आशण जयाअ्थी, महाराष्ट्र िासनाचया नगरशवकास शवभागाकडील अशिसूनचा क्र. शिपीबी-४३१७/६२९/सीआर-११८(III)/२०१७/ नशव-११, शदनांक १२ नोवहेंबर २०१८ रोजीचया िुशधिपत्कानवये बृहनमु ंबई महानगरपाशलका शवकास शनयंत्ण व प्ोतसाहन शनयमावली मंजूर झालेली असून ती शदनांक १३ नोवहेंबर २०१८ पासून अंमलात आलेली आहे (यापुढे जयाचा उललेख "उकत शनयमावली" याप्माणे करणयात आला आहे) ;

आशण जयाअ्थी, महाराष्ट्र िासनाचया गृहशनमा्गण व शविेष सहायय शवभागाने १६ शडसेंबर १९९५ चया अशिसूचना क्रमांक झोपुयो. १०९५/प्.क्र. ३७/गृहशनमा्गण सेल अनवये महाराष्ट्र झोपडपट्ी (सुिारणा, शनमू ्गलन व पुनशव्गकास) अशिशनयम, १९७१ मिील कलम ३(अ) मिील तरतुदीचया अिीन राहून "झोपडपट्ी पुनव्गसन प्ाशिकरणाची" शनयुकती केली आहे. (यापुढे जयाचा उललेख "उकत प्ाशिकरण" याप्माणे करणयात आला आहे) ;

आशण जयाअ्थी, उकत अशिशनयमातील कलम २(१९)(बी) नुसार उकत प्ाशिकरणास बृहनमु ंबई क्ेत्ात झोपडपट्ी पुनव्गसन योजना राबशवणयाकररता सदर अशिशनयमात अशभप्ेत असणारा शनयोजन प्ाशिकरणाचा दजा्ग शदलेला असून तयानुसार उकत अशिशनयमातील कलम ३७(१बी) अनवये मंजूर शवकास योजनेमधये फेरबदल प्सताशवत करणयासंबंिीचा प्सताव तयार करून िासनास सादर करणयाचा उकत प्ाशिकरणास अशिकार प्ापत झाला आहे ;

आशण जयाअ्थी, उकत प्ाशिकरणाचा ठराव क्र. ५/६/४, शदनांक २८ ऑगसि १९९७ अनवये मुखय काय्गकारी अशिकारी, झोपडपट्ी पुनव्गसन प्ाशिकरण यांना उकत अशिशनयमाचया कलम ३७(१-बी) खालील तरतुदीनुसार जनतेकडून सूचना/हरकती मागशवणयाकररता प्ाशिकृत करणयात आले आहे ;

(१)भाग दोन-१४६–१ २ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, डिसेंबर ५, २०२२/अग्रहायण १४, शके १९४४ आशण जयाअ्थी, झोपडपट्ी पुनव्गसन योजनेअंतग्गत/झोपडपट्ी पुनव्गसन क्ेत्ांतग्गत/घोशषत झोपडपट्ी क्ेत्ात/झोपडपट्ी पुनव्गसन प्ाशिकरणाचया काय्गक्ेत्ात, महाराष्ट्र प्ादेशिक व नगररचना अशिशनयम, १९६६ चे कलम ३७(१-बी) व इतर योगय तया कलमाखाली मु ंबई शवकास आराखड्ात आवशयकतेनुसार फेरबदल, सुिारणा इतयादी करणयाचे प्सताव मांडणयाचे झोपडपट्ी पुनव्गसन प्ाशिकरणाचे अशिकार, मुखय काय्गकारी अशिकारी, झोपडपट्ी पुनव्गसन प्ाशिकरण यांना प्ाशिकरणाचया शदनांक ७ जून २००४ रोजीचया बैठकीत बाब शिपपणी क्र. १२.६ अनवये प्दान करणयात आलेले आहेत ;

आशण जयाअ्थी, बोरीवली पशशचम, मु ंबई उपनगर शजलहा, "आर/मधय" शवभाग, ये्ील नगररचना योजना, बोरीवली क्र.-III, अंशतम भुखंड क्र. ५३१ (यापुढे जयाचा उललेख "उकत जमीन" याप्माणे करणयात आला आहे) हे गणनाकृत झोपडपट्ी वसाहत असून ती गावदेवी रशहवािी सहकारी गृहशनमा्गण संस्ा (शनयो.) या नावाने ओळखली जाते (यापुढे जयाचा उललेख "उकत झोपडपट्ी सोसायिी" याप्माणे करणयात आला आहे) ;

आशण जयाअ्थी, उकत झोपडपट्ी सोसायिीने उकत जशमनीवरील प्सताव शवकशसत करणयासाठी "SHUBHYUVI Infrastructure LLP" या शवकासकाची शनयुकती केलेली आहे. (यापुढे जयाचा उललेख "उकत शवकासक" याप्माणे करणयात आला आहे) ;

आशण जयाअ्थी, उकत प्ाशिकरणाने उकत जशमनीवरील उकत झोपडपट्ी सोसायिी महाराष्ट्र झोपडपट्ी (सुिारणा, शनमू ्गलन व पुनशव्गकसन) अशिशनयम, १९७१ मिील कलम ३सी(१) अनवये झोपडपट्ी पुनशव्गकास प्सताव क्ेत् घोशषत केले आहे.

