MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

ORDER

No. D.T.P.-D.P.HINGANGHAT (R+AA)-Sec-127(2)-Order-TPV-II-5170.—

Whereas, the Development Plan of Hinganghat Municipal Council (Revised +AA) has been sanctioned under the provisions of Section 31(1) of Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by Government in Urban Development Department vide Notification No. TPS-2905-3248-CR-121(A)-2005-UD-9, dt. 26th April 2006 (hereinafter referred to as " the said Notification ") & has come into force with effect from 15-06-2006, (hereinafter referred to as " the said Sanctioned Revised Development Plan ") ;

And whereas, as per the said Sanctioned Revised Development Plan, area of 1.64 Ha. Approximately of the land bearing S. No. 173 (New S. No. 273) of Mouza Nandagaon, Dist. Wardha is affected by the Reservation Site No. 19 " Burial Ground " (hereinafter referred to as " the said Reservation ") and the Appropriate Authority for the acquisition and development of the said Reservations is Municipal Coun- cil, Hinganghat (hereinafter referred to as " the said Appropriate Authority ") ;

And whereas, the land under said Reservation has not been acquired by the said Appropriate Au- thority within 10 (ten) years from the date on which the said Sanctioned Revised Development Plan came into force ;

And whereas, the concerned land owners (hereinafter referred to as " the said Land Owners ") of the land under the said Reservation in respect of area 1.62 Ha.of S. No. 173 (New S. No. 273) of Mouza Nandgaon, Dist. Wardha (hereinafter referred to as " the said Land") had served a notice uner Section 127(1) of the said Act, (hereinafter referred to as " the said Notice ") on the said Appropriate Authority on 20th February 2017 ;

And whereas, the said land under the said Reservation is not acquired or no steps as required under Section 127(1) of the said Act has been taken by the Appropritate Authority within the stipulated period from the date of service of the said notice by the said land owners as per the provisions of Section 127 of the said Act ;

And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the judgement dated 11th July 2022 in writ Petition No. 3765-2020 (hereinafter referred to as " the said Writ Petition ") has passed an order that, the reservation on the said land has lapsed under Section 127 of the Said Act and directed to notify the lapsing of the reservation in accordance with law ;

And whereas, Municipal Council, Hinganghat vide letter No. 172, dt. 13th September 2022 has submitted that, the Review Petition or Special Leave Petition is not filed by Municipal Council, Hinganghat against the judgement of Hon'ble High Court and the said Reservation on the said land has lapsed ;

And whereas, the Joint Director of Town Planning, Nagpur Division, Nagpur vide letter No. 1137, dt. 11th October 2022 has submitted report stating that, land affected by the said Reservation and in respect of the said land under the said Reservation, acquisition procedure has not been completed and as per the order issued by the Hon'ble High Court, Mumbai, Nagpur Bench in the said Writ Petition, it is necessary to issue an order under Section 127(2) of the said Act regarding lapsing of the said Reserva- tion on the said land. Accordingly as per the Sanctioned Revised Development Plan Report of the said land, the area affected by the said reservation is 1.64 ha. but after verification of measurement plan and said Sanctioned Development Plan, area affected by the said Reservation in the said land is 0.86 ha., Therefore, the said Reservation admeasuring approximately 0.86 Ha. of the said land has lapsed ;

And whereas, after considering the above facts in respect of the said Reservation on the said land in the said Sanctioned Development plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the lapsing of the said Reservation on the said Land ;

And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dt. 01st December 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said Land under Section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Revised Development Plan, as follows-

After the last entry in the Schedule of Modification accompanying the said Notification of the said Sanctioned Revised Development Plan, the following new entry shall be aded :—

The Development Plan of Gondia (Second Revised) has been sanctioned by Govt. in Urban Develop- ment Department vide Notification No. TPS-2311-2187-CR-249(B)-2011-UD-9, dated 4th April 2012 and came into force with effect from 15th May 2012.

Whereas, the Lakhani Nagar Panchayat, (hereinafter referred to as " the said Planning Authority,") vide Resolution No. 1, dated 15th March 2021, had declared its intention to prepare a Draft Development Plan of Lakhani (hereinafter referred to as the "said Draft Development Plan") for the area under its jurisdiction, (hereinafter referred to as the said " area ") as per the provision of Section 23(1) read with Section 21(2) and Section 38 of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as the " said Act ") and notice to that effect is published in Maharashtra Government Gazette, Nagpur, Division, Supplement Part-1-A, on 15 to 21 July 2021.

