महाराष्ट्र महामार्ग अधिनियम.
क्रमांक खाक्षेस-२०२१/प्र.क्र.३४८/रस्ते-८.— ज्याअर्थी, महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित हे महाराष्ट्र महामार्ग अधिनियम (१९५५ चा ५५) याच्या कलम ४ च्या परंतुकाच्या तरतुदीं अनुसार (यात यापुढे ज्याचा निर्देश "उक्त अधिनियम" म्हणून करण्यात आला आहे) हिंदू (cid:४९३)दयस(cid:२९४)ाट बाळासाहेब ठाकरे महाराष्ट्र समृद्धी महामार्ग यांना जोडणारा शहापूर जोडमार्ग म्हणून ओळखल्या जाणाऱ्या राज्य मार्ग (विशेष) क्र.२ (ब) यासाठी (यात यापुढे ज्याचा निर्देश "उक्त महामार्ग" असा करण्यात आला आहे) महामार्ग प्राधिकरण आहे;
आणि ज्याअर्थी, महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित महामार्ग प्राधिकरणाने उक्त महामार्गाच्या संदर्भात महामार्ग प्राधिकरण म्हणून महाराष्ट्र शासनाला विनंती के ली आहे की, यासोबत जोडलेल्या अनुसूचीत उल्लेखित जमीन (यात यापुढे जिचा निर्देश "उक्त जमीन" असा करण्यात आला आहे) उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन यांसाठी आवश्यक एक सार्वजनिक प्रयोजन म्हणून उक्त अधिनियमाच्या तरतुदीं अंतर्गत उक्त महामार्ग प्राधिकरणासाठी, महाराष्ट्र शासनाकडून अधिग्रहित करण्यात येईल;
आणि ज्याअर्थी, महाराष्ट्र शासनाची खात्री पटली आहे की, एका सार्वजनिक प्रयोजनासाठी उक्त जमीन ही उक्त महामार्गाचे किंवा त्याच्या काही भागाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन यासाठी आवश्यक आहे आणि म्हणून उक्त महामार्ग प्राधिकरणासाठी, पूर्वोक्त प्रयोजनांकरिता, उक्त जमीन संपादित करणे शासनास इष्ट वाटते;
त्याअर्थी, आता, महाराष्ट्र महामार्ग अधिनियम (१९५५ चा ५५) याच्या कलम १५ च्या पोट-कलम (२) व (३) व कलम १७ (cid:४६२)ारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, या(cid:४६२)ारे,—
(एक) उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यांसाठी उक्त महामार्ग प्राधिकरणासाठी उक्त जमिनीचे संपादन करण्याची घोषणा करीत आहे;
(दोन) विनिर्दिष्ट करीत आहे की, उक्त अधिनियमाच्या कलम ७ अंतर्गत निर्गमित के लेल्या अधिसूचनेला प्रतिसाद म्हणून ज्यांच्या हरकती व सूचना यापूर्वीच विचारात घेतल्या आहेत किंवा महामार्ग प्राधिकरणाकडून सुनावणी झाली आहे अशा व्यक्तींखेरीज भाग चार-ब-३७०—१
(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टोबर ४, २०२२/आश्िवन १२, शके १९४४ उक्त जमिनीशी हितसंबंधित कोणतीही व्यक्ती, ही अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून एकवीस दिवसांच्या आत संबंधित भूसंपादन अधिकारी तथा उपजिल्हाधिकारी (सामान्य प्रशासन) ठाणे, जिल्हा ठाणे यांच्याकडे उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन यासाठीच्या प्रयोजनांसाठी उक्त जमिनीच्या वापराबाबत लेखी व त्याच्या कारणांसह आक्षेप घेऊ शकते.

NOTIFICATION
MAHARASHTRA HIGHWAYS ACT.
No. PPP 2021/C.R.348/Road-8.— Whereas, the Maharashtra State Road Development Corporation Limited is the Highway Authority for the State Highway (Special) No. 2 (B) to be known as the Shahapur Connector to Hindu Hridaysamrat Balasaheb Thackeray Maharashtra Samruddhi Mahamarg. (hereinafter referred to as "the said Highway") as per the provisions of the proviso to section 4 of the Maharashtra Highways Act (LV of 1955) (hereinafter referred to as "the said Act");
And whereas, the Maharashtra State Road Development Corporation Limited, being the Highway Authority, in respect of the said Highway, has requested the Government of Maharashtra that, the land mentioned in the Schedule appended hereto (hereinafter referred to as "the said land"), required by it for the building, maintenance, management or operation of the said Highway, being for the public purpose, be acquired by the Government of Maharashtra for the said Highway Authority under the provisions of the said Act;
And whereas, the Government of Maharashtra is satisfied that, for the public purpose, said land is required for the building, maintenance, management or operation of the said Highway or part thereof and therefore considers it expedient to acquire the said land for the aforesaid purposes for the said Highway Authority;
Now, therefore, in exercise of the powers conferred by sub-sections (2) and (3) of section 15 read with section 17 of the Maharashtra Highways Act (LV of 1955), and of all other powers enabling it in this behalf, the Government of Maharashtra hereby,—
(i) declares its intention to acquire the said land for the said Highway Authority for the building, maintenance, management or operation of the said Highway;
(ii) specifies that any person interested in the said land, other than the persons whose objections or suggestions have already been considered or heard by the Highway Authority in response to the notification issued under section 7 of the said Act, may, within twenty-one days from the date of publication of this notification in the Maharashtra Government Gazette, object to the use of the said land for the purposes of the building, maintenance, management or operation of the said Highway, in writing and stating the grounds thereof, to the Deputy Collector (General Administration) Thane, District Thane, being the concerned Land Acquisition Officer.
