Modification under Section 37 of Maharashtra Regional and Town Planning Act, 1966
NOTICE
No. NMC-TPD-1416-2022.—
Whereas, the Revised Development Plan of Nagpur prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966, Section 31(1) has been partially sanctioned by the Govt. Vide Urban Development Department Notification No. TPS-2496-2643-CR-300(a)-97-UD-9, Date 7th January 2000 and came into force from 1st March 2000, Excluded part of Development Plan has been sanctioned vide Govt. Notification No. TPS-2400-1628- CR-200-2000-UD-9, Dated, 10th September 2001 and came into force from Date, 21st September 2001. also Nagpur Municipal Corporation has been declared as the " Planning Authority " for Nagpur City except the area covered under seven schemes vide Govt. Notification No. TPS-2401-855-CR-76-UD-9, Date, 27th February 2002 and Nagpur Municipal Corporation has been declared as " Planning Authority " for Nagpur City the areas covered under seven scheme Vide Govt. Notification No. TPS-2419-1419-CR-154-2019-UD-9, Date, 27th August 2019 and also Nagpur Municipal Corporation has been declared as " Planning Authority " for Nagpur City except the areas covered under seven shceme Vide Govt. Notification No. TPS-2419-1419-CR-154(Part-1)-2019-UD-9, Date, 9th April 2021, NIT is a Planning Authority, for the said Area ;
The land of 106.39 hectare area under the said modification proposal is owned by the Municipal Corporation, taking into account the development of that area and need for reservations to the Municipal Corporation for various purposes and the reservations in the sanctioned Development Plan of the said entire land is scattered in nature and the land is not fully utilized for the said purposes. In view of the planned development of the said land and propose reservations for various purposes to propose modification in sanctioned Development Plan due to this propose modification change in size, location and area of the reservation in the sanctioned Development Plan and implement the said proposed reservation as a Appropriate Authority. Nagpur Improvement Trust is a " Planning Authority " for the said area, NIT issues No-Objection Certificate No. 1353, Date 04-10-2022 to Nagpur Municipal Corporation for proposed modification U/s 37 of MRTP Act, 1966 ;
Due to scattered reservation in sanctioned Development Plan so many problems arises in development of said reservation at Mauza-Wathoda and Bhandewadi in the sanctioned Development Plan of Nagpur, the existing use on that land, the additional area required for the additional purposes excess area to be proposed for various purposes by changing the land use of 106.39 hectares in the sanctioned Development Plan Nagpur Municipal Corporation is required to modify the sanctioned Development Plan reservations for various purposes which is scattered in nature in that area and proposed road network with suitable reservation under Section 37 of the Maharashtra Regional Planning and Town Planning Act, 1966.
Under the proposed modification it is necessary to varies the area of reservation in the sanctioned Development Plan and to reserve areas for required reservation with road network for development. According to the existing uses of the sanctioned reservation in the Development Plan road, the sanctioned reservation and Agriculture zone and rearrange the reservation and new reservation propose in Agriculture Zone with Development Plan, road network.

The total area owned by the Municipal Corporation under this proposed modification in Mauza-Wathoda and Bhandewadi is 106.39 hectares, out of which82.16 hectares area under the various reservation in sanctioned Development Plan for above said purpose which land has been planned with required reservation and DP road network have been proposed and the proposed modification involves widening the existing Chandmari road to 24.00 m. wide D. P. Road in Khasara No. 114 (P) to Khasara No. 119. Also 24.000 m. D. P. Road along the north boundary of Skill Development College and Management Centre. Development Plan Road Propose widening of existing road on west side to Chandmari road and 18.00 m. wide D. P road to north of Animal Slaughter House & Processing and Animal Shelter Center to propose D. P road to connect existing Chandmari road on west side and also Mauza-Wathoda and Bhandewadi which land owned by Nagpur Municipal Corporation. In the Revised Sanctioned Development Plan reservation area, changes in size and location have been propose as shown in the Development Plan, Part Plan. ८ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, +]क्ष्दन् २७-म्दन् २, २०२२/ॅॅ ५-११, ॅ १९४४The 106.39 hectare land in Mauza-Wathoda and Bhandewadi in the revised sanctioned Development Plan of Nagpur is owned by Nagpur Municipal Corporation and in order to develop the said land in accordance with the planning, the said modification proposal is proposed under Section 37 of the Maharashtra Regional Planning and Town Planning Act, 1966 and Nagpur Municipal Corporation is a Appropriate Authority for said reservation. The Administrator NMC passed Administrative Resolution No. 110/NMC/Administration, Dt. 12 October 2022.
And thereafter, the Part Plan of the Revised Development Plan of Nagpur showing the above modification, Town Plannning Department of the Municipal Corporation, The office at Shri. Chhatrapati Shivaji Maharaj Administrative Building, B & C Wing, Third Floor, Mahanagarpalika Marg, Civil Lines, Nagpur-440 001 is open for public inspection on all working days during office hours. However, the citizens are informed that within a period of one month from the date of publication of this notice, the Municipal Corporation will give hearing on the suggestions or objections received to the Municipal Corporation regarding the above proposed modification in the sanctioned Development Plan After that, the said modification proposal will be submitted to the government for approval.
