BY DIRECTOR OF TOWN PLANNING
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No. D.T.P.-D.P.Pusad (R)-Sec-127(2)-Notification-TPV-VI-2183.—
Whereas, the Development Plan of Pusad Municipal Council (Revised) has been partly sanctioned under the provisions of Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the Said Act") by the Government in Urban Development Department vide its Notification No. TPS-2795- 1267-CR-198-95-UD-13, dated 26-05-1998 (hereinafter referred to as " the said Notification ") and came into force with effect from dated 26-07-1998 (hereinafter referred to as " the said Sanctioned Development Plan ") ;
And whereas, in the said Sanctioned Development Plan, the lands bearing S. No. 6 pt. and 8 pt. of Mauza Pusad are affected by the Reservation Site No. 20 "Garden" approximate area 0.69 Ha. (hereinafter referred to as " the said Reservation ") for which Appropriate Authority for the acquisition and development of the said Reservation for the acquisition and development of the said Reservation is Municipal Council, Pusad ((hereinafter referred to as " the said Appropriate Authority ") ;
And whereas, the land under said Reservation has not been auquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Development Plan came into force ;
And whereas, the concerned land owner (hereinafter referred to as " the said land owner ") of the land bearing New S. No. 17 (Part) [As per Cross reference Table of Land record Office, Orignal S. No. 8 (Part) [Old S. No. 118 (Part)] of Mouza Pusad having an area 0.235 Ha. (2350 Sq. mt.) affected by the said reservation (hereinafter referred to as " the said land ") had served a notice under Section 127(1) of the said Act (hereinafter referred to as " the said Notice ") on the said Appropriate Authority on 02-05-2019 ;
And whereas,the said land under the said Reservation is not acquired or no steps as required under Section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice by the said land owner ;
And whereas, the Chief Officer, Municipal Council, Pusad has submitted the proposal vide letter No. 251/2021 dated 10-08-2021 as per the Resolution No. 32, dated 24-02-2021 of the General Body Meeting of Municipal Council, Pusad ;
And whereas, the Assistant Director of Town Planning, Yavatmal Branch, Yavatmal has submitted report vide No. 1534, dated 14-10-2021 that, area admeasuring 0.455 Ha. out of total area 0.69 Ha. of the said Reservation has been lapsed previousdly vide Directorate's Order No. 30, dated 03-01-2018 and now, the remaining area of the Reservation admeasuring 0.2350 Ha. has to be lapsed in respect to the said Notice ;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 102, dated 24-01-2022, has submitted report informing therein that, said Reservation is to be lapsed from the said land as mentioned in the proposal of the Municipal Council and the report of Assistant Director of Town Planning. Yavatmal Branch, Yavatmal, for taking decision about issuing the notification under Section 127 (2) of the said Act to be issued at Directorate level;
And whereas, after considering the above facts in respect of the said Reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127 (2) of the said Act, regarding the lapsing of the said Reservation on the said land ;
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्ध ५-११, २०२२/म् १५-२१, ॅ १९४४And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolu- tion No. TPS-1813-3211-CR-508-UD-13, dated 01-12-2016, has delegated the powers exercisable by it under Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagpur Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land under Section 127 (2) of the said Act and for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows—
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added :—

Note :- 1. The said land so released from the said Reservation shall become available to the said land owners for the purpose of Development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
2. A Copy of the part plan of the said Sanctioned Development Plan showing the part area of the said land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Pusad, District Yavatmal during office hours on all working days for inspection to public upto one month.
3. This Order shall also be published on the Directorate's official website www.dtp. maharashtra.gov.in. Pune :
