महाराष्ट्र धारि जकमनींचे तुकडठे पाडणयास प्कतबंध करणयाबाबत व तयांचे एकत्ररीकरि करणयाबाबत अकधकनयम, १९४७.

क्रमांक एकहत्-२०२१-प्र.क्र.७४-ल-१.— मिाराष्ट्र धारण जहमनीचे तुकडे पाडणयास प्रहतबंध करणयाबाबत व तयांचे एकत्ीकरण करणयाबाबत अहधहनयम (सन १९४७ चा ६२) याचया कलम ४ चया पोट-कलम (२) व कलम ५ चया पोट-कलम (२) द्ारे प्रदान करणयात आलेलया अहधकारांचा वापर करून मिाराष्ट्र शासन हजलिा सललागार सहमतयांसोबत हवचारहवहनमय करून आहण यापूववी यासंदभा्गत हनग्गहमत करणयात आलेलया सव्ग अहधसूचना अंशत: सुधाररत करून, याद्ारे,—

(१) मिानगरपाहलका व नगरपाहलका यांचया िद्ी वगळता, उकत कलम ४ चया पोट-कलम (१) अनवये मिाराष्ट्र शासन सोबतचया अनुसूचीतील सतंभ-४ मधील तातपुरते हनधा्गररत केलेले क्ेत्, सतंभ -३ मधील जहमनीचया प्रकारांकररता, सतंभ-२ मधील स्ाहनक क्ेत्ासाठी, हकमान क्ेत् मिणून घोहित करीत आिे, आहण

(२) याकरीता आक्ेप/िरकती मागहवणयात येत असून यासंदभा्गतील आक्ेप/िरकती या, िी अहधसूचना राजपत्रात प्रहसधद झालयाचया हदनांकापासून तीन महिनयांचया आत अपपर मुखय सहचव, (मिसूल, मुदांक व नोंदणी), मिसूल व वन हवभाग, मादाम कामा माग्ग, िुतातमा राजगुरू चौक, मंत्ालय, मु ंबई ४०० ०३२ यांचयाकडे पाठहवणयात यावयात.

Maharashtra Prevention of fragMentation and Consolidation of holdings aCt, 1947.

No.Ektri-2021/C.R.74/L-1.– In exercise of the powers conferred by sub-section (2) of section 4 read with sub-section (2) of section 5 of the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act (LXII of 1947) and in partial modification of all earlier notifications issued in this behalf, the Government of Maharashtra after consultation with concerned District Advisory Committee hereby,–

(i) publishes the area specified in column (4) of the Schedule appended hereto as the minimum area which the Government of Maharashtra has provisionally settled under sub-section (1) of the said section 4 for the class of land specified in the column (3) thereof in the local areas specified in column (2) thereof, excluding the areas comprised in the municipal limits of all the Municipal Corporations and Municipal Councils; and

(ii) invites objections thereto, which shall be forwarded to the Additional Chief Secretary (Revenue, Stamp and Registration), Revenue and Forest Department, Mantralaya , Madam Cama Marg, Hutatma Rajguru Chowk, Mumbai 400 032, within 3 months from the date of publication of this notification in the Maharashtra Government Gazette.

आदेश

महाराष्ट्र प्ादेकशक कनययोजन व नगर रचना अकधकनयम, १९६६.

क्रमांक आयडीसी २०२१/प्र.क्र. १९२/उ-१४.—जयाअ्वी, मिाराष्ट्र औद्ोहगक हवकास अहधहनयम, १९६१ चया कलम ४३ चया खंड (१ब) वदारे प्रदान करणयात आलेलया अहधकारांचा वापर करून मिाराष्ट्र औद्ोहगक हवकास मिामंडळाने (यात यानंतर जयाचा उललेख "उकत मिामंडळ" असा करणयात आला आि े) काढलेलया अहधसूचना क्र. मऔहवम/आय.आय.ए.(लॉहजससटक पाक्क)/ डी२२३२९/२०२१, हदनांक १४ जुलै २०२१ वदारे "एकासतमक औद्ोहगक क्ेत्" (एकासतमक लॉहजससटक पाक्क) (यात यानंतर जयाचा उललेख "उकत आयएलपी" असा करणयात आला आिे) मिणून, मे. आववी कोलड चैन लॉहजससटक प्रा. हल. (यात यानंतर जयाचा उललेख "उकत हवकासक" असा करणयात आला आिे.) यांचयाकडून हवकहसत करणयात येत असलेलया रायगड हजलह्ातील उरण तालुकयाचया कोप्रोली गावामधील एकूण २.७१३ िे.आर इतके क्ेत् (यात यानंतर जयाचा उललेख उकत क्ेत् असा करणयात आला आिे) अहधसूहचत केलेले आिे ;

