ंबई महानगरपालिका त्यांचे अधिकार क्षेत्राकरिता (यापुढे उल्लेख "उक्त अधिनियम" असा करणेत आलेला आहे.) च्या तरतुदींनुसार बृहन्मु ज्याचा उल्लेख "उक्त महानगरपालिका" असा करणेत आलेला आहे.) नियोजन प्राधिकरण आहे ;
ज्याअर्थी, उक्त अधिनियमाचे कलम ३१ पोट-कलम (१) अन्वये प्राप्त अधिकारांचा वापर करून राज्य शासनाने अधिसूचना क्र. टिपीबी- ४३१७/६२९/प्र.क्र.१९८/२०१७/वियो/नवि-११, दि. ८ मे २०१८ (यापुढे याचा उल्लेख "उक्त अधिसूचना" असा करणेत आलेला आहे) (cid:४६२)ारे ंबई प्रारूप विकास योजना २०३४ (यापुढे याचा उल्लेख "उक्त विकास योजना" असा करणेत आलेला आहे) सह विकास नियंत्रण व बृहन्मु
प्रोत्साहन नियमावली, २०३४ ला उक्त अधिसूचनेसोबतचे परिशिष्ट-ब मध्ये दर्शविलेले सारभूत स्वरूपाचे फे रबदल (ई.पी.) वगळून उक्त अधिसूचनेत परिशिष्ट-अ मध्ये दर्शविलेल्या सुधारणेसह मंजुरी दिली आहे. आणि ज्याअर्थी, शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक दि. २२ जून, २०१८ रोजी निर्गमित के ले असून त्यानुसार उक्त विकास योजना दि. १ सप्टेंबर २०१८ पासून अंमलात आली आहे.
आणि ज्याअर्थी, त्यानंतर शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक व पूरकपत्र दि.२९ जून, २०१९ रोजी पारित के ले असून सदर शुद्धीपत्रक व पूरकपत्र महाराष्ट्र शासनाच्या राजपत्रात दि ३० जून, २०१८ रोजी प्रसिद्ध करण्यात आले आहे ;
आणि ज्याअर्थी, उक्त विकास योजनेमध्ये न.भू.क्र.१/ए (पै) व न.भू.क्र.५१ए (पै), मौजे- विक्रोळी, मु ंबई या जमिनीवर (यापुढे याचा उल्लेख "उक्त जमीन" असा करण्यात आलेला आहे) प्रारूप विकास योजनेनुसार 'एक्झिबिशन सेंटर (RSA५.१)' व 'मेट्रो/मोनो रेल कारशेड (RT३.१)' असे दर्शविण्यात आले होते; आणि ज्याअर्थी, उक्त अधिसुचनेसोबतचे परिशिष्ट-ब नुसार सदर जमीन सारभूत स्वरूपाचे फ़े रबदल ई.पी.-एन१४ व ई.पी.-एन८५ मध्ये समाविष्ट होती; आणि ज्याअर्थी, महाराष्ट्र शासनाने अधिसूचना क्र. टिपीबी-४३२१/प्र.क्र.२०/२०२१/नवि-११ दिनांक १२ मार्च २०२१ नुसार उक्त अधिनियमाचे कलम ३१(१) अन्वये उक्त विकास योजनेतील सदर अधिसूचनेसोबतचे परिशिष्टामध्ये नमूद असल्याप्रमाणे ई.पी.एन १४ व ई.पी.८५ सह काही ठराविक ई.पी. ना शासनाने मंजुरी दिली आहे ; त्यानुसार, मंजूर ई.पी.एन-१४ नुसार मेट्रो कारशेड आरक्षणाचे आकारामध्ये बदल करण्यात आला आहे तर मंजूर ई.पी.एन-८५ नुसार उक्त जमिनीवर 'रेल्वे टर्मिनस' हे आरक्षण दर्शविण्यात आले आहे ;
आणि ज्याअर्थी, बृहन्मु ंबई महानगरपालिके चे (यापुढे याचा उल्लेख "उक्त महापालिका" असा करण्यात आलेला आहे) दि. २९ सप्टेंबर २०२१ रोजीचे पत्र (यापुढे याचा उल्लेख "उक्त पत्र" असा करण्यात आलेला आहे) शासनास प्राप्त झाले असून, उक्त पत्रामध्ये उक्त महापालिके स न ॅशनल हाय स्पीड रेल कॉर्पोरेशन लि. (यापुढे याचा उल्लेख "एन.एच.एस.आर.सी.एल." असा करण्यात आलेला आहे) यांचेकडून प्राप्त झालेल्या निवेदनामध्ये शासनाचे दिनांक १२ मार्च २०२१ च्या वरील अधिसूचने(cid:४६२)ारे मंजूर के लेल्या 'व्हेंटिलेशन शा(cid:१९६)ट, TSS आणि DSS' या आरक्षणाचे स्थान व आकार मु ंबई- अहमदाबाद हाय स्पीड रेल्वे कॉरीडॉर प्रकल्पासाठी व्यवहारिकदृष्(cid:५०३)ा योग्य नसल्याने व ळुुूु -(र्ुै.ु.रुर्ुॆं.)-९४–१
(१)२ महाराष्ट्र शासन राजपत्र, असाधारण, भाग एक---कोकण विभागीय पुरवणी, सप्टेंबर २, २०२२/भाद्रपद ११, शके १९४४ सदर प्रकल्पाकरिता भूसंपादन प्रक्रिया सुरू झाली असल्याने, व्हेंटिलेशन शा(cid:१९६)ट चे सुधारित स्थान विकास योजनेमध्ये दर्शविण्याबाबत उक्त महापालिके स विनंती के ली असल्याचे नमूद के ले आहे; आणि ज्याअर्थी, उक्त महापालिके ने एन.एच.एस.आर.सी.एल. चे सदर विनंतीचे अनुषंगाने योग्य ती कार्यवाही करण्याबाबत उक्त पत्राव्दारे शासनास विनंती के ली आहे ;
