क्रमांक इएसटी-२०२२/प्र.क्र.०१/का-२.----विधि व न्याय विभागाच्या '' सहायक प्रारुपकार-नि-अवर सचिव '' या संवर्गामध्ये कार्यरत असणाया श्रीमती विनया वि. पुल्लीवार (ज्ये.क्र. १ खुला प्रवर्ग), श्री. नरेश मोहन पुसनाके (ज्ये.क्र. २ अ.ज. प्रवर्ग) व श्री. पुष्पेंद्रसिंग मंगलसिंग राजपूत (ज्ये. क्र. ३ वि.जा.अ. प्रवर्ग) यांना वेतन स्तर एस-२५, रुपये ७८,८००---२,०९,२०० या वेतनश्रेणीतील '' उप प्रारुपकार- नि-उप सचिव '' या संवर्गातील पदोन्नतीच्या कोटयातील रिक्त पदावर दिनांक ७ एप्रिल २०२२ (म.पू.) पासून निव्वळ तात्पुरत्या स्वरुपात निवडसूची वर्ष सन २०२१-२२ मधून पदोन्नती देण्यात येत आहे. सदर तात्पुरती पदोन्नती ही, पदोन्नतीच्या कोटयातील रिक्त पदे निव्वळ तात्पुरत्या स्वरुपात सेवाज्येष्ठतेनुसार मा. सर्वोच्च न्यायालयात दाखल केलेल्या विशेष अनुमती याचिका क्रमांक २८३०६/२०१७ मधील अंतिम निर्णयाच्या अधीन राहून भरण्याबाबत सामान्य प्रशासन विभाग/१६-ब, यांनी दिनांक ७ मे २०२१ रोजीच्या शासन निर्णयान्वये दिलेल्या सूचनांनुसार देण्यात येत आहे.

No. SPP. 2022/U.O.R. 16/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974) and section 32 of The Protection of Children from Sexual Offences Act, 2012 (POCSO Act, 2012) the Government of Maharashtra hereby appoints Adv. Ajay Suhas Misar as '' Special Public Prosecutor '' for conducting the case/s in Hon'ble Special (POCSO), Sessions Court, Thane which is/are arising out of C.R. No. 499/2021 registered at Manpada Police Station, Thane.
2. The fees of Adv. Ajay Misar, Special Public Prosecutor shall be paid by Home Department. 3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.
4. The Government reserves right to revoke/modify/annul the order without assigning any reasons.

Pradip Dattatray Gharat as '' Special Public Prosecutor '' for conducting the case/s and applications and related matters before the Hon'ble Metropolitan Magistrate, Borivali, Mumbai and Hon'ble Sessions Court, Dindoshi, Mumbai which is/are arising out of C.R. No. 98/2022 registered at Malwani Police Station, Mumbai, with effect from dated 4th March, 2022.
2. The fees of Adv. Pradip Dattatray Gharat as '' Special Public Prosecutor '' shall be paid by Home Department as per the fee proposal agreed by Home Department and approved by this department. 3. (१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील.
(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९८ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.
(३) वसुली अधिकारी यांनी या कार्यालयाने दिनांक ३१ ऑक्टोबर २०१८ रोजी निर्गमित केलेल्या परिपत्रकानुसार दरमाह विहित नमून्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, (१) मुंबई यांना सादर करावी.
(४) वसुली अधिकार प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ति सेवानिवृत्ती झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.
(५) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.
(६) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.
(७) वसुली अधिकायास त्यांच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि/किंवा "" सिव्हील कोर्ट "", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये) असे लिहावे.
(८) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर "" वसुली अधिकारी, धी कुणबी सहकारी बँक लि., मुंबई "" असा फलक लावता येईल.
(९) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्जवसूल करण्याची कार्यवाही करावी.
११ महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुुरुवार ते बुधवार, एप्रिल २१-२७, २०२२/वैशाख १-७, शके १९४४(१०) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसुलपात्र रक्कम व या कार्यालयाचे कलम १५६ आणि त्याखालील नियम १०७ अन्वये आदेश दिनांक ६ एप्रिल २०१८ मध्ये नमूद केल्याप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.
(११) या कार्यालयाचे दिनांक ३१ ऑक्टोबर २०१८ रोजीच्या परिपत्रकीय सूचनांचे वसुली अधिकारी यांनी तंतोतंत पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमाह वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाचमध्ये नमूद केल्याप्रमाणे घ्यावा.
(१२) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा. वसूली अधिकारी यांनी नोटीसा बजावताना नोटीसीमध्ये त्यांचे नाव, पदनाम व भ्रमणदुरध्वनी क्रमांक नमूद करणे आवश्यक आहे.

स्वरूपात प्रकाशित केले जातात ; त्यामुळे वरील बाबीसंबंधी सर्व संदर्भ निकालात निघाले आहेत असे समजण्यात यावे. अशा
अधिसूचनांमुळे त्यांच्या दुय्यम अधिकायांची कार्यमुक्ती व तत्सम बाबी यासंबंधी आनुषंगिक आदेश काढणे आवश्यक असल्यास
राजपत्र मिळाल्यानंतर त्यांनीच ते काढले पाहिजेत. कारण शासनाकडून इतर कोणतेही आदेश काढले जाणार नाहीत.
