क्रमांक वि.शा./सण/उत्सव/होळी, धुलीवंदन, शिवजयंती/मनाई आदेश/८८१/२०२२.— ठाणे पोलीस आयुक्तालयात परिमंडळ १ ते ५ मध्ये दिनांक १७ मार्च २०२२ रोजी होळी, दिनांक १८ मार्च २०२२ रोजी धुलीवंदन व दिनांक २१ मार्च २०२२ रोजी शिवजयंती (तिथीप्रमाणे) तसचे दिनांक २२ मार्च २०२२ रोजी रंगपंचमी असे हिंदु बांधवांचे सण/उत्सव साजरे होणार आहेत.

ज्याअर्थी, खात्रीशीररित्या असे समजले आहे की, ठाणे पोलीस आयुक्तालयातील पोलीस ठाण्याच्या हद्दीत खालील नमूद घटना घडण्याची शक्यता आहे.

(१) सार्वजनिक ठिकाणातील झाडे/लाकडे तोडण्यास, जाळण्यास/दहन करण्यास,

(२) सदर सणाच्या निमित्ताने रस्त्यावरून जाणाया दुचाकी, चारचाकी व इतर वाहनांना अडवून त्याच्याकडून पैशाची मागणी करणे.

(३) रंगीत पाणी, रंग किवा पादचायावर पावडर फेकणे अथवा उडविण्याचा प्रयत्न करणे.

(४) आरोग्यास अपायकारक होईल अशा रासायनिक रंगांचा वापर करणे.

(५) रंगाचे फुगे, पाण्याचे फुगे अथवा इतर द्रव पदार्थाचे फुगे बनविणे अथवा प्लास्टीकच्या पिशव्याचा वापर करून फेकल्यामुळे आरोग्यास अपाय व जीवास धोका निर्माण होईल असे कृत्य करणे.

(६) सार्वजनिक जागेत अश्लील शब्द उच्चारणे घोषणा देणे, अश्लील गाणी गाणे,

(७) सार्वजनिक जागेत हावभाव करणे किंवा वाकुल्या व विटंबनाचे प्रदर्शन करणे/भरविणे किंवा चित्रे/चिन्हे/प्रतिकृती अथवा कोणत्याही वस्तुचे अथवा उद्देशाचे की, ज्यामुळे एखाद्याची प्रतिष्ठा, योग्यता वा नैतिकतेला धक्का पोहचेल.

वरील नमूद प्रकार १ ते ७ अन्वये लोकांना कोणताही त्रास, अडथळा, दुखापत, जिवीतास धोका, आरोग्यास धोका अथवा सार्वजनिक शांततेस बाधा अथवा दंगा, मारामारी होऊ नये व त्यास प्रतिबंध केला जावा म्हणून,

त्याअर्थी, मी, जय जीत सिंह, पोलीस आयुक्त, ठाणे शहर मला फौजदारी दंड प्रक्रिया संहिता, १९७३ ते कलम १४४ (१) अन्वये प्रदान करण्यात आलेल्या अधिकाराचा वापर करून मी, वरील कृत्यांना (१ ते ७) मनाई करीत आहे.

सदरचा आदेश दिनांक १७ मार्च २०२२ रोजी ००.०० वा. पासून दिनांक २२ मार्च २०२२ रोजीचे २४.०० वा. पयर्ंत अंमलात राहील. वरील आदेशाचा भंग करणायांविरुद्ध भारतीय दंड प्रक्रिया संहिता कलम १८८ प्रमाणे कारवाई करणेत येईल.

सदरचा आदेश हा माझे सही शिक्क्याने जाहीर करण्यात येत आहे.

क्रमांक ना.भू. २/गावठाण/अधिसूचना/२०२२/५३०.— महाराष्ट्र शासन, महसूल व वन विभागाकडील शासन निर्णय क्रमांक आस्थापना १०९३/प्र.क्र. १९/ल-१, दिनांक १८ ऑगस्ट १९९४ अन्वये भूमी अभिलेख विभागाची तालुकास्तरावर पुनर्रचना करणेत आलेली आहे. त्याअनुषंगाने मा. जमाबंदी आयुक्त आणि संचालक, भूमी अभिलेख, (म.राज्य) पुणे यांचेकडील अधिसूचना क्र. एस.व्ही.सी.आर.-४३२०/स-४/९४, दिनांक २२ सप्टेंबर १९९४ अन्वये कोकण विभागातील सजांची पुनर्रचना करणेत आली आहे. तसेच पारंपरिक पद्धतीने नगर भूमापन झालेली गावे परिरक्षणासाठी घेण्याचे अधिसूचना मंजुरीचे अधिकार मा. जमाबंदी आयुक्त आणि संचालक, भूमी अभिलेख (म.राज्य) पुणे यांनी त्यांचेकडील परिपत्रक क्र. गावठाण/परिपत्रक/का.वि. ६०७/प्र.क्र. ०१/२०२२, दिनांक १० जानेवारी २०२२ अन्वये उप संचालक, भूमी अभिलेख (प्रादेशिक प्रमुख) यांना दिलेले आहेत.

