THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
NOTIFICATION
No. TPS-2822-830-CR-09-2022-UD-30.—
Whereas, the Revised Development Plan of Amravati City, District Amravati has been sanctioned by the Government under Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") vide Notification No. TPS 2892-1180-CR-90-92(B)-UD-13, dated 4th December, 1992 and has come into force with effect from the 25th February, 1993 (hereinafter referred to as " the said Development Plan ") ;
And whereas, in the said Development Plan, the land bearing S. No. 194/1 of Mouje Rahatgaon is affected by the Reservation No. 515 A " Primary School " (affected area 0.19 H. A.), Reservation No. 515 B " Secondary School " (affected area 0.29 H. A.), Reservation No. 515 C " Play Ground " (affected area 1.52 H. A.) (hereinafter referred to as " the said land ") (hereinafter referred to as " the said Development Plan Reservations ") ;
And whereas, the Appropriate Authority for the said Development Plan reservations is Amravati Municipal Corporation (hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the said land affected by the said Development Plan reservations, has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, land owners of the said land have served Notice dated 11-05-2015 under Section 127(1) of the said Act, on the said Appropriate Authority (hereinafter referred to as " the said Notice ") ;
And whereas, even after service of the said Notice as aforesaid, the said land had neither been acquired, nor the Notification of land acquisition required under Section 126 (4) of the Maharashtra Regional and Town Planning Act, 1966 read with Section19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettle- ment Act, 2013, has been published by the said Appropriate Authority, within prescribed time period from the date of the service of said Notice under sub-section (1) of Section 127 of the said Act ;
And whereas, the Draft (Second Revised) Development Plan of Amravati City, District Amravati has been published under Section 26 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) in the Official Gazette dated 6-12/12-2018 (hereinafter referred to as " the said draft development plan ") ;
And whereas, in the said Draft Development Plan, the said land is affected by the Reservation No. 9 " Play Ground " and Reservation No. 10 " Public Amenities " (hereinafter referred to as " the said draft development plan reservations ") ;
And whereas, the Hon'ble High Court, Nagpur Bench, in Writ Petition No. 6297 of 2019 filed by the owners of the said land, vide its Order, dated 13-10-2021, has held that the said Development Plan reservations and the said Draft Development Plan reservations, on the said land stand lapsed and directed the State of Maharashtra to notify the lapsing of the said reservations on the said land under Section 127(2) of the said Act ;
And whereas, after receiving the Hon'ble High Court Order and the Report of the Amravati Municipal Corporation and the Report of the Director of Town Planning, Maharashtra State, Pune, it is observed that the said land affected by४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्ध २४-३०, २०२२/ ३-९, ॅ १९४४ the said Development Plan Reservations, had neither been acquired within the prescribed time limit from the date of service of the said Notice, nor Notification of land acquisition required under Section 126 (4) of the Maharashtra Regional and Town Planning Act, 1966 read with Section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within the prescribed time limit by the said Appropriate Authority. And, in consequence thereof, the Government of Maharashtra is of opinion that the Reservation No. 515 A " Primary School " (affected area 0.19 H. A.), Reservation No. 515 B " Secondary School " (affected area 0.29 H. A.), Reservation No. 515 C " Play Ground " (affected area 1.52 H. A.) on the land bearing S. No. 194/1 of Mouje Rahatgaon stand lapsed as per the provisions of Section 127 (1) of the said Act ;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby notifies that the said Development Plan reservations in the said Development Plan of Amravati City stand lapsed to the extent of the area as mentioned in the Annexure below and the land so released, will be available to the owner for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

A copy of the Part Plan, showing the area of the said Reservations which have been lapsed vide this Order, is available in the office of the Municipal Commissioner, Amravati Municipal Corporation, District Amravati during office hours on all working days for inspection of public for the period of one month.
This Order shall also be published on the Govt. website www.maharashtra.gov.in (Acts/Rules) By Order and in the name of the Governor of Maharashtra,

Publication of Draft Development Plan of Shegaon Under Section 26(1) of
Maharashtra Regional & Town Planning Act, 1966

Whereas, the Shegaon Municipal Council (hereinafter referred to the "said Planning Authority,") vide Resolution No. 3, dated 10th December 2019 had declared its intention to prepare a Draft Development Plan of Shegaon (S.R+E.L) (hereinafter referred to as the " said Draft Development Plan ") for the area under its jurisdiction, (hereinafter referred to as the " said area ") as per the provision of Section 23(1) read with Section 21 (2) of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as the " said Act ") and notice to that effect is published in Maharashtra Government Gazette Amravati Division, Supplement Part 1-A on dated January 16-22, Year 2020.
And whereas, as per the provision in Section 24 of the said Act, the Municipal Council vide Order No. 524/2020, dated 22nd June 2020 has appointed Assistant Director, Buldhana Branch as " Town Planning Officer " to prepare the said Draft Development Plan for the said area ;
And whereas, the Town Planning Officer and Assistant Director, Town Planning Buldhana Branch after having prepared Existing Land Use Map as per Section 25 of the said Act, has prepared the said Draft Development Plan of the said area and has handed it over to the said Planning Authority on for publication under Section 26(1) of the said Act ;
And whereas, the said Planning Authority has passed Resolution No. 1, dated 7th March 2022 to publish the said Draft Development Plan under Section 26(1) of the said Act. For inviting suggestions/objections from the public ; +.-ॅ-+-२ (२०६६).

The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following offices on all working days during office hours.

The suggestions/objections if any, in writing from the public in this regard with reasons. Shall be submitted to the Chief Officer, Shegaon, Municipal Council within the period of 30 days from the date of publication of the notice in Maharashtra Govt. Gazette suggestions/objections received by the Municipal Council within the period of 30 days from the date of publication of this notice in Maharashtra Government Gazette shall only be considered.
The copies of the said Draft Development Plan and particulars shall be available to the public at reasonable price in the office of the Shegaon, Municipal Council.
