आिण (cid:249)याअथ(cid:559), बॅकबे (cid:555)र(cid:242)लेमेशन (cid:274)कीम(cid:247)या मंजूर आराख(cid:454)ामधील (यापुढ(cid:578) (cid:249)याचा उ(cid:269)लेख "उ(cid:242)त िवकास आराखडा" असे कर(cid:256)यात आला आहे) भूखंड (cid:312). ११९ 'अ ' व १०५ हे अनु(cid:312)मे शाळा व पािक(cid:598)ग या (cid:332)योजनासाठी दाखिवले आहेत. तसेच उ(cid:242)त िवकास आराख(cid:454)ाम(cid:260)ये सुमारे ३०,००० चौ. मी. (cid:550)े(cid:327)ाचा भूखंड (भूखंड (cid:312)मांक १०५ मागील) हा गाड(cid:595)न व (cid:262)ले (cid:314)ाउ(cid:574)ड (cid:332)योजनासाठी दाखिवलेला आहे;
आिण (cid:249)याअथ(cid:559), िनयोजना(cid:247)या दृ(cid:273)टीकोनातून सदर प(cid:555)रसरातील पािक(cid:598)गची सम(cid:274)या, वाहतुकीची सम(cid:274)या इ(cid:257)यादी ल(cid:550)ात घेता (cid:332)ािधकरणाने िदनांक २७ फ(cid:577)(cid:334)ुवारी, २०१९ रोजी झाले(cid:269)या आप(cid:269)या १४७ (cid:271)या बैठकीत उ(cid:242)त िवकास आराख(cid:454)ाम(cid:260)ये उ(cid:242)त अिधिनयमा(cid:247)या कलम ३७ (१) अ(cid:261)वये खालील(cid:332)माणे आर(cid:550)णात फ(cid:577)रबदल कर(cid:256)यासाठी मा(cid:261)यता िदली होती :
(i) भूखंड (cid:312). ११९ 'अ ' (cid:481)ा भूखंडाचे शाळा हे आर(cid:550)ण बदलून "पािक(cid:598)ग" असे करणे.

आिण (cid:249)याअथ(cid:559), कोिवड-१९ (cid:247)या महामारी(cid:247)या पा(cid:272)व(cid:593)भूमीवर, (cid:332)ािधकरणाकड(cid:564)न नोटीस (cid:312). टीसीपी/(पी-१)/बीबीआरएस/ संकीण(cid:593)/ ६.३३६/७०७/२०१९, िदनांक ३ जुलै २०१९ अ(cid:261)वये जाहीर क(cid:577)ले(cid:269)या नोटीशी(cid:247)या अनुषंगाने उ(cid:242)त अिधिनयमा(cid:247)या कलम ३७ ची पुढील काय(cid:593)वाही पूण(cid:593) होऊ शकली नाही ;
आिण (cid:249)याअथ(cid:559), (cid:332)ािधकरणाने िदनांक २८ फ(cid:577)(cid:334)ुवारी, २०२२ रोजी झाले(cid:269)या (cid:332)ािधकरणा(cid:247)या १५२ (cid:271)या बैठकीत उ(cid:242)त अिधिनयमा(cid:247)या कलम ३७ (१) अनुसार खालील(cid:332)माणे आिण सोबत जोडले(cid:269)या नकाशात दश(cid:593)िव(cid:269)या(cid:332)माणे आर(cid:550)णात बदल कर(cid:256)यासाठी मा(cid:261)यता िदली आहे :
(i) भूखंड (cid:312). ११९ 'अ' (cid:481)ा भूखंडाचे शाळा हे आर(cid:550)ण बदलून " पािक(cid:598)ग" असे करणे.

NOTICE

No. TCP (P-1)/BBRS/DP/1.104/Vol-II/657/2022.— Whereas, the Government of Maharashtra has appointed the Mumbai Metropolitan Region Development Authority (hereinafter referred to as "the Authority") established under the section 3 of the Mumbai Metropolitan Region Development Authority Act, 1974, to be the Special Planning Authority for the area comprising Block III to VI of the Back Bay Reclamation Scheme (hereinafter referred to as "BBRS") by the GOM, Urban Development Department Notification No. BBR/1082/CR - 140/1687/UD, dated 15th June, 1983 promulgated in exercise of its powers conferred by section 40 (1) (c) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") ;
And whereas, in exercise of its powers under Section 40 (3) (d) of the said Act, the Government of Maharashtra approved, by its Urban Development Department's Notification No. BBR/1092/60/ CR-6/92/UD-11, dated 3rd June, 2000 and dated 17th March 2001 has approved the Development Plan of BBRS submitted by the Authority ;
And whereas, the Plot No. 119 'A' and 105 are reserved for "School" and "Parking" respectively in the sanctioned Development Plan of Back bay Reclamation Scheme (herein referred to as the "said Development Plan"). Also the plot approx. 30,000 sq. m. (behind the plot No. 105) is reserved as "Garden & Play Ground" in the said Development Plan ;
And whereas, due to parking problems and heavy traffic in the said area, from planning point of view, the Authority in its 147th meeting held on 27th February, 2019 has resolved to modify the reservations as stated below in the said Development Plan under section 37 (1) of the said Act :
(i) To change the reservation of plot No. 119 'A' from 'School' to 'Parking' ;
(ii) To change the reservation of plot No. 105 from 'Parking' to 'School' ;
(iii) To carve out the required playground for plot of approx. 2,500 sq. m. for the proposed School on plot No. 105 from the adjoining Bay View Marina Garden.
And whereas, the Authority under section 37 of the said Act issued notice No. TCP (P-1) / BBRS/ Misc./6.336/707/2019, dated 3rd July 2019 for its intention to make above modification in the said Development Plan ;
And whereas, in response to the said notice the Authority has received 5 Suggestions / Objections and has appointed the Planning Committee for the purpose of hearing of the suggestions and objections ;
And whereas, in view of the pandemic of Covid - 19, the Authority was unable to complete the procedure as prescribed in section 37 of the said Act subsequent to the issuance of notice No. TCP (P-1)/ BBRS/Misc./6.336/707/2019, dated 03rd July 2019 ;
And whereas, the Authority in the 152nd meeting held on 28th February, 2022 has resolved to modify under section 37 (1) of said Act, the reservation as stated below and as indicated in the enclosed plan for the proposed change of reservation purpose :
(i) To change the reservation of plot No. 119 'A' from 'School' to 'Parking' ;
(ii) To change the reservation of plot No. 105 from 'Parking' to 'School' ;
(iii) To carve out the required playground for plot of approx. 2,500 sq. m. for the proposed School on plot No. 105 from the adjoining Bay View Marina Garden.
(the above modification is hereinafter referred to as the "said Modification")
Now, therefore, this notice is hereby published to invite suggestions and / or objections, if any, to the said modification.