जिल्हा अधीक्षक, भूमी अभिलेख, ठाणे यांनी त्यांचेकडील प्रस्तावामध्ये नगर भूमापन अधिकारी, ठाणे यांचे अधिनस्त सजा तुर्भे मध्ये मौजे सानपाडा हे गाव नव्याने समाविष्ट करणेबाबत प्रस्तावित केले आहे.

त्यानुसार सोबत जोडलेल्या परिशिष्टात नमूद केलेप्रमाणे सजा तुर्र्भे मध्ये मौजे सानपाडा हे गाव नव्याने नगर भूमापन अधिकारी, ठाणे मध्ये समाविष्ट करून त्यांचे कार्यक्षेत्रात बदल करणेत येऊन परिरक्षणास घेणेस एतद्वारे मंजुरी देणेत येत आहे. तसेच सनद फी रुपये ५,६७,३७९.१० वसूल करावी. सदर अधिसूचनेची अंमलबजावणी दिनांक १५ फेब्रुवारी २०२२ पासून होणेची आहे.

मनाई आदेश (सुधारणा)

क्रमांक वि.शा./कोरोना/ओमिक्रॉन/मनाई आदेश/८०२/२०२२.— ज्याअर्थी, महाराष्ट्र राज्यामध्ये कोरोना संक्रमणास आळा घालण्यासाठी निबर्ंध घालण्यात आले आहेत.त्या अनुषंगाने गेल्या काही दिवसांमध्ये कोव्हिड-१९ पॉझिटीव्ह रुग्णांची तसेच ओमायक्रॉन बाधित रुग्णांच्या संख्येमध्ये सातत्याने घट होत आहे. तसेच राज्यात राज्य आपत्ती व्यवस्थापन प्राधिकरणाच्या राज्य कार्यकारी समितीचे अध्यक्ष, तथा मुख्य सचिव, महाराष्ट्र राज्य, मुंबई यांनी आरोग्य विभागाच्या माहितीच्या आधारे तसेच कोविड टास्क फोर्ससह सध्याच्या कोविड परिस्िथतीचा योग्य तो विचार करून, राज्यामध्ये लावण्यात आलेल्या निबर्ंधसंदर्भर्ाने, महाराष्ट्र शासन नोटीफिकेशन क्रमांक डीएमयु/२०२०/सीआर.-९२/आपत्ती व्यवस्थापन-१, दिनांक १ मार्च २०२२ अन्वये सुधारित आदेश निर्गमित केले आहेत.

(२) ज्याअर्थी, महाराष्ट्र शासन नोटीफिकेशन क्र. डीएमयु/२०२०/सीआर. ९२/आपत्ती व्यवस्थापन -१, दिनांक १ मार्च २०२२ नुसार सुधारित आदेश निर्गमित केले आहेत. त्याअनुषंगाने ठाणे पोलीस आयुक्तालय कार्यक्षेत्रात तात्काळ प्रतिबंधक उपाययोजना म्हणून फौजदारी प्रक्रिया संहिता कलम १४४ च्या तरतुदीच्या अनुषंगाने सर्व सामान्य नागरिक, संस्था/संघटना, आस्थापना यांना उद्देशून यापूर्वी पारीत केलेल्या सर्व मनाई आदेशांना अधिक्रमीत करून सुधारित मनाई आदेश निर्गमित करणे आवश्यक असलेबाबत माझी खात्री झालेली आहे.

(३) ज्याअर्थी, महाराष्ट्र शासन राजपत्र, असाधारण भाग-१ मध्य उप-विभाग यांचेकडील अधिसूचना क्रमांक ३ मधील पान क्र. ४ मधील भारतीय दंड प्रक्रिया संहिता, १९७३ चा क्र. एमएससी-१२७४/व्ही-एफ मधील आदेशाने भारतीय दंड प्रक्रिया संहिता, १९७३ (II-१९७४) चे कलम २१ अन्वये आमची विशेष कार्यकारी दंडाधिकारी म्हणून नियुक्ती करून फौजदारी प्रक्रिया संहिता कलम १४४ चे विशेष अधिकार प्रदान केलेले आहेत.

(४) त्याअर्थी, मी, जय जीत सिंह, पोलीस आयुक्त, ठाणे शहर तथा विशेष प्राधिकृत कार्यकारी दंडाधिकारी म्हणून शासनाच्या दिनांक १ एप्रिल १९७४ चे अधिसूचनेद्वारे प्राधिकृत अधिकारी, म्हणून ठाणे शहर पोलीस आयुक्तालयाचे कार्यक्षेत्रात फौजदारी प्रक्रिया संहिता कलम १४४(१) (३) अन्वये, महाराष्ट्र शासन नोटीफिकेशन क्र. डीएमयु/२०२०/सीआर-९२/आपत्ती व्यवस्थापन-१, दिनांक १ मार्च २०२२ नुसार निर्गमित केलेले सुधारित आदेश ठाणे पोलीस आयुक्तालय कार्यक्षेत्रामध्ये दिनांक ४ मार्च २०२२ चे ००.०० पासून पुढील आदेशापयर्ंत लागू करीत आहे.

