भारताचे संविधान.

क्रमांक एसआरव्ही-२०२२/प्र.क्र.५८/का.१२.------ भारतीय संविधानाच्या अनुच्छेद ३०९ खालील परंतुकान्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करून, आणि बृहन्मुंबईतील शासकीय कार्यालयातील " लिपिक टंकलेखक ", गट-क (सेवाप्रवेश) नियम, २०१८ व या संदर्भात सध्या अस्तित्वात असलेले सर्व नियम, आदेश आणि अनुदेश यांचे अधिक्रमण करुन, महाराष्ट्राचे राज्यपाल याव्दारे बृहन्मुंबईबाहेरील शासकीय कार्यालयातील " लिपिक टंकलेखक ", गट-क (सेवाप्रवेश) नियम, २०१७ यामध्ये सुधारणा करण्याकरीता पुढील नियम करीत आहेत :-----

१. संक्षिप्त नाव - या नियमांना बृहन्मुंबईबाहेरील शासकीय कार्यालयातील " लिपिक टंकलेखक ", गट-क (सेवाप्रवेश) (सुधारणा) नियम, २०२२ " असे संबोधण्यात यावे.

२. बृहन्मुंबईबाहेरील शासकीय कार्यालयातील " लिपिक टंकलेखक ", गट-क (सेवाप्रवेश) नियम, २०१७" (यापुढे ज्याचा उल्लेख " मुख्य नियम " असा करण्यात आला आहे) च्या प्रास्ताविकेमधील " बृहन्मुंबईबाहेरील " हे शब्द वगळण्यात यावेत.

३. मुख्य नियमांमधील नियम १ ऐवजी खालील नियम दाखल करण्यात येईल :------

" १. या नियमांना शासकीय कार्यालयातील लिपिक-टंकलेखक, " गट-क", (सेवाप्रवेश) नियम, २०१७ असे संबोधण्यात यावे." ४. मुख्य नियमाच्या नियम २ मधील खंड (क) नंतर पुढील खंड समाविष्ट करण्यात येईल :------

" (कक) " आयोग", याचा अर्थ महाराष्ट्र लोकसेवा आयोग असा आहे."

५. मुख्य नियमाच्या नियम ३ मध्ये :------

(क) " बृहन्मुंबईबाहेरील" हे शब्द वगळण्यात यावेत ;

(ख) खंड (क) नंतर,------

(१)

भाग चार--अ--२०३---१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, नोव्हेंबर १, २०२२/कर्ातिक १०, शके १९४४ (एक) " किंवा " हा शब्द वगळण्यात यावा;

(दोन) खालील परंतुक समाविष्ट करण्यात यावे :------

" परंतु असे की, बृहन्मुंबईबाहेरील शासकीय कार्यालयातील " लिपिक टंकलेखक ", गट-क (सेवाप्रवेश)(सुधारणा) नियम, २०२२ शासन राजपत्रात प्रसिद्ध होण्याच्या दिनांकापूर्वी गट-ड मधील पद धारण करणाया आणि ज्यांनी माध्यमिक शालांत परीक्षा उत्तीर्ण केली आहे आणि खंड (ख) च्या उप खंड (तीन) मध्ये विहित केलेली अर्हता धारण केली आहे, अशा व्यक्तींचा देखील, वरील खंड (क) अंतर्गत, या नियमांच्या प्रसिद्धीपासून पाच वर्षापयर्ंत पदोन्नतीसाठी विचार करता येईल; किंवा " ;

(ग) खंड (ख) मध्ये " पुढील उमेदवारांमधून नामनिर्देशनाद्वारे,--" या शब्दांऐवजी " आयोगामार्फत घेण्यात येणाया स्पर्धा परीक्षेच्या निकालाच्या आधारे निवड झालेल्या व्यक्तींमधून नामनिर्देशनाद्वारे ,-" हे शब्द दाखल करण्यात येतील.

महाराष्ट्राचे राज्यपाल यांच्या आदेशानुसार व नावाने,

NOTIFICATION

CONSTITUTION OF INDIA.

No. SRV2022/CR58/Desk-12.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, and in supersession of the Clerk-Typist, Group C in Government offices in Brihan Mumbai (Recruitment) Rules, 2018 and all the existing rules, orders or instruments issued in this behalf, the Government of Maharashtra hereby pleased to make the following rules further to amend the Clerk-Typist, Group " C '' in the Government Offices, outside Greater Mumbai (Recruitment) Rules, 2017 as follows, namely :—

1. Short title. – These rules may be called the Clerk-Typist, Group-" C " in the Government Offices, Outside Greater Mumbai (Recruitment) (Amendment) Rules, 2022.

2. In the Clerk-Typist, Group " C " in the Government Offices, outside Greater Mumbai (Recruitment) Rules, 2017 (hereinafter referred to as " the principal rules "), in the preamble, the words " outside Greater Mumbai " shall be deleted.

3. In the principal Rules, for rule 1, the following rule shall be substituted, namely :—

" 1. These rules may be called the Clerk-Typist, Group " C " in the Government Offices (Recruitment) Rules 2017."

4. In rule 2 of the principal Rules, after clause (a), the following clause shall be inserted, namely :—

" (aa) " Commission " means, the Maharashtra Public Service Commission.".

5. In rule 3 of the principal Rules,—

(a) the words " outside Greater Mumbai " shall be deleted ;

(b) after Clause (a),—

(i) the word " or " shall be deleted ;

(ii) the following proviso shall be added, namely :—

" Provided that, the persons who are holding the post in Group "D" and who have passed the Secondary School Certificate Examination and possess qualifications mentioned in sub-clause (iii) of clause (b), before the date of publication of the Clerk- Typist, Group " C " in the Government Offices, outside Greater Mumbai (Recruitment)(Amendment) Rules, 2022, in the Official Gazettes, shall also be considered for promotion under clause (a) above, for five years from the date of publication of these rules ; or " ;

(c) in clause (b) for the words " by nomination from amongst the persons, who,-" the words " by nomination from amongst the persons, on the basis of result of Competitive Examination held by the Commission who,-" shall be substituted.
