THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No.TPS-2420-1572-C.R. 72-2021-UD-9.—
Whereas, Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, Dated 7th January 2000 and finally sanctioned vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, Dated 10th September, 2001 and has come into force with effect from 1st March, 2000 and 21st September 2001 respectively (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"); And whereas, in the said Development Plan, the land bearing Khasara No. 8(part), 20 (part) and 21 (part) area admeasuring about 2,0480 Ha. of Mouja Wathoda (hereinafter referred to as "the said Reserved Land") is reserved as "Site No. ME-52 Community Centre"(hereinafter referred to as "the said Reservation") and the Appropriate Authority for the said reservation is Nagpur Improvement Trust, Nagpur (hereinater referred to as "said Authority");
And whereas, the said land has not been acquired by the said authority within ten years from the date on which the said Development Plan came into force;
And whereas, the owner of the land bearing Khasara No. 21-1-B, P.H. No. 34A, C.T.S. No. 29 of Mouje Wathoda admeasuring about 0.81 Ha. (hereinafter referred to as "the said Land") more particularly de- scribed in Schedule appended hereto, out of the said reserved land, had issued a notice dated 30-09-2011 under Section 127 (1) of the said Act (hereinafter referred to as "the said Notice") to the said authority;
And whereas, even after service of the said Notice as aforesaid, the said land has not been acquired within a sitpulated period from the date of the service of the said Notice under sub-section (1) of Section 127 of the said Act, intimated by the said authority vide its letter dated 22-06-2021;
And whereas, Hon'ble High Court in Writ Petition No. 6338-2013 file by the owner of the said land, vide its order dated the 11-08-2014 held that the said reservation to the extend of the said land stands Iapsed, U/s 127 of the said Act;
And whereas, Now, it becomes expedient to notify by an order under Section 127 (2) of the said Act that the said Reservation on the said Land, in the said Development Plan has been lapsed.;
Now, therefore, in exercise of the power conferred by sub-Section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby Notifies that, the said reservation on the said land stands lapsed and the land so released shall be available to the land- owner for the purpose of Development as otherwise permissible in the case of adjacent land under the Development Plan subject to the condition by Hon'ble High Court;

The Development Plan of Umred has already been partly sanction by the Government Urban Devlopment Department Vide Resolution No. TPS-2498-287-CR-25-98-UD-9, Dated 8th July 2003 with effect from 25th August 2003 and Vide resolution No. TPS-2498-287-CR-25-98-UD-9, Dated 9th July 2005 Excluded part Development Plan which came in force with effect from 5th September 2005.
The Municipal Council Umred has proposed to make modification under Maharashtra Regional and Town Planning Act, 1966 Section 37 (1) in the aforesaid final Development Plan vide its General Committee Resolution No. 183 Dated 29 December 2021 as below.—

The Plan and reports containing the description of the above minor modification can be seen in the office of the Municipal Council during the office hours.
Now, in pursuance of Section 37 (1) of Maharashtra Regional and Town Planning Act, 1966 it is hereby notified that any person having any suggestion or objection to the proposed modification as details above shall communicate the same in writing to the undersigned within one month from the date on which this notification Publish in the Official Gazette.
The objection or suggestion if any received within the above mentioned period of one month will be considered by the Council while submitting the proposed modification to the Government for sanction.