(५) सदर आदेशाचे उल्लंघन करणारी व्यक्ती भारतीय दंड विधान संहिता कलम १८८ प्रमाणे शिक्षेस पात्र राहील.

(६) उपरोक्त आदेशासंदर्भात सर्व सामान्य नागरिक, संस्था/संघटना, कार्यक्रमांची ठिकाणे येथील संबंधित ट्रस्टी व आस्थापना व्यवस्थापक यांना प्रत्येकास आदेशापूर्वी स्वतंत्र नोटीस बजावणे शक्य नसल्याने फौजदारी दंड प्रक्रिया संहिता, १९७३ चे कलम १४४(२) अन्वये प्राप्त अधिकारानुसार सदरचा आदेश हा एकतर्फी काढण्यात आलेला आहे. याबाबतची माहिती प्रसारमाध्यमे, पोलीस स्टेशन, सहा. पोलीस आयुक्त तसेच परिमंडळीय पो. उप आयुक्त कार्यालय यांचे नोटीस बोर्डावर नागरीकांचे सुविधेसाठी उपलब्ध करून देण्यात येत आहे. सर्व नियंत्रण कक्ष व पोलीस स्टेशन पेट्रोलिंग मोबाईल मधून ध्वनीक्षेपकांवरून सदर सूचनांच्या अंमलबजावणी बाबत प्रक्षेपण करून जनतेस आवाहन करावे.

(७) सदरचा आदेश हा माझ्या सही शिक्यानिशी आज दिनांक ३ मार्च २०२२ रोजी दिलेला आहे.

Order

No. DMU/2020/CR. 92/DisM-l, Date 1st March 2022.—Various restrictions have been imposed in the State currently in order to curb the transmission of the COVID-19 virus. Now, based on the inputs of the Health Department as well as the COVID Task force along with due consideration to the current COVID scenario in the State, the State Executive Committee (SEC) has decided to modify these.

State Executive Committee has decided to differentiate in response to the Covid-19 situation through restrictions or relaxations thereof, between various administrative areas depending upon the current risk profile of the area, appreciation of which should depend upon vaccination status, positivity rate of tests as well as occupancy of beds by patients.

Thereby, as decided and directed by the State Executive Committee in the meeting held on 25th February, 2022, the undersigned, in his capacity as Chief Executive Officer of the State Executive Committee, hereby promulgates the following directions, that will come into force from, 4th March 2022 from 00.00 hrs across the State and will remain in force till the issue of any new order. This order is in super-cession of all the earlier orders issued for imposing/ relaxing of restrictions. The definition of status of fully vaccinated for an individual as well as general orders about Covid Appropriate Behaviour continue to apply and are reproduced in the end for ready reference. It is also declared that in case there is any activity that is not covered by this order, all GOI guidelines for that activity shall be applicable, and that in case of an activity finding mention in both, stricter of the two shall apply.

A. Administrative Units

1. Municipal Corporations shall be dealt as separate Administrative Units and rest of the districts shall be dealt as single separate Administrative Units.

2. An Administrative Unit fulfilling all the following criteria shall be included in List A (a) First dose vaccination is more than 90%.

(b) Second dose vaccination is more than 70%.

(c) Positivity Rate is less than 10%.

(d) Bed Occupancy of Oxygen Supported or ICU beds is less than 40%.

B. Status of these parameters is dynamic and thus District Disaster Management Authority shall declare periodically the status of these parameters for all Administrative Units under it, for information to public and in case current status of parameters demand inclusion or exclusion from list A, DDMA shall declare so, under intimation to SDMA. Restrictions for controlling the spread of Covid-19 virus shall change as soon as an exclusion or inclusion occurs, in sync with the provisions herein.

C. Requirement of being fully vaccinated

(i) All staff of all the establishments that cater to public at large shall necessarily be fully vaccinated.

(ii) All home delivery staff shall necessarily be fully vaccinated.

(iii) All users of any public transport must be fully vaccinated.

(iv) All visitors to Malls, theatres, natyagrihas, tourist places, restaurants, sporting events, religious places etc. where general public also visits must be fully vaccinated.

(v) DDMAs may enforce requirement of fully vaccinated on any public service wherein there is a possibility of interaction with other citizens and wherein such interaction may cause spread of Covid-19 and wherein Covid Appropriate Behaviour (CAB) may not be effectively implementable.

(vi) All staff working in any office or establishment, public or private that has a dealing with general public must be fully vaccinated.

