आलि ज्याअर्थी, महाराष्ट्र प्रादेलशक लनयोजन व नगररिना अलिलनयम, १९६६ (या्त यापुढे ज्याच्या लनददेश "उक्त अलिलनयम" असा करण्या्त आिा आहे) िे किम ११३(१) द्ारे प्रदान करण्या्त आिेल्या अलिकारांिा वापर करून शासनाने नगरलवकास, साव्वजलनक आरोग्य व गृहलनमा्वि लवभागािी अलिसूिना क्रमांक आरपीबी. ११७१/१८१२४/११३/आय डब्ल्यू, लदनांक २० माि्व १९७१ द्ारे, या्त नमूद करण्या्त आिेिे क्ेत् हे नवी मु ंबई ह्ा नवीन नगरािे क्ेत् म्हिून घोलि्त केिे आहे व लसडकोस नगरलवकास, साव्वजलनक आरोग्य व गृहलनमा्वि लवभागािी अलिसूिना क्रमांक आरपीबी. १८१२४/II डब्ल्यू, लदनांक २० माि्व १९७१ अन्वये, उक्त अलिलनयमांच्या किम ११३(३अ) नुसार नवी मु ंबई या नवीन नगर क्ेत्ासाठी (उक्त नवनगरक्ेत्) नवनगर लवकास प्रालिकरि म्हिून लनयुक्त केिे आहे ;

आलि ज्याअर्थी, उक्त अलिलनयमाच्या किम ३१(१) द्ारे प्रदान करण्या्त आिेल्या अलिकारांिा वापर करून, शासनाने उक्त नवनगर क्ेत्ासाठी लसडकोने सादर केिेल्या रिनाबध्द आराखडयाच्या (Structural Plan) स्वरूपा्त असिेल्या प्रारूप लवकास योजनेस (उक्त अंल्तम लवकास योजना) नगरलवकास व साव्वजलनक आरोग्य लवभाग अलिसूिना क्रमांक आरपीबी. ११७५/६३५/ यूडी-५, लदनांक १८ ऑगस्ट १९७९ सह अलिसूिना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, लदनांक १८ जानेवारी १९८० अन्वये मंजुरी लदिेिी आहे आलि उक्त लवकास योजना लदनांक १ माि्व १९८० पासून अंमिा्त आिेिी आहे ;

भाग दोन-१२७–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, सप्टेंबर २१, २०२२/भाद्रपद ३०, शके १९४४ आलि ज्याअर्थी, महाराष्ट्र महानगरपालिका अलिलनयम (या्त यापुढे ज्यािा उल्िेख " उक्त महानगरपालिका अलिलनयम " असा करण्या्त आिा आहे) िे किम ३ च्या पोट-किम (४) नुसार महाराष्ट्र शासन नगर लवकास लवभाग, अलिसूिना क्रमांक पनप – २९१४/ व्ही आय फी सं.क्र. ३०१/प्र.क्र. ३५४/नलव-२३, लदनांक २६ सप्टेंबर २०१६ अन्वये पनवेि नगरपररिदेिे संपूि्व क्ेत् व २९ महसुिी गावांच्या क्ेत्ासाठी पनवेि महानगरपालिकेिी स्र्ापना करण्या्त आिी असून ्ती लदनांक १ ऑक्टोबर २०१६ पासून अस्स्त्वा्त आिी आहे ;

आलि ज्याअर्थी, पनवेि महानगरपालिका हद्ीमध्ये उक्त एम एम आर डी ए लवकास योजने्तीि ११ महसुिी गांवािा समावेश करिे्त आिेिा आहे ;

आलि ज्याअर्थी, उक्त अंल्तम लवकास योजना व उक्त मंजूर एम एम आर डी ए लवकास योजना या एकमेकांना िागून आहे्त आलि मंजूर लवकास योजने्तीि रस्ते उक्त मंजूर ्त्कािीन एम एम आर डी ए लवकास योजने्तीि बीड या महसुिी गावाच्या हद्ीपययं्त ्तयार करण्या्त आिेिे आहे ;

आलि ज्याअर्थी, उक्त अंल्तम लवकास योजना व उक्त मंजूर एम एम आर डी ए लवकास योजनामध्ये Missing Links असल्याने पनवेि महानगरपालिका क्ेत्ा्तीि वाह्तूक सोयीिी व दळिवळि सुकर होण्यासाठी नवीन जोड रस्ते ्तयार करिे गरजेिे आहे ;

