No. SPP-1121/859/CR-100/D-XIV.–– In exercise of the powers conferred by sub-section (8) of the Section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974) and Section 32 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act, 2012) the Government of Maharashtra, hereby appoints Advocate Pradip E. Bavaskar as "Special Public Prosecutor" for conducting the Sessions Case No. 57/2021, pending before Hon'ble Special (POCSO) Sessions Court, Ahmednagar which is arising out of C. R. No. 530/2010 registered at Pathardi Police Station, district Ahmednagar.

His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

Lump sum fees of Rs. 25,000 (Rupees Twenty Five Thousand only) as per quoted by Advocate Pradip E. Bavaskar has been already deposited by the Applicant Smt. Sarita Damale with the Government vide R.B.I. Challan No. 8496, dated 29th March 2022. The amount will be paid to Advocate Pradip E. Bavaskar after completion of the case.

The Government reserves the right to revoke / modify / annul the order without assigning any reasons.

क्रमांक नावि/प्र.ा.स./प्रा.यो. जळगाव-भुसावळ/कलम २० (४)/मौजे चाळीसगाव, तालुका चाळीसगाव/सव्र्हे नंबर ५५ व इतर/५३९/ २०२२.--- ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यात यापुढे ज्यास "उक्त अधिनियम" असे संबोधले आहे) मधील तरतुदींनुसार जळगाव जिल्ह्याची प्रादेशिक योजना (यात यापुढे ज्यास "उक्त प्रादेशिक योजना" असे संबोधले आहे ) शासनाने दिनांक १२ नोव्हेंबर १९९१ रोजी मंजूर केली असून ती दिनांक १ ेब्रुवारी १९९२ पासून अंमलात आलेली आहे; आणि ज्याअर्थी, उक्त प्रादेशिक योजनेनुसार मौजे चाळीसगाव तालुका चाळीसगाव सव्र्हे नंबर ५५, ५६ (पै.) व ७२ (पै.) मधील एकूण क्षेत्र १०.२४९४ हेक्टर, (यात यापुढे ज्यास "उक्त जमीन" असे संबोधले आहे) "शेती विभागात" समाविष्ट आहेत ;

आणि ज्याअर्थी, राज्यात मंजूर असलेल्या प्रादेशिक योजनांमध्ये उक्त अधिनियमाचे कलम २० अन्वये वेळोवेळी कराव्या लागणाया जमीन वापराच्या ेरबदलासंदर्भाने करावयाच्या कार्यपद्धतीबाबत उक्त अधिनियमाचे कलम १५४ अन्वये शासन निर्णय क्रमांक टीपीएस-१८१५/प्र. क्र. ४९/१५/नवि-१३, दिनांक ६ मे २०१५ व दिनांक ४ जानेवारी २०१६ अन्वये शासनाने निर्देश दिलेले आहेत (यात यापुढे ज्यास "उक्त शासन निर्णय" असे संबोधले आहे) व त्या अनुषंगाने शासनाने "प्रस्ताव ाननी समिती " गठित केली आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाचे कलम २०, पोट-कलम (२) मधील तरतुदींनुसार उक्त जमिनी "शेती विभागातून" वगळून, खालील अटींच्या अधीन राहून, "रहिवास विभागात" समाविष्ट करण्याचे प्रस्तावित असून त्याअनुषंगाने उक्त प्रादेशिक योजना सुधारित करणे आवश्यक आहे (यात यापुढे ज्यास "उक्त ेरबदल" असे संबोधले आहे) असे उक्त शासन निर्णयान्वये गठित "प्रस्ताव ाननी समितीचे" मत झाले आहे.

(१) शासनाच्या दिनांक ४ जानेवारी २०१६ च्या निर्णयात नमूद तरतुदींनुसार अधिमूल्य रक्कम भरणे बंधनकारक राहील.

(२) उक्त शासन निर्णयात व त्यासोबतच्या सहपत्रात नमूद केलेल्या मार्गदर्शक सूचनांनुसार, सदर जमिनींचा विकास करणे बंधनकारक राहील.

