क्रमांक बीडी/भु.सं./बुलेट ट्रेन/अविसुचना/कावि-६५४.—भूवमसंपादन, पुनि्वसन ि पुनि्वसाहत करताना उवचत भरपाई वमळण्याचा आवि पारदर्वकतेचा हक्क अविवन्यम, २०१३ (२०१३ चा ३०) च्या कलम ३ च्या खंड (इ) च्या द्ारे प्रदान करण्यात आलेल्या अविकारांचा िापर करून काढण्यात आलेली अविसूचना, महसूल ि िन विभाग, क्र. संकीि्व ११/२०१४/प्र.क्र.७७/अ-२, वदनांक १९ जानेिारी, २०१५ (्यात ्यापुढरे वजचा वनददेर् " उक्त अविसूचना '' असा करण्यात आला आहे) ्याद्ारे असे अविसूवचत केले आहे की, उक्त अविवन्यमाच्या कलम ३ च्या खंड (झेड अ) मध्ये व्याख्या केलेल्या एखाद्ा साि्वजवनक प्र्योजनासाठी, एखाद्ा वजल्ह्ातील ५०० हेक्टरपेक्ा अविक नसेल इतक्या क्ेत्ाकररता जमीन संपादन करण्याच्या संबंिात, अर्ा वजल्ह्ाचा वजल्हाविकारी हा उक्त अविवन्यमाच्या प्र्योजनासाठी समुवचत र्ासन असलेल्या, ठािे वजल्ह्ाच्या वजल्हाविकाऱ्यास ्यासोबत जोडलेल्या अनुसूची एकमध्ये अविक तपर्ीलिार ि्वन केलेली जमीन साि्वजवनक प्र्योजनासाठी (्यात ्यापुढरे ज्याचा वनददेर् " उक्त साि्वजवनक प्र्योजन '' असा करण्यात आला आहे) आिश्यक आहे. अथिा वतची आिश्यकता भासण्याची र्क्यता आहे असे िाटते. ज्याचे स्िरूपाचे विरि ्यासोबत जोडलेल्या अनुसूची दोनमध्ये वदलेले आहे आवि म्हिूनच उक्त अविवन्यमाच्या कलम ११ च्या पोट-कलम (१) च्या तरतुदीन्ि्ये ्याद्ारे असे अविसूवचत करण्यात ्येते की, उक्त जवमनीची साि्वजवनक प्र्योजनासाठी आिश्यकता भासण्याची र्क्यता आहे ;

आवि ज्याअथथी, प्रस्तावित भूवमसंपादनाच्या अनुषंगाने बािीत व्यक्तींचे विस्थापन करण्यास भाग पाडिारी कारि े, ्यासोबत जोडलेल्या अनुसूची तीनमध्ये वदलेले आहेत; कोितीही व्यक्ती विस्थापन होत नाही तसेच सामावजक पररिाम वनिा्वरि करण्याची गरज नसल्याचे भूवमसंपादन, पुनि्वसन ि पुनि्वसाहत करताना उवचत भरपाई वमळण्याचा आवि पारदर्वकतेचा हक्क अविवन्यम, २०१३ चे कलम १० (क) पासून र्ासनाचे वदनांक १ जुलै २०१९ अन्ि्ये अविवन्यमाच्या प्रकरि दोनच्या ि तीनच्या तरतुदी लागू करण्यापासून उक्त प्रकल्पाला सूट वदली आहे ;

आवि ज्याअथथी, उक्त अविवन्यमाच्या कलम ४३ च्या पोट-कलम (१) अन्ि्ये पुनि्वसन ि पुनि्वसाहत ्या प्र्योजनासाठी वन्युक्त केलेल्या प्र्ासकाचा तपर्ील, ्यासोबत जोडलेल्या अनुसूची पाचमध्ये वदलेला आहे.