आणि, ज्याअर्थी, एन.एच.एस.आर.सी.एल.ने दिनांक २२ ऑक्टोबर २०२१ रोजीचे पत्र शासनास प्राप्त झाले असून, 'व्हेंटिलेशन शा(cid:१९६)ट, टिएसएस व डि.एस.एस.' चे सुधारित स्थान विकास योजनेमध्ये दर्शविण्याबाबत उक्त जमिनीकरिता मंजूर विकास योजनेमध्ये सुधारणा करण्याबाबत एन.एच.एस.आर.सी.एल. ने के लेल्या विनंतीवर त्चरित कार्यवाही करण्याबाबत शासनास विनंती के ली आहे ;
आणि ज्याअर्थी, उक्त महापालिका व एन.एच.एस.आर.सी.एल. यांचे पत्रातील विनंती विचारात घेता, व्हेंटिलेशन शा(cid:१९६)ट चे सुधारित स्थानाप्रमाणे उक्त जागेवर ''व्हेंटिलेशन शा(cid:१९६)ट, टिएसएस व डि.एस.एस. व अनुषंगिक वापर'' असे आरक्षण दर्शविण्याकरिता मंजूर विकास योजनेमध्ये फे रबदल करणे हे सार्वजनिक हिताचे दृष्टीने आवश्यक आहे, अशी शासनाची खात्री झाली आहे ;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३७ च्या पोट-कलम (१कक) अन्वये प्राप्त अधिकाराचा वापर करून शासनाने समक्रमांकाची दिनांक २३ फे ब्रुवारी २०२२ रोजीची सूचना त्यासोबतचे परिशिष्टामध्ये नमूद प्रस्तावित फे रबदलावर (यापुढे याचा उल्लेख 'प्रस्तावित फे रबदल' असा करणेत आलेला आहे) जनतेकडून हरकती / सूचना मागविण्यासाठी प्रसिध्द करण्यात आली आहे. आणि ज्या(cid:४६२)ारे, प्रस्तावित फे रबदलाबाबत प्राप्त होणाऱ्या हरकती / सूचनांवर संबंधितांना सुनावणी देण्याकरिता तसेच उक्त अधिनियमाच्या कलम ३७(१कक)
ंबई यांची अधिकारी (यापुढे अन्वये विहित के लेली कार्यवाही पूर्ण करून प्रस्ताव शासनास सादर करणेसाठी उप संचालक, नगररचना, बृहन्मु ज्यांचा उल्लेख "उक्त अधिकारी" असा करण्यात आला आहे. ) म्हणून नियुक्ती करण्यात आली आहे;
आणि ज्याअर्थी, प्रस्तावित फे रबदलाची सदर शासन सूचना दिनांक २३ फे ब्रुवारी २०२२ ही महाराष्ट्र शासन राजपत्रामध्ये (भाग-१ कोकण विभागीय पुरवणी) (यापुढे याचा उल्लेख 'शासकीय राजपत्र' असा करणेत आलेला आहे) दिनांक १० मार्च २०२२ रोजी प्रसिद्ध करण्यात आली आहे आणि उक्त अधिकारी यांनी अधिनियमाचे कलम ३७(१कक) अन्वये वैधानिक कार्यवाही पूर्ण करून दिनांक २० जून २०२२ रोजीच्या पत्रान्वये त्यांचा अहवाल नगररचना संचालनालयामार्फ त शासनास सादर के ला आहे ;
आणि ज्याअर्थी, उक्त अधिकारी यांनी सादर के लेला अहवाल विचारात घेता व संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्ला मसलत के ल्यानंतर उक्त प्रस्तावित फ़े रबदल काही सुधारणेसह मंजूर करणे जनहिताच्या दृष्टीने आवश्यक आहे, असे शासनाचे मत झाले आहे ;
आता त्याअर्थी, उक्त अधिनियमाच्या कलम ३७(१कक)(ग) अन्वये प्राप्त अधिकारात आणि त्या संदर्भातील सर्व शक्तींचा वापर करून शासन या(cid:४६२)ारे :—
(अ) उक्त प्रस्तावित फे रबदलाचे प्रस्तावास खालील परिशिष्टामध्ये नमूद के लेप्रमाणे मंजुरी देत आहे.
(ब) सदरची अधिसूचना शासकीय राजपत्रामध्ये प्रसिद्ध झालेचा दिनांक हा उक्त फे रबदल अंमलात आलेचा दिनांक असेल.
(क) बृहन्मु ंबई महानगरपालिके च्या उक्त विकास योजनेच्या मंजुरी सोबतच्या फे रबदलाचे परिशिष्टामध्ये शेवटच्या नोंदीनंतर खालील परिशिष्ट समाविष्ट करणेचे निर्देश देत आहे.
परिशिष्ट
(i) "The reservation of 'Railway Terminus (RT4.2)' shown on the land bearing CTS No.1/A(pt) and CTS No.51A(pt), Village-Vikroli, Mumbai is deleted and the land so deleted is included in reservation of 'Exhibition Centre (RSA5.1)'.
