Whereas, the Government has sanctioned the Revised Development Plan of Nagpur Municipal Corporation (hereinafter referred to as "the said Development Plan") vide Urban Development Department Notification No. TPS-2496-2643-C.R. 300(A)-97-UD-9, dated 7th January 2000 under sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") which has come into force with effect from 1st March 2000 and Excluded Part of the said Development Plan has been sanctioned under Section 31(1) of the said Act vide Government in Urban Development Department Notification No. TPS-2400-1628-C.R. 200-2000-UD-09, dated 10th September 2001 which has come into force with effect from 21st September 2001 ;

And whereas, in the said Development Plan, land bearing khasra No. 1(Pt.), Khasra No. 2 (Pt.) of Mouje Ambazari, Taluka-District Nagpur (hereinafter referred to as "the said lands") are affected by exisiting Ambazari Garden & Site No. W-8 "Extention to Ambazari Garden"(hereinafter referred to as "the said land Use"). The Appropriate Authority for the acquisition & development of land under the said reservation is Nagpur Improvement Trust (hereinafter referred to as "the said Planning Authority") ;
And whereas, out of the said land, land bearing Khasra No. 1/1/1, C.T.S. No. 1 of Ambazari given for care and maintaince to Nagpur Municipal Corporation and measured as 42.42 Acre (171662.698 Sq. Mt.) as per measurement Plan have been leased to Maharashtra Tourism Development Corporation for the period of 30 years vide Collector, Nagpur Order bearing Marathi No. +. ॅ.--द्ध..ह्यम्.द्ध.-ॅह्यम्-४९१-२०१७, dated 20 September 2017 subject to conditions mention in the said order, for the mentaince of the same.
The possession of the said land has been handed over to Tourism Development Corporation on 31st January 2018 ;
And whereas, for the Development and Operation Maintenance of Ambazari Garden in Nagpur on Design Build Finance Operate and Transfer (DBFOT) basis appointed M/s. Garuda Amusement Park (Nagpur) Pvt. Ltd. by Maharashtra Tourism Development Corporation on 6th September 2019 and Concession Agreement in respect of the same have been executed vide document bearing No. 3138, dated 22nd November 2019 ;
And whereas, the said Appropriate Authority desirous of Tourism Activities such as Urban Haat shall Comprise of Shops/Stalls for Handicrafts and products. Amphitheatre, Exhibiton Centre, Food Court, theme Park, Garden Amusement Park, Recreational Club, Community/Banqueting facilities, Amusement activities, Public Recreational Zone, Theme Garden and it is necessary to delete the said land from the said use in order to enable the said proposed Tourism Activities and therefore requested the Government to issue notice under Section 37(1AA) (A) in respect of modification of the said land from the said use i. e. deleting the said land from the said use and include the same in the "Tourism Development Zone" considering the urgency & larger Public interest and further requested to appoint MTDC as the Special Planning Authority for the said proposal (hereinafter referred to as "the modification proposal") ;
And whereas, the State Government is of opinion that, in public interest, it is necessary to take recourse of Section 37 (1AA) (a) of the said act to make modification in the sanction Dévelopment Plan regarding the said proposal ;
Now, therefore, in exercise of the powers vested under Section 37 (1AA) (a) of the said Act, the Government hereby publishes this Notice for inviting Suggestion/Objection from the general public in respect of the said Modification, as specified in the Schedule, within a period of one month from the date of publication of this notice in the Official Gazette. Any Suggestion/Objection in respect of the said Modification, should be forwarded to the Joint Director of Town Planning, Nagpur Division, Nagpur having his office at "Old Secretriate Building, 1st Floor, Civil Lines, Nagpur" who has been appointed as the Officerद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, रू]क्ष्दन् १-७, २०२२ / १०-१६, ॅ १९४४ ५ under Section 162(1) of the said Act, to hear suggestions/objection and after obtaining the remarks from the concerned on the following points, submit report to the Government, within 30 days after the expiry of the above mentioned period.
(1) As per the Serial No. 1 of the published Heritage list dated 15th October 2003, Ambazari Garden alongwith Ambazari lake is included in the Grade-I Heritage Building. As per the regulation No. 14.5.3 & 14.5.8. (c) Scope for Change of the UDCPR-2020. the Herigate Conservation Committee is to be consulted priorly by the authority. Accordingly the remarks of the Heritage Conservation Committee are to be obtained.
(2) As the report of the Planning Authority i. e. Nagpur Improvement Trust, Ambazari Garden is well planned famous garden. There is always crowd of people. There are various equipments in the large number present for the exercise of seniors, playing and entertainment of little children.
Hence this garden needs to always kept open for General Public and no major changes needs to be carried out in this planned garden. Hence considering the request, remarks of Nagpur Improvement Trust shall be taken.
(3) Exact location of the land under modification has not been shown on the Measurement Plan.
Metro line is passing through Existing Ambazari Garden. Hence these things need to be verified and finalised considering the situation on the site.
(4) Distance from Natural lake needs to be followed as per regulation No. 3.1.12 of the UDCPR-2020 and in the absence of the provision in such plan the distance as may be specified by irrigation Department shall be followed. The necessary action shall be taken acordingly.

The plan and reports containing the description of the above modification can be seen in the office of the Municipal Council, Chandrapur during the office hour's.
Now, in pursuance of Section 37 of Maharashtra Regional and Town Planning Act, 1966 it is hereby notified that any person having any suggestion or objection to the proposed modification as mentioned above shall communicate the same in writing to the undersigned within one month from the date of publi- cation of this notification in the official Gazette. The objections or suggestion, if any received within the above mentioned period of one month will be considered for compliance of judicial procedure by the Com- missioner, Municipal Corporation of City of Chandrapur while submitting the proposal of Modification to the Govt. for decision on merit basis.
