क्र. व्टपीबी-४३१९/प्र.क्र.१८८/२०१९/नवि-११.–ज्याअर्थी, महाराष्ट्र प्रािेविक ि नगर रचना अविवनयम, १९६६ (यापुढे ज्याचा ंबई महानगरपावलका (यापुढे ज्याचा उल्लेख "उक्त ंबई क्ेत्ा्तील काही अविसूवच्त क्ेत् िगळ्ता त्यांचे अविकार क्ेत्ाकरी्ता उल्लेख "उक्त अविवनयम" असा करणे्त आलेला आहे.) च्या ्तर्तुिींनुसार बृहन्मु महानगरपावलका" असा करणे्त आलेला आहे.) ही बृहन्मु वनयोजन प्राविकरण आहे ;
ंबई महानगर प्रिेि विकास प्राविकरण अविवनयम, १९७४ अं्तग्ग्त स्र्ापन केलेल्या मु आवण ज्याअर्थी, उक्त अविवनयमाचे कलम ४० च्या उपकलम (१) च्या खंड (c)अन्िये प्राप्त अविकारांचा िापर करून िासनाने, अविसूचना क्र.बीबीआर-१०८२/प्र.क्र.-१४०/१६०७/नवि-११, वि. १५ जून, १९८३ अन्िये, बॅक-बे ररक्लेमेिन स्कीमच्या ब्ललॉक III, IV, V आवण VI मिील सािारण्त: २२२.५८ हेक्टर अविसूवच्त क्ेत्ासाठी (यापुढे ज्याचा उल्लेख "उक्त अविसुवच्त ंबई महानगर क्ेत्" असा करणे्त आलेला आहे.) मु प्रिेि विकास प्राविकरणाची (यापुढे ज्याचा उल्लेख "उक्त प्राविकरण" असा करणे्त आलेला आहे.) 'विेष वनयोजन प्राविकरण' म्हणून वनयुक्ती केली आहे ;
आवण ज्याअर्थी, उक्त अविवनयमाच्या कलम ३१(१) अन्िये िासन नगर विकास विभागाकडील अविसूचना क्र.बीबीआर- १०९२/६०/प्र.क्र.६/९२/नवि-११, वि. ३ जून, २००० अन्िये िासनाने उक्त अविसुवच्त क्ेत्ासाठी उक्त प्राविकरणाने िासनास सािर केलेला सुिारर्त प्रारुप विकास आराखडा (यापुढे ज्याचा उल्लेख "उक्त विकास योजना" असा करणे्त आलेला आहे.) उक्त अविूसचनेसोब्तचे पररविष्ट्ट-I मिील सुिारणेसह ि पररविष्ट्ट-II मिील सारभू्त स्िरुपाचे प्रस्तावि्त फेरबिल i.e. मंजूरी्तून िगळलेला भाग ( ई.पी.) िगळ्ता मंजूर केला आहे; आवण ज्याअर्थी, िासन नगर विकास विभागाकडील अविसूचना क्र. बीबीआर-१०९२/६०/ प्र.क्र.६/९२/नवि-११, वि. १७ माच्ग, २००१ अन्िये िासनाने उक्त अविसूवच्त क्ेत्ासाठीचे उक्त विकास योजने्तील सारभू्त स्िरुपाचे फेरबिलांना (ई.पी.) मंजूरी विली आहे ;

