याचा उल्लेख "उक्त अविवनयम" असा करणे्त आलेला आहे) च्या ्तर्तुिींनुसार बृहन्मु बृहन्मु

क्रमांक व्टेपीबी-४३१८/४८४/प्र.क्र.४४/२०२२/नवि-११.–ज्याअर्थी, महाराष्ट्र प्रािेविक ि नगररचना अविवनयम, १९६६ (यापुढे ंबई महानगरपावलकेच्या अविकार क्ेत्ाकरर्ता ंबई महानगरपावलका (यापुढे याचा उल्लेख "उक्त महानगरपावलका" असा करणे्त आलेला आहे) हे वनयोजन प्राविकरण आहे ;

आवण ज्याअर्थी, मु ंबई महानगर प्रिेि विकास प्राविकरण या विेष वनयोजन प्राविकरणाच्या अविकार क्ेत्ा्तील, (i) बांद्ा-कुलाला संकुलाच्या अविसूवच्त क्ेत्ा्तील वमठी निी आवण लालबहािूर िास्त्ी मागला यामिील क्ेत्, (ii) बांद्ा-कुलाला संकुलाच्या अविसूवच्त क्ेत्ा्तील 'ए' ब्ललॉकचे क्ेत् आवण, (iii) ओविरा वजल्हा केंद्ाच्या अविसूवच्त क्ेत्ा्तील स्िामी विेकानंि रस्तयाच्या पश्चचमेकडील क्ेत्, ही ्तीन क्ेत्े (यापुढे याचा उल्लेख "उक्त क्ेत्े" असा करणे्त आलेला आहे) िासनाच्या नगरविकास विभागाकडील अविसूचना अनुक्रमे (i) क्र.CMS/TPB-४३१४/१३०/CR.No.४२/२०१४/UD-११, वि. ३०ऑगस्टे २०१४, (ii) क्र.TPB-४३१४/१४६८/ CR-३०/२०१५/UD-११, वि. १८ नोव्हेंबर २०१५ आवण, (iii) क्र. CMS/TPB-४३१३/६५८/CR-११६/२०१४/UD-११, वि. १८ नोव्हेंबर २०१५ अन्िये संबंवि्त अविसूवच्त क्ेत्ामिून िगळून वनयोजन प्राविकरण म्हणून बृहन्मु ंबई महानगरपावलकेच्या अविकार क्ेत्ामध्ये समाविष्ट्टे केली आहे्त ;

आवण ज्याअर्थी, वनयोजन प्राविकरण म्हणून बृहन्मु ंबई महानगरपावलकेने उक्त अविवनयमाच्या कलम २३ (१) च्या ्तर्तुिींनुसार वि. ३० ऑगस्टे २०१६ चा ठराि क्र.८९४ अन्िये उक्त क्ेत्ांसाठीची विकास योजना ्तयार करण्याच्या उद्ेिास मंजुरी विली ि ्तयानुसार यासंिभाला्तील सूचना वि. २९ सप्टेंबर २०१६ च्या शासकीय राजपत्रात प्रवसध्ि करण्या्त आली. ्तद्नं्तर, उक्त अविवनयमाच्या कलम २५ मिील ्तर्तुिींनुसार उक्त क्ेत्ा्तील जवमनीच्या विद्यमान भू िापराचे सिवेक्ण करण्या्त येऊन ्तयानुसार विद्यमान भू-िापर नकािे ्तयार करण्या्त आले ;

आवण ज्याअर्थी, उक्त महानगरपावलकेने उक्त क्ेत्ांकरर्ता प्रारुप विकास योजना (यापुढे याचा उल्लेख "उक्त प्रारुप विकास योजना" असा करणे्त आलेला आहे) ्तयार केली आवण, उक्त क्ेत्े ि उक्त महानगरपावलकेच्या अविकार क्ेत्ा्तील क्ेत्ाच्या विकासामध्ये सम्तोल राखण्याचे अनुषंगाने उक्त महापावलकेने महापावलकेच्या अविकार क्ेत्ासाठी महापावलका ठराि क्र.३०७ वि. २७ मे २०१६ अन्िये यापूिथीच प्रवसध्ि केलेली प्रारूप विकास वनयंत्ण ि प्रो्तसाहन वनयमािली-२०३४ उक्त क्ेत्ांकरर्ता लागू करण्याचे प्रस्तावि्त केले; आवण ज्याअर्थी सिलासािारण सभेची वि. १२ ऑक्टेोबर २०१७ च्या ठराि क्र. ७६१ अन्िये मंजूरी घेऊन प्रारुप विकास योजनेिर नागररकांच्या हरक्ती / सूचना मागविणारी उक्त अविवनयमाच्या कलम २६ च्या पो्टे-कलम (१) खालील सूचना वि. १८ ऑक्टेोबर २०१७ रोजीच्या शासन राजपत्रामध्ये प्रवसध्ि करणे्त आली हो्ती ;