(ii) The part portion of reservation of 'Exhibition Centre (RSA5.1)' is deleted and the land so deleted is reserved for the purpose of 'Ventilation shaft, TSS and DSS & allied users' for 'Mumbai-Ahmedabad High Speed Railway Corridor' project and a 12.00 m wide DP road is shown from existing road on North-West side by deleting part portion of reservation of 'Exhibition Centre (RSA5.1)' to provide an access to this reservation."

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPB-4321/CR-145/2021/UD-11.— Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") ;
Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act, the State Government vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as "the said Notification") has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification. And whereas, Government has issued a corrigendum of even number dated 22nd June, 2018 to the said Notification, as per which the said Development Plan has come into force from 1st September 2018. And whereas, thereafter Government has issued a Corrigendum and Addendum of even number dated 29th June, 2018 to the said Notification, which is published in the Government Gazette, dated 30th June, 2018 ;
And whereas, as per the Draft Development Plan-2034, the land bearing CTS No.1/A(pt) and CTS No.51A(pt), Village-Vikroli, Mumbai (hereinafter referred to as "the said land") was reserved for Exhibition Centre (RSA5.1) & Metro-Mono Rail Car Shed (RT3.1) ; And whereas, as per SCHEDULE-B of the said notification, the said land was included in Excluded Part EP-N14 & EP-N85 ; And whereas, Government of Maharashtra vide Notification No.TPB-4321/CR- 20/2021/UD-11, dated 12th March 2021 has accorded sanction under section 31(1) of the said act to certain Excluded Part (E.P.) of the said Development Plan as given in the schedule appended to this notification including EP-N14 & EP-N85. Wherein, as per sanctioned EP-N14, the shape of the Car Shed is changed so that it is not bifurcating the reservation of Exhibition Centre (RSA5.1) in bits & parcels and, as per EP-N85, the reservation of Railway Terminus (RT4.2) is shown on the said land ;
And whereas, Government of Maharashtra in Urban Development Department has received letter dated 29th September 2021 (hereinafter referred to as "the said letter") from Municipal Corporation of Greater Mumbai (hereinafter referred to as "MCGM") wherein it stated that, a representation from National High Speed Rail Corporation Ltd. (hereinafter referred to as "NHSRCL") has been received by MCGM stating that the shape and position of Ventilation Shaft, TSS & DSS as per sanctioned N-85 is not feasible to NHSRCL and requested MCGM to modify the location of Ventilation Shaft as the acquisition proceedings have already been started with the respective land owners. And whereas, MCGM vide its said letter has requested Government to take appropriate action on the request of NHSRCL for change of location of Ventilation Shaft and modification to the said Development Plan for the said land in that regard ;