भाग एक (को.वि.पु)-१०९–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, ऑक्टोबर १८, २०२२/आव्विन २६, शके १९४४ आवण ज्याअर्थी, उक्त अविसूवच्त क्ेत्ाचे बहु्तांि भागाचा विकास पूिथीच पूण्ग झाला आहे आवण उक्त अविसूवच्त क्ेत्ासाठी उक्त प्राविकरणाची 'विेष वनयोजन प्राविकरण' म्हणून वनयुक्ती करण्याचे उवदिष्ट्ट पूण्ग झाले असल्याने उक्त प्राविकरणाने वि.११/०५/२००९, वि. १०/१२/२०१४ आवण वि.२७/१२/२०१७ रोजीचे पत्ाद्ारे उक्त अविसूवच्त क्ेत् उक्त प्राविकरणाचे 'विेष वनयोजन प्राविकरण' क्ेत्ा्तून िगळण्या्त येऊन, सिर क्ेत् उक्त महापावलकेच्या अविकार क्ेत्ा्त समाविष्ट्ट करण्याबाब्त िासनास विनं्ती केली आहे ;
आवण ज्याअर्थी, उक्त क्ेत् 'अविसूवच्त क्ेत्' म्हणून रदि करणे आवण उक्त अविसूवच्त क्ेत्ासाठी उक्त प्राविकरणाची 'विेष वनयोजन प्राविकरण' म्हणून केलेली वनयुक्ती मागे घेणे आिश्यक आहे, असे िासनाचे म्त झाले आहे ;
आवण त्याअर्थी, िासन याद्ारे,
(अ) सिर क्ेत् उक्त अविवनयमाचे कलम ४०(१)(c ) नुसारचे 'अविसूवच्त क्ेत्' म्हणून रदि करण्या्त ये्त आहे. ्तसेच, (ब) उक्त अविसूवच्त क्ेत्ासाठी उक्त प्राविकरणाची कलम ४०(१)(c ) नुसार 'विेष वनयोजन प्राविकरण' म्हणून केलेली वनयुक्ती मागे घेण्या्त ये्त आहे. ्तसेच,
(क) स्पष्ट्ट्ता करण्या्त ये्ते की, उक्त अविवनयमाचे कलम २(१५)(a) नुसार उक्त क्ेत् स्र्ावनक प्राविकरण म्हणून बृहन्मु ंबई महानगरपावलकेच्या अविकारक्ेत्ा्त ये्त असल्याने, उक्त अविवनयमाच्या कलम २(१९) नुसार यापुढे उक्त महानगरपावलका उक्त क्ेत्ासाठी वनयोजन प्राविकरण म्हणून काम पावहल. ्तसेच,
(ड) स्पष्ट्ट्ता करण्या्त ये्ते की, उक्त क्ेत्ासाठी िासनाने अविसूचना क्रमांक बीबीआर-१०९२/६०/प्र.क्र.६/९२/नवि-११, विनांक ३ जून, २००० आवण विनांक १७ माच्ग, २००१ द्ारे मंजूर केलेला विकास आराखडा, बृहन्मु ंबई विकास वनयंत्ण ि प्रोत्साहन वनयमािली, २०३४ मिील च्टई क्ेत् वनिदेिांकाबाब्तचे ्तर्तुिी ्तसेच, सीआरझेड अविसूचना वि.१८/०१/२०१९ चे ्तर्तुिींसह त्यामध्ये िेळोिेळी होणाऱ्या सुिारणेसह उक्त क्ेत्ासाठी लागू राहील. एमएमआरडीएने पुिथीच विकास परिानगी विलेल्या ्तर्ावप, विकास अियाप पूण्ग न झालेल्या प्रकरणांमध्ये उक्त महानगरपावलकेने एमएमआरडीए िी सल्लामसल्त करून काय्गिाही करािी.
या अविसूचनेची प्र्त नकािासह एका मवहन्याच्या कालािीसाठी खालील काया्गलयांमध्ये पाहणीसाठी उपलब्ि करून िेण्या्त यािी :–
(अ) प्रमुख, िहर ि प्रिेि वनयोजन विभाग, मु ंबई महानगर प्रिेि विकास प्राविकरण, िांद्े-कुला्ग कलॉम्प्लेक्स, िांद्े (पूि्ग), मु ंबई ४०० ०५१.
