महाराष्ट्र महामार्ग अधिनियम.

क्रमांक खाक्षेस-२०२१/प्र.क्र.११५/रस्ते-८.-----ज्याअर्थी, महाराष्ट्र महामार्ग अधिनियम (१९५५ चा ५५) (यात यापुढे ज्याचा निर्देश "उक्त अधिनियम " असा करण्यात आला आहे) याच्या कलम १५ च्या पोट-कलम (२) तसेच उक्त कलमाच्या पोट-कलम (३) आणि कलम १७ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करुन, महाराष्ट्र शासनाने, शासन अधिसूचना, सार्वजनिक बांधकाम विभाग, क्रमांक खाक्षेस-२०२१/प्र.क्र.११५/रस्ते-८, दिनांक ४ मे २०२२ (यात यापुढे जिचा निर्देश "उक्त अधिसूचना " असा करण्यात आला आहे) द्वारे, सार्वजनिक प्रयोजन असलेल्या यशवंतराव चव्हाण द्रुतगती मार्ग क्षमतावाढ प्रकल्प [ राज्य महामार्ग (विशेष) क्र. ०३(A)] (यात यापुढे ज्याचा निर्देश " उक्त महामार्ग "असा करण्यात आला आहे) याचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यांसाठी, उक्त अधिसुचनेसोबत जोडलेल्या अनुसूचीमध्ये नमूद केलेली जमीन संपादित करण्याचा उद्देश घोषित केला होता ; आणि उक्त अधिसूचनेसोबत जोडलेल्या अनुसूचीमध्ये ज्यांच्या जमिनी समाविष्ट आहेत, अशा, उक्त जमीन मालकांकडून किंवा जमिनींच्या हितसंबधित व्यक्तींकडून, उक्त अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून एकवीस दिवसांच्या आत हरकती उप विभागीय अधिकारी, उप विभाग मावळ-मुळशी यांच्याकडे मागविल्या होत्या ;

आणि ज्याअर्थी, उप विभागीय अधिकारी, उप विभाग मावळ-मुळशी, जिल्हा पुणे यांनी जमीन मालकांकडून आणि जमिनींच्या हितसंबंधित व्यक्तीकडून, त्याबाबतीत प्राप्त हरकती विचारात घेऊन, उक्त अधिनियमाच्या कलम १८ च्या पोट-कलम (१) मध्ये तरतूद केल्याप्रमाणे, त्याचा अहवाल राज्य शासनास सादर केला आहे ;

आणि ज्याअर्थी, महाराष्ट्र शासनाने, उक्त अहवाल विचारात घेऊन, या अधिसुचनेसोबत जोडलेल्या अनुसूचीमध्ये विर्िनदिष्ट केलेली जमीन उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यासाठी आवश्यक असल्याचे ठरविले आहे ;

त्याअर्थी, आता, महाराष्ट्र महामार्ग अधिनियम (१९५५ चा ५५) याच्या कलम १८ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे, या अधिसूचनेसोबत जोडलेल्या अनुसूचीच्या रकाना (२) मध्ये विर्िनदिष्ट केलेल्या गावाच्या बाबतीत, त्या अनुसूचीच्या रकाना (३) मध्ये नमूद केलेला भूसंपादन क्रमांक किंवा गट क्रमांक असलेल्या जमिनी, त्या अनुसूचीच्या रकाना (४) मध्ये विर्िनदिष्ट केलेले क्षेत्र हे, उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यासाठी संपादित करण्यात येईल असे घोषित करीत आहे :----- भाग चार--ब--२९६--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑगस्ट १०, २०२२/श्रावण १९, शके १९४४

NOTIFICATION

MAHARASHTRA HIGHWAYS ACT.

No.PPP-2021/CR-115/Road-8.- Whereas, in exercise of the powers conferred by sub-section (2) of section 15 read with sub-section (3) of the said section 15 and section 17 of the Maharashtra Highways Act (LV of 1955) (hereinafter referred to as " the said Act "), and all other powers enabling it in that behalf, the Government of Maharashtra had, vide Government Notification, Public Works Department, No.PPP-2021/CR-115/Road-8, dated the 4th May 2022 (hereinafter referred to as " the said notification "), declared it's intention to acquire the land as mentioned in the Schedule appended to the said notification, for the public purpose i.e. for building, maintenance, management or operation of the Capacity Augmentation Project of Yeshwantrao Chavan Expressway [State Highway (Special) No.03(A)] (hereinafter referred to as " the said Highway ") ; and invited the objections from any person interested in the said land, whose lands are included in the Schedule appended to the said notification to the Sub- Divisional Officer, Sub-Division Maval-Mulshi, District Pune, within twenty-one days from date of the publication of the said notification, in the Maharashtra Government Gazette;

And whereas, the said Sub-Divisional Officer, Sub-Division Maval-Mulshi, District Pune, has, after considering the objections received from the persons interested thereof, submitted its report to the State Government as provided in sub-section (1) of section 18 of the said Act ; And whereas, the Government of Maharashtra has, after considering said report, decided that the land specified in the Schedule appended to this notification is required for building, maintenance, management or operation of the said Highway;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 18 of the Maharashtra Highways Act (LV of 1955) and of all other powers enabling it in this behalf, the Government of Maharashtra, hereby declares that in respect of the village specified in column (2) of the Schedule appended hereto, the land bearing Survey Numbers or Gat Numbers mentioned in column (3) thereof, the area specified in column (4) of that Schedule shall be acquired for building, maintenance, management or operation of the said Highway :—