(vii) All staff engaged in any industrial activities must be fully vaccinated.

D. Social/ Sports/ Entertainment/ Academic/ Cultural/ Religious/Political/ Festival Related events, including those relating to Marriages and Funerals and other gatherings and congregations are permitted in Administrative Units included in List A to the extent of 50% of capacity of the venue; however, whenever a gathering is expected to be of more than 1000 persons, DDMA shall be informed and DDMA may put reasonable restrictions on the same. For the Administrative Units not finding mention in list A, total attendance in any of such gathering or congregations shall be limited to 50% of the capacity of thevenue or 200 whichever is lower.

E. Offline classes may resume in all academic institutions, subject to any orders of concerned administrative department of Government of Maharashtra. Administrations of all academic institutions are encouraged to leverage hybrid model of imparting education though online and offline modes. All pre-schools as well as Aanganwadis can now be restarted physically as well. All these institutions, establishments shall scrupulously follow CAB.

F. All home delivery services are allowed for all Administrative Units.

G. All shopping complexes, cinema halls, restaurants & bars, sports complexes, gyms, spas, swimming pools, religious places, natyagrihas, tourist places, entertainment parks etc. are allowed to operate with 100% capacity in Administrative Units included in List A. For other Administrative Units that are excluded from List A, these shall operate at 50% of the capacity.

H. There shall be no restrictions for inter-state and intra-state movement for fully vaccinated persons. For persons who are not fully vaccinated, inter-state movement is subject to production of negative RT-PCR test valid for 72 hours. There shall be no need for any NOC for such travel, not required otherwise than for purposes of DMA.

I. All offices, including government and private, may function with full capacity.

J. All industrial and scientific institutions may function with full capacity.

K. Any activity not included in here, are allowed to the extent of 100% capacity in the administrative areas falling in List A and 50% for the remaining areas. In case of any issues of interpretation, DDMA shall provide the final interpretation.

L. DDMAs to be authorised to impose restriction stricter than provided here, with prior consent of SDMA. It is expected that DDMAs shall meet frequently, as and when required but at least once a week to take the stock of the situation and to react to any trend.

M. Districts are instructed to press for 100 % vaccine coverage of all eligible beneficiaries in an accelerated manner. Door-to-Door vaccination drives must be undertaken in Administrative units not covered in List A. Though currently vaccination status of less than 18 years of age citizens is not included in the list of criteria mentioned in Para B, with passing time, it may be included. Precautionary dose and adolescent dose to be taken up for eligible people. DDMA to also ensure that all staff in schools including teachers and non-teaching staff are vaccinated. GOI guidelines and advisories for vaccination must be adhered to scrupulously.

N. Public Health department should provide all information regarding current Covid situation, testing infrastructure etc to the community at large for avoiding any misinformation and panic. Community involvement to be encouraged by the districts and strict enforcement of norms to be ensured for CAB. Evidence based information to be made available to the community regularly.

O. It may be noted finally that situation of Covid-19 is ever evolving as thus all DDMA and SDMA officials must be alert and informed of daily situation. These orders shall remain in operation till modified due to any emergent situation.

क्रमांक पोआ/नमुं/विशा/जनरल/९८२/२०२२.— ज्याअर्थी, महाराष्ट्र लोकसेवा आयोगामार्फत महाराष्ट्र दुय्यम सेव गट-ब (अराजपत्रित) संयुक्त पुर्व परीक्षा-२०२१ ही शनिवार दिनांक २६ फेब्रुवारी २०२२ रोजी नवी मुंबई पोलीस परिमंडळ-१ मध्ये एकूण २० उपकेंद्रांवर घेण्यात येणार असून सदर परीक्षेकरिता सुमारे ६४५६ विद्यार्थी बसणार आहेत ;

ज्याअर्थी, महाराष्ट्र लोकसेवा आयोगामार्फत महाराष्ट्र दुय्यम सेवा गट-ब (अराजपत्रित) संयुक्त पुर्व परीक्षा-२०२१ या शांततेच्या निर्भय व र्िनविघ्न वातावरणात पार पाडावे याकरिता नवी मुंबई आयुक्तालयातील हद्दीतील २० परीक्षा उप केंद्रावर १०० मीटर परिसरात खालीलप्रमाणे मनाई आदेश जारी करणे जरुरीचे आहे. याबाबत माझी खात्री झालेली आहे.

त्याअर्थी, मी, बिपिन कुमार सिंह, पोलीस आयुक्त, नवी मुंबई मला फौजदारी प्रक्रिया संहिता, १९७३ चे कलम १४४ अन्वये प्रदान केलेल्या अधिकारांचा वापर करून नवी मुंबई आयुक्तालय पोलीस स्टेशन हद्दीतील सोबत जोडलेल्या यादीतील २० परिक्षा उप केंद्रे तसेच परिसरात परीक्षाथर्ींना व महाराष्ट्र लोकसेवा आयोग मंडळाने दिलेल्या अधिकारान्वये ज्यांना सूट दिलेली आहे. असा इसमांव्यतिरिक्त इतर कोणत्याही इसमास दिनांक २६ फेब्रुवारी २०२२ रोजी ००-०१ वा. पासून ते २४-०० वा. पयर्ंत खालील कृत्यांस मनाई आदेश देत आहे.