(३) सदरची परवानगी म्हणजे मालकीहक्काबाबत प्रमाणीकरण नाही. ेरबदल प्रस्तावाखालील जमिनींच्या मालकीहक्काबाबत सर्वस्वी अर्जदार यांची जबाबदारी राहील.

(४) विषयांकित जमिनींमध्ये विकसन करण्यापूर्वी सदर जमिनी वनसोंमध्ये येत नाहीत, याबाबत वन विभागाकडून 'ना-हरकत दाखला' घेणे आवश्यक राहील.

(५) विषयाधीन जमिनीचे विकसन करताना १५ टक्के क्षेत्र "सार्वजनिक सुविधांसाठी" प्रस्तावित करणे आवश्यक आहे.

(६) विषयाधीन जमिनीचे विकसन करताना व विकासपश्चात तेथील पाणीपुरवठा, सांडपाणी व्यवस्था, घनकचरा विल्हेवाट / व्यवस्थापन यांकरिता योग्य ती स्वयंपूर्ण व्यवस्था अर्जदार यांनी करणे आवश्यक आहे.

(७) , (पाण्याचा पुनर्वापर) व अशा स्वरूपाच्या संकल्पना सदर जमिनीचे विकसन करताना अंमलात आणण्यात याव्यात.

(८) विषयाधीन जमिनीवर अर्जदार / विकसनकत यांनी विकसन करताना प्रती हेक्टरी २५० वृक्ष लावणे बंधनकारक राहील. तसेच विकसित रेखांकनातील भूखंडधारकाने भूखंडात ५ वृक्ष लावणे बंधनकारक राहील. सदरची बाब विकसनास अंतिम मंजुरी देताना पडताळणी करण्यात यावी.

(९) जागेत बांधकाम करणेपूर्वी सार्वजनिक बांधकाम विभागाची परवानगी घेणे तसेच त्यांच्या अटींचे पालन करणे बंधनकारक आहे ;

(१०) जर अभिन्यासात समूह गृहबांधणी योजना विकसित करावयाची असेल, तर जागेत सर्व मूलभूत सुविधा विकसित झाल्याशिवाय भोगवटा प्रमाणपत्र देण्यात येणार नाही.

(११) सदर जमिनींवरील अभिन्यासातील भूखंड / सदनिका यांची विक्री खालील तक्त्यानुसार करणे बंधनकारक राहील.

तक्ता

अभिन्यासातील भूखंड / सदनिका यांची सुविधांच्या विकसनाची सांगड

(अ) अभिन्यास अंतिमत: मंजूर झाल्यावर .. एकूण २५ टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(ब) सुमारे ४० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण ५० टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(क) सुमारे ६० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण ७५ टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(ड) सुमारे ८० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण ९० टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(इ) सुमारे १०० टक्के मूलभूत सुविधा पूर्ण झाल्यावर .. एकूण १०० टक्के भूखंड / सदनिका विक्री अनुोय राहील.

(१२) प्रस्तावित विंधन विहीर व विहीर खोदल्यानंतर त्यातील आवक व पाणी गुणवत्ता तपासून व गरजेनुसार आवश्यक त्या प्रमाणात शुद्ध पाण्याची व्यवस्था अर्जदाराने प्रत्यक्ष विकासापूर्वी करणे आवश्यक आहे.

(१३) सदरचा प्रस्ताव हा एकूण १०.२४९४ हेक्टर इतक्या क्षेत्राकरिता करण्यात येत आहे.

(१४) १:५ पेक्षा जास्त तीव्र उतारावर विकसन अनुोय राहणार नाही.

