आशर जयाअर्थी, प्तयक् भूसंपादनाप्मारेची सदर रस्तयाची आखरी (STUPMNVWXYZ ने दि्णशवलयाप्मारे) आशर ठराव क्र.१४२८ नुसार मंजूर केलेली आखरी यामधये फरक आहे. ्तयामुळे उक् अशिसूशच् क्ेत्ाचया मंजूर शवकास योजने्ील आरक्रांचया क्ेत्ामधये फरक हो् आहे. एकास्तमकृ् नगर वसाह् प्कलपामधये आरक्र क्र.SS-४८ सर्लां्री् (relocate) केले असून पोहोच रस्ा उपलबि न होरारे आरक्र क्र.PG-२८ यांस सदर प्कलपाचया शवकासकाने प्कलपाअं्ग्ण् रस्ा देरेशवषयी आशवाशस् केले आहे. उक् रस्तयाचया सुिारर् STUPMNVWXYZ आखरीमुळे पूव्ण-पसशचम १८मी., २४मी. व ४५मी. रंद रस्तयांची ्सेच भाग नकािावर LMNO ने दि्णशवलेलया १५मी. रंद रस्तयाची जोडरी (connectivity) नाहीिी हो्े. राष्ट्रीय महामागा्णला (NH-३) उक् रस्ा vehicular underpass माफ्फ् जोडणयाकरर्ाचया प्स्ावास भार्ीय राष्ट्रीय राजमाग्ण प्ाशिकरर (NHAI) यांचेकडून ्तव्: मानय्ा प्ाप् झाली असून ्तयानुसार भूसंपादन करावयाचया जशमनींबाब् शवही् काय्णवाही सुरू असलयाने उक् रस्ा NH-३ ला जोडणयाची संपूर्ण काय्णवाही झालयानं्र शवकास योजने्ील मौ.दापोडे येर्ील आरक्र क्र.FS-१०, PRB-५१, PA-५० यांचया क्ेत्ामिील फरकाशवषयी नेमका उलगडा होऊ िकेल ;

आशर जयाअर्थी, प्ाशिकरराने शदनांक २८ फेब्ुवारी २०२२ रोजी झालेलया बैठकी् पारर् केलेलया ठराव क्र.१५९३ अनवये उक् अशिसूशच् क्ेत्ा्ील मंजूर शवकास योजनेमिील उक् रस्तयाचया आखरी्ील वस्ुससर्ी्ील बदलामुळे इ्र जोडरारे रस्े, आरक्रे व झोन यामधये खालील (अ) ्े (उ) यामधये नमूद केलेलया मुदांप्मारे शवकास योजनेचया भाग नकािावर दि्णशवलयानुसार महाराष्ट्र प्ादेशिक शनयोजन व नगररचना अशिशनयम, ३७(१) अनवये फेरबदल करणयासाठी मानय्ा शदली आहे (यापुढे जयाचा उललेख 'उक् फेरबदल' असा करणया् आला आहे);

(अ) मंजूर शवकास योजने्ील उक् रस्तयाचया वगळलेलया आखरीमिील रस्तयालग्ची आरक्रे आशर रस्े वगळ्ा, R-a या पट्टामिील जमीन संलगन वाशरजय, a-O मिील भागि: वाशरजय व भागि: रशहवास, O-b मिील भागि: रशहवास व भागि: ट्रानसपोट्ट हब अँड लॉशजससटक पाक्फ, b-c मिील ट्रानसपोट्ट हब अँड लॉशजससटक पाक्फ, c-d मिील रशहवास आशर d-e मिील ना शवकास पररमंडळामधये भाग नकािामधये दि्णशवलयानुसार समाशवष्ट कररे.