भाग एक (को.वि.पु)-१०७–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑक्टोबर ११, २०२२/आव्विन १९, शके १९४४ आवण ज्याअर्थी, उक्त अविवनयमाच्या कलम २८ (२) अन्िये गवठ्त केलेल्या वनयोजन सवम्तीने उक्त प्रारुप विकास योजनेबाब्त महानगरपावलकेकडे विवह्त मुि्ती्त प्राप्त झालेल्या हरक्ती/सूचना विचारा्त घेऊन उक्त अविवनयमाचे कलम २८(३) नुसार, वि. १५ मे २०१९ रोजी उक्त महानगरपावलकेस ्तयांच्या विफारिीसह अहिाल सािर केला हो्ता ;

आवण ज्याअर्थी, उक्त महानगरपावलकेच्या विनं्तीिरून, संचालक, नगर रचना, महाराष्ट्र राज्य यांनी ्तयांचे वि. ११ सप्टेंबर २०१८ ि वि. १८ जून २०१९ रोजीचे आिेिांन्िये, उक्त महानगरपावलकेने उक्त अविवनयमाचे कलम ३०(१) अन्िये उक्त प्रारूप विकास योजना िासनास मंजुरीस्ति सािर कराियाचे कालािीस वि. ३१ जुलै २०१९ रोजी पययं्त मुि्तिाढ विली आहे ;

आवण ज्याअर्थी, वनयोजन सवम्तीचा अहिाल विचारा्त घेऊन उक्त महानगरपावलकेने ठराि क्र.१६४, वि. २४ जून २०१९ अन्िये महानगरपावलकेने सुचविलेल्या फेरबिलास अिीन राहून वनयोजन सवम्तीने सुचविलेल्या २३ फ़ेरबिलांसह (एम-१ ्ते एम-२३) उक्त प्रारुप विकास योजनेस मंजुरी विलेली असून, सिर फेरबिल उक्त अविवनयमाचे कलम २८(४) नुसार प्रवसध्ि करून, उक्त अविवनयमाचे कलम ३० पो्टे-कलम (१) चे ्तर्तुिीनुसार उक्त प्रारुप विकास योजना िासनास वि. ३१ जुलै २०१९ रोजीचे पत्ान्िये मंजुरीसाठी सािर केलेली आहे ;

आवण ज्याअर्थी, िासनाने अविसूचना क्र.व्टेपीबी-४३१७/६२९/प्र.क्र.११८/२०१७/डीपी/नवि-११, वि.०८ मे २०१८ अन्िये उक्त महानगरपावलकेच्या अविकार क्ेत्ाकरर्ता लागू असलेल्या बृहन्मु ंबई विकास वनयंत्ण ि प्रो्तसाहन वनयमािली-२०३४ ला (यापुढे याचा उल्लेख "उक्त वनयमािली" असा करणे्त आलेला आहे.) मंजुरी विली आहे; आवण ज्याअर्थी, उक्त क्ेत्ाकरर्ता उक्त वनयमािली लागू करण्याबाब्तचे वनयोजन सवम्तीचे विफ़ारिीस उक्त महानगरपावलकेने ठराि क्र.१६४, वि.२४ जून २०१९ अन्िये मान्य्ता विली आहे;

आवण ज्याअर्थी, संचालक, नगररचना यांनी ्तयांचे वि.२१ जुलै २०२०, वि.२५ नोव्हेंबर २०२१ ि वि.०७ माचला २०२२ रोजीचे पत्ांन्िये उक्त प्रारूप विकास योजनेच्या महापावलकेच्या प्रस्तािाचे अनुषंगाने िासनास अहिाल सािर केला आहे ;

आवण ज्याअर्थी, उक्त अविवनयमाचे कलम ३१ चे पो्टे-कलम (१) अन्िये योग्य ्ती चौकिी करून ्तसेच संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचेिी सल्लामसल्त केल्यानं्तर, उक्त प्रारूप विकास योजना सारभू्त स्िरुपाचा फेरबिल (ई.पी.) िगळ्ता भागि: मंजूर करणे आि्चयक असल्याचे िासनाचे म्त झाले आहे ;

