ज्याअर्थी, अंबरनार् – कुळगां्व बदिापूर ्व पररसर अलिसूलि्त क्ेत्ािी ल्वकास योजना शासनािे नगर ल्वकास ल्वभाग अलिसूिना क्र. टी पी एस-१२०४/९४१/ सीआर-१६३/०४/नल्व-१२ लदनांक २५ जुिै २००५ अन्वये शासनाने मंजुर केिी आहे आलि उक्त ल्वकास योजना लद. १२ ऑगस्ट २००५ पासून अंमिां्त आिेिी आहे (या्त या पुढे ज्यािा उल्िेख "उक्त एम एम आर डी ए ल्वकास योजना" असा करण्या्त आिा आहे) ;
आलि ज्याअर्थी, महाराष्ट्र महानगरपालिका अलिलनयम (या्त यापुढे ज्यािा उल्िेख "उक्त महानगरपालिका अलिलनयम" असा करण्या्त आिा आहे) िे किम ३ च्या पोट किम (४) नुसार महाराष्ट्र शासन नगर ल्वकास ल्वभाग अलिसूिना क्रमांक पनप – २९१४/ व्ही आय फी सं.क्र. ३०१/प्र.क्र.३५४/नल्व-२३, लदनांक २६ सप्टेंबर २०१६ अन्वये पन्वेि नगरपररषदेिे संपुि्ण क्ेत् ्व २९ महसुिी गा्वांच्या क्ेत्ासाठी पन्वेि महानगरपालिकेिी स्र्ापना करण्या्त आिी असून ्ती लदनांक ०१ ऑक्टोंबर २०१६ पासून अस्स्त्वा्त आिी आहे ;
आलि ज्याअर्थी, पन्वेि महानगरपालिका हद्ीमध्ये अंबरनार् – कुळगां्व बदिापूर ्व पररसर अलिसूलि्त क्ेत् ल्वकास योजने्तीि ११ महसुिी गां्वािा समा्वेश करिे्त आिेिा आहे ;
आलि ज्याअर्थी, पन्वेि महानगरपालिका हद्ी्तीि पन्वेि-मु ंब्ा राज्य महामागा्ण्वरीि (NH-4) मौजे-िरिा कॅम्प येर्ीि सव्हहे नं. १ (जुना सव्हहे नं. १५४) ्ते मौजे- ्तुभहे येर्ीि सव्हहे नं. ८३ पययं्त ३०.०० मी. रुंदीिा रस्ता पू्वा्णश्रमीच्या अंबरनार् – कुळगां्व बदिापूर ्व पररसर अलिसूलि्त क्ेत्ाच्या मंजूर ल्वकास आराखड्ा्त दश्णल्विा असून सदर रस्त्यामुळे मौजे-िरिा कॅम्प येर्ीि सव्हहे नं. १ (जुना सव्हहे नं. १५४) या जलमनी्वरीि लजल्हालिकारी काया्णिय, रायगड-अलिबाग यांिे आदेशान्वये मंजूर अलभन्यासा्तीि भूखंड बालि्त हो्त असल्याने संबंलि्त भूखंडिारकांनी ल्वद्यमान प्रस्ताल्व्त रस्त्याऐ्वजी सदर अलभन्यासा्तीि अस्स्त्वा्तीि १५.०० मी. रस्त्या्वरुन ३०.०० मी. रुंदीच्या रस्त्यािी आखिी घेण्या्त या्वी असे सुिल्विे आहे ;
२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, ऑक्टोबर २१, २०२२/आश्ववन २९, शके १९४४आलि ज्याअर्थी, मौजे-िरिाकॅम्प सव्हहे नं. १ (जुना सव्हहे नं. १५४) भूखंडा्वरीि मंजूर अलभन्यास हा अंबरनार्–कुळगां्व बदिापूर ्व पररसर अलिसूलि्त क्ेत्ािी ल्वकास योजना मंजूर होण्यापू्वथीिा असून उपरोक्त नमूद ३०.