(आ) शनयोजनाचया दृष्टीने आरक्र क्र. JF-६३, G-४९, PS-१८, D/MH-२३, PS-२४, PA-७१, SWM-४, D/MH-२६, SS-४८ व Park-१७ यांचे क्ेत् व सर्ळ यामधये सोब्चया ्क्ा क्र.१ मधये नमूद केलयानुसार व भाग नकािावर दि्णशवलयानुसार फेरबदल कररे आशर एकास्तमकृ् नगर वसाह् प्कलपामधये मंजूर केलयानुसार आरक्र क्र.SS-४८ सोब्चया भाग नकािावर दि्णशवलयाप्मारे सर्लां्री् (relocate) करून शवकास योजने्ील आरक्रा्ून मुक् झालेली जमीन लग्चया रशहवास पररमंडळामधये समाशवष्ट कररे.

(इ) भाग नकािावर (LMNO) दि्णशवलयाप्मारे १५ मी. रंद डी.पी. रस्ा वगळरे आशर ्तयाखालील जमीन संलगन ट्रानसपोट्ट हब अँड लॉशजससटक पाक्फ पररमंडळामधये समाशवष्ट कररे.

(ई) उक् रस्तयाचया सद:ससर्ी्ील सुिारर् STUPMNVWXYZ आखरीमुळे जोडरी (Connectivity) नाहीिी होरारे पूव्ण-पसशचम १८ मी., २४ मी. व ४५ मी. रंद रस्तयांची सलग्ा कायम ठेवरे.

(उ) उक् रस्ा NH-३ ला जोडणयाची संपूर्ण काय्णवाही झालयानं्र सुिारर् आखरीप्मारे आरक्र क्र.FS-१०, PRB-५१, PA-५० यांचया आरक्रांमधये ्सेच रस्तयास संलगन झोनमधये आवशयक ्े बदल कररे ;

आशर जयाअर्थी, प्ाशिकरराने सदर ठराव क्र.१५९३ नुसार उक् अशिशनयमाचया कलम १३९ अनवये ्सेच मु ंबई महानगर प्देि शवकास प्ाशिकरर अशिशनयम, १९७४ चया कलम ७-अ अनवये प्ाप् झालेलया अशिकारांचा वापर करून शवकास योजनेमधये फेरबदल करणयासंदभा्ण् उक् अशिशनयमाचया कलम ३७(१) मिील सव्ण वैिाशनक काय्णवाही पूर्ण करूनिासनास उक् फेरबदल प्स्ाव मंजुरीसाठी सादर कररे यासाठी व उक् अशिशनयमानुसार आवशयक असलेली सव्ण काय्णवाही पूर्ण करणयास महानगर आयुक् यांना प्ाशिकृ् केले आहे.

महरून आ्ा, उक् अशिसूशच् क्ेत्ाचया मंजूर शवकास योजनेमधये उक् अशिशनयमाचया कलम ३७(१) अनवयेचा उक् फेरबदल करणयासाठी उक् अशिशनयमाचया कलम ३७(१) मिील ्र्ुदींनवये उक् फेरबदलाबाब् जन्ेकडून सूचना आशर / शकूंवा आक्ेप मागशवणयासाठी ही नोटीस प्शसद्ध करणया् ये् आहे.

शनररक्रासाठी ठेवणया् आला आहे.

ही नोटीस महाराष्ट्र िासनाचया राजपत्रात प्शसद्ध झालयाचया ्ारखेपासून ३० (्ीस) शदवसांचया आ् याबाब् काही सूचना आशर/ ं. म. प्. शव. प्ा., उप-प्ादेशिक काया्णलय, बहुउद्ेशिय हॉल, २ रा मजला, ओसवाल पाक्फ शकूंवा आक्ेप असलयास वररष्ठ शनयोजक, मु लग्, पोखरर रोड नं. २, माशजवडा, ठारे (प.) ४०० ६०१ यांचेकडे लेखी सवरूपा् दाखल झालेलया सूचना आशर / शकूंवा आक्ेप यांचा उक् अशिशनयमा्ील ्र्ुदींनुसार शवचार करणया् येईल. उक् फेरबदल दि्णशवरारा मंजूर शवकास योजनेचा भाग नकािा व नोटीस प्शिकरराचया https://mmrda.maharashtra.gov.in या संके् सर्ळावर देखील उपलबि आहे.

