क्रमांक ससंवन ०३२०/ प्र.क्र.६३/ १३स.—महाराष्ट्र सहकारी संस्था अविवनयम,१९६० (१९६१ चा महा.२४) याच्या कलम १६५ च्या पटो्ट-कलम (१) ि (२) द्ारे प्रदान केलेल्या अविकारांचा आवि त्याबाब्ती्त त्यास सम्थ्ग करिाऱ्या इ्तर सि्ग अविकारांचा िापर करून, महाराष्ट्र सहकारी संस्था (सवम्तीची वनिडिूक) वनयम, २०१४ यामध्ये आिखी सुिारिा करण्यासाठी, महाराष्ट्र शासनाने सुिारिा करण्याचे प्रस्तावि्त केलेल्या वनयमांचे पुढील प्रारूप, त्यामुळे बािा पटोहचण्याचा संभि असलेल्या सि्ग व्यक्तींच्या मावह्तीकरर्ता, उक्त अविवनयमाच्या कलम १६५ च्या पटो्ट-कलम (३) द्ारे आिश्यक असल्याप्रमािे, याद्ारे, प्रवसद्ध करण्या्त ये्त आहे; आवि याद्ारे अशी नटो्टीस देण्या्त ये्त आहे की, उक्त प्रारूप, महाराष्ट्र शासनाकडून वदनांक ११ नटोव्हेंबर, २०२२ रटोजी वकंिा त्यानं्तर विचारा्त घेण्या्त येईल.

२. उपरटोक्त वदनांकापूिवी, उक्त प्रारूपाच्या बाब्ती्त, कटोित्याही व्यक्तीकडून अपर मुख्य सवचि, (सहकार ि पिन), सहकार, ंबई ४०० ०३२ यांच्याकडे ज्या कटोित्याही पिन ि िस्त्टोद्टोग विभाग, मादाम कामा माग्ग, हु्तात्मा राजगुरू चौक, मंत्ालय, विस्तार, मु हरक्ती वकंिा सूचना प्राप्त हटो्तील त्या शासनाकडून विचारा्त घेण्या्त ये्तील.

प्ारूप कनयम

महाराष्ट्र सहकारी संस्था अकधकनयम, १९६०.

(१)

भाग चार-ब-३८०-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑक्टटोबर १३, २०२२/आश्ववन २१, शके १९४४ िापर करून, महाराष्ट्र शासन, महाराष्ट्र शासन राजपत्र, असािारि, भाग चार-ब, वदनांक **** २०२२ यामध्ये प्रवसद्ध केलेली शासकीय अविसूचना, सहकार, पिन ि िस्त्टोद्टोग विभाग, क्रमांक **** वदनांक **** २०२२ अनुसार, हरक्ती ि सूचना विचारा्त घे्तल्यानं्तर, याद्ारे, महाराष्ट्र सहकारी संस्था (सवम्तीची वनिडिूक) वनयम,२०१४ यामध्ये आिखी सुिारिा करण्यासाठी पुढील वनयम करी्त आहे :—

१. या वनयमांस, महाराष्ट्र सहकारी संस्था (सवम्तीची वनिडिूक) (**सुिारिा) वनयम,२०२२ असे म्हिािे.

२. महाराष्ट्र सहकारी संस्था (सवम्तीची वनिडिूक ) वनयम, २०१४ (या्त यापुढे ज्याचा वनददेश, " मुख्य वनयम " असा केला आहे) याच्या वनयम ४ मध्ये,—

(अ) खंड (दटोन) मिील, "ब" िग्ग प्रकारा्त मटोडिाऱ्या संस्था या शीर्ा्गखालील, नोंद (३) ऐिजी पुढील नोंद दाखल करण्या्त येईल :—

"(३) रुपये दहा लाख वकंिा त्यापेक्ा अविक भरिा झालेले भाग भांडिल असिाऱ्या सि्ग प्रा्थवमक कृवर् सहकारी प्तसंस्था आवि आवदिासी कृवर् सहकारी प्तसंस्था."

(ब) खंड (्तीन) मिील, "क" िग्ग प्रकारा्त मटोडिाऱ्या संस्था या शीर्ा्गखालील, नोंद (२) आिी, पुढील नोंद समाविष्ट्ट करण्या्त येईल :—

"(१)रुपये दहा लाखांपेक्ा कमी भरिा झालेले भाग भांडिल असिाऱ्या सि्ग प्रा्थवमक कृवर् सहकारी प्तसंस्था आवि आवदिासी कृवर् सहकारी प्तसंस्था."

