क्र्मांक-भूसंपा-२०२१/प्र.क्र.४९/झोपदन-२.— ज्याअर्थी, ्मुख्य काय्गकारी अदिकारी, झोपडपट्ी पुनर्गसन प्रादिकरण, र्ांद्रे, ्मु ंबई यांच्या अदभर्रेदनार्रून ्महाराष्ट्र शासनास असरे ददसून आलरे आहरे की, उक्त प्रादिकाऱ्यास यासोबत जोडलरेल्या अनुसूची्मध्यरे (यात यापुढे ज्याचा दनददेश उक्त अनुसूची असा करण्यात आला आहरे.) न्मूद केलरेल्या झोपडपट्ी पुनर्गसन क्रेत्ार्र झोपडपट्ी पुनर्गसन योजना राबदर्णरे शक्य व्हार्रे म्हणून उक्त अनुसूची्मध्यरे दर्दनदद्गष्ट्टे केलरेली ज्मीन (यात यापुढे दजचा दनददेश उक्त ज्मीन असा करण्यात आला आहरे.) संपा ददत करणरे आर्श्यक आहरे ;

आदण ज्याअर्थी, ्महाराष्ट्र झोपडपट्ी (सु. दन. र् पु.) अदिदनय्म, १९७१ (्महा.१९७१ चा २८) च्या प्रकरण I-A च्या कल्म ३ (D) (c) (i) च्या पररच्छेद (A) अन्र्यरे सुिारणा करण्यात आलरेल्या प्रकरण पाच ्मिील कल्म १४ च्या पो्टे-कल्म (१) (यात यापुढे ज्याचा दनददेश उक्त अदिदनय्म असा करण्यात आला आहरे.) नुसार ्मुख्य काय्गकारी अदिकारी, झोपडपट्ी पुनर्गसन प्रादिकरण, र्ांद्रे, ्मु ंबई यांनी बजार्लरेल्या त्यांच्या क्र. झोपुप्रा/उदज/्टे-२/भूसंपा/ठाकुर चाळ सह.गृह./सुनार्णी/कादर्/२०१८, ददनांक २३ जानरेर्ारी २०१९ तसरेच "आपला र्ाता्गहार" या ्मराठी र्ृत्तपत्ात र् "द्मड डे" या इंग्रजी र्ृत्तपत्ात ददनांक १७ जुलै २०१८ रोजी जाहीर नो्टेीस प्रदसद्ध करण्यात यरेऊन आदण उक्त अदिदनय्मांच्या कल्म ३६ अन्र्यरे, सदर क्रेत्ात सर्ांना ठळकपणरे ददसरेल अशा दठकाणी दचक्टेर्ून, उक्त अनुसूचीच्या स्तंभ (६) ्मध्यरे न्मूद केलरेल्या ज्या व्यक्ती, उक्त जद्मनीचरे ्मालक आहरेत र्ा दहतसंबं दिय आहरेत, अशा व्यदक्तंना उक्त ज्मीन संपाददत करण्यासाठी शासनास प्रस्तार् का सादर करण्यात यरेऊ नयरे, याबाबत उपरोक्त नो्टेीस द्मळाल्यापासून र्ा र्ृत्तपत्ात नो्टेीस प्रदसद्ध झाल्याच्या तारखरेपासून १५ ददर्सांच्या कालार्िीत कारणरे दाखल करण्याबाबत फ्मा्गदर्लरे होतरे ;

भाग चार-ब-३२०–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, सप्टेंबर १४, २०२२/भाद्रपद २३, शके १९४४ आदण ज्याअर्थी, ्मुख्य काय्गकारी अदिकारी, झोपडपट्ी पुनर्गसन प्रादिकारी यांनी संबंदित झोपडीिारकांच्या सहकारी गृहदन्मा्गण संस्र्ा तसरेच जद्मनीचरे ्मालक र् दहतसंबं दित यांच्या घरेतलरेल्या सुनार्णीत, संबंदित झोपडीिारकांच्या सहकारी गृहदन्मा्गण संस्र्रेचा युक्तीर्ाद, अदिकार अदभलरेखांतील नोंदी, उक्त जद्मनीर्र दर्कास आराखड्ानुसार असलरेलरे आरक्ण तसरेच संरदक्त झोपडीिारकांनी सादर केलरेली ंबई ्मागणी न्याय्य असल्याबाबत उक्त ज्मीन संपादनाबाबतचरे अदभर्रेदन ्मुख्य काय्गकारी अदिकारी, झोपडपट्ी पुनर्गसन प्रादिकरण, ्मु यांनी राज्य शासनास ददनांक ४ जून २०२१ रोजी सादर केलरे आहरे;