NOTICE

Maharashtra regional and town Planning act, 1966

No. : SROT/2500/BSNA/DP-MODIFICATION/ (45m road Vil. Mankoli)/400/2022.—WHEREAS, the Govt. of Maharashtra has appointed the Mumbai Metropolitan Region Development Authority (hereinafter referred to as 'the said Authority') established under the Mumbai Metropolitan Region Development Authority Act, 1974, (Maharashtra-IV of 1975) to be the Special Planning Authority for the 'Bhiwandi Surrounding Notified Area' (hereinafter referred to as 'the said Notified Area') by the Urban Development Department's Notification No.TPS 1206/330/CR-230/06/UD-12, dated 17th March, 2007 in exercise of its powers conferred by Section 40 (1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as the 'said Act');

And Whereas, the Govt. of Maharashtra, Urban Development Department by its Notification No.TPS-1212/1699/C.R.No.127/2013/UD-12,dated 11th March, 2015 has sanctioned the Development Plan along with Development Control Regulations for the said Notified Area and published certain parts in the form of E.P.(Excluded Parts);

And Whereas, the Govt. of Maharashtra, in Urban Development Department by its Notification No. TPS-1216/1169/C.R.162/16/UD-12, dated 4th November, 2016; Notification No. TPB-1216/1169/ C.R. 162/16/UD-12, dated 10th March, 2017; Notification No. TPS-1216/2874/C.R. 366/16/UD-12, dated 24th March, 2017 and Notification No. TPS-1216/1169/C.R. 162/16/UD-12, dated 13th June, 2017 (Published in Maharashtra Govt. Gazette on 13th March, 2015; 10th-16th November, 2016; 6th- 12th April, 2017; 13th-19th April, 2017 and 29th June-5th July, 2017 respectively) has sanctioned the E.P. (Excluded Parts) for the said Notified Area under section 31 (1) of said Act;

And Whereas, the Authority in its 143rd meeting held on 13th July, 2017 vide Resolution No.1428 has accorded its approval to initiate the procedure under Section 37(1) of the said Act for carrying out modification in alignment of 45m wide DP road passing through villages Mankoli, Sarang, Surai, Dapode, Tal. Bhiwandi and also, empowered Metropolitan Commissioner to complete the statutory procedure under Section 37(1) of the said Act and to make any changes, if required after verifying on-site condition for the alignment of 45m wide road (hereinafter referred to as 'the said road');

And Whereas, variation is observed in alignment of the said road approved vide Resolution No.1428 and its alignment as per actual land acquisition (shown as STUPMNVWXYZ on part plan). Therefore, areas of DP reservations are changed. Reservation No.SS-48 is relocated in Integrated Township Project (ITP) and developer of the said ITP has assured to provide access to Reservation No. PG-28, which is inaccessible, due to modified alignment of the said road. Due to such modified alignment STUPMNVWXYZ of the said road, the connectivity of east-west 18m, 24m and 45m DP roads and 15m wide DP road as shown by LMNO on part plan is missing. Since, National Highway Authority of India (NHAI) has granted in-principle approval for the proposal of connecting the said road to National highway-3 (NH-3) through vehicular underpass and accordingly, land acquisition is under process, exact difference in areas of Reservation No. FS-10, PRB-51, PA-50 can be identified after completing procedure of connection of NH-3 and the said road;

And Whereas, the Authority in its 152nd meeting held on 28th February, 2022 vide Resolution No.1593 has accorded its approval to initiate the procedure u/s 37(1) of the said Act for carrying out modification to the Sanctioned Development Plan of the said Notified Area under Section 37(1) of the said Act for changes in adjoining Roads, reservations and zones as mentioned in (A) to (E) below due to revised alignment of the said road, as shown on part plan of Sanctioned Development Plan of the said Notified Area (hereinafter referred as 'the said modification');

A. Except roads and reservations, lands so released from alignment of the said road as per Development Plan is to be included in adjoining R-a in Commercial zone, a-O in partly Commercial and partly Residential, O-b in partly Residential zone and partly Transport hub and Logistic park (TH & LP zone), b-c in TH & LP zone, c-d in Residential zone and d-e in No Development Zone as shown on the part plan.