आलि ज्याअर्थी, महाराष्ट्र महानगरपालिका अलिलनयमािे किम २०५, २०६ व २०९ अन्वये महानगरपालिका क्ेत्ामध्ये नलवन रस्ते ्तयार करिे, रस्त्यािी रूंदी लनस्चि्त करिे व रस्त्यांिी सुिारिा करिेिा अलिकार महानगरपालिकेिा आहे ;

आलि ज्याअर्थी, वरीि संदभ्व उक्त करण्यासाठी पनवेि महानगरपालिकेच्या सव्वसािारि सभेने ठराव क्र. १९०, लदनांक ५ सप्टेंबर २०१९ अन्वये आयुक्त, पनवेि महानगरपालिका यांना प्रालिकृ्त केिे आहे ;

आलि ज्याअर्थी, पनवेि महानगरपालिकेच्या सव्वसािारि सभेने ठराव क्र. ४९६, लदनांक ६ जुिै २०२२ अन्वये महाराष्ट्र महानगरपालिका अलिलनयमा्तीि ्तर्तुदीनुसार पनवेि महानगरपालिका हद्ीमध्ये खािीि नमूद नवीन रस्ते प्रस्तालव्त करून नवीन रस्त्यांिी आखिी अंल्तम करिे व सदर रस्त्याखािीि जागांिे हस्तां्तरिीय लवकास हक्क (TDR) च्या माध्यमा्तून भूसंपादन व लवकास करिे या कामासाठी मा. आयुक्त, पनवेि महानगरपालिका यांना प्रालिकृ्त करण्यास सवा्वनुम्ते मान्य्ता लदिी आहे ;

आलि ज्याअर्थी, पररलशष्टट 'अ' व पररलशष्टट 'ब' मध्ये नमूद केिेल्या मौजे बीड, ्ता. पनवेि या महसूिी गावाच्या मंजूर ३५.०० मी. रुंद साव्वजलनक रस्त्यािग्तिा स. नं. ६१ या भूखंडापासून ्ते स. नं. ६५, ६६, ६७ पययं्त ३०.०० मी. रुंदीिा व स. नं. ५४ पासून ्ते स. नं. १ या भूखंडापययं्त १८.०० मी. रुंदीिा व मौजे- अडीविी, ्ता. पनवेि या महसुिी गावाच्या अंबरनार् – कुळगांव बदिापूर व पररसर अलिसूलि्त क्ेत्ािी मंजूर लवकास योजने्त दश्वलविेल्या २४.०० मी. रुंद साव्वजलनक रस्त्यािग्तिा स. नं. १० या भूखंडापासून ्ते मंजूर ३५.०० मी. रस्त्यापय्वन्त २४.०० मी. व मंजूर ३५.०० मी. रस्त्यापासून ्ते स. नं. ८९ पययं्त ३०.०० मी. रुंदीिा नवीन साव्वजलनक रस्ता आखिे व ्तयार करण्याबाब्त महाराष्ट्र महानगरपालिका अलिलनयमािे किम २०५, २०६ व २०९ अन्वये या काया्वियािे जाहीर प्रकटन जा. क्र.पमपा/नरलव/रस्ते/२६-२१/प्र.क्र.-/२१३७/२०२२, अन्वये महाराष्ट्र शासनािे असािारि राजपत्र क्र.११२, लदनांक १० आॅगस्ट २०२२ व लदनांक ११ आॅगस्ट २०२२ च्या दै. रामप्रहार, दै. नवाकाळ, दै. लकल्िे रायगड व दै. सामना या वृत्तपत्ा्त प्रलसद्ी देऊन वरीि प्रकटन शासनाच्या राजपत्रात प्रलसद् झािेल्या लदनांकापासून ३० लदवसांच्या आ्त नागररकांकडून हरक्ती व सूिना मागलवण्या्त आिेल्या आहे्त ;

आलि ज्याअर्थी, वरीि रस्त्याच्या आखिीबाब्त नागररकांकडून लवलह्त मुद्ती्त कोित्याही हरक्ती व सूिना प्राप्त झाल्या नाही्त.