०० मी. रूंदीच्या ल्वकास योजना रस्त्याच्या जागे्वर मंजूर अलभन्यासानुसार प्रत्यक् बांिकाम झाल्यािे लदसून ये्ते. त्यामुळे अज्णदारांच्या मागिी ल्विारा्त घे्तल्यास प्रस्ताल्व्त ३०.०० मी. रूंदीच्या ल्वकास योजनेच्या आखिीमध्ये बदि कर्ताना ्व त्यापुढे ्तुभहे गा्वाच्या हद्ीपययं्त जािाऱ्या रस्त्याच्या आखिीमध्ये सुद्ा काही प्रस्ता्वा्त बदि करिे गरजेिे आहे. ्तसेि, महाराष्ट्र शासनाच्या नगरल्वकास ल्वभागाने मंजूर केिेल्या एकलत्कृ्त ल्वकास लनयंत्ि ्व प्रोत्साहन लनयमा्विी–२०२० मिीि लनयम क्र.३.११ नुसार 'ड' ्वग्ण महानगरपालिकेच्या बाब्ती्त सहसंिािक, नगररिना यांिेशी समन्वय सािून रस्त्याच्या प्र्वेशािा भाग ्व बाहेर जाण्यािा भाग ्तसेि ्वाह्तूक प्र्वाह यामध्ये बदि न कर्ता रस्त्याच्या आखिीमध्ये लकरकोळ बदि कर्ता येईि अशी ्तर्तूद आहे ;
आलि ज्याअर्थी, पन्वेि महानगरपालिका क्ेत्ा्तीि ्वाह्तूक सोयीिी ्व दळि्वळि सुकर होण्यासाठी अंबरनार्–कुळगां्व बदिापूर ्व पररसर अलिसूलि्त ल्वकास योजने्तीि रस्त्याच्या आखिीमध्ये लकरकोळ बदि करिे गरजेिे आहे ;
आलि ज्याअर्थी, महाराष्ट्र महानगरपालिका अलिलनयम, १९४९ िे किम २०५ अन्वये आयुक्तास महानगरपालिका क्ेत्ामध्ये लनलह्त असिेिा ल्वद्यमान सा्व्णजलनक रस्ता लकूं्वा त्यािा कोि्ताही भाग लफरल्विे लकूं्वा ्वळल्विे याबाब्त महानगरपालिकेिा अलिकार प्रदान केिे आहे ;
आलि ज्याअर्थी, ्वरीि संदभ्ण उक्त करण्यासाठी पन्वेि महानगरपालिकेच्या स्व्णसािारि सभेने ठरा्व क्र. १९० लद.०५/०९/२०१९ अन्वये आयुक्त, पन्वेि महानगरपालिका यांना प्रालिकृ्त केिे आहे ;
आलि ज्याअर्थी, पन्वेि महानगरपालिका हद्ी्तीि मौजे- िरिाकॅम्प येर्ीि सव्हहे नं. १ पासुन ्ते मौजे- ्तुभहे येर्ीि सव्हहे नं. ८३ पययं्तच्या अंबरनार्–कुळगां्व बदिापूर ्व पररसर अलिसूलि्त ल्वकास योजने्त दश्णल्विेल्या ३०.०० मी. रूंदीच्या रस्त्याच्या आखिीमध्ये बदि करून सदर पररसरा्तीि लनयोलज्त रस्त्याच्या िग्तच्या अस्स्त्वा्तीि रस्त्यांिा शक्य ल्त्तक्या भागांिा समा्वेश करून सदर रस्त्यािा ल्वकास करिे सुिभ होईि या अनुषंगाने पन्वेि महानगरपालिका स्व्णसािारि सभा ठरा्व क्र.५४६ लदनांक १८ आॅक्टोबर २०२२ अन्वये ्वरीि रस्त्याच्या आखिीमध्ये लकरकोळ बदि करून त्यानुसार सदर रस्त्यािी आखिी अंल्तम करिे ्व सदर रस्त्याखािीि जागांिे हस्तां्तरिीय ल्वकास हक्क (TDR) च्या लकूं्वा ्त्सम अन्य माध्यमा्तून भूसंपादन ्व ल्वकास करिे या कामासाठी मा. आयुक्त, पन्वेि महानगरपालिका यांना प्रालिकृ्त करण्यास स्वा्णनुम्ते मान्य्ता लदिी आहे ;
