Whereas, the Bhandara Municipal Council, (hereinafter referred to as "the said Planning Authority,") vide Resolution No.01, Dated 31 May 2021 had declared its intention to prepare a Draft Development Plan of Bhandara (hereinafter referred to as the "said Draft Development Plan") for the area under its jurisdic- tion, (hereinafter referred to as the said "area") as per the provision of Section 23(1) read with Section 38 of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as the "said Act") and notice to that effect is published in Maharashtra Government Gazette, Nagpur, Division, Supplement Part-1-A on 10th June 2021.

And whereas, the Town Planning Officer and Assistant Director, Town Planning, Bhandara, Branch after having prepared Existing Land Use Map as per Section 25 of the said Act, has prepared the said Draft Development Plan of the said area and has handed it over to the said Planning Authority on date 4th October 2022 for publication under Section 26(1) of the said Act;
And whereas, the said Planning Authority has passed Resolution No. 134, dated 4th October 2022 to publish the said Draft Development Plan under Section 26(1) of the said Act, for inviting suggestions/ objections from the public;
Therefore, Bhandara Municipal Council hereby publishes the said Draft Development Plan along with the Report under Section 26(1) of the said Act for inviting suggestions/objections from the public. The copy of the said Draft Development Plan and Report thereof are kept open for inspection of the public at the following offices on all working days during office hours.

The suggestions/objections if any, in writing from the public in this regard with reasons, shall be submitted to the Chief officer, Bhandara Municipal Council, within the period of 30 days from the date of publication of the Notice in Maharashtra Government Gazette. Suggestions/objections received by the Municipal Council within the period of the 30 days from the date of publication of this Notice in Maharashtra Government Gazette shall only be considered.
The copies of the said Draft Development Plan and particulars shall be available to the public at reason-able price in the office of the Bhandara Municipal Council.

Whereas, Revised Development Plan of Nagpur City has been sanctioned by the Government vide Urban Develop- ment Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 7th January 2000 and finally sanctioned the Government vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated the 10th September, 2001 and has come into force with effect from the 1st March 2000 and 21st September 2001 (hereinafter referred to as "the said Development Plan") under Sction 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Maharashtra Act No. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Khasara No. 28/1 area 1.26 Hector of Mouje Dabha (hereinafter referred to as "the said Land"), is included in Agricultural Zone;
And whereas, the Nagpur Improvement Trust, Nagpur (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No. 1180, dated the 13-06-2018 has resolved to delete the said Land from Agricultural Zone and to include the same in Residential Zone and accordingly submitted to the Government for its sanction, a modifica- tion proposal as per the provisions of sub section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas,after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune , the Government is of the opinion that the proposed Modification should be sanctioned with some conditions And whereas, the Land Owners of the said lands have deposited Rs. 16,69,500 towards the 50% Government share of 5% premium amount as per the value of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2021-22 in the Government Treasury on 11-02-2022 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 16,69, 500 payable to the Planning Authority has been deposited with the Chairman, Nagpur Improvement Trust, Nagpur on 12-01-2022;
Now therefore, in exercise of the powers conferred on it under sub, section (2) of Section 37 of the said Act, the Governent hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 07th January 2000 as follows;
"in the Schedule of Modifications appended to the Notification dated 7th January 2000 sanctioning the said Devel- opment Plan the following new entry shall be added after the last entry".

" The land bearing Khasara No. 28/1 area 1.26 Hector of Mouje Dabha is deleted from Agriculture Zone and land thus released, is included in Residential Zone as shown on the plan, subject to the conditions mentioned specified below :–
Condition No. 1 : In the layout of the said Land, 10% Amenity Space shall be provided in addition to compulsory open space, as per the prevailing Development Control Regulations for Nagpur.
Condition No. 2 : It is necessary to construct compound wall around the open space.
Condition No. 3 : It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the land under modification at his own cost. The basic amenities included as road, water supply, sewerage and drainage etc.
Condition No. 4 : If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chairman, Nagpur Improvement Trust, Nagpur in relation to development of basic amenities as per the stages given below.—.
(a) After final approval of layout Sale of 25% of the total Plots shall be permissible.
(b) After completion of 40% basic Sale of 50% of the total Plots shall be permissible.

Whereas, Revised Development Plan of Nagpur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496/2643-CR-300(A)-97-UD-9, dated 7th January, 2000 and finally sanctioned th Government vide Notification No. TPS-2400/1628-CR-200-2000- UD-9, dated the 10th September, 2001 & has come into force with effect from 1st March, 2000 & 21st September, 2001 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") ;
And whereas, in the said Development Plan, land bearing Khasara Nos. 6, 7, 8(pt.), 9(pt.), 10(pt.), 11/ 2, 11/3, 12, 13 & 80(pt.) of Mouje Bhandewadi and Khasara No. 69/1, 69/2 & 81/1 of Mouje Pardi (herein- after referred to as "the said Lands") are reserved for Site No.E-34 Primary School, Site No.E-33 Market, Site No.ME-40 Park and 18.00 Mt. (East--West) D.P. Road (hereinafter referred to as "the said reserva- tions") ;
And whereas, the Nagpur Municipal Corporation, Nagpur being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its Resolution No. 35, dated 20th Juanuary 2021 has resolved to making modification in reservation boundary, change in nomenclature, for the said reservation and proposed to Site No.E-33 Market, Parking, Grave-Yard, Site No.E-34 Mutton & Fish Market, Site No.ME-40 Vegetable Market, Residential, 12.00mt. D.P. Road towards Southern from Bhandara road & 12.00mt. D.P. Road upto 18.00mt. D.P. Road on Eastern side. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act submitted to the Government for it's sanction, modification proposal (hereinafter referred to as "the said Modification Pro- posal") ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the said Modification proposal should be sanctioned with some Conditions ;
And whereas, the some of the land/s out of the said modification proposal are Private and such land/s are proposed to be included in Residential Zone. The Notificaiton in respect of such Private land/s will be issued after payment of 5% premium calculated as per rate of land prescribed in ASR, as per government policy dated 20 April 2016, by the land owner ;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 07 January 2000 as follows.—