१. महाराष्ट्र लोकसेवा आयोग मंडळाने सर्व परीक्षा उप केंद्राजवळच्या १०० मीटर परिसरातील सर्व सार्वजनिक झेरॉक्स मशिन, सायबर कॅफे, दुरध्वनी/फॅक्स केंद्र, ध्वनीक्षेपक तत्सम दुरसंचाराची साधने, आयोगाने विहित केलेल्या वेळेत (सर्वसाधारणपणे परीक्षेच्या प्रत्यक्ष कालावधीच्या १ तास पुर्वपासून ते अर्धा-तास नंतरपयर्ंत) सुरू राहणार नाहीत.

२. महाराष्ट्र दुय्यम सेवा गट-ब (अराजपत्रित) संयुक्त पुर्व परीक्षा २०२१ परीक्षेचे दिवशी संबंधित परीक्षा उपकेंद्रावर तसेच परीक्षा उप केंद्राच्या १०० मीटरपासून परीक्षार्थी व परीक्षेकरिता नियुक्त केलेल्या अधिकृत व्यक्ती यांनाच स्वत: चे ओळखपत्र दाखवून प्रवेश देण्यात येईल. त्या व्यतिरिक्त कोणत्याही अन्य व्यक्ती किंवा वाहनास कोणत्याही परिस्थितीत प्रवेश देता येणार नाहीत.

३. मोबाईल फोन, पेजर, कॉर्डलेस फोन अगर इतर कोणतेही संदेशवाहक यंत्र बाळगता व वापरता येणार नाहीत.

४. प्रश्नपुस्तिकांची पार्सल ठेवलेल्या कक्षात कोणत्याही प्रकारचे मोबाईल अथवा अन्य दुरसंचार साधने नेता व वापरता येणार नाही.

५. परीक्षेकरिता नियक्त केलेल्या पर्यवेक्षक/समावेक्षक यांना परीक्षेच्या दालनात मोबईल आणण्यास किंवा मोबाईलचा वापर करता येणार नाही.

६. डिजीटल डायरी पेजर, मायक्रोफोन, मोबाईल फोन, कॅमेरा अंतभर्ूत असलेली कोणत्याही प्रकारची साधने, सिमकार्ड, दूरसंचार साधने म्हणून वापरण्यायोग्य कोणतीही वस्तु, बॅग्ज इत्यादी साधने परीक्षा केंद्राच्या परिसरात तसेच परीक्षा कक्षात आणण्यास अथवा स्वत: जवळ बाळगात येणार नाही.

७. सदर परिसरात एकत्र जमणे घोषणाबाजी किंवा निदर्शने करणे, परीक्षा केंद्रांवर येणाया परीक्षाथर्ींवर प्रभाव टाकण्यासाठी कोणतेही कृत्य करणे, तसेच ते परीक्षा देण्यापासून वंचित राहतील असे कोणतेही कृत्य करता येणार नाही.

८. कोणत्याही प्रकारची शस्त्रे, अग्निशस्त्रे, ज्वालाग्रही व दाहक पदार्र्थ जवळ बाळगता अथवा वाहून नेता येणार नाही.

या आदेशाच्या भंग करणारा इसम भा.द.वि.क. १८८ प्रमाणे कायदेशीर कारवाईस पात्र राहील.

उपरोक्त आदेशाच्या प्रती, नवी मुंबई आयुक्तालयातील सोबत जोडलेल्या यादीतील २० परीक्षा उपकेंद्र व परिसरात सहज दिसणाया सार्वजनिक ठिकाणी चिटकवून व ध्वनी क्षेपकाद्वारे प्रक्षेपित करून त्याचा प्रचार करावा व त्यासंबंधीच्या नोंदी अभिलेखावर ठेवाव्यात.

Commissioner of Police (Operations), Brihan Mumbai in exercise of the powers conferred upon me under sub-section (1) and (2) of section 37 read with sub-section (6) of section 2 and sub-section (2) of section 10 of the Maharashtra Police Act (Mah. XXII of 1951) do hereby prohibit the following acts throughout Brihan Mumbai for the period from 00.01 hours of 28th February 2022 to 24.00 hours on 29th March 2022.

1, (a) Carrying of arms, cudgels, swords, spears, bludgeons, unlicensed guns, knives, sticks or lathis or any other articles which are capable of being used for causing physical harm (violence) save for such firearms where license has been granted by this authority or where specific permission is sought for carriage of such arms from the competent authority.

(b) The carrying of any corrosive substance or explosives.

