क्रमांक बीडी/भुसंपादन/मुमरी/एस आर/१४५/२०२२.—भूमीसंपादन पुनि्वसन ि पुनि्वसाहत, करताना उवित भरपाई वमळण्यािा आवि पारदर्वकतेिा हक्क अविवन्यम २०१३ (२०१३ िर ३०) मिील कलम ३ च्या खंड (इ) च्याद्ारे प्रदान करण्यात आलेल्या अविकारािा िापर करून काढण्यात आलेली अविसूिना, महसूल ि िन विभाग क्र. संवकि्व-११/२०१४/प.क्र.७७ /अ-२, वदनांक १९ जानेिारी, २०१५ (्यात ्यापुढे वजिा वनददेर् उक्त अविसूिना असा करण्यात आला आहे.) ्याद्ारे असे अविसुवित केले आहे, उक्त अविवन्यमाच्या कलम ३ च्या खंड (झेड अ) मध्ये व्याख्या केलेल्या साि्वजवनक प्र्योजनासाठी, एखाद्ा वजल्ह्ातील ५०० हेक्टर अविक नसेल इतक्या क्ेत्ाकरीता जवमन संपादन करण्याच्या संबंिात अर्ा वजल्ह्ािा अविकारी हा उक्त अविवन्यमाच्या प्र्योजनासाठी समुवित र्ासन असलेल्या ठािे वजल्ह्ाच्या वजल्हाविकाऱ्यास ्या सोबत जोडलेल्या अनुसूिी एक मध्ये अविक तपर्ीलिार ि्वन केलेली जवमन (्यात ्यापुढे ज्यािा वनददेर् उक्त जवमन असा करण्यात आला आहे.) साि्वजवनक प्र्योजनासाठी (्यात ्यापुढे ज्यािा वनददेर् उक्त साि्वजवनक प्र्योजन असा करण्यात आला आहे.) आिश्यक आहे. अथिा वतिी आिश्यकता भासण्यािी र्क्यता आहे असे िा्टते. ज्यािे स्िरुपािे विरि ्यासोबत जोडलेल्या अनुसूिी दोनमध्ये वदलेले आहे आवि म्हिुनि उक्त अविवन्यमाच्या कलम ११ च्या पो्ट-कलम (१) च्या तरतुदी अन्ि्ये ्याद्ारे असे अविसूवित करण्यात ्येते की, उक्त जवमनीिी उक्त साि्वजवनक प्र्योजनासाठी आिश्यकता भासण्यािी र्क्यता आहे.

आवि ज्याअथथी, प्रस्तावित भूवमसंपादनाच्या अनुषंगाने बावित व्यक्क्तंिे विस्थापन करण्यास भाग पाडिारी कारिे, ्यासोबत जोडलेल्या अनुसूिी तीन मध्ये वदलेली आहेत.

आवि ज्याअथथी, मुमरी िरि प्रकल्पास र्ासनािे जी.आर वदनांक १ जुन २०१९ ि सामावजक पररिाम मुल्यांकना पासुन सु्ट वमळाल्याबाबत भार्त राजपत्रा्त प्रवसध्दी केलेला क्र. १७०, वदनांक २१ सप्टेंबर २०२२ अन्ि्ये प्राप्त झालेली आहे.

त्या अथथी असे घोवषत करण्यात ्येत आहे की, उक्त अविवन्यमाच्या कलम ११ िा पो्ट-कलम (४) नुसार कोितीही व्यक्ती ही अविसूिना प्रवसध्द झाल्याच्या वदनांकापासून ते उक्त अविवन्यमाच्या प्रकरि िार खालील का्य्विाही पूि्व होईल त्या कालािी प्ययंत उक्त जवमनीिा अथिा वतच्या भागािा कोिताही व्यिहार करिार नाही वकंिा उक्त जवमनीिर कोितेही भार वनमा्वि करिार नाही. परंतु उक्त जवमनीच्या अथिा वतच्या भागाच्या मालकाने अज्व केल्यािर वजल्हाविकाऱ्यास विर्ेष पररक्स्थतीिी कारिे लेखी नमुद करून अर्ा मालकास उपरोक्त तरतुदीच्या प्रित्वनातुन सु्ट देता ्येईल.

भाग एक (को.वि.पु)-११६–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, नोव्हेंबर ३, २०२२/काव्त्षक १२, शके १९४४ परंतु आिखी असे की, जर कोित्याही व्यक्तीने ्या तरतुदीिे बुध्दीपुरस्पर उल्लंघन केल्यामुळे वतला झालेल्या कोित्याही हानीिी वकंिा क्तीिी वजल्हाविकाऱ्या कडून भरपाई वदली जािार नाही.