आ्ता ्तया अर्थी, उक्त अविवनयमाच्या कलम ३१, पो्टे-कलम (१) अन्िये प्राप्त अविकार आवण ्तयासंिभाला्तील सिला िक्तीचा िापर करून िासनाने खालीलप्रमाणे वनणलाय घे्तला आहे :–

१. उक्त क्ेत्ांसाठीचे उक्त प्रारूप विकास योजनेच्या भागि: क्ेत्ास या अविसूचने सोब्तचे "पररवि ष्ट्टे-ब" मध्ये िलाविण्या्त आलेला 'एम१६' सारभू्त स्िरुपाचा फेरबिल (ई.पी.) िगळ्ता "पररविष्ट्टे-अ" मध्ये िलाविलेल्या 'एम१' बाब्त सुिारणेस मंजुरी िेण्या्त ये्त आहे.

२. उक्त प्रारूप विकास योजनेच्या उिलारर्त भागासह फ़ेरबिल क्र.एम २ ्ते एम १५ आवण एम १७ ्ते एम २३ बाब्तचा वनणलाय राखून ठेिण्या्त ये्त आहे.

३. िासनाने अविसूचना क्र.व्टेपीबी-४३१७/६२९/प्र.क्र.११८/२०१७/डीपी/नवि-११, वि. ०८ मे २०१८ अन्िये मंजूर ंबई विकास वनयंत्ण ि प्रो्तसाहन वनयमािली-२०३४, केलेली उक्त महानगरपावलकेच्या अविकार क्ेत्ाकरर्ता लागू असलेली बृहन्मु सिर वनयमािलीसंिभाला्त ्तद्नं्तर िेळोिेळी वनगलावम्त केलेल्या अविसुचनांसवह्त ि सिर वनयमािलीमध्ये िेळोिेळी होणा-या बिलांसह उक्त क्ेत्ाकरर्ता सुद्ा लागू राहील.

४. सिरची अविसूचना महाराष्ट्र शासन राजपत्रामध्ये प्रवसद् झालेल्या विनांकाच्या एक मवहन्यानं्तरचा विनांक हा उक्त मंजूर विकास योजना-२०३४ अंमला्त आल्याचा विनांक राहील.

या अविसूचनेनुसार मंजूर करणे्त आलेली भागिः अंव्तम विकास योजना ही नागररकांचे अिलोकनार्ला अविसूचना अंमला्त आल्यािर एक मवहन्याच्या कालािीपययं्त नागररकांना खालील वठकाणी कायालालयीन िेळेमध्ये अिलोकनार्ला उपलब्ि राहील :– (i) प्रमुख अवभयं्ता (विकास वनयोजन), बृहन्मु ंबई महानगरपावलका, महापावलका मागला, फो्टे्ट, मु ंबई ४०० ००१.

(ii) उप संचालक, नगररचना, बृहन्मु ंबई , इन्सा ह्टेमेंट्स, ई-ब्ललॉक, आझाि मैिान, महापावलका मागला, मु ंबई ४०० ००१.

सिर अविसूचना महाराष्ट्र िासनाच्या www.maharashtra.gov.in (कायिे ि वनयम) या िेबसाई्टेिर प्रवसध्ि करण्या्त आली आहे.

URBAN DEVELOPMENT DEPARTMENT

Mantralaya, Mumbai 400 032, dated 29th September, 2022

NOTIFICATION

No. TPB-⁴³¹⁸/⁴⁸⁴/CR-⁴⁴/²⁰²²/UD-¹¹.–Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 ( hereinafter referred to as "the said Act") ;

And whereas, the jurisdiction of Mumbai Metropolitan Region Development Authority as a Special Planning Authority over the 3 Areas namely, (i) area between Mithi river and L.B.S.Marg from the notified area of Bandra-Kurla Complex, (ii) area of 'A' Block from the notified area of Bandra-Kurla Complex and, (iii) area on the west side of S.V.Road from the notified area of Oshiwara District Centre (hereinafter referred as "the said areas"), has been withdrawn from respective notified areas and these areas have been included in the area of jurisdiction of the said Corporation, vide Government in Urban Development Department's Notification (i)No.CMS/TPB- 4314/130/CR. 42/2014/UD-11, dtd. 30th August 2014, (ii) No.TPB 4314/1468/CR-30/2015/UD-11, dtd. 18th November 2015 and (iii) No.CMS/TPB-4313/658/CR-116/2014/UD-11, dtd. 18th November 2015 respectively ;