And whereas, NHSRCL vide its letter dated 22th October 2021 has requested the Government to expedite the request of NHSRCL to mark the revised location of 'Ventilation shaft, TSS & DSS' on the said Development Plan and to modify the said Development Plan accordingly ;
And whereas, considering the request of the MCGM and of NHSRCL, the Government is satisfied that in the public interest it is expedient to modify the said Development Plan in respect of the said land so as to show the reservation of 'Ventilation shaft, TSS & DSS and allied uses' on the said land as per the revised location ;
४ महाराष्ट्र शासन राजपत्र, असाधारण, भाग एक---कोकण विभागीय पुरवणी, सप्टेंबर २, २०२२/भाद्रपद ११, शके १९४४And whereas, in exercise of the powers conferred under sub-section (1AA) of Section 37 of the said Act, Government had issued Notice of even no. dated 23rd February, 2022 for inviting suggestions/objections from the general public with regard to the proposed modification (hereinafter referred to as 'the proposed modification') as mentioned in the Schedule appended to the said Notice and appointed the Deputy Director of Town Planning, Greater Mumbai as the Officer (hereinafter referred to as "the said Officer") to complete the procedure as stipulated under Section 37(1AA) of the said Act and to submit a report on the objections/suggestions received in respect of the proposed modification to the Government after giving hearing to the concerned persons ;
And whereas, the said Notice dated 23rd February, 2022 was published in the Maharashtra Government Gazette (Part 1- Kokan Division supplement) (hereinafter referred to as "the Maharashtra Government Gazette") dated 10th March, 2022 and the said officer has submitted his report to the Government vide letter dated 20th June, 2022 through the Director of Town Planning, Maharashtra State, Pune after completing the legal procedure as stipulated under Section 37(1AA) of the said Act ;
And whereas, after considering the Report of the said Officer and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned with certain changes ;
Now, therefore, in exercise of the powers conferred upon it under Section 37(1AA)(c) of the said Act, the Government hereby :—
(A) Sanctions the proposed modification as described more specifically in the Schedule hereinunder.
(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification.
(C) Directs the Municipal Corporation of Greater Mumbai that in the Schedule of Modifications sanctioning the said Development Plan, after the last entry, the Schedule referred to at (A) above shall be added.
Schedule
(i) "The reservation of 'Railway Terminus (RT4.2)' shown on the land bearing CTS No.1/A(pt) and CTS No.51A(pt), Village-Vikroli, Mumbai is deleted and the land so deleted is included in reservation of 'Exhibition Centre (RSA5.1)'.