(c) The carrying, collection and preparation of stones or other missiles or instruments or means of casting or impelling missiles.

(d) The exhibition of persons or corpses or figures or effigies thereof.

(e) The public utterance of cries, singing of songs, playing of music.

(f) Delivery of harangues, the use of gestures or mimetic, representations and the preparation, exhibition or dissemination of pictures, symbols. placards or any other object or thing which may in the opinion of any police officer posted in Brihan Mumbai City, offend against decency or morality or undermine the security of or tend to overthrow the state.

2. If any person goes armed with such article or carries any corrosive substance or explosive or missile in contravention of such prohibition, he/she shall be liable to be disarmed of the corrosive substance or explosive or missile shall be liable to be seized from him/her by any police officer and the article, corrosive substance, explosive or missile so seized shall be forfeited to the State Government.

3. This order will not be applicable to any person being in service or employment of any Government or Government Undertaking required by his superiors or by the nature of his duties, to carry weapons. The order will also not be applicable to Private Security Guards or Gurkhas or Chowkidars etc., employed on watch-n-ward duties carrying lathis admeasuring in length not exceeding 3½ feet.

4. Notwithstanding the expiration of this order after the period hereinabove mentioned, (a) Any investigation or legal proceedings may be instituted, continued or enforced.

(b) Any penalty, forfeiture or punishments incurred in respect of any contravention of this order may be imposed, as if this order had not expired.

5. I further direct that this order shall be published and promulgated in Brihan Mumbai by affixing copies thereof in conspicuous public places and by announcing the same through loudspeakers or megaphones, as well as publishing through media of whatever form available.

The prohibition contained in the order exempted for :—

(a) Marriage ceremony and matrimonial functions etc.

(b) Funeral assemblies and procession on way to crematoriums/burial places.

(c) Statutory meeting of companies of clubs, co-operative societies and other societies and associations.

(d) Social gathering and meeting of clubs, co-operative societies and other societies and associations to transact their normal business.

(e) Assemblies in or about Cinema houses, theatres or any place of public amusement for the purpose of watching films, dramas or performances as the case may be.

(f)Assemblies in or about courts of law and offices of the Government and local bodies in discharge of Governmental or Semi-Governmental functions.

(g) Assemblies in or about schools, colleges and other educational institutions for academic activities.

(h)Assemblies in factories, shops and establishments for normal trade, business and callings

(i) Such other assemblies and the processions as may be permitted by Zonal Deputy Commissioners of Police, Brihan Mumbai and their supervisory officers.

Notwith standing the expiration of this order after the period hereinabove mentioned.

(a) Any investigation or legal proceeding may be instituted, continued-or-enforced.

WHEREAS it has become necessary that certain restrictions should be put on the activities of such elements across the Brihanmumbai Police Commissionerate to prevent probable sabotages through such drones, remote controlled micro-light aircrafts, para-gliders, for which some preventive and proactive measures needed be taken to prevent the same.

3. THEREFORE, I, Sanjay Latkar, Dy. Commissioner of Police (Operations), Brihanmumbai and Executive Magistrate, vide powers conferred upon me under section 144 of the Criminal Procedure Code, 1973 (Act II of 1974), do hereby order that no flying activities of drone, remote controlled micro-light aircrafts, para-gliders, Para-Motors Hang gliders, Hot air balloons, Private Helicopers etc. shall be allowed in the jurisdiction of Brihanmumbai Police Commissionerate for the period of next 30 Days, i.e. from 10th March 2022 to 8th April 2022 except for aerial surveillance by Mumbai Police or by specific permission in writing by Dy. Commissioner of Police (Operations), Brihanmumbai.

4. This order shall remain in force with effect 00-01 hrs. of 10th March 2022 till 24-00 hrs. of 8th April 2022 unless withdrawn earlier.

5. Any person contravening this order shall be punishable under Section 188 of the Indian Penal Code, 1860.

6. As the notice cannot be served individually to all concerned, the order is hereby passed ex-parte. It shall be published for the information of public, through press and by affixing copies on the Notice Boards of the police stations, Divisional ACsP, Zonal DCsP, Municipal Ward offices, and by affixing copies at Tahsil and Ward offices.

No. XI(6)/1134 /(01)/2022.—Whereas reports have been received that in the areas under the control of Commissioner of Police, Brihan Mumbai, it is noticed that flying balloons, high riser crackers, light emitting objects, kites etc. are sent up in and around the airspace and also in the approach path of runway's Laser Light Beams are flashed specifically towards landing aircraft, in the Free Flight Zone around Chhatrapati Shivaji Maharaj International Airport, Juhu Aerodrome, naval air station INS Shikra thereby endangering the safe operation of aircraft in the said area;

2. And whereas it is necessary that checks should be put on the flying of paragliders, sending up of balloons, use of high riser crackers, usage of light emitting objects, flying of kites and usage of Laser Beam illumination for establishing a safe and Laser Beam Free Flight Zone around Chhatrapati Shivaji Maharaj International Airport so that usage of paragliders, balloons, high riser crackers, light emitting objects, kites, Laser Beams should not affect aircraft landing, take off and safe Aircraft flying operations and that immediate action is necessary for the same.