त्याअर्थी, मी गिेश देशमुख, आयुक्त, पनवेि महानगरपालिका मिा प्राप्त अलिकारांन्वये खािीि पररलशष्टट 'अ' मध्ये लवलनदथीष्टट केिेल्या नवीन जोड रस्त्यािी आखिी व पररलशष्टट 'ब' मध्ये नकाशा्त दश्वलवल्या प्रमािे रस्त्यािे संरेखांकन मंजूर करी्त आहे. सदर पररलशष्टट 'अ' व पररलशष्टट 'ब' च्या प्रल्त नागरीकांच्या पाहिी करर्ता सहाय्क संिािक, नगररिना लवभाग, पनवेि महानगरपालिका यांिे काया्विया्त काया्वियीन लदवशी व काया्वियीन वेळे्त नागररकांच्या अविोकनार्व १ मलहन्यांच्या कािाविीसाठी उपिब्ि राहीि.

रस्तयाचे संकषिप्त कववरण

मौजे-बीड, ्ता. पनवेि या महसुिी गावाच्या मंजूर ३५.०० मी. रुंद साव्वजलनक रस्त्यािग्तिा स. नं. ६१ या भूखंडापासून ्ते स. नं. ६५, ६६, ६७ पययं्त ३०.०० मी. रुंदीिा व स. नं. ५४ पासून ्ते स. नं. १ या भूखंडापययं्त १८.०० मी. रुंदीिा नवीन साव्वजलनक रस्ता आखिे ्तयार करिे. वरीि रस्त्यािे संरेखांकनामुळे बालि्त होिारे सव्हदे नं./गट नं.

मौजे-अडीविी, ्ता. पनवेि या महसुिी गावाच्या मंजूर २४.०० मी. रुंद साव्वजलनक रस्त्यािग्तिा स. नं. १० या भूखंडापासून ्ते मंजूर ३५.०० मी. रस्त्यापय्वन्त २४.०० मी. व मंजूर ३५.०० मी. रस्त्यापासून ्ते स. नं. ८९ पययं्त ३०.०० मी. रुंदीिा नवीन साव्वजलनक रस्ता आखिे व ्तयार करिे. वरीि रस्त्यािे संरेखांकनामुळे बालि्त होिारे सव्हदे नं./गट नं.

्टेीप :-वरीि रस्त्यािी प्रत्यक् आखिी कर्तेवेळी वरीि बालि्त जागेव्यल्तररक्त इ्तर जागा बालि्त हो्त असल्यास सदरिी जागा ही प्रस्तालव्त रस्त्यािा भाग समजण्या्त येईि.

PUBLIC NOTICE

Maharashtra Municipal Corporation Act,1949 Section 205, 206 & 209

No. PMC/TPD/ROADS/26 -21/S.NO.03/2358/2022

Whereas the Ambarnath - Kulgaon - Badlapur & Surrounding Notified area Development Plan has been sanctioned by the Government of Maharashtra in Urban Development Department vide notification No. TPS – 1204/941/CR – 1630/UD -12, dated 25th July 2005 and it has come into force with effect from 12th August 2005 (hereinafter referred as the said MMRDA Development plan) ;

And whereas, the Government in exercise of the powers conferred by Section 113(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " said Act ") has designated site for New – Town of Navi Mumbai (hereinafter referred to as " Said New Town ") vide Urban Development and Public Health Department's (UD and PH) Notification No. RPB. 1171/18124/I.W., dated the 20th March 1971 and CIDCO has been appointed as New Town Department Authority (NTDA) for the said New Town Under Section 113(3A) of the said Act vide Urban Development and Public Health Department's Notification No. RPB. 117/18124/II.W., dated the 20th March 1971 ;

And whereas, the Govt. in exercise of the Powers conferred by Section 31(1) of the said Act vide UD and PHD's Notification No.RPB. 1175/635/UD-5, dated the 18th January 1980 has been sanctioned the Draft Development Plan (hereinafter referred to as said Final Development Plan) in the form of structural plan submitted by CIDCO for the said New Town area and the said Final Development Plan came into force with effect from 1st March 1980 ;

