NOTIFICATION
No. TPS-2220-1382-CR-24-2022-UD-9.—
Whereas, Revised Development Plan of Warora City has been partly sanctioned by the Government vide Urban Development Department Notification No. TPS-2212-521(N)-Reco.No.57-C. R. 102(A)-2012- UD-9, dated 28th December, 2012 & has come into force with effect from the 27th January, 2013 and excluded part of the Development Plan has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2212-521(N)-Reco.No.57-C. R. 102(A)-2012-UD-9, dated the 03rd Janu- ary, 2015 (hereinafter referred to as "the said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, ा २१-२७, २०२२/+रु ३०-रम् ५, ॅ १९४४ ३And whereas, in the said Development Plan, land bearing Survey Nos. 169, 170 & 171 of mouje Warora is reserved for site No. 52, "Primary School & Play Ground" and Site No. 53 "Secondary School & Play Ground" (hereinafter referred to as "the said Reservations");
And whereas, the Warora Municipal Council Being the Planning Authority (hereinafter referred to as "the said Planning Authority"); vide it's General Body Resolution No. 19, dated the 02nd July, 2019 has resolved to delete the land bearing the Survey No. 169/1 admeasuring 0.06 Hectare area delete from said Reservations and to include the same in Residential Zone and after following the procedure laid down in the provision of sub-section (1) of Section 37 of the said Act, submitted the proposal to the Government, for its sanction (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of the opinion that the proposed modification should be sanc- tioned ;
And whereas, the Owner of the land bearing Survey No. 169/1 of the said Reservation has deposited Rs. 1,71,500/- towards the 50% Government Share of 5% premium amount as per the valuation of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Trea- sury vide Chalan No. MH0014680635, dated the 5th May, 2022, through the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and the remaining 50% of 5% premium amount Rs.1,71,500/ - towards Authority share has been deposited with the Warora Municipal Council, Warora Vide Receipt No. FI04/202, dated the 17th May, 2022;
Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification subject to certain conditions and for that purpose amends the aforesaid Notification dated the 28th December, 2012 as follows;
"In the schedule of Modification appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry"—
ENTRY
The part of Site No. 52 "Primary School & Play Ground", Site No. 53 "Secondary School & Play Ground" admeasuring about 1.20 Hectare of Mouza Warora was deleted earlier by the Government vide Notification dated the 05th January, 2018 from reservations. And the remaining area of the reservations, of the land bearing Survey No. 169 (pt) is deleted and included in Residential Zone, as shown on the plan- A copy of the Notification, along with the part plan of the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Warora Municipal Council, Warora during office hours on all working days.