आणि ज्याअर्थी, शासनाने उक्त अधिनियमाचे कलम १५१, पोट-कलम (१) अन्वये शासन निर्णय क्रमांक टीपीएस-१८१५/प्र. क्र. ४९/१५/ नवि-१३, दिनांक ११ जून २०१५ नुसार कलम २० (२), २० (३) व २० (४) खालील अधिकार विभागीय सहसंचालक, नगररचना यांना प्रदान केलेले आहेत ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम २० चे पोट-कलम (३) च्या तरतुदींनुसार सहसंचालक, नगररचना, नाशिक विभाग, नाशिक यांनी सूचना क्रमांक नावि/प्र.ा.स./प्रा.यो. जळगाव-भुसावळ/कलम-२० (४)/मौजे चाळीसगाव, तालुका चाळीसगाव/स.नं. ५५ व इतर /१०९४, दिनांक १४ ऑक्टोबर २०२१ अन्वये उक्त प्रस्तावित ेरबदलाबाबत सर्व संबंधितांकडून विहित मुदतीत सूचना/हरकती दाखल करणायांना सुनावणी देण्याकरिता व त्यावरील अहवाल सादर करण्यासाठी सहायक संचालक, नगररचना, जळगाव शाखा, जळगाव यांना प्राधिकृत करण्यात आले होते ;

आणि ज्याअर्थी, प्राधिकृत अधिकारी तथा सहायक संचालक, नगररचना, जळगाव यांनी वैधानिक कार्यवाही पूर्ण करून त्यांचा अहवाल सदस्य- सचिव यांचेकडे सादर केला आहे. तसेच कलम २० (३) च्या अधिसूचनेतील अट क्रमांक ११ नुसार मुख्य अभियंता, तापी पाटबंधारे विकास महामंडळ, जळगाव यांनी सदर प्रकरणी त्यांचा अहवाल सदस्य सचिव यांचेकडे सादर केला आहे. प्रस्ताव ाननी समितीच्या दिनांक ११ मार्च २०२२ रोजीच्या बैठकीत अर्जदार यांनी अधिमूल्य रक्कम जमा केल्यानंतर कलम २० (४) ची अंतिम अधिसूचना निर्गमित करण्यास मान्यता देण्यात आली आहे. त्यानुसार अर्जदार यांनी अधिमूल्य रकमेचा भरणा केला आहे.

आता त्याअर्थी, याबाबतीत शासनाने प्रदान केलेल्या उक्त अधिकारांनुसार उक्त अधिनियमाच्या कलम २०, पोट-कलम (४) अन्वये उक्त ेरबदलास पुढीलप्रमाणे मंजुरी देत आहे व त्यासाठी उक्त प्रादेशिक योजना मंजुरीची दिनांक १२ नोव्हेंबर १९९१ रोजीची अधिसूचना सुधारित करण्यात येत आहे.

जळगाव जिल्ह्याच्या मंजूर प्रादेशिक योजनेतील मौजे चाळीसगाव, तालुका चाळीसगाव सव्र्हे नंबर ५५, ५६ (पै.) व ७२ (पै.) मधील एकूण क्षेत्र १०.२४९४ हेक्टर जमिनींचा वापर सोबतच्या भाग नकाशात दर्शविल्यानुसार खालील अटींच्या अधीन राहून "शेती विभाग" ऐवजी "रहिवास विभाग" असा बदलण्यात येत आहे.

अटी :

(१) उक्त शासन निर्णयात व त्यासोबतच्या सहपत्रात नमूद केलेल्या मार्गदर्शक सूचनांनुसार, सदर जमिनींचा विकास करणे बंधनकारक राहील.

(२) सदरची परवानगी म्हणजे मालकीहक्काबाबत प्रमाणीकरण नाही. ेरबदल प्रस्तावाखालील जमिनींच्या मालकीहक्काबाबत सर्वस्वी अर्जदार यांची जबाबदारी राहील.

(३) विषयांकित जमिनींमध्ये विकसन करण्यापूर्वी सदर जमिनी वनसोंमध्ये येत नाहीत, याबाबत वन विभागाकडून 'ना-हरकत दाखला' घेणे आवश्यक राहील.

उक्त मंजूर ेरबदल दर्शविणारा नकाशा नागरिकांच्या अवलोकनार्थ खालील कार्यालयांत कामकाजाच्या दिवशी कार्यालयीन वेळेत उपलब्ध राहील.