आशण जयाअ्थी, उकत जडमनटीचा शवकास झोपडपिी पुनव्गसन योजनेअंतग्गत उकत डनयमावलटी शवशनयम क्र. ३३(१०) चया तरतुदीनुसार करणयाचे प्सताशवत केलेले असून, उकत प्ाडधकरणाने उकत जडमनटीवरटील उकत झोपिपट्टी सोसायटटी पुनडव्षकास प्सताव क्ेत्रास इरादा पत्र (LOI) डनग्षडमत केले आहे

आशण जयाअ्थी, उकत जमीन उकत शवकास योजनेमधये "Leisure Park (RSA3.7)" या आरक्णाने बाशित होत आहे ;

आशण जयाअ्थी, उकत जशमनीवरील उकत शवकास योजनेमिील "Leisure Park (RSA3.7)" हे आरक्ण बदलून तयाऐवजी "Municipal School (RE1.1)" हे आरक्ण बदलणयासाठी मा. स्ाशनक लोकप्शतशनिींनी व उकत शवकासकाने शवनंती केली आहे ;

आशण जयाअ्थी, उकत जशमनीवरील झोपडपट्ी पुनव्गसन योजनेची अंमलबजावणी होणेचया दृष्िीने व मा. स्ाशनक लोकप्शतशनिींनी केलेली शवनंती शवचारात घेतलयानंतर उकत जशमनीवरील "Leisure Park (RSA3.7)" या आरक्णाचा वापर बदलून "Municipal School (RE1.1)" असा वापर करणे या फेरबदलाकररता उकत अशिशनयमातील कलम ३७ (१बी) प्माणेची काय्गवाही करणे आवशयक आहे, असे उकत प्ाशिकरणाचे मत झाले आहे (यापुढे जयाचा उललेख "उकत फेरबदल" असा करणयात आला आहे.) ;

आशण तयाअ्थी, आता उकत अशिशनयमातील कलम ३७ मिील उप-कलम (१बी) अनुसार उकत प्ाशिकरण खालील अनुसूचीमधये शवशलेशषत केलयानुसारचया प्सताशवत फेरबदला संदभा्गत आम नागररकांकडून सूचना आशण/शकंवा हरकती मागशवणयाची सूचना प्शसधि करीत आहे. सदरची सूचना शासन राजपत्रात प्शसधि झालयाचया शदनांकापासून १ (एक) मशहनयात सूचना आशण/शकंवा हरकती मुखय काय्गकारी अशिकारी, झोपडपट्ी पुनव्गसन प्ाशिकरण, शतसरा मजला, प्िासकीय इमारत, प्ो. अनंत काणेकर माग्ग, वांद्े (पूव्ग), ंबई ४०० ०५१ यांचेकडे दाखल करणयात यावयात. शवशहत मुदतीत प्ापत होणाऱया सूचना आशण/शकंवा हरकती झोपडपट्ी पुनव्गसन मु प्ाशिकरणाकडून शवचारात घेणयात येतील.

अनुसूचटी

"¨ ¨बृहनमु ंबई महानगर पाशलका क्ेत्ातील बोरीवली पशशचम, मु ंबई उपनगर शजलहा, "आर/मधय" शवभाग, ये्ील नगररचना योजना, बोरीवली क्र.-III, अंशतम भुखंड क्र. ५३१ एकूण क्ेत् ५११०.२० चौ.मी. या बृहनमु ंबई महानगरपाशलकेचया मालकीचया क्ेत्ावरील "Leisure Park (RSA3.7)" या आरक्णाचा वापर बदलून "Municipal School (RE1.1)" याप्माणे आरशक्त करणयाचे प्सताशवत करणयात येत आहे."

२. उपरोकत प्सताशवत फेरबदल दि्गशवणारा भाग नकािा खालील काया्गलयांमधये काया्गलयीन वेळेत एक मशहनयाचया कालाविीकररता सव्गसामानय जनतेचया अवलोकना्ग उपलबि राहील.

