क्रमांक एमव्हहीिही ०४२२/प्र.क्र.८२/परर-२.—ज्याअर्थी, महाराष्ट्र शासेनाने, शासेकहीय अदिसेूचना, गृह दिभाग क्रमांक एमव्हहीआर ०२१५/प्र. क्र.१०२/परर-२, ददनांक १३ मे, २०१५ (यात यापुढे दजचा दनददेश "उक्त अदिसेूचना" असेा केला आहे) अनुसेार राज्य रस्ता सेुरक्ा पररषद ि प्रत्येक दजल्हाकररता दजल्हा रस्ता सेुरक्ा सेदमतही पुनग्गठहीत केलही आहे ;
आदि ज्याअर्थी, रस्ता सेुरक्ेिरहील सेिवोच्च न्यायालयाच्या सेदमतहीने राज्यांना ि सेंघ राज्यक्ेत्ांना दजल्हा रस्ता सेुरक्ा सेदमत्या गठहीत करण्याचे दनदेश ददले आहेत, मोटार िाहन अदिदनयम, १९८८(१९८८ चा ५९) याच्या कलम २१५ च्या पोट-कलम (३) अन्िये तरतुदींचे अनुपालन करण्याकररता शक्य असेल त्याप्रमािे एकरूप सेंरचना ठेिण्याकररता सेि्ग राज्यांना ि सेंघराज्य क्ेत् यांना अनुपालनासेाठही दिदनयामक सेंरचनेचे दनदेश ददले आहेत ;
आदि ज्याअर्थी, रस्ता सेुरक्ेिरहील सेिवोच्च न्यायालयाच्या सेदमतहीचे दनदेश लक्ात घेता, उक्त अदिसेूचनेत सेुिारिा करिे महाराष्ट्र शासेनासे इष्टट िाटते ;
त्याअर्थी आता, मोटार िाहन अदिदनयम, १९८८(१९८८ चा ५९) याच्या कलम २१५ च्या पोट-कलम (२) ि (३) द्ारे प्रदान केलेल्या अदिकारांचा िापर करून महाराष्ट्र शासेन याद्ारे शासेकहीय अदिसेूचना गृह दिभाग क्रमांक एमव्हहीआर ०२१५/प्र.क्र. १०१/ परर-२, ददनांक १३ मे, २०१५ यामध्ये पुढहीलप्रमािे सेुिारिा करहीत आहे :—

(ख) दजल्हा रस्ता सेुरक्ा सेदमतही, पुढहील काय्ग पार पािहील :—
(एक) दजल्ह्ातहील रस्ते अपघातांचा दनयतकादलक आढािा घेिे.
(दोन) राज्य रस्ता सेुरक्ा िोरिाचही अंमलबजािही आदि त्या अंतग्गत ठरिलेलही उददिष्टटे यांचे सेदनयंत्ि करिे.
(तहीन) रस्ता सेुरक्ेिरहील सेिवोच्च न्यायालयाच्या सेदमतहीच्या रस्ता सेुरक्ा बाबींिर भारत सेरकार ि राज्य शासेन िेळोिेळही देईल अशा दनदेशांचही अंमलबजािही करिे.
(चार) दजल्ह्ातहील राज्य रस्ता सेुरक्ा पररषदेच्या दनि्गयांचही अंमलबजािही करिे.
(पाच) दजल्ह्ात झालेल्या रस्ते अपघातांचा सेदिस्तर मागिा घेिे आदि राज्य रस्ते सेुरक्ा पररषदेला त्याबाबत अिगत करिे, त्यामध्ये पुढहील बाबींचा सेमािेश असेल :—
(१) िाहनाचा तपशहील; (२) अपघाताचे कारि; (३) घटनास्र्ळाच्या तपासेाचा तपशहील, कोिताहही असेल्यासे; (४) अपराध्याचा/अपरािांचा तपशहील (कोिताहही असेल्यासे); (५) अपघात झालेल्या व्यक्तहीचा/व्यक्तींचा तपशहील/त्यांचही सेद्य:स्स्र्तही; (६) झालेल्या दुखापतहीचा प्रकार;