And whereas, the Government in exercise of the power conferred by Section 3 of the Maharashtra Municipal Corporation Act, 1949 (hereinafter referred to as the " said MMC Act ") vide the Urban Development Department notification no. PNP. 2014/VIP No. 301/CR. 354/UD/23, dated the 26th September, 2016 constituted the Panvel Municipal Corporation for the areas of whole area of Panvel Municipal Council &29 revenue villages specified therein, which came into force with effect from 1st October 2016 ;

And whereas, the said MMRDA Development Plan's 11 revenue villages has been included in the Panvel Municipal Corporation Area ;

And whereas, the said Final Development Plan & said MMRDA Developed Plan are adjacent to each other and the roads already developed in the said Sanctioned Development plan are up to the boundary limit of Bid revenue village in said erstwhile MMRDA Development Plan ;

And whereas, there are Missing links in the said Final Development Plan & the said MMRDA Development Plan it has become expedient to connect the Missing Links by preparing new roads so as to enable the traffic Smoothly & to make the conveniently traffic within the Panvel Municipal Corporation ;

And whereas, as per the provisions of the said MMC Act, Sections 205, 206, & 209 empowers the Municipal Corporation to prepare the new roads, to decide the width of the roads and to improve the roads within the Municipal Corporation Area ;

And whereas, the Panvel Municipal Corporation vide General Body Resolution no. 190 dated 5th September 2019 delegated the powers under Section 205, 206 & 209 of the said MMC Act to Commissioner, Panvel Municipal Corporation;

And whereas, the Panvel Municipal Corporation vide General Body Resolution no. 496 dated 6th July 2022 approved and delegated powers to The Commissioner, Panvel Municipal Corporation to prepare the following mentioned roads and decide its alignment and to acquire lands affected by new roads in lieu of Transferable Development Right (TDR) within the Municipal Corporation Area as per the provisions of the said MMC Act ;

10th August 2022 and published in Daily Ramprahar, Daily Nava Kal, Daily Kille Raigad and Daily Samana newspapers on dated 11th August 2022 for inviting suggestions and objections to the said proposed draft alignment of 30.00 m wide new public street/road from S.No.61 to S.No.65, 66, 67 and 18.00 m wide new public street/road from S.No.54 to S.No.1 of Bid revenue village and 24.00 m wide new public street/road from S.No.10 adjacent to 24.00 m wide DP road shown in AKBSNA Development Plan to 35.00 m Wide Road Sanctioned under MMC Act and 30.00 m wide new public street/road from 35.00 m Wide Road Sanctioned under MMC Act to S.No.89 of Adivali revenue village, Tal-Panvel as shown in the Annexure 'A' and Annexure 'B' with the provisions contained in the sections 205, 206 and 209 of Maharashtra Municipal Corporation Act, 1949 from the public thereof within 30 days from the date of publication of the notice in Maharashtra Government Extra-Ordinary Gazette ;

And whereas, no any suggestions and objections received from public within prescribed period ;

Therefore, as per the powers delegated by Panvel Municipal Corporation to the Commissioner, Panvel Municipal Corporation and in exercise of the powers, I, Ganesh Deshmukh, Commissioner, Panvel Municipal Corporation hereby sanctions the alignment of proposed new road as mentioned in the Annexure 'A' and plan appended hereto Annexure 'B' showing the alignment of new road is kept open for the inspection of general public on all working days and in working hours in the office the of the Assistant Director of Town Planning, Panvel Municipal Corporation for a period of one month.

Description of Road

Sanctioned alignment of 30.00 m wide new public street/road from S.No.61 to S.No.65, 66, 67 and 18.00 m wide new public street/road from S.No.54 to S.No.1 of Bid revenue village, Tal-Panvel.

Details of S.No. of lands affected by the proposed alignment of the new road is as below.

Sanctioned alignment of 24.00 m wide new public street/road from S.No.10 adjacent to 24.00 m wide DP road shown in AKBSNA Development Plan to 35.00 m Wide Road Sanctioned under MMC Act and 30.00 m wide new public street/road from 35.00 m Wide Road Sanctioned under MMC Act to S.No.89 of Adivali revenue village, Tal-Panvel.

Details of S.No. of lands affected by the proposed alignment of the new road is as below.

Note.—Other than above listed survey number, if any other survey number existed while laying out the road then it will also be the part of the above proposed road.

Plan showing final alignment of both roads is kept open for Inspection in the office of the Assistant Director of Town Planning, Panvel Municipal Corporation.
