(cid:312).आयडीसी २०१६/((cid:332).(cid:312).५४१)/उ(cid:464)ोग १४.— (cid:249)याअथ(cid:559), अनुसूचीत उ(cid:269)लेिखले(cid:269)या (cid:550)े(cid:327)ात महारा(cid:273)(cid:322) औ(cid:464)ोिगक िवकास अिधिनयम, १९६१ (१९६२ चा महा. तीन) चे (cid:332)करण सहा, जे अिधसूचना (cid:312)मांक आयडीसी २१८९/(१२२८०)/उ(cid:464)ोग १४, िदनांक ९ जून १९८९ अ(cid:261)वये महारा(cid:273)(cid:322) शासनाने सदर अिधसूचने(cid:247)या अनुसूचीत उ(cid:269)लेिखले(cid:269)या (cid:550)े(cid:327)ात महारा(cid:273)(cid:322) औ(cid:464)ोिगक िवकास अिधिनयम, १९६१ (सन १९६२ चा महारा(cid:273)(cid:322) अिधिनयम तीन) चे कलम सहा, िदनांक २३ जून १९८९ रोजी अंमलात आणले होते व उ(cid:242)त अिधिनयमा(cid:247)या आधारे मौजे गडिहं(cid:244)लज, तालुका गडिहं(cid:244)लज, िज(cid:269)हा को(cid:269)हापूर येथील उ(cid:242)त अनुसूचीत नमूद क(cid:577)लेले (cid:550)े(cid:327) अिधिनयमा(cid:247)या कलम २, खंड (ग) अ(cid:261)वये औ(cid:464)ोिगक (cid:550)े(cid:327) (cid:266)हणून जाहीर क(cid:577)लेले आहे;
आिण (cid:249)याअथ(cid:559), उप िवभागीय अिधकारी गडिहं(cid:244)लज, उप िवभाग गडिहं(cid:244)लज, िज(cid:269)हा को(cid:269)हापूर यांनी उ(cid:242)त अिधिनयमातील कलम ३२ (cid:247)या पोट-कलम १ नुसार, भाग एक पुरवणी, पृ(cid:273)ठ (cid:312).१३३५ ते १३३६ वर िदनांक ३० मे १९९२, (cid:247)या महारा(cid:273)(cid:322) शासना(cid:247)या राजप(cid:327)ात नोटीस (cid:312)मांक एमआयडीसी/गडिहं(cid:244)लज/एमआर/४/९१, िदनांक ३० मे १९९२ रोजी (cid:332)िस(cid:460) क(cid:544)न, उ(cid:242)त औ(cid:464)ोिगक (cid:550)े(cid:327)ासाठी भूसंपादन (cid:332)ि(cid:312)या सु(cid:544) क(cid:577)ली आहे आिण उ(cid:242)त कलम ३२ (cid:247)या पोट-कलम ४ नुसार उ(cid:242)त नोिटसेत नमूद क(cid:577)लेले (cid:550)े(cid:327) सव(cid:593)भार मु(cid:242)त होऊन रा(cid:249)य शासना(cid:247)या ठायी िनिहत झाले आहे;
आिण (cid:249)याअथ(cid:559), यासोबत जोडले(cid:269)या अनुसूचीतील जिमनीचा (यापुढ(cid:578) िजचा उ(cid:269)लेख 'उ(cid:242)त जमीन' असा कर(cid:256)यात येईल) ताबा रा(cid:249)य शासन िक(cid:573)वा (cid:257)या(cid:247)या वतीने घे(cid:256)यात आलेला नाही आिण उ(cid:242)त जमीन उ(cid:242)त काय(cid:464)ा(cid:247)या (cid:332)योजनासाठी आव(cid:272)यक नाही असे रा(cid:249)य शासनाचे मत झाले आहे.

भाग चार-ब—१२ महारा(cid:273)(cid:322) शासन राजप(cid:327), भाग चार-ब, गु(cid:543)वार ते बुधवार, जुलै २१-२७, २०२२/आषाढ ३०-(cid:342)ावण ५, शक(cid:577) १९४४ (cid:257)याअथ(cid:559) आता, उ(cid:242)त अिधिनयमा(cid:247)या कलम ३२ (cid:247)या पोट-कलम (४) मधील परंतुक व इतर अिधकारांचा वापर क(cid:544)न रा(cid:249)य शासन उ(cid:242)त जमीन संपादनातून काढ(cid:564)न घेत आहे आिण असे घोिषत करीत आहे की, ही सूचना महारा(cid:273)(cid:322) शासन राजप(cid:327)ात (cid:332)िस(cid:460) झा(cid:269)यानंतर कलम ३२ (cid:247)या पोट-कलम (१) नुसार नोटीस (cid:332)िस(cid:260)द हो(cid:256)या(cid:247)या लगतपूव(cid:559) उ(cid:242)त जमीन िज(cid:247)याकड(cid:578) िनिहत होती (cid:257)या (cid:271)य(cid:242)तीकड(cid:578) ती (cid:257)यावेळी अ(cid:556)(cid:274)त(cid:257)वात असतील असे भारांना अधीन राहून पूव(cid:593)ल(cid:550)ी (cid:332)भावासह पुनिन(cid:593)िहत होईल.

NOTIFICATION
No.IDC 2016/(C.R.541)/IND. 14.—Whereas, by Government Notification, Industries, Energy and Labour Department, No.IDC. 2189/(12280)/IND-14, dated the 9th June 1989 issued under sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah.III of 1962) (hereinafter referred to as "the said Act "), the Government of Maharashtra has appointed the 23rd June 1989, to be the date from which the provisions of Chapter VI of the said Act shall take effect in certain areas in village Gadhinglaj, Taluka Gadhinglaj, District Kolhapur mentioned in the Schedule appended to the said notification and declared the said area as an industrial area under clause (g) of section 2 of the said Act;
And whereas, the Sub Divisional Officer Gadhinglaj, Sub Division Gadhinglaj, District Kolhapur has by issuing notice No. (cid:14)(cid:47)(cid:4)(cid:48)(cid:34)(cid:147)(cid:59)(cid:147)/(cid:24)(cid:34)(cid:105)(cid:60)(cid:168)(cid:541)(cid:29)/(cid:14)(cid:47)(cid:4)(cid:49)/4/91, dated 30th May 1992, published in the Maharashtra Government Gazette, Part I Supplementary, Pune Divisional Supplement, Ordinary dated 9th July 1992, on pages 1334 to 1335, under sub-section (1) of section 32 of the said Act, acquired the lands in the said industrial area, and as such, the lands mentioned in the said notice have vested absolutely in the State Government free from all encumbrances under sub-section (4) of said section 32;
And whereas, the actual possession of the lands mentioned in the Schedule appended hereto (thereinafter referred to as " the said lands") was not taken by or on behalf of the State Government and it appears to the State Government that the said lands is no more required for the purpose of the said Act.
Now, therefore in exercise of the powers conferred by the proviso to sub-section (4) of section 32 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby withdraws the said land from acquisition and declares that, on the publication of this Notice in the Maharashtra Government Gazette, the said land shall re-vest with retrospective effect in the person in whom it was vesting immediately before the publication of the notice under sub-section (1) of said section 32, subject to such encumbrances, if any, as may be subsisting at that time.