आहण जयाअ्वी अशी अहधसूचना काढणयात आलयानंतर मिामंडळ िे, मिाराष्ट्र प्रादेहशक व नगर रचना अहधहनयम, १९६६ (यात यानंतर जयाचा उललेख "उकत अहधहनयम" असा करणयात आला आिे) अनवये, उकत "आयएलपी" यासाठी "हवशेि हनयोजन प्राहधकरण" झालेले आिे ;

आहण जयाअ्वी, शासन हनण्गय उद्ोग, ऊजा्ग व कामगार हवभाग क्रमांक आयडीसी २०१८/प्र.क्र. १३५/उद्ोग-२, हदनांक २७ ऑगसट २०१९ वदारे मिाराष्ट्र शासनाने "आयएलपी" चया हवकासासंबंधीची काय्गपधदती हविीत करणयात आलेली आि े ;

आहण जयाअ्वी, उकत अहधहनयमाचया कलम १५१ चया पोट-कलम (१) अनवये प्रदान करणयात आलेलया अहधकारांनुसार खाजगी जहमनीवरील "एकासतमक औद्ोहगक क् ेत्" (एकासतमक लॉहजससटक पाक्क) चया संबंहधत, उकत अहधहनयमाचया कलम ४०, पोट-कलम (३) चया खंड (ड) चया उप खंड (१) अनवये हनयोजन प्रसताव मंजूर करणयाचा अहधकार, शासकीय अहधसूचना नगर हवकास हवभाग क्रमांक टीपीबी ४३१७/प्र.क्र. ५४/२०१७/नहव-११, हदनांक २ जून २०१७ वदारे प्रधान सहचव (उद्ोग) यांना प्रदान करणयात आला आिे ;

आहण जयाअ्वी, उकत मिामंडळाने उकत अहधहनयमाचया कलम ४० मधये तसेच कलम ११५ चया पोट-कलम (२) मधये हनधा्गररत केलेली काय्गपधदती पार पाडलेली आि े आहण राजय शासनाकडे तयाचया मंजुरीसाठी बृित आराखडा प्रसताव सादर केला आि े;

तयाअ्वी, आता उकत अहधहनयमाचया कलम ४० चया पोट-कलम (३) चा खंड (ड) तसेच कलम ११५ चे पोट-कलम (३) यावदारे प्रदान करणयात आलेलया अहधकारांचा आहण याबाबत तयास सम्गन करणाऱया इतर सव्ग अहधकारांचा वापर करून, अपर मुखय सहचव (उद्ोग), उद्ोग, ऊजा्ग व कामगार हवभाग यावदारे, आराखड्ावर दश्गहवणयात आलयाप्रमाणे, उकत क्ेत्ाचया बृित आराखडा प्रसतावाला पुढील शतवीचया अहधनतेने मंजुरी देत आिे : —

(१) जहमनीचा वापर, सोई-सुहवधांचया जागा, मोकळया जागा, रसतयाचे सवरुप यासारखया सदर मंजुरी केवळ प्रसताहवत प्रसतावांसाठी आिे.

(२) मिाराष्ट्र औद्ोहगक हवकास मिामंडळाचया आयएलपी हवकास हनयंत्ण हनयमावलीनुसार, मिाराष्ट्र औद्ोहगक हवकास मिामंडळाकडून हवनयास/बांधकामाचा आराखडा अंतग्गत प्रवेश माग्ग, तलपृष्ठ हनददेशांक, वािनतळ वयवस्ा इतयादींची सखोल छाननी करणयात यावी.

(३) मिाराष्ट्र प्रदूिण हनयंत्ण मंडळाने नमूद केलेलया शतवी आहण संबंहधत प्राहधकरणाकडील पया्गवरण हवियक परवानगी (लागू असलयास) बंधनकारक रािील.

(४) बांधकाम आराखड्ाला मंजुरी देताना, उकत हवकासक साव्गजहनक बांधकाम हवभाग, मिाहवतरण (म.रा.हव.म.) इतयादी हवभागांकडून जे्े जे्े आवशयक असेल ते्े ते्े ना- िरकत प्रमाणपत् घेईल.

