क्रमांक संकीर्ण २०१ ९ /प्र.क्र.९ ४ /१ ९ /विशि -१. ज्याअर्थी , राज्य शासनाने स्थापन केलेल्या, चालविलेल्या तसेच अनुदान दिलेल्या विवक्षित शैक्षणिक संस्थामधील अध्यापक संवर्गासाठी , अनुसूचित जाती , अनुसूचित जमाती , निरधिसूचित जमाती ( विमुक्त जमाती ) , भटक्या जमाती , विशेष मागास प्रवर्ग , इतर मागास वर्ग आणि आर्थिकदृष्ट्या दुर्बल घटक यांतील व्यक्तींची सरळसेवा भरतीद्वारे नियुक्ती करताना , पदे आरक्षित ठेवण्यासाठी आणि तत्संबंधित किंवा तनुषंगिक बाबींसाठी तरतूद केली आहे ;
ज्याअर्थी, राज्यातील शैक्षणिक संस्थांमध्ये अध्यापकांच्या सरळसेवा भरतीसाठी विषयनिहाय आरक्षणाऐवजी संवर्गनिहाय आरक्षण लागू करण्याचे धोरण राबविण्यात येत आहे ;
ज्याअर्थी , महाराष्ट्र शैक्षणिक संस्था ( अध्यापक संवर्गातील आरक्षण ) अधिनियम , २०२१ ( २०२२ चा १७ ) चे कलम ३ मधील पोट- कलम ( १ ) हे , राज्य शासनास, एखाद्या शैक्षणिक संस्थेमधील सरळसेवा भरतीमध्ये अध्यापक संवर्गातील मंजूर बळाच्या आरक्षणाची मर्यादा व रीत विनिर्दिष्ट करण्याचे अधिकार प्रदान करते ;
त्याअर्थी, महाराष्ट्र शैक्षणिक संस्था ( अध्यापक संवर्गातील आरक्षण) अधिनियम , २०२१ ( २०२२ चा १७ ) मधील कलम ३ च्या पोट- कलम ( १ ) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन विनिर्दिष्ट करते की,-
१. राज्य शासनाने स्थापन केलेल्या, चालविलेल्या तसेच अनुदान दिलेल्या शैक्षणिक संस्थामधील अध्यापक संवर्गातील ( समान वेतनश्रेणीतील) सर्व विषयांतील मंजूर पदे एकत्रित करण्यात येतील व खाली नमूद केल्यानुसार संवर्गनिहाय आरक्षण लागू राहील : -
ⅰ. प्रत्येक अकृषि विद्यापीठाने ( सर्व विभाग , केंद्र/ उप परिसर , संचलित/ घटक महाविद्यालये मिळून ) अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
ii. विद्यापीठ अनुदान आयोग अधिनियम , १ ९ ५६ (१ ९ ५६ चा ३ ) च्या कलम ३ अन्वये अभिमत विद्यापीठ म्हणून घोषित केलेली , आणि राज्य शासनाकडून चालविलेली किंवा अनुदान मिळणाऱ्या प्रत्येक संस्थेने अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी . (१)

iii सर्व शासकीय ( कला , वाणिज्य व विज्ञान ) महाविद्यालये , विज्ञान संस्था, न्याय सहाय्यक विज्ञान संस्था , सिडनेहॅम महाविद्यालय, सडनेहॅम व्यवस्थापन संस्था यांची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
iv सर्व शासकीय अध्यापक महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
υ सर्व शासकीय विधि महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
vi. सर्व शारीरिक शिक्षण महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
vii. अशासकीय अनुदानित महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असणारी संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
viii सर्व शासकीय अभियांत्रिकी महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
ix. अशासकीय अनुदानित अभियांत्रिकी महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असणारी संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
सर्व शासकीय तंत्रनिकेतन महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी. X.
xi. अशासकीय अनुदानित तंत्रनिकेतन महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असलेली संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xii. सर्व शासकीय औषधनिर्माण शास्त्र ( पदवी) महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xiii. अशासकीय अनुदानित औषधनिर्माण शास्त्र ( पदवी) महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असणारी संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xiv. सर्व शासकीय औषधनिर्माण शास्त्र ( पदविका ) महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xυ . अशासकीय अनुदानित औषधनिर्माण शास्त्र (पदविका) महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असलेली संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xvi. सर्व शासकीय हॉटेल व्यवस्थापन महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xvii. सर्व शासकीय दृश्यकला ( पदवी व पदव्युत्तर ) महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी .
xviii. सर्व शासकीय दृश्यकला ( पदविका) महाविद्यालयातील अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xix. अशासकीय अनुदानित दृश्यकला (पदविका) संस्थांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असलेली संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी .
xx. अशासकीय अनुदानित वास्तुशास्त्र (पदवी ) महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असलेली संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
xxi. अशासकीय अनुदानित वास्तुशास्त्र ( पदविका ) महाविद्यालयांच्या बाबतीत एखाद्या सोसायटीने किंवा विश्वस्त संस्थेने किंवा खाजगी व्यवस्थापन संस्थेने चालविलेली आणि राज्य शासनाकडून प्रत्यक्ष किंवा अप्रत्यक्षपणे अनुदान मिळत असलेली संस्था किंवा महाविद्यालय किंवा संस्थांच्या किंवा महाविद्यालयांच्या गटाची अध्यापक संवर्गातील सर्व मंजूर पदांची एक बिंदुनामावली ठेवावी.
२. वरीलप्रमाणे संवर्गनिहाय आरक्षण हे संवर्गातील एकूण मंजूर पदांची संख्या विचारात घेऊन प्रचलित आरक्षण धोरणातील विहित टक्केवारीनुसार निश्चित करण्यात यावे.