And whereas, the Town Planning Officer and Assistant Director, Town Planning, Bhandara Branch after having prepared Existing Land Use Map as per Section 25 of the said Act, has prepared the said Draft Development Plan of the said area and has handed it over to the said Planning Authority on date 16th September 2022 for publication under Section 26(1) of the said Act;

And whereas, the said Planning Authority has passed Resolution No. 01, dated 20th September 2022 to publish the said Draft Development Plan under Section 26(1) of the said Act, for inviting suggestions/ objections from the public;

Therefore, Lakhani Nagar Panchayat hereby publishes the said Draft Development Plan along with the Report under Section 26(1) of the said Act for inviting suggestions/objections from the public. The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following offices on all working days during office hours.

The Development Plan of Hinganghat has been sanctioned by the Government of Maharashtra, Urben Development Department vide Resolution No. TPS-2905-3248-.ॅ.क्ष्-929(+)क्ष्-5-ह्यम्-क्ष्क्ष्9, dated 26 April 2006.

Under the Development Plan field Survey No. 12 of Mauza Shahalangadi having area 0.40 H. A. field Survey No. 13 of Mauza Shahalangadi, having area 0.59 H. A. field Survey No. 107 of Mauza Nandgaon, having area 1.21 H. A. field Survey No. 108 of Mauza Nandgaon having area 1.43 H. A. are proposed as .-ॅ-+-४ (१७३१).

No Development Zone in Development Plan. The above field survey No. are adjacent to Sant Dnyaneshwar ward of Mauza Shahalangadi and Shashtri ward of Mauza Nandgaon which are included in Residential Zone.

The oweners of the said field Survey No. have demanded to include the above field Survey No. in Residential Zone of Development Plan. Since the said field Survey No. are included in No Development Zone of Development Plan, it is necessary to include above area in Residential Zone by under taking minor modification under Section 37(1) of the Maharashtra Regional and Town Planning Act, 1966.

Modification Under Section 37 of Maharashtra Regional and Town Planning Act, 1966

No. NMC-TPD-2148-2022.—

Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966, Section 31(1) has been partially sanctioned by the Govt. vide Urban Development Department Notification No. TPS-2496-2643-CR-300(a)-97-UD-9, dated 7th January 2000 and came into force from dated 1st March 2000. Excluded part of Development Plan has been sanctioned vide Govt. Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September 2001 and came into force from dated 21st September 2001. Also Nagpur Municipal Corporation has been declared as the "Planning Authority" for Nagpur City except the area covered under seven schemes vide Govt. Notification No. TPS-2401-855-CR-76-UD-9, dated 27th February 2002. However, as per the Government Notification No. TPS-2419-1419-CR154-2019-UD-9, dated 27th August 2019 under the Nagpur Improvement Trust Jurisdiction the Planning of the Seven Schemes under Nagpur Municipal Corporation has also been declared by the Government, but as per the Government Notification No. TPS-2419-1419-CR154 (Bhag-1)-2019-UD-9, dated 09-04-2021. So the power has been given to implement seven projects under Nagpur Municipal Corporation and Nagpur Improvement Trust ;

In the sanctioned Development Plan of Nagpur City. The land admeasuring 0.90 H.A. bearing Khasara No. 28/1 at Mouza-Jattarodi, Plot No. 'B' is reserved for Police Station vide Reservation No. MS-127 (0.90 H.A.). The Police Department is an Appropriate Authority for the said reservation. Out of the area 0.90 H.A. of said reservation 0.565 H.A. land deleted from Police Station Reservation No. MS-127 and Included in "Public Semipublic" Zone. For the said modification passed the General Body Resolution No. 218, dated 25-01-2022 under Section 37(a) as per of the Maharashtra Regional and Town Planning Act, 1966.

Therefore, the part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Deptt. of Nagpur Municipal Corporation for inspection by public during office hours on all working days. The suggestions and objections which may be received to Municipal Corporation in respect of the said modification to the Development Plan within a period of one month from the date of publication of this notice will be heard by the Municipal Commissioner before submitting the said modification proposal, to the State Government for sanction.