आणि ज्याअर्थी, उक्त विकास योजनेमध्ये न.भू.क्र.१/ए (पै) व न.भू.क्र.५१ए (पै), मौजे- विक्रोळी, मु ंबई या जमिनीवर (यापुढे याचा उल्लेख "उक्त जमीन" असा करण्यात आलेला आहे) प्रारूप विकास योजनेनुसार 'एक्झिबिशन सेंटर (RSA५.१)' व 'मेट्रो/मोनो रेल कारशेड (RT३.१)' असे दर्शविण्यात आले होते; आणि ज्याअर्थी, उक्त अधिसुचनेसोबतचे परिशिष्ट-ब नुसार सदर जमीन सारभूत स्वरूपाचे फ़े रबदल ई.पी.-एन१४ व ई.पी.-एन८५ मध्ये समाविष्ट होती; आणि ज्याअर्थी, महाराष्ट्र शासनाने अधिसूचना क्र. टिपीबी-४३२१/प्र.क्र.२०/२०२१/नवि-११ दिनांक १२ मार्च २०२१ नुसार उक्त अधिनियमाचे कलम ३१(१) अन्वये उक्त विकास योजनेतील सदर अधिसूचनेसोबतचे परिशिष्टामध्ये नमूद असल्याप्रमाणे ई.पी.एन १४ व ई.पी.८५ सह काही ठराविक ई.पी. ना शासनाने मंजुरी दिली आहे ; त्यानुसार, मंजूर ई.पी.एन-१४ नुसार मेट्रो कारशेड आरक्षणाचे आकारामध्ये बदल करण्यात आला आहे तर मंजूर ई.पी.एन-८५ नुसार उक्त जमिनीवर 'रेल्वे टर्मिनस' हे आरक्षण दर्शविण्यात आले आहे ;
आणि ज्याअर्थी, बृहन्मु ंबई महानगरपालिके चे (यापुढे याचा उल्लेख "उक्त महापालिका" असा करण्यात आलेला आहे) दि. २९ सप्टेंबर २०२१ रोजीचे पत्र (यापुढे याचा उल्लेख "उक्त पत्र" असा करण्यात आलेला आहे) शासनास प्राप्त झाले असून, उक्त पत्रामध्ये उक्त महापालिके स न ॅशनल हाय स्पीड रेल कॉर्पोरेशन लि. (यापुढे याचा उल्लेख "एन.एच.एस.आर.सी.एल." असा करण्यात आलेला आहे) यांचेकडून प्राप्त झालेल्या निवेदनामध्ये शासनाचे दिनांक १२ मार्च २०२१ च्या वरील अधिसूचने(cid:४६२)ारे मंजूर के लेल्या 'व्हेंटिलेशन शा(cid:१९६)ट, TSS आणि DSS' या आरक्षणाचे स्थान व आकार मु ंबई- अहमदाबाद हाय स्पीड रेल्वे कॉरीडॉर प्रकल्पासाठी व्यवहारिकदृष्(cid:५०३)ा योग्य नसल्याने व ळुुूु -(र्ुै.ु.रुर्ुॆं.)-९४–१
(१)२ महाराष्ट्र शासन राजपत्र, असाधारण, भाग एक---कोकण विभागीय पुरवणी, सप्टेंबर २, २०२२/भाद्रपद ११, शके १९४४ सदर प्रकल्पाकरिता भूसंपादन प्रक्रिया सुरू झाली असल्याने, व्हेंटिलेशन शा(cid:१९६)ट चे सुधारित स्थान विकास योजनेमध्ये दर्शविण्याबाबत उक्त महापालिके स विनंती के ली असल्याचे नमूद के ले आहे; आणि ज्याअर्थी, उक्त महापालिके ने एन.एच.एस.आर.सी.एल. चे सदर विनंतीचे अनुषंगाने योग्य ती कार्यवाही करण्याबाबत उक्त पत्राव्दारे शासनास विनंती के ली आहे ;
आणि, ज्याअर्थी, एन.एच.एस.आर.सी.एल.ने दिनांक २२ ऑक्टोबर २०२१ रोजीचे पत्र शासनास प्राप्त झाले असून, 'व्हेंटिलेशन शा(cid:१९६)ट, टिएसएस व डि.एस.एस.' चे सुधारित स्थान विकास योजनेमध्ये दर्शविण्याबाबत उक्त जमिनीकरिता मंजूर विकास योजनेमध्ये सुधारणा करण्याबाबत एन.एच.एस.आर.सी.एल. ने के लेल्या विनंतीवर त्चरित कार्यवाही करण्याबाबत शासनास विनंती के ली आहे ;
