(cid:312)मांक ड(cid:264)(cid:269)युपी-०२२१/(cid:332).(cid:312).११/प(cid:555)र-२.– (cid:249)याअथ(cid:559) जनिहत यािचका (एल) (cid:312). ९७७५/२०२० म(cid:260)ये मा. उ(cid:247)च (cid:261)यायालयाने िदनांक ०७ माच(cid:593) २०२२ रोजी मोटार वाहन अिधिनयम, १९८८ (१९८८ चा ५९) (cid:247)या कलम ९३ (cid:247)या उपकलम (१) नुसार रा(cid:249)यातील (cid:332)ादेिशक प(cid:555)रवहन (cid:332)ािधकरण यांना समु(cid:247)चयकांना अनु(cid:551)(cid:262)ती जारी कर(cid:256)यासाठी अनु(cid:551)(cid:262)ती (cid:332)ािधकारी (cid:266)हणून व कलम ८९ (cid:247)या (cid:332)योजनाक(cid:555)रता रा(cid:249)य प(cid:555)रवहन अपीलीय (cid:261)यायािधकरण यांना अिपलीय (cid:332)ािधकारी (cid:266)हणून (cid:332)ािधक(cid:565)त कर(cid:256)याबाबत अिधसूचना जारी करावी (cid:266)हणून रा(cid:249)य शासनास िनद(cid:616)श िदले आहेत.
आिण (cid:249)याअथ(cid:559), महारा(cid:273)(cid:322) शासनास कलम ९३ (cid:247)या पोट-कलम (१) अ(cid:261)वये अनु(cid:551)(cid:262)ती जारी कर(cid:256)यासाठी स(cid:550)म (cid:332)ािधकारी (cid:266)हणून (cid:332)ादेिशक प(cid:555)रवहन (cid:332)ािधकरण यांस व रा(cid:249)य प(cid:555)रवहन अिपलीय (cid:261)यायािधकरण यांना अिपलीय (cid:332)ािधकारी करणे उिचत वाटत आहे ;
(cid:257)याअथ(cid:559) आता, मोटार वाहन अिधिनयम, १९८८ (cid:247)या कलम ९३ (cid:247)या पोट-कलम (१) अंतग(cid:593)त (cid:332)दान क(cid:577)ले(cid:269)या अिधकारांचा वापर क(cid:544)न महारा(cid:273)(cid:322) शासन या(cid:465)ारे रा(cid:249)यातील सव(cid:593) (cid:332)ादेिशक प(cid:555)रवहन (cid:332)ािधकरण यांना समु(cid:247)चयकांना अनु(cid:551)(cid:262)ती जारी कर(cid:256)यासाठी स(cid:550)म

भाग चार-अ-४१–१महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-अ, माच(cid:593) ९, २०२२/फा(cid:269)गुन १८, शक(cid:577) १९४३ (cid:332)ािधकारी (cid:266)हणून आिण कलम ९३ (cid:247)या पोट-कलम (१) अ(cid:261)वये रा(cid:249)य प(cid:555)रवहन अिपलीय (cid:261)यायािधकरण (The State Transport Appellate Tribunal) यांना अिपलीय (cid:332)ािधकारी (cid:266)हणून खालील शत(cid:559)ं(cid:247)या अधीन राहून (cid:332)ािधक(cid:565)त कर(cid:256)यात येत आहे :– (i) समु(cid:247)चयक यांना अनु(cid:551)(cid:262)तीसाठी िदनांक १६ माच(cid:593) २०२२ पय(cid:597)त अथवा (cid:257)यापूव(cid:559) अज(cid:593) करणे आव(cid:272)यक असेल.
(ii) जर समु(cid:247)चयकाने उ(cid:242)त िदनांकापय(cid:597)त अथवा (cid:257)यापूव(cid:559) अज(cid:593) क(cid:577)ला नसेल िक(cid:573)वा अज(cid:593) स(cid:550)म (cid:332)ािधकाराने नाकारला असेल तर अशा समु(cid:247)चयकास महारा(cid:273)(cid:322) रा(cid:249)यात जोपय(cid:597)त तो उिचत अनु(cid:551)(cid:262)ती (cid:332)ा(cid:262)त करणार नाही तोपय(cid:597)त पुढील संचलन करता येणार नाही.

NOTIFICATION
No.WP-0221/C.R.11/TR-2.– Whereas, the Hon'ble High Court of Judicature at Bombay, vide its order dated the 7th March 2022, in Public Interest Litigation (L) No. 9775 of 2020, directed the State Government to issue notification to empower Regional Transport Authority in the State of Maharashtra to act as the Licencing Authority for grant of license to aggregator under sub-section (1) of section 93 of the Motor Vehicles Act, 1988 (59 of 1988) and the State Transport Appellate Tribunal as Appellate Authority for the purposes of section 89 of the said Act;
And whereas, the Government of Maharashtra considers it expedient to empower the Regional Transport Authority as Competent Authority for grant of license under sub-section (1) of section 93 of the said Act and the State Transport Appellate Tribunal as Appellate Authority for the said purpose;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 93 of the Motor Vehicles Act, 1988, the Government of Maharashtra hereby empowers all the Regional Transport Authority in the State of Maharashtra as Competent Authority and the State Transport Appellate Tribunal as Appellate Authority for the purposes of issuing license to an aggregator under sub-section (1) of section 93 of the said Act, subject to the following conditions :–
(i) An aggregator shall apply for license on or before the 16th March 2022.
(ii) If an aggregator does not apply for license on or before the said date or the application is rejected by the competent authority, an aggregator shall not be permitted to carry on operation in the State of Maharashtra till such time an appropriate license is obtained by the aggregator.