त्याअर्थी, मी गिेश देशमुख आयुक्त, पन्वेि महानगरपालिका मिा प्राप्त अलिकारांन्वये खािीि पररलशष्टट 'अ' मध्ये ल्वलनदथीष्टट केिेल्या न्वीन जोड रस्त्यािे आखिी ्व पररलशष्टट 'ब' मध्ये नकाशा्त दश्णल्वल्या प्रमािे रस्त्यािे संरेखांकन जाहीर करी्त आहे सदर पररलशष्टट 'अ' ्व पररलशष्टट 'ब' च्या प्र्ती नागररकांच्या पाहिी करर्ता सहाय्यक संिािक, नगररिना ल्वभाग, पन्वेि महानगरपालिका यांिे काया्णिया्त काया्णियीन लद्वशी ्व काया्णियीन ्वेळे्त खुिा ठे्वण्या्त आिेल्या आहे्त.
कोित्याही नागररकास प्रस्ताल्व्त रस्त्यािे आखिी बाब्त काही हरक्ती लकूं्वा सूिना असल्यास हे जाहीर प्रकटन महाराष्ट्र शासनाच्या राजपत्रात प्रलसद् झािेल्या लदनांका पासून ३० लद्वसांिे आ्त सहाय्यक संिािक, नगररिना ल्वभाग, ३ रा मजिा, अस्ननशमन इमार्त, दे्वाळे ्तिा्व पन्वेि महानगरपालिका, यांिे काया्णिया्त काया्णियीन लद्वशी ्व काया्णिया्त ्वेळे्त सादर कराव्या्त. महाराष्ट्र शासन राजपत्रात प्रलसद् लदनांकापासून ३० लद्वसांिे आ्त प्राप्त झािेल्या सूिना लकूं्वा हरक्ती यांिाि ल्विार केिा जाईि. मुद्तीनं्तर प्राप्त झािेल्या हरक्ती ्व सुिना ल्विारा्त घे्तल्या जािार नाही्त.

PANVEL MUNICIPAL CORPORATION
PUBLIC NOTICE
Through Section 205 of Maharashtra Municipal Corporation Act,1949
No. PMC/TPD/ROADS/26 -21/S.NO.05/2594/2022
Whereas the Ambarnath-Kulgaon-Badlapur and Surrounding Notified area Development Plan has been sanctioned by the Government of Maharashtra in Urban Development Department vide notification no. TPS – 1204/941/CR – 1630/UD -12, dated 25 July 2005 and it has come into force with effect from 12th August 2005 (hereinafter referred as the said MMRDA Development plan);
And whereas, the Government in exercise of the power conferred by Section 3 of the Maharashtra Municipal Corporation Act, 1949 (hereinafter referred to as the "said MMC Act") vide the Urban Development Department notification no. PNP.2014/VIP No. 301/CR. 354/UD/23 dated the 26th September, 2016 constituted the Panvel Municipal Corporation for the areas of whole area of Panvel Municipal Council and 29 revenue villages specified therein, which came into force with effect from 1st October 2016.