आणि ज्याअर्थी, उक्त महापालिका व एन.एच.एस.आर.सी.एल. यांचे पत्रातील विनंती विचारात घेता, व्हेंटिलेशन शा(cid:१९६)ट चे सुधारित स्थानाप्रमाणे उक्त जागेवर ''व्हेंटिलेशन शा(cid:१९६)ट, टिएसएस व डि.एस.एस. व अनुषंगिक वापर'' असे आरक्षण दर्शविण्याकरिता मंजूर विकास योजनेमध्ये फे रबदल करणे हे सार्वजनिक हिताचे दृष्टीने आवश्यक आहे, अशी शासनाची खात्री झाली आहे ;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३७ च्या पोट-कलम (१कक) अन्वये प्राप्त अधिकाराचा वापर करून शासनाने समक्रमांकाची दिनांक २३ फे ब्रुवारी २०२२ रोजीची सूचना त्यासोबतचे परिशिष्टामध्ये नमूद प्रस्तावित फे रबदलावर (यापुढे याचा उल्लेख 'प्रस्तावित फे रबदल' असा करणेत आलेला आहे) जनतेकडून हरकती / सूचना मागविण्यासाठी प्रसिध्द करण्यात आली आहे. आणि ज्या(cid:४६२)ारे, प्रस्तावित फे रबदलाबाबत प्राप्त होणाऱ्या हरकती / सूचनांवर संबंधितांना सुनावणी देण्याकरिता तसेच उक्त अधिनियमाच्या कलम ३७(१कक)
ंबई यांची अधिकारी (यापुढे अन्वये विहित के लेली कार्यवाही पूर्ण करून प्रस्ताव शासनास सादर करणेसाठी उप संचालक, नगररचना, बृहन्मु ज्यांचा उल्लेख "उक्त अधिकारी" असा करण्यात आला आहे. ) म्हणून नियुक्ती करण्यात आली आहे;
आणि ज्याअर्थी, प्रस्तावित फे रबदलाची सदर शासन सूचना दिनांक २३ फे ब्रुवारी २०२२ ही महाराष्ट्र शासन राजपत्रामध्ये (भाग-१ कोकण विभागीय पुरवणी) (यापुढे याचा उल्लेख 'शासकीय राजपत्र' असा करणेत आलेला आहे) दिनांक १० मार्च २०२२ रोजी प्रसिद्ध करण्यात आली आहे आणि उक्त अधिकारी यांनी अधिनियमाचे कलम ३७(१कक) अन्वये वैधानिक कार्यवाही पूर्ण करून दिनांक २० जून २०२२ रोजीच्या पत्रान्वये त्यांचा अहवाल नगररचना संचालनालयामार्फ त शासनास सादर के ला आहे ;
आणि ज्याअर्थी, उक्त अधिकारी यांनी सादर के लेला अहवाल विचारात घेता व संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेशी सल्ला मसलत के ल्यानंतर उक्त प्रस्तावित फ़े रबदल काही सुधारणेसह मंजूर करणे जनहिताच्या दृष्टीने आवश्यक आहे, असे शासनाचे मत झाले आहे ;
आता त्याअर्थी, उक्त अधिनियमाच्या कलम ३७(१कक)(ग) अन्वये प्राप्त अधिकारात आणि त्या संदर्भातील सर्व शक्तींचा वापर करून शासन या(cid:४६२)ारे :—
(अ) उक्त प्रस्तावित फे रबदलाचे प्रस्तावास खालील परिशिष्टामध्ये नमूद के लेप्रमाणे मंजुरी देत आहे.
(ब) सदरची अधिसूचना शासकीय राजपत्रामध्ये प्रसिद्ध झालेचा दिनांक हा उक्त फे रबदल अंमलात आलेचा दिनांक असेल.
(क) बृहन्मु ंबई महानगरपालिके च्या उक्त विकास योजनेच्या मंजुरी सोबतच्या फे रबदलाचे परिशिष्टामध्ये शेवटच्या नोंदीनंतर खालील परिशिष्ट समाविष्ट करणेचे निर्देश देत आहे.
परिशिष्ट
(i) "The reservation of 'Railway Terminus (RT4.2)' shown on the land bearing CTS No.1/A(pt) and CTS No.51A(pt), Village-Vikroli, Mumbai is deleted and the land so deleted is included in reservation of 'Exhibition Centre (RSA5.1)'.
(ii) The part portion of reservation of 'Exhibition Centre (RSA5.1)' is deleted and the land so deleted is reserved for the purpose of 'Ventilation shaft, TSS and DSS & allied users' for 'Mumbai-Ahmedabad High Speed Railway Corridor' project and a 12.00 m wide DP road is shown from existing road on North-West side by deleting part portion of reservation of 'Exhibition Centre (RSA5.1)' to provide an access to this reservation."

