ येथे नमूद पदावर नामनिर्देशनाद्वारे नियुक्त होणाया व्यक्तीने, महाराष्ट्र नागरी सेवा (लहान कुटूंबाचे प्रतिज्ञापन) नियम, २००५ किंवा या संदर्भात शासनाने वेळोवेळी केलेले अन्य कोणतेही नियम, आदेश अथवा अन्य संलेख यांमधील तरतूदीनुसार लहान कुटूंबाचे प्रतिज्ञापन सादर करणे आवश्यक राहील, अन्यथा सदर पदावरील नियुक्तीसाठी तिला अपात्र ठरविण्यात येईल.
(२) लहान कुटुंबाचे प्रतिज्ञापन सादर करण्याच्या दिनाकांस दोनपेक्षा अधिक अपत्ये असणाया व्यक्तीस शासन सेवेतील नियक्तीसाठी अपात्र ठरविण्यात येईल.
(३) शासन सेवेतील नियुक्तीनंतर व्यक्तीस दोनपेक्षा अधिक अपत्ये आहेत असे सिद्ध झाल्यास तिला शासन सेवेतील सदर पदावरील नियुक्तीसाठी अपात्र ठरविण्यात येईल.
८. नियम क्रमांक ३ मध्ये नमूद केलेल्या पदावर नियुक्त केलेल्या व्यक्तीला आवश्यकतेनुसार सशस्त्र दलात भारतातील किंवा भारताबाहेरच्या संरक्षण विषयक उपक्रमात कमाल ४ वषार्ंची सेवा करावी लागेल. सेवेची १० वर्षे पूर्ण झाल्यानंतर अथवा वयाची ४५ वर्षे पूर्ण झाल्यानंतर सशस्त्र दलातील संरक्षण विषयक उपक्रमाशी संबंधित सेवेचे दायित्व व्यक्तीवर राहणार नाही.
९. नियम क्रमांक ३ मध्ये नमूद केलेल्या पदावर नियुक्त झालेली व्यक्ती महाराष्ट्र राज्यामध्ये कोणत्याही ठिकाणी बदलीस पात्र राहील.

NOTIFICATION
CONSTITUTION OF INDIA.
No. SEPRANI. 3019/C.R.3/VAISEVA 3.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Medical Officer, Group B (Gazatted) in the Government Medical Colleges and Hospitals under the Directorate of Medical Education and Research under the Medical Education and Drugs Department of the Government of Maharashtra, namely :—
1. These rules may be called the Medical Officer, Group B (Gazatted) in the Government Medical Colleges and Hospitals, under the Directorate of Medical Education and Research (Recruitment) Rules, 2021.
2. In these rules unless the context requires otherwise,—
(a) " Commission " means the Maharashtra Public Service Commission ;
(b) " Degree" means a degree of a Statutory University ;
(c) " Directorate" means the Directorate of Medical Education and Research under the Medical Education and Drugs Department of the Government ;
(d) " Government " means the Government of Maharashtra ;
(e) " Statutory University " means a University established by law for the time being in force.
3. Appointment to the post of Medical Officer, Group B in Government Medical Colleges and Hospitals shall be made by nomination on the recommendation of the Commission from amongst the candidates, who,—
(i) are not less than nineteen years of age and are not more than thirty-eight years of age in case of persons belonging to open category and forty-three years of age in case of persons belonging to reserved category ; and (ii) possess the MBBS Degree of a Statutory University or any other qualification recognised under the National Medical Commission Act, 2019 (30 of 2019) ;
and
(iii) have registered their names as per provisions of the Maharashtra Medical Council Act, 1965 or whose names have been registered in the register maintained under the said Act.
4. A person appointed to the post mentioned in rule 3 shall be on probation for a period of two years. The probation period may be extended further for a period of one year. A person appointed to such post is required to complete the prescribed probation period satisfactorily. If he fails to complete probation period satisfactorily or is not found suitable for the post then he shall be liable to be terminated from service.
४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च ७, २०२२/फाल्गुन १६, शके १९४३5. A person appointed to the post mentioned in rule 3 shall pass Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within prescribed time limit after appointment unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.
6. A person appointed to the post mentioned in rule 3 shall possess a certificate in knowledge of Computer Operations within prescribed by the Government, from time to time, within prescribed time limit after appointment, unless he has been exempted from possessing such certificate in knowledge of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possesses such certificate.
7. (1) A person appointed to the post mentioned in rule 3 by nominatioin shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf, by the Government from time to time, otherwise he shall not be eligible for appointment to the post.
(2) A person having more than two children on the date of submission of Declaration of Small Family, shall be disqualified for the appointment in Government Service.
(3) After appointment of a person in the Government Service, if it is proved that he has more than two children then he shall be disqualified for the said post in Government Service.
8. A person appointed to the post mentioned in rule 3 shall have to serve in the Armed Forces for a maximum period of four years on work relating to Defence efforts in India or abroad if so required. The liability to serve in the Armed Forces on work relating to Defence efforts will not apply after completing ten years of service or completing forty- five years of age.
9. A person appointed to the post mentioned in rule 3 shall be liable for transfer anywhere in the State of Maharashtra.