तसेि उक्त अविवन्यमाच्या कलम ११ च्या पो्ट-वन्यम (५) नुसार वजल्हाविकारी भूवमसंपादन पुनि्वसन ि पुनि्वसाहत करताना उवित भरपाई वमळण्यािा आवि पारदर्वकतेिा हक्क महाराष्ट्र वन्यम १४ (्यापुढे ज्यािा वनददेर् उक्त वन्यम असा करण्यात आला आहे.) ्यांच्या वन्यम १० च्या उपवन्यम (३) द्ारे विहीत केल्याप्रमािे भूवम अवभलेखाच्या अद्ाितीकरिािे कामहाती घेिार असल्यािे ि पुि्व करिार असल्यािे देखील घोवषत करण्यात ्येत आहे.

आवि ज्याअथथी, उक्त अविवन्यमाच्या कलम ३ िा खंड (छ) समुवित र्ासन असलेल्या वजल्हाविकारी, उक्त अविवन्यमा खालील वजल्हाविकाऱ्यािी का्य्व पार पाडण्यासाठी उपविभागी्य अविकारी वभिंडी, विभाग वभिंडी ्यांस पदवनददेवर्त केले आहे.

मौजे सारंगपुरी, कोठारे, खैरे, ि जुनिीे ता. र्हापुर, वज.ठािे, क्ेत् २१७.२०० हे.आर. जवमन भातसा प्रकल्पांतग्वत मुमरी िरिासाठी संपावदत होत आहे. मुमरी िरिाच्या बांिकामामुळे मौजे सारंगपुरी, कोठारे, खैरे ि जुनिी ्या िार गािातील १०२ घरातील ३४९ लोकसंख्या विस्थापीत होत आहे, त्यांिे पुनि्वसनासाठी मौजे खैरे ्येथील अनुसुिी-३ मध्ये नमुद सव्हदे क्रमांकाच्या जवमनीमध्ये करण्यात ्येिार आहे.

विप :- उक्त जवमनीच्या नकार्ािे उप विभागी्य अविकारी वभिंडी वनररक्ि करता ्येऊ र्कते.

NOTIFICATION

No. bd/Bhusampadan/Mumari/S.R/ 145 /2022.—Whereas, the Government Of Maharashtra Vise Government Notification, Revenue And Forest department No. MIS-11/2014C.R.77/A-2, Date the 19th January 2015 (hereinafter referred to as "the said Notification") issued in exercise of the powers conferred by the provision to clause (e) of section 3 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 (30 of 2013), has notified that in relation to acquisition of land in respect of a public for an area not exceeding 500 hectors, the Collector of such District shall be deemed to be the appropriate Government, for the purpose of the said act;

And whereas, it appears to the Sub Divisional Officer Bhiwandi Division Bhiwandi, Thane District Being the appropriate Government in view of the said notification, that land more particulary described in Scheduled I appended hereto (hereinafter referred to as "the said land") is needed or likely to be needed for the public purposr, (a statement of the nature there of is contained in schedule II appended hereto) and thereof, it is hereby notified under the provision of sub- section (1) of section 11 of the said Act, that the land is likely to be needed for the said public purpose;

And whereas the reason necessitating the displacement of the affected person in view of the purpose land acquisition are contained in Schedule III appended hereto ( if there as any displacement then state the reson in this schedule);

And whereas, the summary of the Social Impact Assessment is not required as per letter no. 170, date 21 Sept 2022 given by Mumari Dam Project & Government G.R Date 26 June 2019, exempted section 10(C) for the project;

And whereas, the particulars of an administrator appointed for the purpose of Rehabilitation and Resettlement under sub-section (1) of section 43 contained in Schedule V appended hereto (if required to be appointed then state the particulars in this Schedule).

Now therefore, it is declared that as per sub-section (4) of section 11 of the said Act, no person shall make any transaction of land or part there of or create any encumbrances on said land from the date of publication of this notification till such time as the proceeding under Chapter IV of the said Act are completed;

Provided that, the Sub Divisional Officer may, on the application made by the owner of the said land or part thereof exempt in special circumstances to be recorded in writing, such owner from the operation of the above provision;

It is further declared that according to sub-section (5) of section 11 of the said Act, the Sub Divisional Officer is going to undertake and complete the exercise of updating of land records as prescribed by sub-rule (3) of rule 10 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Maharashtra) Rules, 2014 (hereinafter referred as the said Rules).

And Whereas, under clause (g) of section 3 of the said Act, the Collector being the Appropriate Government Please to designate Sub Divisional Officer Bhiwandi Division Bhiwandi, Dist-Thane (name and address of the officer to filled in before issue) to perform the function of a Collector under the said Act.

N.B- A plan of the said land can be inspected at the office of Sub Divisional Officer, Bhiwandi Division Bhiwandi.