The Maharashtra Regional and Town Planning Act, 1966

NOTIFICATION

No. NKDN/P.S.C./R.P. Jalgaon/Section 20 (4)/Mouje Chalisgaon, taluka Chalisgaon / Survey No. 55 and others/339/2022.– Whereas, the Government has sanctioned the Revised Regional Plan for Jalgaon district on dated 12th November 1991 (hereinafter referred to as " the said Regional Plan") under the provisions of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act") and has came into force with effect from 1st February 1992 and whereas, in the said Regional Plan, the land admeasuring about 10.2494 hectares bearing S. Nos. 55, 56 (Pt.), and 72 (Pt.) Mouje Chalisgaon, taluka Chalisgaon, district Jalgaon (hereinafter referred to as " the said land") is included in "Agriculture Zone";

and whereas, the Government vide it's Resolution No. TPS-1815/CR-49/15/UD-13, dated 6th May 2015 and dated 4th January 2016 (hereinafter referred to as "the said Government Resolution") has issued the directives under Section 154 of the said Act, regarding the procedure to be followed under Section 20 of the said Act, for making changes in the use of land in the areas of Sanctioned Regional Plans, and for that purpose constituted "Proposal Scrutiny Committee";

and whereas, the "Proposal Scrutiny Committee" constituted under the said Government Resolution, is of the opinion that the said land shall be deleted from "Agriculture Zone" and proposed to be included in "Residential Zone", and accordingly it is necessary to the modify the said Regional Plan (hereinafter referred to as "the said Modification") in accordance with the provisions of sub-section (2) of Section 20 of the said Act, subject to the following conditions :

(1) It shall be binding to deposit the premium amount as mentioned in Government Resolution, dated 4th January 2016.

(2) It shall be binding to develop the said land as per the guidelines mentioned in the said Government Resolution and Annexure with it.

(3) This permission does not confirm ownership of the said land. The Applicant will be completely responsible regarding any issue about ownership of the said land.

(4) It shall be binding to get "No Objection Certificate" from the Forest Department prior to development of the said land.

(5) While developing the said land it shall be binding to provide 15 per cent Amenity Space.

(6) Applicant / Developer shall make necessary self-contained arrangements to provide Water Supply, Waste Water Treatment, Solid Waste Disposal / Management while developing the said land and after development of the said land at his own cost.

(7) It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and Solar Energy while developing the said land.

(8) It shall be binding on Applicant / Developer to plant 250 trees per hectare, while developing the land and Plot holder of sanctioned layout to plant 5 trees per plot. This shall be verified at the time of final sanction to development.

(9) It shall be binding to obtain permission from Public Works Department before construction in the said land and to follow their conditions.

(10) If the Group Housing Scheme is proposed in the layout then, Occupancy Certificate shall not be issued unless all the basic amenities are fully developed in the said land.

(11) It shall be binding to sale layout plot of the said land as per table given below.

(a) After sanction of final layout .. Sale of 25 per cent of the total Plots / Flats

shall be permissible.

(b) After approximate 40 per cent .. Sale of 50 per cent of the total Plots / Flats development of basic infrastructure. shall be permissible.

(c) After approximate 60 per cent .. Sale of 75 per cent of the total Plots / Flats development of basic infrastructure. shall be permissible.

(d) After approximate 80 per cent .. Sale of 90 per cent of the total Plots / Flats development of basic infrastructure. shall be permissible.

(e) After approximate 100 per cent .. Sale of 100 per cent of the total Plots / Flats development of basic infrastructure. shall be permissible.

(12) It shall be binding on the Applicant to check the quality of water after digging the Borewell or the open Well and to make proper arrangment to provide pure water before the development of the land.

(13) The said notification is published for land area of 10.2494 Ha. in the said proposal.