Notice

[Under section 37(1-B) of the Maharashtra Regional and Town Planning Act, 1966] No. SRA/DDTP/Modification/Gaodevi Rahivashi CHS/Borivali TPSIII/

Whereas, the Development Plan of Greater Mumbai Municipal Corporation Area (hereinafter referred to as " the said Development Plan ") has been sanctioned by the State Government in the Urban Development Department, partly under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") vide Notification No. TPB-4317/629/ CR-118/2017/DP/UD-11, dated 8th May 2018 and the said Development Plan came into force from 18th May 2018;

And whereas, the revised Development Control and Promotional Regulations for Greater Mumbai Municipal Corporation Area have been sanctioned by the State Government vide Urban Development Department's Corrigendum Notification No.TPB-4317/629/CR-118(III)/2017/UD-11 dated 12th November 2018 (hereinafter referred to as "the said DCPR") and the said DCPR came into force with effect from 13th November 2018;

And whereas, the Government of Maharashtra vide Notification of Housing Department No.SRD 1095/CR-37/Housing, dated 16th December 1995 has appointed "Mumbai Slum Rehabilitation Authority" under the provisions of section 3(A) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 for its jurisdiction. (hereinafter referred to as "the said Authority");

And whereas, according to the provisions of section No-2(19) (b) of the said Act the said Authority has been declared as the Planning Authority for the purpose of implementation of Slum Rehabilitation Scheme in its jurisdiction and according to the provisions of section No- 37 (1b) of the said Act, the said Authority has been empowered for initiating modification in the said Development Plan and submit it to Government;

And whereas, the Chief Executive Officer of the said Authority has been empowered to initiate modification to the said Development Plan under the provisions of sub-section (1B) of section 37 of the said Act and call upon suggestions/objections from public by the resolution No. 5/6/4 dated 28th August 1997 of the said Authority ;

And whereas, the Chief Executive Officer of the said Authority has been empowered and authorized to make modification or correction etc. in the sanctioned Development Plans in the areas of Slum Rehabilitation Scheme/Slum Rehabilitation Area/Notified Slum Area under their jurisdiction as stipulated in section 37(1-B) of the said act and to submit proposal to the state Government for sanction under the provision of section 37 of the said Act, vide their Resolution No.12.6, dated 7th June 2004 ;

And whereas, the lands bearing Final Plot No. 531 of Town Planning Scheme, Borivali No. III, Borivali West, Tal. Borivali, Dist. Mumbai Sub-urban, District Ward No. R/C (hereinafter referred to as "the said Land") is notified Slum area and this Slum is popularly Known as Gaodevi Rahivashi Co-operative Housing Society (prop.) (hereinafter referred to as "the said Slum Society");

And whereas, the said Slum Society has appointed "SHUBHYUVI Infrastructure LLP" for the development of their proposal on the said land (hereinafter referred to as "the said Developer");

And whereas, the said Authority has declared the said Land as Slum Society Rehabilitation Area under section 3C(1) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act 1971;

And whereas, the said Authority has proposed to develop the said Land under regulation No. 33(10) of the said DCPR and the said Authority has sanctioned the Letter of Intent (LOI) for the said Slum Society rehabilitation proposal of the said Land;

And whereas, in the said Development Plan, the said Land is reserved as "Leisure Park (RSA3.7)" (hereinafter referred to as "the said Reservation");

And whereas, the Respected Local Public Representatives and the said Developer have requested to modify the said Reservation from "Leisure Park (RSA3.7)" to "Municipal School (RE1.1)" (hereinafter referred to as "the said Modification");

And whereas, after considering the request of the Respected Local Public Representatives and the said Developer, for the planned implementation of the scheme the said Authority is of the opinion that it is necessary to initiate the procedure under section 37(1B) of the said Act to modify the purpose of the said Reservation from "the "Leisure Park (RSA3.7)" to "Municipal School (RE1.1)" (hereinafter referred to as said Modification");

Now therefore, in accordance with the provisions contained in sub-section (1B) of section 37 of the said Act, the said Authority hereby publishes this notice for inviting suggestions and/or objections in respect of the proposed modification described in the schedule herein below, from the general public within 30 (thirty) days from the date of publication of the notice in the Maharashtra Government Gazette. The suggestion and/or objections shall be addressed to the Chief Executive Officer, Slum Rehabilitation Authority, Third Floor, Administrative Building, Prof Anant Kanekar Marg, Bandra (E.), Mumbai 400 051. The suggestions and/or objections received within the aforesaid stipulated period shall only be considered by the said Authority.

Schedule

"The lands bearing Final Plot No. 531 of Town Planning Scheme, Borivali No. III, situated at Borivali west, Tal-Borivali, Dist- Mumbai Sub-urban District, Ward No- R/C, owned by the Municipal Corporation of Greater Mumbai, having an area admeasuring 5110.20 sq.m which is reserved for the purpose of "Leisure Park (RSA3.7)" in the said Development Plan is proposed to modify to "Municipal School (RE1.1)";

2. A copy of the proposed modification shall be kept open for inspection by the general public in the following offices for the period of one month :—

(1) Chief Engineer, Development Plan, Municipal Corporation of Greater Mumbai, 5th floor, Extn. Building, Mahapalika Marg, Mumbai 400 001.

(2) The Dy. Director of Town Planning, Slum Rehabilitation Authority, First Floor, Administrative Building, Prof. Anant Kanekar Marg, Bandra (E.), Mumbai 400 051.

(3) The Dy. Director of Town Planning, Ensa-hutment, Azad Maidan, Mahapalika Marg, Mumbai 400 001.

(4) Assistant Commissioner, R/C Ward Office, Municipal Corporation of Greater Mumbai, Chandavarkar Road, Borivali (W.), Mumbai 400 092.