त्याअथथी, असे घोवषत करण्यात ्येते की, उक्त अविवन्यमाच्या कलम ११ च्या पोट-कलम ४ नुसार कोितीही व्यक्ती ही अविसूचना प्रवसद्ध झाल्याच्या वदनांकापासून ते उक्त अविवन्यमाच्या प्रकरि चार खालील का्य्विाही पूि्व होईल त्या कालािीप्ययंत उक्त जवमनीचा अथिा वतच्या भागाचा कोिताही व्यिहार करिार नाही वकंिा उक्त जवमनीिर कोिताही भार वनमा्वि करिार नाही. परंतु उक्त जवमनीच्या अथिा वतच्या भागाच्या मालकाने अज्व केल्यािर वजल्हाविकाऱ्यास विर्ेष पररस्स्थतीची कारिे लेखी नमूद करून अर्ा मालकास उपरोक्त तरतुदीच्या प्रित्वनातून सूट देता ्येईल:

भाग एक (को.वि.पु)-१२३–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, नोव्हेंबर २९, २०२२/अग्रहायण ८, शके १९४४ परंतु आिखी असे की, जर कोित्याही व्यक्तीने ्या तरतुदीचे बुध्दीपुरस्सर उल्लंघन केल्यामुळरे वतला झालेल्या कोित्याही हानीची वकंिा क्तीची वजल्हाविकाऱ्याकडून भरपाई वदली जािार नाही.

तसेच, उक्त अविवन्यमाच्या कलम ११ च्या पोट-कलम (५) नुसार वजल्हाविकारी, भूवमसंपादन, पुनि्वसन ि पुनि्वसाहत करताना उवचत भरपाई वमळण्याच्या ि पारदर्वकता हक्क (महाराष्ट्) वन्यम, २०१४ (्यात ्यापुढरे त्यांचा वनददेर् " उक्त वन्यम '' असा करण्यात आला आहे.) ्यांच्या वन्यम १० च्या उप वन्यम (३) द्ारे विवहत केल्याप्रमािे भूवमअवभलेखाच्या अद्याितीकरिाचे काम हाती घेिार असल्याचे ि पूि्व करिार असल्याचे देखील घोवषत करीत आहे ;

आवि ज्याअथथी, उक्त अविवन्यमाच्या कलम ३ च्या खंड (छ) अन्ि्ये समुवचत र्ासन असलेले वजल्हाविकारी, ठािे उक्त अविवन्यमाखालील वजल्हाविकाऱ्यांची का्यदे पार पाडण्यासाठी उप विभागी्य अविकारी, वभिंडी, उप विभाग, वभिंडी ्यांस पदवनददेवर्त करीत आहोत.

अनुसूची-चार

महाराष्ट्र शासन राजपत्र, असािारि क्र.५७, वदनांक २६ एवप्रल, २०१८ अन्ि्ये साि्वजवनक-खाजगी भागीदारी खालील प्रकल्पांसह पा्याभूत सुविा प्रकल्प, ज्यात जवमनीची मालकी राज्य र्ासनाकडरे विवहत असण्याचे चालू राहील. अश्या वसंचन प्रकल्पांना सामावजक प्रभाि वनिा्वरिापासून सूट वदली असल्यामुळरे सामावजक प्रभाि वनिा्वरि करण्यात आलेले नाही. त्यामुळरे त्याचा सारांर् प्रकावर्त करण्याचा प्रश्न उद्भित नाही.

(सामावजक प्रभाि वनिा्वरि अभ्यास करिाऱ्या अविकाऱ्याने वदलेल्या सामावजक प्रभाि वनिा्वरि सारांर्) र्ासन, महसूल ि िन विभाग, मंत्ाल्य, मु ंबई-३२ ्यांनी त्यांचेकडील अविसूचना, क्रमांक ०१/२०१५/ प्र.क्र.३/अ-२, वदनांक १३ माच्व, २०१५ व्दारे भूवमसंपादन, पुनि्वसन ि पुनि्वसाहत करताना उवचत भरपाई वमळण्याचा आवि पारदर्वकतेचा हक्क अविवन्यम, २०१३ (२०१३ चा ३०) ्यामध्ये कलम १० समाविष्टट केले असून, त्यामध्ये अर्ी तरतूद केली आहे की, समुवचत र्ासनाला जनवहताच्या दृष्टटीने अविसूचनेद्ारे उक्त अविवन्यमाच्या प्रकरि दोन ि प्रकरि तीन ्यांच्या तरतुदी लागू करण्यापासून सूट देता ्येते. त्यानुसार महाराष्ट्र शासन राजपत्र, असािारि क्रमांक १६०, वदनांक २९ जून २०१९ नुसार उक्त फरक प्रकल्पाला जनवहताच्या दृष्टटीने लोकवहतकारी प्रकल्प असल्याकारिाने प्रकरि दोन आवि प्रकरि तीनच्या तरतुदी लागू करण्यापासून उक्त प्रकरिाला सूट देण्यात आली आहे.