(14) Development will not be allowed on the slope more than 1:5.

and whereas, as per the provision of sub-section (1) of Section 151 of the said Act, Government vide Notification No.TPS-1815/CR-49/15/UD-13, dated 11th June 2015 has delegated the powers under Sections 20 (2), 20 (3) and 20 (4) of the said Act to the concerned Joint Director of Town Planning ;

and whereas, in accordance with the provisions of sub-section (3) of Section 20 of the said Act, Joint Director of Town Planning, Nashik Division, Nashik vide Notice No. NKDN/P.S.C./R.P. Jalgaon-Bhusawal/ Section 20 (3)/Mouje Chalisgaon, taluka Chalisgaon/S. No. 55 and other/1094, dated 14th October 2021७ महाराष्ट्र शासन राजपत्र, भाग एक -------- नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार, एप्रिल २८ ते मे ४, २०२२ / वैशाख ८ - १४, शके १९४४ has published, the Notice regarding the Proposed Modification and Assistant Director of Town Planning, Jalgaon Branch, Jalgaon was Appointed to hear the suggestions / objections received within the stipulated period ;

and whereas, the Appointed Officer has submitted his report to the Member-Secretary as mentioned in condition No. 11 of notification under Section 20 (3) the Chief Engineer, Tapi Irrigation Project Authority, Jalgaon Irrigation Department has submitted his report to the Member-Secretary also the Proposal Scrutiny Committee, in the meeting, dated 11th March 2022 accorded approval to this proposal and directed Member-Secretary to issue the Final Notification according to sub-section (4) of Section 20, after the payment of the premium by the Applicant. Accordingly, the Applicant has deposited the premium amount.

Now, therefore, in exercise of the powers conferred by sub-section (4) of Section 20 of the said Act, Joint Director of Town Planning, Nashik Division, Nashik hereby sanctions the said Modification and for that purpose amends the aforesaid Notification, dated 12th November 1991 as follows.

In the said Regional Plan, the following new Entry shall be added after the last entry of the Schedule of Modifications.

ENTRY

In the Sanctioned Regional Plan of Jalgaon district the allocation of the land admeasuring about 10.2494 hectares bearing S. Nos. 55, 56 (Pt.), and 72 (Pt.) Mouje Chalisgaon, taluka Chalisgaon, district Jalgaon is changed from "Agriculture Zone" (No Development Zone) to "Residential Zone" as shown on the Plan, subject to the following conditions.

Conditions :

(1) It shall be binding to develop the said land as per the guidelines mentioned in the said Government Resolution and Annexure with it.

(2) This permission does not confirm ownership of the said land. The Applicant will be completely responsible regarding any issue about ownership of the said land.

(3) It shall be binding to get "No Objection Certificate" from the Forest Department prior to development of the said land.

(4) While developing the said land it shall be binding to provide 15 per cent Amenity Space.

(5) Applicant / Developer shall make necessary self-contained arrangements to provide Water Supply, Waste Water Treatment, Solid Waste Disposal / Management while developing the said land and after development of the said land at his own cost.

(6) It shall be necessary to develop the concept like Rainwater Harvesting, Water Recycling and Solar Energy while developing the said land.

(7) It shall be binding to Applicant / Developer to plant 250 trees per hectare, while developing the land and Plot holder of sanctioned layout to plant 5 trees per plot. This shall be verified at the time of final sanction to development.

(8) It shall be binding to obtain permission from Public Works Department before construction in the said land and to follow their conditions ;

(9) If the Group Housing Scheme is proposed in the layout then, Occupancy Certificate shall not be issued unless all the basic amenities are fully developed in the said land;

(10) It shall be binding to sale layout plots / flats of the said land as per table given below.

(12) The said notification is published for land area of 10.2494 Ha. in the said proposal.

(13) Development will not be allowed on the slope more than 1:5.

आणि ज्याअर्थी, अहमदनगर जिल्ह्याचे जिल्हाधिकारी यांनी कलम १५ च्या पोट-कलम (२) अन्वये दिलेला अहवाल, कोणताही असल्यास, विचारात घेतल्यानंतर, उक्त सार्वजनिक प्रयोजनासाठी उक्त जमिनी संपादित करण्याची आवश्यकता आहे याबाबत त्यांची खात्री पटली आहे ;

आणि म्हणून उक्त अधिनियमाच्या कलम १९ च्या पोट-कलम (१) च्या तरतुदींन्वये उक्त सार्वजनिक प्रयोजनासाठी उक्त जमिनींची आवश्यकता आहे, असे याद्वारे घोषित करण्यात येत आहे ;

