MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
No. TPS-2420-1219-CR-144-UD-9-2020.—
Whereas, Development Plan (Revised + Additional Area) of Katol City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2406-3123-CR-133(A)-2007- UD-9, dated 4th November 2008 and has come into force with effect from 15th December 2008 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") ;
And whereas, in the said Development Plan, land bearing P.H. No. 44, Survey No. 608/1 and 609 respectively 1.13 H. A . and 0.96 H. A. total admeasuring 2.09 H. A. of Mouja Katol are included in Agricul- tural Zone (hereinafter referred to as "the said Lands") ;
And whereas, the Katol Municipal Council, Katol being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No. 09, dated 4th December 2019 has resolved to change the allocation of the said land from Agricultural Zone to Residential Zone and after following the procedure laid down under the said Act. Submitted a proposal to the Government for its sanction (hereinafter referred to as "the Proposed Modification") ;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed Modification should be sanctioned with some conditions ;
And whereas, the land owner of the said land have deposited Rs. 7,26,275 towards the 50 % Government share of 5 % premium amount as per the value of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2021-22 in the Government Treasury on 2nd February 2022 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5 % premium amount Rs. 7,26,275 payble to the Planning Authority has been deposited with the Chief Officer, Katol Municipal Council, Katol on 18th January 2022. ;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 4th November 2008 as follows.—
"In the Schedule of Modifications appended to the Notification dated 4th November 2008 sanctioning the said Development Plan, the following new entry shall be added after the last entry "–
ENTRY
The land bearing P.H. No. 44, Survey No. 608/1 and 609 respectively 1.13 H. A. and 0.96 H. A. total admeasuring 2.09 H. A. of Mouja Katol excluding the land under 18.00 meter D. P. road remaining land is deleted from Agricultural Zone and included in Residential Zone as shown on the plan subject to the condition specified below—
Condition No.1. : 10% amenity space shall be provided in the lay-out in addition to 10% compulsory open space as per the prevailing Development Control Regulations for Katol.
Condition No. 2.: It is necessary to construct compound wall around the open sapce.
Condition No. 3. : It is compulsosry for the land owner/developer to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewage and drainage etc.
४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र,द्ध १०-१६, २०२२/त्र्ॅा १९-२५, ॅ १९४३Condition No. 4 : If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Offcer, Katol Municipal Council, Katol in relation to development of basic amenities as per the stages given below.
(a) After final approval of layout
. . Sale of 25% of the total plots shall be permissible.
(b) After completion of 40% of Basic Amenities . . Sale of 50% of the total plots shall be permissible.
(c) After completion of 60% of Basic Amenities . . Sale of 75% of the total plots shall be permissible.
(d) After completion of 80% of Basic Amenities . . Sale of 90% of the total plots shall be permissible.
(e) After completion of 100% of Basic Amenities . . Sale of 100% of the total plots shall be permissible.
If Group Housing Scheme is proposed in the layout, then occupation certificate shall not be given by Chief Officer, Katol Muncipal Council, Katol unless all the basic amenities are fully developed ;
Condition No. 5. : The area affected by proposed 18.00 mt. wide Development Plan Road is retained as same.
A copy of the Notification, along with the part plan showing the aforesaid sactioned modification, shall be available for inspection of the general public, in the Office of the Chief Officer, Katol Municipal Council, Katol during office hours on all working days for a period of one month.
This Notification shall also be available on the Government web site www.maharashtra.gov. in By Order and in the name of the Governor of Maharashtra,
