क्रमांक वक्फ २०२२/प्र.क्र. ५३/काया्गसन-४.—ज्याअर्थी, वक्फ अदिदनयम, १९९५ (१९९५ चा ४३ वा) च्या कलम ८३ च्या पो्ट-कलम (१) व (४) अन्वये प्रदान करण्यात आलेल्या अदिकारांचा व यासंबंिी प्राप्त असलेल्या इतर सव्ग शक्तींचा वापर करुन, महाराष्ट्र शासनाने, शासन अदिसूचना, अल्पसंख्याक दवकास दवभाग, क्र.वक्फ २०१५/प्र.क्र.१४२/काया्गसन-४, ददनांक १ ऑगस्ट २०१७, अन्वये, एखाद्ा वक्फ दकंवा वक्फ मालमत्ेशी संबंदित दववाद, प्रश्न व इतर संबंदित बाबींचे दनिा्गरण करण्यासाठी, एखाद्ा भाडेकरुचे दनष्टकासन दकंवा अशा मालमत्ा संदभा्गतील भाडेपट्ाकार व भाडेपट्ादार यांच्या अदिकारांचे व बंिनांचे (obligation) दनिा्गरण उक्त अदिदनयमांतग्गत करण्यासाठी, संपूण्ग महाराष्ट्र राज्यावर अदिकाररता असलेले, महाराष्ट्र राज्य वक्फ न्यायादिकरण, औरंगाबाद ची स्र्ापना केली आहे ;

आदण ज्याअर्थी, अॅड. मुहम्मद इक्बाल हुसैन यांचा सदस्य, महाराष्ट्र राज्य वक्फ न्यायादिकरण या पदावरील ५ वर्ांचा कालाविी ददनांक ९ ऑगस्ट, २०२२ रोजी संपुष्ट्टात आला आहे ;

आदण ज्याअर्थी, महाराष्ट्र राज्य वक्फ दनयम, २०२२ मिील दनयम ४५ च्या उप-दनयम (ब) मिील खंड (३) (i) अन्वये गठीत सदमतीने वक्फ अदिदनयम, १९९५ (१९९५ चा ४३ वा) च्या कलम ८३ च्या उप-कलम (४) मिील खंड (क) मिील तरतुदीनुसार अॅड. मोहम्मद मोदहयोद्ीन मोईद यांची सदस्य, महाराष्ट्र राज्य वक्फ न्यायादिकरण या पदासाठी दश्फारस केली आहे.

भाग चार-अ-१६२–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑगस्ट १२, २०२२/श्ावण २१, शके १९४४ त्याअर्थी, वक्फ अदिदनयम, १९९५ (१९९५ चा ४३ वा) च्या कलम ८३ च्या उप-कलम (४) मिील खंड (क) आदण महाराष्ट्र राज्य वक्फ दनयम, २०२२ मिील दनयम क्रमांक ४५ अन्वये प्रदान करण्यात आलेल्या अदिकारांचा व यासंबंिी प्राप्त असलेल्या इतर सव्ग शक्तींचा वापर करून महाराष्ट्र शासन याद्ारे अॅड. मोहम्मद मोदहयोद्ीन मोईद यांची सदस्य, महाराष्ट्र राज्य वक्फ न्यायादिकरण, औरंगाबाद म्हणून दनयुक्ती करत आहे, आदण त्या उदद्ष्ट्टाकररता उक्त अदिसूचनेमध्ये पुढीलप्रमाणे सुिारणा करीत आहे :—

उक्त अदिसूचनेसोबतच्या तक्त्यामध्ये अनुक्रमांक १ मध्ये रकाना क्रमांक २ " नाव " या दशर्गकाखाली " अॅड. मुहम्म्द इकबाल हुसैन " या शब्दांऐवजी " अॅड. मोहम्मद मोदहयोद्ीन मोईद " या शब्दांचा समावेश करण्यात यावा.

महाराष्ट्राचे राज्यपाल यांच्या आदेशानुसार व नावाने,

NOTIFICATION

Waqf act, 1995.

No. Waqf 2022/C.R.53/Desk-4.—Whereas, in exercise of the powers conferred by sub-sections (1) and (4) of section 83 of the Waqf Act, 1995 (43 of 1995) and of all other powers enabling it in that behalf the Government of Maharashtra vide Government Notification, Minorities Development Department, No.Waqf-2015/C.R.142/Desk-4, dated the 1st August 2017 (hereinafter referred to as "the said Notification"), has constituted the Maharashtra State Waqf Tribunal at Aurangabad, for the determination of any dispute, question or other matter relating to a waqf or waqf property, eviction of a tenant or determination of rights and obligations of the lessor and the lessee of such property, under the said Act, having jurisdiction over whole of the State of Maharashtra ;

And whereas, the tenure of five years of Adv. Muhammad Iqbal Hussain as a Member of the Maharashtra State Waqf Tribunal has expired on the 9th August, 2022 ;

And whereas, the Committee constituted by the State Government under sub-clause (i) of clause (3) of sub-rule (B) of rule 45 of the Maharashtra State Waqf Rules, 2022, has recommended the name of Adv. Mohammed Mohiuddin Moied for appointment as a Member to the Maharashtra State Waqf Tribunal under clause (c) of sub-section (4) of section 83 of the Waqf Act, 1995.

Now, therefore, in exercise of the powers conferred by clause (c) of sub-section (4) of section 83 of the Waqf Act, 1995 (43 of 1995) read with rule 45 of the Maharashtra State Waqf Rules, 2022 and of all other powers enabling it in that behalf, the Government of Maharashtra hereby appoints Adv. Mohammed Mohiuddin Moied as a Member of the Maharashtra State Waqf Tribunal, Aurangabad for a period of five years from the date he assume his office and for that purpose amends the said Notification as follows :—

In Table appended to the said Notification, in Serial No.3, in column (2), under the heading "Name", for the words "Adv. Muhammad Iqbal Hussain" the words "Adv.Mohammed Mohiuddin Moied" shall be substituted.