सदर अविसूचनेव्दारे ज्या जवमनीची साि्वजवनक प्र्योजनासाठी आिश्यकता आहे वकंिा आिश्यकता भासण्याचा संभि असल्याचे का्यद्ाचे ११ चे उप-कलम (१) खांली अविसूवचत करण्यात आले आहे. प्रारंवभक अविसूचनेच्या तारखेपासून ६० वदिसांच्या आत उप विभागी्य अविकारी तथा भूसंपादन अविकारी, वभिंडी ्यांचे का्या्वल्यात आक्ेप नोंदविेत ्येईल.

NOTIFICATION

No.BD/LAQ/Mumbai-Ahmadabad High Speed/SR- 654.-----Whereas, the Government of Maharashtra vide Government Notification, Revenue and Forest department, No. MIS-11/2014/ C.R.77/A-2, date the 19th January 2015(hereinafter referred to as "the said notification") issued in exercise of the powers conferred by the provision to clause (e) of section 3 of the right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act,2013 (30 of 2013), has notified that in relation to acquisition of land in respect of a public for an area not exceeding 500 hectares, the collector of such District shall be deemed to be the appropriate Government, for the purpose of the said act ;

And whereas, it appears to the Sub Divisional Officer, Bhiwandi Division, Bhiwandi, Thane District Being the appropriate Government in view of the said notification, that land more particularly described in Scheduled-I appended hereto (hereinafter referred to as "the said land"), is needed or likely to be needed for the public purpose (a statement of the nature there of is contained in Schedule-II appended hereto) and thereof, it is hereby notified under the provisions of sub-section(1) of section 11 of the said Act, that the land is likely to be needed for the said public purpose ;

And whereas, the reason necessitating the displacement of the affected persons in view of the purpose land acquisition are contained in Schedule-III appended hereto (if there as any displacement then state the reasons in this schedule); There is no displacement ;

And whereas, the summary of the Social Impact Assessment is not required as per letter No.57, date 26th April 2018 given by the Mumbai-Ahmedabad National High Speed Rail Project & Government G.R., Date 1/7/2019, exempted section 10(C) for this project ;

And whereas, the particulars of an Administrator appointed for the purpose of rehabilitation and resettlement under sub-section (1) of section 43 contained in Schedule-V appended hereto (if required to be appointed then state the particulars in this Schedule) ;

Now, therefore, it is declared that as per sub-section (4) of section 11 of the said Act, no person shall make any transaction of land or part thereof or create any encumbrances on said land from the date of publication of this Notification till such time as the proceeding under Chapter IV of the said Act are completed :

Provided that, the Sub Divisional Officer may, on the application made by the owner of the said land or part thereof exempt in special circumstances to be recorded in writing, such owner from the operation of the provision :

Provided further that, any loss or injury suffered by any person due to his willful violation of this provision shall not be made by the Collector.

It is further declared that according to sub-section (5) of section 11 of the said Act, the Sub Divisional Officer is going to undertake and complete the exercise of updating of land records as prescribed by sub-rule (3) of rule 10 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Maharashtra) Rules, 2014 (hereinafter referred as the said rules) ;

And whereas, under clause(g) of section 3 of the said Act, the Collector being the Appropriate Government Please to designate Sub Divisional Officer, Bhiwandi Division, Dist. Thane (name and address of the Officer to filled in before issue) to perform the functions of a Collector under the said Act.