३. मुख्य वनयमांच्या वनयम ७७ ऐिजी, पुढील वनयम दाखल करण्या्त येईल :—

"७७. पदाकधकाऱ्यांची कनवडणूक—सवम्तीच्या सदस्यांची वनिड झाल्यानं्तर लगेचच अशा कटोित्याही संस्थेच्या पदाविकाऱ्यांची वनिडिूक, मािळत्या सवम्तीची मुद्त समाप्त हटोण्यापूिवी घेण्या्त येईल :

परं्तु, जर अविवनयमाच्या ्तर्तुदींन्िये सवम्तीची मुद्त िाढविली असेल ्तर वकंिा जेव्हा अविवनयमाच्या कलम ७८, ७८अ, वकंिा ११०अ अन्िये वनयुक्त केलेल्या प्रशासकाची वकंिा अविवनयमाच्या कलम ७७अ अन्िये वनयुक्त केलेल्या प्राविकृ्त अविकाऱ्याची मुद्त समाप्त झाल्यानं्तर वनिडिुका घे्तल्या जा्त अस्तील त्या बाब्ती्त, अशा कटोित्याही संस्थेच्या पदाविकाऱ्यांची वनिडिूक, व्तच्या उप-विींमध्ये ्तर्तूद केल्याप्रमािे, वनकाल जाहीर झालेल्या ्तारखेपासून पंिरा वदिसांच्या आ्त, घेण्या्त येईल. या प्रयटोजना्थ्ग घे्तलेली सवम्तीची सभा, राज्य सहकारी वनिडिूक प्राविकरिाने प्राविकृ्त केलेल्या अविकाऱ्याच्या अध्यक्तेखाली घेण्या्त येईल."

NOTIFICATION

Maharashtra Co-operative soCieties aCt, 1960.

No. Sasani-0320/ C.R.63/13C.—The following draft of rule further to amend the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014 (hereinafter referred to as "the principal Rules"), which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-sections (1) and (2) of section 165 of the Maharashtra Co-operative Societies Act, 1960 (Mah. XXIV of 1961), and of all other powers enabling it in that behalf, is hereby published, as required by sub-section (3) of section 165 of the said Act, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after the 11th November, 2022.

2. Any objections or suggestions, which may be received by the Additional Chief Secretary (Co-operation and Marketing), Co-operation, Marketing and Textile Department, Madam Cama Marg, Hutatma Rajguru Chowk, Mantralaya, Annex, Mumbai 400 032, from any person with respect to the said draft before the aforesaid date, will be considered by the Government.

DRAFT RULES

Maharashtra Co-operative soCieties aCt, 1960.

No. Sasani-0320/ C.R.63/13C.—In exercise of the powers conferred by sub-sections(1) and (2) of section 165 of the Maharashtra Co-operative Societies Act, 1960 (Mah.XXIV of 1961), and of all other powers enabling it that behalf, the Government of Maharashtra hereby, after considering objections and suggestions, pursuant to the Government Notification, Co-operation, Marketing and Textiles Department, No.****, dated the **** of **** 2022, published in the Maharashtra Government Gazette, Extraordinary, Part IV-B, dated the *** 2022, makes the following rules further to amend to the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014, namely :—

1. These rules may be called the Maharashtra Co-operative Societies (Election to Committee) (**Amendment ) Rules, 2022.

2. In rule 4 of the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014 (hereinafter referred to as the principal Rules),—

(a) in clause ( II ), under the heading "Type "B" Societies", for entry (3) the following entry shall be substituted, namely:—

"(3) All primary Agricultural Co-operative Credit Societies and Adiwasi Agricultural Co-operative Credit Societies having paid up share capital of ten lakh rupees or more.";

(b) in clause ( III ), under the heading "Type "C" Societies", before entry (2) the following entry shall be inserted, namely :—

"(1) All primary Agricultural Co-operative Credit Societies and Adiwasi Agricultural Co-operative Credit Societies having paid up share capital less than ten lakh rupees."

3. For rule 77 of the principal Rules, the following rule shall be substituted, namely :—

"77. Election of office bearers.— As soon as the members of the committee are elected, the election of office bearers of any such society shall be held before the expiry of the term of the outgoing committee :

Provided that, if the term of committee is extended under the provisions of the Act or where the elections are held after the expiry of the term of the administrator appointed under sections 78, 78A or 110A of the Act or authorized officer appointed under section 77A of the Act, then the election of office bearers of any such society shall be held within a period of fifteen days from the date of declaration of result as provided in its bye-laws. The meeting of the committee for this purpose shall be presided over by officer authorized by the SCEA.".