(५) प्रसताहवत सोई-सुहवधांची जागा आहण मोकळी जागा यामधये करणयात येणारे वापर मिाराष्ट्र औद्ोहगक हवकास मिामंडळाचया आयएलपी हवकास हनयंत्ण हनयमावलीचया आवशयकतेनुसार असतील.

(६) उकत हवकासक, भूहम अहभलेख हवभागाकडील, हनयोजन प्रसतावानुसार सीमांकन आराखडा प्रापत करील.

(७) उकत अहधहनयमाचया कलम ४० चया पोट-कलम (३) चा खंड (ड) तसेच कलम ११५ चे पोट-कलम (३) यानवये मानयता हमळालयाचया हदनांकापासून प्रसताव तातकाळ अंमलात येतील.

(८) हवना परवागनी बांधकामाकररता प्रशमन शुलक (Compounding Charges) आकारणयाबाबत म. औ. हव. मिामंडळाने हदनांक १० जानेवारी २०२२ रोजीचे धोरण लागू रािील.

हनयोजन प्रसताव दश्गहवणारा आराखडा सामानय जनेतचया हनरीक्णासाठी मिाराष्ट्र औद्ोहगक हवकास मिामंडळाचया काया्गलयांमधये काया्गलयीन वेळेत उपलबध करून देणयात येईल.

Order

Maharashtra regional and town Planning aCt, 1966.

No. IDC 2021/C.R. 192/IND-14.—Whereas, Maharashtra Industrial Development Corporation (hereinafter referred to as the said Corporation) vide Notification No. MIDC/IIA(Logistic Park)/D-22329/2021 dated the 14th July 2021 issued in exercise of powers conferred by clause (1B) of section 43 of the Maharashtra Industrial Development Act, 1961 has notified total area of 2.713 Hectare are from village Koproli of Taluka Uran in District Raigad (hereinafter referred to as 'the said Area') for being developed by M/s. AARVEE COLD CHAIN LOGISTICS PRIVATE LIMITED. (hereinafter referred to as 'the said Developer') to be an' Integrated Logistic Park (hereinafter referred to as 'the said ILP') ;

And whereas upon such notification, the Corporation has become the 'Special Planning Authority' for the said ILP under the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'the said Act') ;

And whereas, the Government of Maharashtra vide Government Resolution, Industry, Energy and Labour Department No.IDC/2018/C.R. 135/Industry-2, dated the 27th August, 2019 has laid down the procedure regarding development of the ILP ;

And whereas, in pursuance of the powers conferred under sub-section (1) of section 151 of the said Act, the power to approve Planning Proposals under sub-clause (1) of clause (d) of sub-section (3) of section 40 of the said Act regarding Integrated 'Industrial Area' (Integrated Logistic Park) on private lands has been delegated to Principal Secretary (Industries) vide Government Notification, Urban Development Department No. TPB 4317/CR-54/2017/UD-11, dated the 2nd June 2017 ;

And whereas, the said corporation has completed the procedure laid down in section 40 read with sub-section (2) of section 115 of the said Act and submitted the Master Plan proposal to the State Government for its approval.

Now therefore, in exercise of the powers conferred by clause (d) of sub-section (3) of section 40 read with sub-section (3) of section 115 of the said Act and of all other powers enabling him in this behalf, the Additional chief Secretary (Industries) of Industry, Energy and Labour Department hereby grant approval to the Master Plan proposal of the said Area as shown on plan, subject to following conditions, namely :—

(1) This sanction is only for the planning proposals like proposed land use, amenity spaces, open spaces, road pattern.

(2) Detailed scrutiny of layout/building plans, internal means of access, FSI, parking etc. should be done by MIDC according to MIDC's ILP DCR.

(3) Conditions mentioned by MPCB (Maharashtra Pollution Control Board) and Environmental Clearance from the respective authority shall be binding (if applicable).

(4) While sanctioning building plans, the said Developer shall take NOC from PWD, Mahavitaran (MSEB) etc. Departments wherever necessary.

(5) Users provided in proposed amenity space and open space shall be as per requirement of MIDC's ILP DCR.

(6) The said developer shall obtain demarcation plan as per planning proposals from the land record department.

(7) The proposals shall immediately came into effect from date of approval under clause (d) if sub-section (3) of section 40 read with sub-section (3) of section 115 of the said Act. (8) Compounding Charges will be applicable to Unauthorized construction as per Maharashtra Industrial Development Corporation dated 10th January 2022 Policy.

The plan showing the planning proposal shall be made available for inspection for general public during office hours in offices of MIDC.
