MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.
Notification
No. TPS-2721-533-CR-20-2021-UD-09.—
Whereas, the Government in Urban Development Department, vide Notification No. TPS-2716-CR- 28(A)-2016-UD-09, dated 20 December 2016 has Partly sanctioned the revised Development Plan for Gadchiroli City (hereinafter referred to as ' the said Development Plan') under Section 31(1) of the Maharashtra Regional and Twon Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act") and the same has come into force with effect from dated the 06 February 2017;
And whereas, the Gadchiroli, Municipal Council is the Planning Authority for the said Develop- ment Plan (hereinafter rreferred to as " the said Planning Authority ");
And whereas, in the said Development Plan, land bearing Survey No. 12/4, of Mouje Rampur Tukum (hereinafter referred to as " the said land ") is affected by 18.00 meter wide Development Plan Road (hereinafter referred to as " the said use ");
And Whereas, the said Planning Authority vide its General Body Resolution No. 38, dated 04th June 2018 resolved to modify the said Development Plan by deleting the part of said land, except area under 7.50 meter existing road from the said use and to be included in Residential Zone (hereinafter referred to as " the said Modification Proposal ") by carrying out a modification to the said Development Plan, by following all the legal formalities stipulated under the said Act, submitted the proposal to Government for sanction vide letter dated 18th December 2018;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed Modification should be sanctioned ;
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, +]क्ष्दन् २०-२६, २०२२/+्रम् २८-ॅॅ ४, ॅ १९४४ ३And whereas, the land owners of the said land as per the Government policy have deposited Rs. 3,38,800/- towards the 50% Government share of premium amount a per the 5% rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2022-23 in the Government Treasury on 29th August 2022 through the Assistant Director of Town Planning, Gadchiroli Branch, Gadchiroli and remaining 50% of the premium amount Rs. 3,38,800/- payable to the Planning Authority has been deposited with the Chief Officer, Gadchiroli, Municipal Council, Gadchiroli on 01st September 2022 ;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated 20th December 2016.
" In the Schedule of Modifications appended to the aforesaid Notification dated 20th December 2016 sanctioning the said Development Plan, the following new entry shall be added of the last entry "—
ENTRY
The area, affected by 18.00 meter wide Development Plan road, except area under 7.50 meter wide North-South road in center as per Non-agriculture layout, is deleted from Development Plan road and land thus released, is included in Residential Zone as shown on the plan.
This Notification shall be kept open for inspection by the general public during office hours, for the period of one month in the office of the Chief Officer, Gadchiroli Municipal Council, Gadchiroli, District Gadchiroli.

Whereas, the Development Plan of Chandrapur Town (Extended Area) is sanctioned by the Urban Development Department, Govt. of Maharashtra vide Resolution No. TPS-2294-1315-CR-253-96-UD-9, Dated 2nd June 1997 which came into force from 15th August 1997. Also the Commissioner, Chandrapur City Municipal Corporation Chandrapur has been appointed as on the Administrative Post of Chandrapur Municipal Corporation by the Urban Development Department, Govt. of Maharashtra vide Order No. MCO-2020-C.R.71 (Part-2)-UD-14, Dated 28th April 2022.
And now, Municipal Corporation of the city of Chandrapur has proposed to make Minor Modification in the aforesaid Final Development Plan vide Government Resoulation No. 49, dated 18th August 2022 under Section 37 of the Maharashtra Regional and Town Planning Act, 1966 as follows ;

Now, in pursuance of Section 37 of Maharashtra Regional and Town Planning Act, 1966 it is hereby notified that any person having any suggestions or objections to the proposed modification as mentioned above shall communicate the same in writing to the undersigned within one month from the date of publication of this notification in the official Gazette. The objections or suggestions, if any received within the above mentioned period of one month will be considered for compliance of judicial procedure by the Commissioner, Municipal Corporation of the City of Chandrapur while submitting the proposal of Modification to the Government for decision on merit basis.