आदण ज्याअर्थी, उक्त अदिदनय्माच्या प्रकरण I-A च्या कल्म ३ (D) (c) (i) च्या पररच्छेद (A) अन्र्यरे सुिारणा करण्यात आलरेल्या प्रकरण पाच ्मिील कल्म १४ च्या पो्टे-कल्म (१) नुसार ्मुख्य काय्गकारी अदिकारी, झोपडपट्ी पुनर्गसन प्रादिकरण, ्मु ंबई यांनी सादर केलरेलरे अदभर्रेदन, अहर्ाल र् त्यांनी या प्रकरणी केलरेली काय्गर्ाही राज्य शासनास उक्त अनुसूची्मध्यरे न्मूद केलरेल्या झोपडपट्ी पुनर्गसन क्रेत्ाच्या दर्कासासाठी झोपडपट्ी पुनर्गसन योजनरे अंतग्गत दर्कास करणरे शक्य व्हार्रे म्हणून उक्त ज्मीन संपाददत करणरे आर्श्यक असल्याचरे ददसून आलरे आहरे;

त्याअर्थी आता, उक्त अदिदनय्माच्या प्रकरण I-Aच्या कल्म ३ (D) (c) (i) च्या पररच्छेद (A) अन्र्यरे सुिारणा करण्यात आलरेल्या प्रकरण पाच ्मिील कल्म १४ च्या पो्टे-कल्म (१) द्ाररे प्रदान करण्यात आलरेल्या अदिकारांचा र्ापर करून ्महाराष्ट्र शासन या नोद्टेशीद्ाररे असरे घोदित करीत आहरे की त्यानरे उक्त ज्मीन संपाददत करण्याचरे ठरदर्लरे आहरे.

Maharashtra sluM areas (IMproveMent, ClearanCe and redevelopMent) aCt, 1971.

No. Bhusampa-2021/C.R.49/Zopani-2.—Whereas, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, it appears to the Government of Maharashtra that in order to enable the said Authority to implement the Slum Rehabilitation Scheme in relation to the Slum Rehabilitation Area mentioned in the Schedule appended hereto (hereinafter referred to as "the said Schedule"), it is necessary that the land specified in the said Schedule (hereinafter referred to as "the said land"), should be acquired ;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (Mah. XXVIII of 1971) (hereinafter referred to as "the said Act"), the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, has by his notice No. SRA/Dy.Coll./Te-2/L.A/Thakur Chawl CHS/Sunavani/KaVi/2018, dated the 23rd January, 2019, served in prescribed manner and also by notice published in the daily Marathi newspaper "Aapla Vartahar" and English newspaper "Mid Day" dated the 17th July 2018, and also by affixing on the conspicuous part in the premises of the said land, as provided in section 36 of the said Act, called upon the persons mentioned in column (6) of the said Schedule, who are the owners of the said land or any other person interested therein to show cause, within fifteen days from the date of its publication in the newspapers, as to why the proposal to acquire the said land for implementation of the Slum Rehabilitation Scheme for the concerned protected slum dwellers should not be sent to the State Government for approval ;

And whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, after considering the objections received in this behalf for the acquisition of the said land and pleading received on behalf of the proposed Co-operative Housing Society of the slum dwellers, entries as to the rights in the land record, reservation in the Development Plan and the legitimate request of the protected slum dwellers, by his representation dated the 4th June 2021, has submitted the report for the acquisition of the said land ;

And whereas, as required by the first proviso to sub-section (1) of section 14 of Chapter V read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, on representation received from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai and after considering his report, it appears to the State Government that, in order to enable the Slum Rehabilitation Authority to carry out the development under the Slum Rehabilitation Scheme in the Slum Rehabilitation Area mentioned in the said Schedule, the said land should be acquired ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, the Government of Maharashtra hereby declares by this notice that, it has decided to acquire the said land.