B. From planning point of view, modifying location and areas of reservation No. JF-63, G-49, PS-18, D/MH-23, PS-24, PA-71, SWM-4, D/MH-26, SS-48 and Park-17 as mentioned in Table No.1 and as shown on part plan and to relocate Reservation No. SS-48 as approved for ITP Project and to include land so released in Residential zone.

C. To delete 15m wide DP road as shown by LMNO on part plan and to include land so released in adjoining TH & LP zone

D. To maintain continuity of east-west 18m, 24m and 45m wide DP road which are disconnected due to modified alignment STUPMNVWXYZ of the said road.

E. After completion of procedure to connect the said road to NH-3, required changes will be made in Reservation No. FS-10, PRB-51, PA-50 and adjoining zones;

AND WHEREAS, the Authority by its Resolution No.1593, in exercise of the powers under Section 7-A of MMRDA Act, 1974 and under Section 139 of the said Act has authorized the Metropolitan Commissioner to carry out all the statutory procedure under Section 37(1) of the said Act and submit the said modification proposal to the Government for sanction and to carry out all required necessary action under the said Act.

NOW THEREFORE, this notice is hereby published under Section 37(1) of the said Act for inviting suggestions and/or objections from public for carrying out the said modification to the Sanctioned Development Plan of the said Notified Area under Section 37(1) of the said Act.

The part plan of the sanctioned Development Plan showing the said modification and Table No.1 is kept for inspection of the public in the following offices during office hours.

The suggestions and/or objections received in writing to the Senior Planner, MMRDA Sub- Regional Office, Multipurpose Hall, 2nd Floor, Besides Oswal Park,Pokharan Road 2, Majiwada, Thane (W) – 400601 within 30 (thirty) days from the date of publication of this notice in the Maharashtra Government Gazette will be considered. The Notice and part plan of the sanctioned Development Plan showing the said modification is also available on MMRDA's website at https://mmrda.maharashtra. gov.in.

No. SROT/2600/AMC/VILL.AMBERNATH/(S.No.166Pt.)/RES.No.180/380/2022 WHEREAS, the Govt. of Maharashtra has appointed Mumbai Metropolitan Region Development Authority (hereinafter referred to as "the said Authority") established under the Mumbai Metropolitan Region Development Authority Act, 1974, (Maharashtra-IV of 1975) to be the Special Planning Authority for the "Kalyan Complex Notified Area" by the Urban Development and Public Health Department Notification No.TPB-1275/1199/UD-8, dated 15th March, 1976 promulgated in exercise of its powers conferred by Section 40 (1) (c) of the Maharashtra Regional and Town Planning Act, 1966. (hereinafter referred to as the "said Act");

AND WHEREAS, the Govt. of Maharashtra, Urban Development Department by its Notification No. TPS -1200/1957/CR-32/2001/UD-12, dated 22nd March, 2001 has changed the name of the Kalyan Complex Notified Area as "Ulhasnagar, Ambernath, Kulgaon-Badlapur and Surrounding Notified Area";

AND WHEREAS, the Govt. of Maharashtra, Urban Development Department by its Notification No.TPS-1202/806/CR-83/2002/UD-12, dated 26th October, 2004 excluded the area within the jurisdiction of Ulhasnagar Municipal Corporation from "Ulhasnagar, Ambernath, Kulgaon-Badlapur and Surrounding Notified Area" and name of the said Notified Area is changed to "Ambernath, Kulgaon-Badlapur and Surrounding Notified Area" (hereinafter referred to as the "said Notified Area");

AND WHEREAS, the Govt. of Maharashtra, Urban Development Department by its Notification No.TPS-1204/941/CR-163/04/UD-12, dated 25th July, 2005 has sanctioned the Development Plan along with Development Control Regulations for the said Notified Area and published certain parts in the form of E.P.(Excluded Parts);