3. Now, therefore I, Sanjay Latkar, Dy. Commissioner of Police, (Operations), Greater Mumbai and Executive Magistrate, vide powers conferred upon me u./sec 144 of the Criminal Procedure Code, 1973 (Act II of 1974) r/w the Commissioner of Police Brihan Mumbai's Order dated 23rd December 1959 u/s 10 sub-section (2) of the Maharashtra Police Act, 1951 (Mah. Act XXII of 1951) do hereby order that, in the jurisdiction of Brihanmumbai Police Commissionerate:

(A) No person shall use paragliders, send up balloons, use high riser crackers, release light emitting objects, fly kites and shoot Laser Beam in the Free Flight Zone around Chhatrapati Shivaji Maharaj International Airport.

(B) Any person or individual who notices such type of activities being used with the intent to obstruct landing, take off and flying operations of any aircraft shall inform the nearest Police Station.

4. This order shall come into force with effect from 20/02/2022 and shall be effective for a period of 60 days upto 20/04/2022 (both days inclusive) unless withdrawn earlier.

5. Any person contravening this order shall be punishable under section 188 of the Indian Penal Code.

क्रमांक विशा/मनाई आदेश/१३१/२०२२.---- ज्याअर्थी, ठाणे पोलीस आयुक्तालयाच्या हद्दीत विविध राजकीय पक्ष, सामाजिक संघटना इत्यांदीकडून जनतेच्या विविध मागण्यांसाठी मोर्चे, आंदोलने, निदर्शने, घेराव, धरणे, सभा, उपोषणे इ. कार्यक्रमांचे आयोजन केले जाण्याची शक्यता आहे. तसेच सद्या विविध आंदोलने सुरू आहेत. त्याचप्रमाणे दिनांक १ मार्च २०२२ रोजी महाशिवरात्री/शब-ए-मेराज, दिनांक ६ मार्च २०२२ रोजी छत्रपती संभाजीराजे धर्मवीर दिन, असे सण/उत्सव संपन्न होणार आहेत. तसेच इयत्ता १२ वी उच्च माध्यमिक परीक्षा होणार आहे.

सदर घटनांच्या अनुषंगाने माझी खात्री झाली आहे की, ठाणे पोलीस आयुक्तालयाच्या हद्दीत सार्वजनिक शांतता व सुव्यवस्था अबाधित राखण्याकामी प्रतिबंधक आदेश जारी करणे आवश्यक आहे.

त्याअर्थी, मी, जय जीत सिंह, पोलीस आयुक्त, ठाणे शहर, महाराष्ट्र पोलीस अधिनियम सन १९५१ चे कलम ३७ (१) व (३) अन्वये आम्हास प्रदान करण्यात आलेल्या अधिकाराचा वापर करून ठाणे पोलीस आयुक्तालय परिसरात जीवित व वित्त सुरक्षित राहण्यासाठी आणि कायदा व सुव्यवस्था राखण्यासाठी खालील कृत्यांना मनाई आदेश देत आहे.

(१) शस्त्रे, सोटे, तलवारी, भाले, दंड, बंदुका, लाठया किंवा शरीरास इजा करण्यासाठी वापरण्यात येईल अशी कोणतीही वस्तु बरोबर वाहून नेणे, बाळगणे, जमा करणे व तयार करणे.

(२) दगड किंवा क्षेपणास्त्रे किंवा फेकावयाची उपकरणे किंवा साधने बरोबर नेणे, जमा करणे व तयार करणे.

(३) कोणताही दाहक किंवा स्फोटक पदार्थ आणि द्रव बाळगणे, बरोबर नेणे.

(४) सार्वजनिक रितीने घोषणा देणे, गाणी म्हणणे, वाद्य वाजविणे इत्यादी.

(५) कोणत्याही इसमाचे चित्राचे/प्रतिकात्मक प्रेताचे किंवा पुढायांच्या चित्राचे/प्रतिमेचे प्रदर्शन व दहन करणे.

(६) सभ्यता अगर नितीमत्ता यास धोका पोहोचेल किंवा राज्यातील शांतता धोक्यात येईल किंवा ज्यामुळे राज्यशासन उलथून पडेल अशी भाषणे, हावभाव, चित्रफलक, प्रर्दशित करणे.

(७) पाच किंवा पाचापेक्षा अधिक लोकांनी एकत्र जमणे, जाहीर सभा घेणे, मिरवणुका काढणे, घोषणा, प्रतिघोषणा देणे इत्यादी कृत्ये.

