MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
NOTIFICATION
No. TPS-2421-934 & 1065-CR-91-UD-9-2021.—
Whereas, Revised Development Plan of Nagpur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496/2643-CR-300(A)-97-UD-9, dated 7th January, 2000 and finally sanctioned th Government vide Notification No. TPS-2400/1628-CR-200-2000- UD-9, dated the 10th September, 2001 & has come into force with effect from 1st March, 2000 & 21st September, 2001 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") ;
And whereas, in the said Development Plan, land bearing Khasara Nos. 6, 7, 8(pt.), 9(pt.), 10(pt.), 11/ 2, 11/3, 12, 13 & 80(pt.) of Mouje Bhandewadi and Khasara No. 69/1, 69/2 & 81/1 of Mouje Pardi (herein- after referred to as "the said Lands") are reserved for Site No.E-34 Primary School, Site No.E-33 Market, Site No.ME-40 Park and 18.00 Mt. (East--West) D.P. Road (hereinafter referred to as "the said reserva- tions") ;
And whereas, the Nagpur Municipal Corporation, Nagpur being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its Resolution No. 35, dated 20th Juanuary 2021 has resolved to making modification in reservation boundary, change in nomenclature, for the said reservation and proposed to Site No.E-33 Market, Parking, Grave-Yard, Site No.E-34 Mutton & Fish Market, Site No.ME-40 Vegetable Market, Residential, 12.00mt. D.P. Road towards Southern from Bhandara road & 12.00mt. D.P. Road upto 18.00mt. D.P. Road on Eastern side. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act submitted to the Government for it's sanction, modification proposal (hereinafter referred to as "the said Modification Pro- posal") ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the said Modification proposal should be sanctioned with some Conditions ;
And whereas, the some of the land/s out of the said modification proposal are Private and such land/s are proposed to be included in Residential Zone. The Notificaiton in respect of such Private land/s will be issued after payment of 5% premium calculated as per rate of land prescribed in ASR, as per government policy dated 20 April 2016, by the land owner ;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 07 January 2000 as follows.—

Corporation Condition No. 1. No Objection Certificate from Collector Nagpur shall be obtained before the develop- ment of the Government land under the said modification proposal.
Condition No. 2. In case there are Court Cases in respect of the said land or reservations on the said land, the order of the Hon'ble Court shall be strictly complied.
A copy of the Notification, along with the part plan showing the aforesaid sactioned modification, shall be available for inspection of the general public, in the Office of the Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for a period of one month.