AND WHEREAS, the Govt. of Maharashtra, in Urban Development Department by its Notification No.TPS-1204/941/CR-163/04(Part-II)/UD-12, dated 11th August, 2008 has sanctioned the E.P. (Excluded Parts) for the said Notified Area;

AND WHEREAS, the Govt. of Maharashtra in Urban Development Department vide letter dated 05th January, 2022 has informed to submit proposal for sanction to Government after completing procedure u/s 37(1) of the said act, Government regarding exclusion of about 11.00 Ha land from reservation No. 180, "Public Park" having area about 26.81 Ha on S.No. 102Pt, 103Pt, 104, 106Pt, 166Pt of Village Ambernath and Inclusion of this about 11.00 Ha land in reservation of "Government Medical College and Hospital" for which implementing agency will be Medical Education Department, Government of Maharashtra.

AND WHEREAS, Authority in its 152nd meeting held on 28th February, 2022 by its Resolution No.1590 has approved to initiate the procedure u/s 37(1) of the said Act for carrying out modification regarding exclusion of about 11.00 Ha land from reservation No.180, "Public Park" having area about 26.81 Ha on S.No. 102Pt, 103Pt, 104, 106Pt, 166Pt of Village Ambernath and Inclusion of this about 11.00 Ha land in reservation of "Government Medical College and Hospital" for which implementing agency will be Medical Education Department, Government of Maharashtra, as shown on the part plan of sanctioned Development Plan of the said Notified Area (hereinafter referred as the said modification);

AND WHEREAS, as per Authority's Resolution No. 1590, in exercise of the powers under section 139 of said Act and section 7A of Mumbai Metropolitan Region Development Authority Act, 1974 has authorized the Metropolitan Commissioner to complete all the statutory procedure with respect to the said modification in exercise of the powers under section 37 of the said Act;

NOW, THEREFORE, this notice is hereby published under Section 37 of the said Act for inviting suggestions and/or objections from public for carrying out said modification to the sanctioned Development Plan of the said Notified area by excluding about 11.00 Ha land from reservation No.180, "Public Park" having area about 26.81 Ha on S.No. 102Pt, 103Pt, 104, 106Pt, 166Pt of Village Ambernath and including this approx. 11.00 Ha land in reservation of "Government Medical College and Hospital" for which implementing agency will be Medical Education Department, Government of Maharashtra.

Part plan of the sanctioned Development Plan showing the said modification is kept for inspection by the public in the following offices during office hours.

Recovery Dept., First Floor, Shreeji Arcade, Beside Tandool Bazar, Bhabola Bangli Road, Vasai (W), Tal. Vasai, Dist. Palghar. The successful bidder shall deposit the 15% earnest money of bid amount and remaining amount within fifteen days from the date of acceptance of the offer failing which earnest money deposited is liable to be forfeited. The Decree Holder Bank vis-a-vis Recovery officer, reserves the right to reject all or any tender without assigning any reason whatsoever.

3. The successful bidder shall be required to make remaining balance of the finalized bid amount excluding Earnest Money Within 15 days from the date of Auction.

4. In case, the successful bidder fails to pay remaining 85 % of the bid amount as mentioned in the Clause 3 above, the Earnest Money deposited will stand forfeited. Similarly, if the successful bidder fails to pay the full amount within 15 days from the date of auction the amount paid till date will stand forfeited.

5. All charges, levies, taxes dues/or any other liability/ongoing accrued against the property shall be borne by the successful bidder. Present accrued liabilities on the property are not known and if any, it will be borne by the successful bidder.

6. Offer/Bid amount lesser than reserve price will not be accepted.

7. Successful bidder should carry out due diligence prior to purchase of the property and neither the Decree Holder Bank nor the Recovery Officer in any way shall be responsible for any dispute arising there from. Successful Bidder will have to deal it in his /her/their Own cost and consequences.