आणि ज्याअर्थी, अनुसूची " तीन " मध्ये अधिक तपशीलवार वर्णन केलेले क्षेत्र हे बाधित कुटुंबीयांच्या पुनर्वसन व पुनर्वसाहतीच्या प्रयोजनासाठी " पुनर्वसाहत क्षेत्र " म्हणून निरंक निर्धारित केले असल्याचे याद्वारे घोषित केले जात असून, पुनर्वसन व पुनर्वसाहत योजनेचा सारांश अनुसूची " चार " मध्ये निरंक विनिर्दिष्ट केला आहे ;

प्राप्त झालेल्या अधिकारांचा वापर करून धुळे जिल्ह्याच्या हद्दीत कोणत्याही

इसमास खालील कृत्ये करण्यास याद्वारे मनाई करीत आहे.

सार्वजनिक प्रयोजनाच्या स्वरूपाबाबत विवरण

प्रकल्पाचे नाव : उध्र्व प्रवरा प्रकल्प (निळवंडे-२) उजवा कालवा, तालुका अकोले व तालुका संगमनेर, जिल्हा अहमदनगर.

प्रकल्पाच्या कामाचे वर्णन : उध्र्व प्रवरा उजवा कालवा या प्रकल्पासाठी मातीकाम आणि बांधकामासाठी मौजे धुमाळवाडी, तालुका अकोले व मौजे निमगाव बु, तालुका संगमनेर, जिल्हा अहमदनगर येथील भूसंपादन.

समाजाला होणारे लाभ : उध्र्व प्रवरा प्रकल्प (निळवंडे-२) उजवा कालवा अंतर्गत येणाया गावातील जमिनींना व पिण्यासाठी पाणीपुरवठा (आर्थिक, रोजगार, पायाभूत सुविधा, सोयीसुविधा याबाबत व इतर लाभांसंबंधात).

(१) रस्त्यावरील किंवा रस्त्याने जाणाया मिरवणुकीतील किंवा जमावातील लोकांनी गैररीतीने चालणे व गैरशिस्त वर्तणूक करण्यास मनाई आहे ;

(२) कोणत्याही मिरवणुका ठरविलेल्या मार्गाव्यतिरिक्त मार्गाने नेण्यास मनाई आहे ;

(३) सर्व मिरवणुकींच्या, जमावाच्या प्रसंगी व प्रार्थना स्थळाचे आसपास प्रार्थनेच्या वेळी कोणत्याही रस्त्यावरील किंवा सार्वजनिक जागी किंवा लोकांच्या एकत्र जमण्याच्या जागी गर्दी करण्यास किंवा अडथळा निर्माण करण्यास मनाई आहे ;

(४) सर्व रस्त्यांवर, रस्त्यांमध्ये, घाटात किंवा घाटांवर, सर्व धक्क्यांवर किंवा धक्क्यांमध्ये आणि सार्वजनिक स्नानाच्या उतरण्याच्या जागांच्या

अनुसूची - तीन

पुनर्वसाहत क्षेत्राचे वर्णन : निरंक.

ठिकाणी व जागांमध्ये जत्रा, देवालय, मशिद, दर्गा आणि सार्वजनिक किंवा लोकांच्या जाण्या-येणाच्या जागांमध्ये गोंधळ व बेशिस्तपणे वर्तन करण्यास सक्त मनाई आहे ;

अनुसूची - चार

पुनर्वसन व पुनर्वसाहत योजनेचा सारांश : लागू नाही.

टीप.-- उक्त जमिनींच्या नकाशाचे उपविभागीय अधिकारी, संगमनेर भाग, संगमनेर यांच्या कार्यालयामध्ये निरीक्षण करता येईल.

(५) कोणत्याही रस्त्यात किंवा रस्त्याजवळ किंवा सार्वजनिक ठिकाणी अनियमित व विनापरवाना वा वाजविण्यास, गाणे म्हणण्यास ढोल, ताशे वाजविण्यास, कर्कश वा वाजविण्यास मनाई आहे ;