(ब) प्रमुख अवभयं्ता (विकास वनयोजन), बृहन्मु ंबई महानगरपावलका, महापावलका माग्ग, फो्ट्ट, मु ंबई ४०० ००१.
सिर अविसूचना महाराष्ट्र िासनाच्या www.maharashtra.gov.in (कायिे/वनयम) या िेबसाई्टिर िेखील प्रवसध्ि करण्या्त यािी.

NOTIFICATION
Maharashtra regional & town Planning act, 1966.
No.TPB 4319/CR-188/2019/UD-11.–Whereas, the Municipal Corporation of Greater Mumbai (hereinafter referred to as "the said Corporation") is the Planning Authority for jurisdiction of Greater Mumbai as per the provisions of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act"), excepting some Notified Areas ;
And whereas, the Government of Maharashtra, in exercise of the powers conferred on it by clause (c) of sub-section (1) of section 40 of the said Act, by its Notification No.BBR-1082/C.R-140/1607/ UD-11, dated 15th June, 1983, appointed the Mumbai Metropolitan Region Development Authority (hereinafter referred to as "the said Authority") established under the Mumbai Metropolitan Region Development Authority Act, 1974 as Special Planning Authority (SPA) for the Notified Area comprised within Blocks III, IV, V and VI of the Back-bay Reclamation Scheme admeasuring approx. 222.58 Ha.(hereinafter referred to as "the said Notified Area") ;
And whereas, in accordance with the sub-section (1) of Section 31 of the said Act, the Government in the Urban Development Department vide Notification No.BBR-1092/60/C.R-6/92/UD-11, dated 3rd June, 2000 has sanctioned Revised Draft Development Plan (hereinafter referred to as "the said Development Plan") submitted by the said Authority with some modifications shown in Schedule-I and excluding the proposed modifications of substantial nature i.e. Excluded Part (E.P.) shown in Schedule-II appended to the abovesaid Notification; and whereas, the Government in the Urban Development Department vide Notification No.BBR-1092/60/C.R-6/92/UD-11, dated 17th March, 2001 has sanctioned the Excluded Part (E.P.) of the said Development Plan of the said Notified Area ;
And whereas, since the most of the development of the said Area has already been done and the purpose of appointment of MMRDA as a Special Planning Authority for the said Notified Area is completed, the said authority vide its letter dated 11/05/2009, 10/12/2014 and dated 27/12/2017 has requested the Government to exclude the said Notified Area from jurisdiction of the said Authority as a Special Planning Authority and include the said area in the jurisdiction of the said Corporation ;
And whereas, the State Government is of the opinion that the said Area shall be cancelled to be the Notified Area and to withdraw an appointment of the said Authority as a Special Planning Authority for the said Notified Area ;
Now therefore, the Government hereby,
(a) Cancels the said area to be the Notified Area u/s 40 (1)(c ).
(b) Withdraws an appointment of the said Authority as a Special Planning Authority u/s 40(1)(c) ;
(c) Clarifies that, since the said area falling within the jurisdiction of BMC as a Local Authority within the meaning of section 2(15)(a), henceforth BMC shall act as a Planning Authority u/s 2(19) of the said Act.
(d) Clarifies that, the said Development Plan sanctioned by the State Government vide Notification No. BBR-1092/60/C.R-6/92/UD-11, dated 3rd June, 2000 and dated 17th March, 2001 shall continue to be in force for the said area subject to the floor space indices as per Development Control Regulations, 2034 for Greater Mumbai and also subject to the provisions of CRZ Notification dated 18th January 2019, amended from time to time. The development permission already been granted by MMRDA in which development is not completed shall be dealt with in consultation with MMRDA by the said Corporation.

(a) Chief, Town and Country Planning Division, Mumbai Metropolitan Region Development Authority, Bandra-Kurla Complex, Bandra (East), Mumbai 400 051.
(b) Chief Engineer (Development Plan), Municipal Corporation of Greater Mumbai.