And whereas, the said Corporation being a Planning Authority for the said areas vide its Resolution No.894, dated 30th August 2016 declared its intention to prepare the Development Plan for the said areas as per section 23(1) of the said Act. Accordingly, notice to that effect was published in the Official Government Gazette on 29th September 2016. Thereafter, the survey of Existing Land Use for the said areas was carried out as laid down under section 25 of the said Act and the Existing Land Use maps were prepared ;

And whereas, the said Corporation prepared the Draft Development Plan for the said areas (hereinafter referred as "the said Draft Development Plan") and in order to maintain the balance in the development of the said areas and the remaining area under jurisdiction of the said Corporation, the said Corporation proposed to apply to the said areas, the already published Draft Development Control and Promotion Regulations (DCPR-2034) by the said Corporation vide Resolution No.307 dated 27th May 2016 for the area under jurisdiction of the said Corporation; and whereas, after obtaining sanction from the General Body, vide Resolution No.761 dated 12th October 2017, published a Notice in the Maharashtra Government Gazette dated 18th October 2017, under sub-section (1) of section 26 of the said act for inviting suggestions/objections from general public on the said Draft Development Plan ;

And whereas, the Planning Committee constituted under section 28(2) of the said Act, has considered the suggestions/objections to the said Draft Development Plan received within stipulated period by the said Corporation and submitted their report along with their recommendations to the said Corporation under section 28(3) of the said Act on 15th May 2019 ;

And whereas, on the request of the said Corporation, Director of Town Planning, Maharashtra State vide his order dated 11th September 2018 & dated 18th June 2019 has extended the time period for the submission of the said Draft Development Plan by the said Corporation under section 30(1) of the said Act to the Government for sanction up to and inclusive of dt. 31st July 2019 ;

And whereas, after considering the report of the Planning Committee, the said Corporation vide its Resolution No.164, dated 24th June 2019 has approved the said Draft Development Plan६ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑक्टोबर ११, २०२२/आव्विन १९, शके १९४४ with 23 modifications or changes (M1 to M23) carried out by Planning Committee subject to the modifications suggested by the said Corporation, which were published under section 28(4) of the said Act and submitted in accordance with the provisions of sub-section (1) of Section 30 of the said Act, to the State Government for sanction vide letter dated 31st July 2019 ;

And whereas, the Development Control and Promotion Regulations-2034 (hereinafter referred as "the said Regulations") which are applicable for the Greater Mumbai area are already sanctioned by the Government vide Notification No.TPB-4317/629/CR-118/2017/DP/UD-11, Dt. 8th June 2018;

and whereas, the said Corporation vide its Resolution No.164, dated 24th June 2019 has approved Planning Committee's recommendation to apply the said regulations to the said areas ;

And whereas, the Director of Town Planning, vide his letter dt.21st July 2020, dt. 25th November 2021 & dt. 07th March 2022 has submitted his report on the said Draft Development Plan ;

And whereas, in accordance with provisions of sub-section (1) of section 31 of the said Act, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that, it is expedient to sanction the said Draft Development Plan partly excluding the substantial Modifications ;

Now therefore, in exercise of the powers conferred by sub-section (1) of section 31 of the said Act and of all other powers enabling it on that behalf, the Government hereby :–

1. Accords sanction to the said Draft Development Plan partly, for the said areas along with the modification No.M1 shown in SCHEDULE-A appended to this Notification excluding the substantial Modification No.M16 as shown in SCHEDULE-B appended hereto.

2. Reserves the decision on remaining part of the said Draft Development Plan including Modifications No.M2 to M15 and M17 to M23 proposed by the said Corporation.

3. Clarifies that, the Development Control & Promotion Regulations-2034 sanctioned vide Government in Urban Development Department's notification No.TPB-4317/629/CR- 118/2017/DP/UD-11, dt.08/05/2018 alongwith the Notifications issued thereafter from time to time in respect of DCPR-2034 which are applicable to the Greater Mumbai area shall also be applicable to the said areas under the said Development plan with the amendments made thereto from time to time.

4. Fixes the date, one month after publication of this Notification in the Official Gazette to be the date on which the said sanctioned Development Plan for the said areas shall come into force.

The aforesaid part Final Development Plan for the said areas, sanctioned by the State Government vide this Notification shall be kept open for inspection by the general public during office hours on all working days for a period of one month from the date of coming into force of this Notification, at the office of the–

i. Chief Engineer (Development Plan), Municipal Corporation of Greater Mumbai, Mahapalika Marg, Mumbai 400 001.

ii. Deputy Director of Town Planning, Greater Mumbai, 'E' Block, ENSA Hutment, Azad Maidan, Mahapalika Marg, Mumbai 400 001.