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPB-4321/CR-145/2021/UD-11.— Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") ;
Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act, the State Government vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as "the said Notification") has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") along with the Development Control and Promotion Regulations-2034 for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification. And whereas, Government has issued a corrigendum of even number dated 22nd June, 2018 to the said Notification, as per which the said Development Plan has come into force from 1st September 2018. And whereas, thereafter Government has issued a Corrigendum and Addendum of even number dated 29th June, 2018 to the said Notification, which is published in the Government Gazette, dated 30th June, 2018 ;
And whereas, as per the Draft Development Plan-2034, the land bearing CTS No.1/A(pt) and CTS No.51A(pt), Village-Vikroli, Mumbai (hereinafter referred to as "the said land") was reserved for Exhibition Centre (RSA5.1) & Metro-Mono Rail Car Shed (RT3.1) ; And whereas, as per SCHEDULE-B of the said notification, the said land was included in Excluded Part EP-N14 & EP-N85 ; And whereas, Government of Maharashtra vide Notification No.TPB-4321/CR- 20/2021/UD-11, dated 12th March 2021 has accorded sanction under section 31(1) of the said act to certain Excluded Part (E.P.) of the said Development Plan as given in the schedule appended to this notification including EP-N14 & EP-N85. Wherein, as per sanctioned EP-N14, the shape of the Car Shed is changed so that it is not bifurcating the reservation of Exhibition Centre (RSA5.1) in bits & parcels and, as per EP-N85, the reservation of Railway Terminus (RT4.2) is shown on the said land ;
And whereas, Government of Maharashtra in Urban Development Department has received letter dated 29th September 2021 (hereinafter referred to as "the said letter") from Municipal Corporation of Greater Mumbai (hereinafter referred to as "MCGM") wherein it stated that, a representation from National High Speed Rail Corporation Ltd. (hereinafter referred to as "NHSRCL") has been received by MCGM stating that the shape and position of Ventilation Shaft, TSS & DSS as per sanctioned N-85 is not feasible to NHSRCL and requested MCGM to modify the location of Ventilation Shaft as the acquisition proceedings have already been started with the respective land owners. And whereas, MCGM vide its said letter has requested Government to take appropriate action on the request of NHSRCL for change of location of Ventilation Shaft and modification to the said Development Plan for the said land in that regard ;
And whereas, NHSRCL vide its letter dated 22th October 2021 has requested the Government to expedite the request of NHSRCL to mark the revised location of 'Ventilation shaft, TSS & DSS' on the said Development Plan and to modify the said Development Plan accordingly ;
And whereas, considering the request of the MCGM and of NHSRCL, the Government is satisfied that in the public interest it is expedient to modify the said Development Plan in respect of the said land so as to show the reservation of 'Ventilation shaft, TSS & DSS and allied uses' on the said land as per the revised location ;
४ महाराष्ट्र शासन राजपत्र, असाधारण, भाग एक---कोकण विभागीय पुरवणी, सप्टेंबर २, २०२२/भाद्रपद ११, शके १९४४And whereas, in exercise of the powers conferred under sub-section (1AA) of Section 37 of the said Act, Government had issued Notice of even no. dated 23rd February, 2022 for inviting suggestions/objections from the general public with regard to the proposed modification (hereinafter referred to as 'the proposed modification') as mentioned in the Schedule appended to the said Notice and appointed the Deputy Director of Town Planning, Greater Mumbai as the Officer (hereinafter referred to as "the said Officer") to complete the procedure as stipulated under Section 37(1AA) of the said Act and to submit a report on the objections/suggestions received in respect of the proposed modification to the Government after giving hearing to the concerned persons ;
And whereas, the said Notice dated 23rd February, 2022 was published in the Maharashtra Government Gazette (Part 1- Kokan Division supplement) (hereinafter referred to as "the Maharashtra Government Gazette") dated 10th March, 2022 and the said officer has submitted his report to the Government vide letter dated 20th June, 2022 through the Director of Town Planning, Maharashtra State, Pune after completing the legal procedure as stipulated under Section 37(1AA) of the said Act ;
And whereas, after considering the Report of the said Officer and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned with certain changes ;
Now, therefore, in exercise of the powers conferred upon it under Section 37(1AA)(c) of the said Act, the Government hereby :—
(A) Sanctions the proposed modification as described more specifically in the Schedule hereinunder.
(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification.
(C) Directs the Municipal Corporation of Greater Mumbai that in the Schedule of Modifications sanctioning the said Development Plan, after the last entry, the Schedule referred to at (A) above shall be added.
Schedule
(i) "The reservation of 'Railway Terminus (RT4.2)' shown on the land bearing CTS No.1/A(pt) and CTS No.51A(pt), Village-Vikroli, Mumbai is deleted and the land so deleted is included in reservation of 'Exhibition Centre (RSA5.1)'.