३. संवर्गातील एकूण मंजूर पदे व कार्यरत पदे विचारात घेऊन अध्यापक संवर्गाची बिंदुनामावली पदांच्या गोषवाऱ्यासह विहित नमुन्यात ठेवण्यात यावी . महाराष्ट्र शैक्षणिक संस्था ( अध्यापक संवर्गातील आरक्षण ) अधिनियम, २०२१ ( २०२२ चा १७ ) नुसार संवर्गनिहाय आरक्षण हे संवर्गातील एकूण मंजूर पदांच्या संख्येस लागू होणार आहे . त्याप्रमाणे बिंदुनामावलीची तपासणी करून रिक्त पदांचे प्रवर्गनिहाय आरक्षण निश्चित करण्यात यावे व सदर बिंदुनामावलीस सक्षम प्राधिकरणाची मान्यता घेण्यात यावी .
४. सदर अधिसूचना दिनांक ७ एप्रिल, २०२२ पासून अंमलात येईल.

NOTIFICATION
MAHARASHTRA EDUCATIONAL INSTITUTIONS (RESERVATION IN TEACHERS' CADRE) ACT , 2021 .
No.Misc - 2019/C.R.94/19 /Vishi- 1.- WHEREAS the Government of Maharashtra has provided for the reservation of posts in appointments by direct recruitment of persons belonging to the Scheduled Castes , Scheduled Tribes , De - notified Tribes ( Vimukta Jatis ) , Nomadic Tribes , Special Backward Category , Other Backward Classes and Economically Weaker Sections to teachers ' cadre in certain Educational Institutions established , maintained or aided by the State Government and for the matters connected therewith or incidental thereto ;
AND WHEREAS , the policy of cadre - wise reservation instead of subject - wise reservation for appointments of teachers by direct recruitment in the Educational Institutions , is being implemented ;
AND WHEREAS , sub- section ( 1) of section 3 of the Maharashtra Educational Institutions (Reservation in Teachers ' Cadre ) Act , 2021 (Mah . XVII of 2022) empowers the State Government to specify the extent and the manner for reservation of posts in direct recruitment out of the sanctioned strength in teachers ' cadre in an educational institution ;
NOW , THEREFORE , in exercise of the power conferred by sub - section ( 1 ) of section 3 of the Maharashtra Educational Institutions (Reservation in Teachers ' Cadre ) Act , 2021 ( Mah . XVII of 2022 ) , the Government of Maharashtra hereby specifies that ,-
1. All sanctioned posts in teachers' cadre ( in the same scale of pay) in all subjects in the Educational Institutions established , maintained or aided by the State Government , shall be combined and the cadre - wise reservation shall be made applicable in the following manner , namely
(i) Each non - agricultural university ( including all departments , centre/ sub - campus , conducted/ constituent colleges ) shall maintain a single roster of all sanctioned posts in teachers ' cadre .
(ii) An institution declared as deemed to be university under section 3 of the University Grants Commission Act , 1956 (3 of 1956) and maintained by or receiving aid from the State Government , shall maintain a single roster of all sanctioned posts in teachers ' cadre .
(iii) All Government ( Arts , Commerce and Science ) colleges , Science Institutions , Forensic Science Institutions , Sydenham College , Sydenham Management Institution , shall form a single roster of all sanctioned posts in teachers ' cadre .
(iv) All Government Teaching colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(v) All Government Law colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(vi) All Physical Education colleges shall form a single roster of all sanctioned posts in teachers ' cadre.

(vii) In case of Non - Government aided colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers' cadre .
(viii) All Government Engineering colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(ix) In case of Non - Government aided engineering colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly, shall maintain a single roster of all sanctioned posts in teachers ' cadre .
(x) All Government Polytechnic colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(xi) In case of Non - Government aided polytechnic colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers' cadre .
(xii) All Government pharmaceutical science ( degree) colleges shall form a single roster of all sanctioned posts in teachers' cadre .
(xiii) In case of Non -Government aided pharmaceutical science (degree ) colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers ' cadre .
(xiv) All Government pharmaceutical science ( diploma ) colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(xv ) In case of Non- Government aided pharmaceutical science ( diploma ) colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers ' cadre .
(xvi) All Government hotel management colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(xvii) All Government visual arts ( degree and post - graduate degree ) colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(xviii) All Government visual arts ( diploma ) colleges shall form a single roster of all sanctioned posts in teachers ' cadre .
(xix) In case of Non - Government aided visual arts ( diploma ) institutions , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers' cadre .

(xx) In case of Non - Government aided architecture ( degree) colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers ' cadre .
(xxi) In case of Non - Government aided architecture ( diploma ) colleges , an institution or college or a group of institutions or colleges maintained by a society or trust or private management body and receiving aid from the State Government , whether directly or indirectly , shall maintain a single roster of all sanctioned posts in teachers ' cadre .
2. Cadre - wise reservation as mentioned above shall be determined after considering the total number of sanctioned posts in the cadre and as per the percentage of reservation prescribed under the prevailing reservation policy .
3. The roster in the teachers ' cadre alongwith the summary of posts shall be maintained in the prescribed format , after considering the total number of sanctioned posts and occupied posts in the cadre . The cadre - wise reservation shall be applicable to the total number of sanctioned posts in the cadre as per the Maharashtra Educational Institutions (Reservation in Teachers ' Cadre) Act , 2021 ( Mah. XVII of 2022 ) . The cadre - wise reservation in respect of the vacant posts shall be determined after verification of the roster . Such roster shall be approved by the competent authority .
4. This Notification shall come into force with effect from the 7th April 2022 .