वरील मनाई आदेश खालील व्यक्तींना लागू राहणार नाहीत. ' जो कोणी इसम सरकारी नोकर आहे, ' किंवा ज्यास वरिष्ठांच्या आदेशानुसार कर्तव्य निमित्ताने शस्त्रे घेणे भाग पडेल, किंवा ज्यास अधिकार प्रदान केलेल्या अधिकायाने सूट दिलेली आहे.

सदर आदेश खालील मिरवणुका व जमावास लागू राहणार नाहीत.

(१) लग्न कार्यासाठी जमलेले लोक.

(२) प्रेत यात्रा व अंत्यसंस्कारासाठी काढण्यात आलेल्या मिरवणुका.

(३) सरकारी/निमसरकारी कामासाठी कोर्ट, कचेया येथे जमलेले लोक.

(४) सरकारी संस्था, शैक्षणिक संस्था या ठिकाणी जमलेला जनसमुदाय.

(५) पोलीस आयुक्त व त्यांनी प्रदान केलेल्या पोलीस अधिकायांनी परवानगी दिलेल्या सभा/मिरवणुका

(६) सर्व शासकीय निमशासकीय कर्मचारी हे कर्तव्य पार पाडीत असलेले ठिकाण.

सदर मनाई आदेश दिनांक २४ फेब्रुवारी २०२२ रोजी ००-०१ वाजेपासून दिनांक १० मार्च २०२२ रोजी २४-०० वाजेपयर्ंत अंमलात राहील.

वरील मनाई आदेशाचा भंग करणाया विरुद्ध महाराष्ट्र पोलीस अधिनियम सन १९५१ चे कलम १३५ प्रमाणे कारवाई करण्यात येईल.

ज्याअर्थी, परीक्षा केंद्राभोवतालच्या १०० मीटर परिसरात बेकायदेशीर जमाव जमून परीक्षा केंद्रातील इमारती मधील सार्वजनिक मालमत्तेचे नुकसान करून सार्वजनिक शांतता भंग करण्याची दाट शक्यता आहे. तसेच झेरॉक्स सेंटर, फॅक्स सेंटर, टेलिफोन बुथ, मोबाईल फोन, डीजीटल डायरी, पेजर, लॅपटॉप, आयपॉड, मायक्रोफोन इ. तत्सम साधनांचा वापर करून गैरप्रकार केले जाण्याची शक्यता नाकारता येत नाही.

त्याअर्थी मी, जय जीत सिंह, पोलीस आयुक्त, ठाणे शहर, आम्हाला इएक्सएम/०७८३/५५०/एसपीएल-२, गृहविभाग, मंत्रालय, मुंबई-३२, दिनांक १ मे १९८३ अन्वये प्रदान केलेल्या अधिकाराचा वापर करून परीक्षार्थी, पर्यवेक्षक, परीक्षा प्रक्रिया संबंधी अधिकारी व कर्मचारी तसेच बंदोबस्तावरील पोलीस अधिकारी व पोलीस अंमलदार खेरीज करून परीक्षा केंद्राच्या सभोवतालच्या १०० मीटर परिसरात बेकायदेशीर जमावास मज्जाव करण्यास तसेच झेरॉक्स सेंटर, फॅक्स सेंटर, सायबर कॅफे, टेलिफोन बुथ इत्यादी दुकाने, सेवा बंद ठेवण्याबाबत व परीक्षा केंद्र आवारात मोबाईल फोन, पेजर, लॅपटॉप, आयपॅड, मायक्रोफोन इ. तत्सम साधनांचा वापर करण्यास व सेवा बंद ठेवण्याबाबत मनाई आदेश निर्गमित करीत आहे. सदर सुचनांचे उल्लंघन करणायांवर " महाराष्ट्र प्रिव्हेंशन ऑफ माल प्रॅक्टीसेस ऍक्ट युनिव्र्हसिटी बोर्ड ऍन्ड अन्डर स्पेसिफाईड एक्झामिनेशन अॅक्ट १९८२ " मधील तरतुदीनुसार आवश्यक ती कार्यवाही करण्यात येईल.

सदरचा मनाई आदेश दिनांक ४ मार्च २०२२ रोजी ०८-०० वाजेपासून ते दिनांक ४ एप्रिल २०२२ रोजी सांयकाळी १९-०० वा. पयर्ंत ज्या दिवशी १०वी व १२वी चा पेपर आहेत त्यादिवशी पोलीस आयुक्तालय ठाणे शहर हद्दीत परिक्षाकेंद्र परिसरापुरताच अंमलात राहील.

मी सूचित करतो की, या आदेशाच्या प्रती माध्यमिक शाळेच्या व महाविद्यालयाच्या तसेच सार्वजनिक ठिकाणी स्पष्टपणे सहज दर्शनीय भागात चिकटवून व आदेशाची ध्वनीक्षेपकाद्वारे जाहीर करून, प्रसिद्धी करावी तशा कागदोपत्री नोंदी घ्याव्यात.