And whereas ; the said Ambarnath-Kulgaon-Badlapur and Surrounding Notified area Development Plan's 11 revenue villages have been included in the Panvel Municipal Corporation Area ;
And whereas, the alignment of 30.00 m wide public street/road from S.No.1 (Old Survey No. 154) of Dharana Camp Revenue Village to S.No.83 of Turbhe revenue village, Tal-Panvel shown in Sanctioned Ambarnath-Kulgaon-Badlapur and Surrounding Notified area Development Plan and the layout has been sanctioned on Survey No.1 (Old Survey No.154) of Dharana Camp revenue village by the office of The District Collector, Raigad-Alibag before the sanctioning of Ambarnath-Kulgaon-Badlapur and Surrounding Notified area Development Plan, so that the owners of aforesaid land requested to shift the alignment of 30.00 m wide public street/road over existing 15.00 m wide road in the same approved layout ;
And whereas, the layout has been sanctioned on Survey No.1 (Old Survey No.154) of Dharana Camp revenue village before the sanctioning of Ambarnath-Kulgaon-Badlapur and Surrounding Notified area Development Plan and the construction on proposed 30.00 m wide development road shown in AKBSNA development plan has been done on site as per approved layout in Survey No.1 (Old Survey No.154) of Dharana Camp revenue village. And it is need to consider the applications of owners regarding shift of alignment of 30.00 m wide public street/road shown in AKBSNA development plan. However, there is provision given in Regulation No- 3.11 of Sanctioned Unified Development Control and Promotion regulation–2020 is 'in case of shifting of road alignment the same shall be allowend without change in the inlet and outlet points and also, without affecting flow of traffic Provided that such shifting shall be carried out by Authority in consultation with Divisional Joint Director of Town Planning in case of 'D' Class Municipal Corporation' ;
And whereas, in exercise the powers vested as per section 205 of Maharashtra Municipal Corporation Act,1949 empowers the Municipal Corporation to prepare the new roads, to realign existing/proposed street/road, to decide the width of the roads and to improve the roads within the Municipal Corporation Area ;
And whereas, there is need to realign existing development plan road to enable the traffic Smoothly and to make the conveniently traffic within the Panvel Municipal Corporation ;
And whereas, the Panvel Municipal Corporation vide General Body Resolution no. 190 dated 5th September 2019 delegated the powers to The Commissioner, Panvel Municipal Corporation ;
And whereas, layout and shift of alignment of 30.00 m wide public street/road from S.No.1 of Dharana Camp revenue village to S.No.83 of Turbhe revenue village, Tal-Panvel shown in Sanctioned Ambarnath-Kulgaon-Badlapur and Surrounding Notified area Development Plan and need to be realign on existing road as where possible and the Panvel Municipal Corporation vide General Bodyमहाराष्ट्र शासन राजपत्र असाधारण भाग दोन, आॅक्टोबर २१, २०२२/आश्ववन २९, शके १९४४ ५ Resolution no. 546, dated 18th October 2022 approved and delegated the powers to The Commissioner, Panvel Municipal Corporation to prepare and realign the above-mentioned road and decide its alignment and to acquire lands affected by shift of existing proposed alignment shown in AKBSNA development plan in lieu of Transferable Development Right (TDR) or by other means of land acquisition tools within the Municipal Corporation Area as per the provisions of the said MMC Act; Therefore, as per the powers delegated by Panvel Municipal Corporation to the Commissioner, Panvel Municipal Corporation and in exercise of the powers, I, Ganesh Deshmukh, Commissioner, Panvel Municipal Corporation hereby declares the new public road mentioned in Annexure 'A' and Annexure 'B' has been proposed and it is kept open for the inspection of the public on all working days and in working hours in the office the of the Assistant Director of Town Planning, Panvel Municipal Corporation;
Any citizen, who want to submit any objection and/or suggestion about the proposed alignment of the road, he/she may submit in writing to Assistant Director of Town Planning, 3rd Floor, Fire Brigade Building, Panvel Municipal Corporation within 30 days from the publication of this notice in Maharashtra Government, Gazette. It shall be noted that, suggestion or objection if any, received by Panvel Municipal Corporation in writing within 30 days from the date of publication of this notice in the Maharashtra Government Gazette would only be considered. The suggestion/objection received after 30 days would not be considered.
