मे. टफ एंटरप्ाईजेस (यापुढे जयाचा वनददेश "उक्त कसूरदार" असा केलेला आहे) ही कंपनी, कंपनी अविवनयम, २०१३ चया ्तर्तुदींनुसार संस्ावप्त आहे आवि महाराष्ट्र मूलयिविधि्त कर अविवनयम, २००२ (यापुढे जयाचा वनददेश "मूलयिविधि्त कर अविवनयम" असा केलेला आहे) खालील करदा्ता ओळख क्रमांक (टीन) २७८८०६८३९९३v/c िारि केलेला आहे. उक्त कसूरदाराचया वयिसायाचे विकाि हे रूम नं. ५५७/५७९, ओम शां्ती भिन, जे. एस. एस. मागधि, काळबादेिी, मु ंबई ४०० ००२ ये्े सस्त आहे.
याद्ारे जन्तेस सुवच्त करणया्त µ µये्त की, उक्त कसूरदार मूलयिविधि्त कर अविवनयमाखालील वनिाधिरर्त कर, वयाज ि शास्तीची रककम रु. ४,६२,२७,३१७ (अक्षरी रुपये चार कोटी बासष्ट लक्ष सत्ािीस हजार ्तीनशे स्तरा फक्त) शासकीय कोषागारा्त भरिा करणया्त कसूर केलयाने े मे. टफ एंटरप्ाईजेस ्तसेच इ्तर सिधि वयक्ती की जयांना यासोब्त जोडलेलया अनुसूवच्त नमूद मालमत्ा खरेदी करणयास रस आहे तयांचयासािी महाराष्ट्र जमीन महसूल संवह्ता, १९६६ ि महाराष्ट्र जमीन महसूल पररपू्तती वनयम, १९६७ सह मूलयिविधि्त कर अविवनयमाचया कलम ३२(५) ि ३४ चया ्तर्तुदीनुसार उक्त ्वक्त रकमेचया िसुलीसािी सदर नोटीस ही जमीन महसूल ्कबाकीसािीची नोटीस असलयाचे मानणया्त येईल.
याद्ारे सिधि जन्तेस ि इ्तर इच्छुक वयक्तींसािी नोटीस देणया्त ये्त आहे मूलयिविधि्त कर अविवनयमाचया कलम ३७ चया ्तर्तुदीनुसार या जाहीर नोटीसीला जोडलेलया मालमत्ेिर "प्म भार" िस्तू ि सेिा कर विभागाचा असेल. ्तसेच असा "प्म भार" हा याला जोडलेलया अनुसूचीमधये िधिन केलेलया उक्त मालमत्ेचया संबंिा्त संरवक्ष्त िनको ि इ्तर सिधि वयक्तींचया विरुद्ध असेल याद्ारे असे सुद्धा घोवष्त करणया्त ये्ते की, मालमत्ा हस्तां्तरि अविवनयम, १८८२ चया कलम १०० चया प्योजना्धि ही जाहीर सूचना अशा प्म भाराची नोटीस मानणया्त येईल.
मूलयिविधि्त कर अविवनयमाचया कलम ३८ चया ्तर्तुदीसुद्धा सिधिसामांनयांचया लक्षा्त आिून देणया्त ये्त आहे्त की, उक्त कसूरदाराकडे िर नमूद केलयाप्मािे मूलयिविधि्त कर अविवनयमानुसार देय रकमेची ्कबाकी आहे. सबब, उक्त कसूरदाराने यापुढे याला जोडलेलया अनुसूचीमधये नमूद केलेलया कोितयाही मत्ेिर भार वनमाधि केला वकंिा विक्री, ्तारि, भेट वकंिा अदला बदल यासह कोितयाही

M/s. Tuff Enterprises (hereinafter referred to as the "said defaulter") is a company incorporated as per the provisions of the Companies Act, 2013 and holds the Tax Identification Number (TIN) 27880683993V/C under the Maharashtra Value Added Tax Act, 2002 (hereinafter referred to as "MVAT Act"). The said defaulter is having the place of business situated at 577/579, 12A, OM SHANTI BHAWAN, J.S.S. ROAD, KALBADEVI, MUMBAI 400 002.
Notice is hereby given to the public in general, M/s. Tuff Enterprises in particular and all other persons who may be interested in the purchase of the properties more particularly described in the Schedule appended hereto that the said defaulter has failed to make the payment into Government Treasury of the tax, interest and penalty assessed under the MVAT Act at Rs. 4,62,27,317 ( In words Rs. Four Crore Sixty Two Lac Twenty Seven Thousand Three Hundred Seventeen Only). Also the Notice is given to the effect that the said recovery of the outstanding amount within the scope of section 32(5) and 34 of the MVAT Act read with Maharashtra Land Revenue Code, 1966 and Maharashtra Realization of Land Revenue Rules, 1967 shall, be deemed to be arrears of Land Revenue.
Notice is also given hereby to the public in general and all other interested persons that as per the provisions of operation of section 37 of the MVAT Act the "First Charge" has been created on property as described in the Schedule appended to this Public Notice. This "First Charge" shall be against all other persons that may be secured creditor or may have charge or interest in respect of the said property as described in the Schedule appended hereto. It is hereby also declared that for the purposes of section 100 of the Transfer of Property Act, 1882 this Public Notice shall be deemed to be Notice of such First Charge.
Further the provisions of section 38 of the MVAT Act are also brought to the Notice of the general public that the said defaulter is in arrears of the MVAT dues as stated hereinabove and therefore, in case the said defaulter hereafter creates a charge on, or parts with the possession by any mode of transfer whatsoever, including sale, mortgage, gift or exchange of any of the assets as stated in the Schedule appended hereto, is at the risk of declaring by the appropriate authority, the aforesaid acts as void and this Public Notice shall be deemed to be a notice of the pendency of the proceeding.