(सेहा) सेाि्गजदनक दठकािही मादसेक तत्िािर रस्ते अपघाताचही मादहतही प्रदसेद्ध करिे :—
(१) दजल्हा सेंकेतस्र्ळ पोट्टल (सेि्गत् प्रदसेद्ध कराियाचे); आदि
(२) माग्ग पररिहन ि महामाग्ग पोट्टल मंत्ालय
( http://morthroadsafety.nic.in/edisha/index.aspx)
(सेात) दजल्हा रस्ता सेुरक्ा योजना दिकदसेत करिे.
(आठ) मोटार िाहन अदिदनयमाच्या कलम १३५ क अन्िये दजल्ह्ातहील सेि्ग मोठ्ाप्रमािािरहील अपघातही मृत्यूचही तातिहीने न्याय सेहाय्यक तपासेिहीचही सेुदनस्चचतही करिे.
(नऊ) प्रदतसेाद िेळ ि रुग्िालयात पोहचदिण्याचही िेळ सेुिारण्यासे सेहाय्य व्हािे म्हिून सेुयोग्य रुग्ि िादहका ठेिण्याचही सेुदनस्चचतही करिे.
(दहा) दजल्ह्ातहील दिदि प्रकरिांच्या प्रमािानुसेार िेगिेगळ्या प्रकारच्या रुग्िादहकांचही पुरेशही उपलब्िता सेुदनस्चचत करिे.
(अकरा) दजल्ह्ातहील मोठ्ाप्रमािािरहील प्रािघातक अपघाताकररता आकस्स्मक िैद्यकहीय योजना तयार करिे.
(बारा) पूि्ग अदिसेूचना यंत्िा उभही करून रुग्िालय ि रुग्िादहका यांच्यामिहील दुिा सेुदनस्चचत करिे. सेंकटकालहीन पररस्स्र्तहीत, रुग्िालयातहील खाटांच्या उपलब्ितेचही मादहतही शोिण्यासेाठही रुग्िालयादरम्यान दुिा सेुदनस्चचत करिे.
(तेरा) गरजांचही पूत्गता ि रस्ता सेुरक्ा दनिहीचे दितरि करण्यासेाठही जसेजसेही आि्चयकता असेल तसेतसेा राज्य रस्ता सेुरक्ा पररषदेशही सेंिाद सेािण्यासेाठही मध्यितथी सेंस्र्ा म्हिून काय्ग करिे.
(चौदा) राज्य रस्ता सेुरक्ा पररषदेला/राज्याच्या प्रमुख एजन्सेहीला दनयदमत मादहतही देिे आदि रस्ता सेुरक्ा उपाययोजना खासे करून, प्रमुख अपघात प्रि क्ेत्/काळे खड्े इत्यादींच्या ओळखही सेंबंिात तसेच ४Esviz अदभयांदत्कही, दशक्ि, अंमलबजािही ि तातिहीच्या सेंबंिात दशर्ारसे करिे.
(पंिरा) रस्ते अपघात दपदिताना सेहाय्य करण्याकररता चांगल्या परोपकारही व्यक्तींना प्रेररत करिे.
(सेोळा) मांिही दकंिा सेुिारिा करण्याचही जसेजशही दिनंतही करण्यात येईल तसेतशही राज्य शासेनाला सेूचना देिे :—
(१) उक्त अदिदनयमानाच्या कलम १०७, १३८, १७६, २१० घ ि २१५ घ अन्िये केलेले दनयम;

(२) उक्त अदिदनयमाच्या कलम १३५ खालहील योजना.
(ग) दजल्हा रस्ता सेुरक्ा सेदमतही, पंिरिड्ातून दकमान एकदा आभासेही पद्धतहीने आदि मदहन्यातून दकमान एकदा प्रत्यक्पिे, अध्यक्ांनही दिदहत केलेल्या दठकािही बैठक घेईल. बैठकहीचे काय्गिृत्त बैठक झाल्यापासेून ४८ तासेांच्या आत, दजल्हा सेंकेतस्र्ळािर प्रदसेद्ध करण्यात येईल तसेच ते माग्ग पररिहन ि महामाग्ग मंत्ालयाच्या (http://morthroadsafety.nic.in/edisha/index. aspx) या सेंकेत पोट्टलिर/ माग्ग पररिहन ि महामाग्ग मंत्ालयाने सेंकल्पदचदत्त केलेल्या ि मान्यता ददलेल्या नमुन्यात अपलोि करण्यात येईल "

भाग चार-अ-२३७–२४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, डिसेंबर ५, २०२२/अग्रहायण १४, शके १९४४ HOME DEPARTMENT Mantralaya, Madam Cama Marg, Hutatma Rajguru Chowk, Mumbai 400 032, dated the 5th December, 2022.
NOTIFICATION
Motor Vehicles Act, 1988.
No. MVR-0422-/C.R.82/TR-2.—Whereas, the Government of Maharashtra has vide Government Notification, Home Department No.MVR.0215/C.R. 102/TRA-2, dated the 13th May 2015 (hereinafter referred to as "the said notification"), reconstituted the State Road Safety Council and District Road Safety Committee for each District ;
And whereas, the Supreme Court Committee on Road Safety has directed to the States and Union Territories that to constitute the District Road Safety Committees, a regulatory structure is directed for compliance by all the States and Union Territories, to maintain a uniform structure as far as feasible, in order to comply with the provisions under sub-section (3) section 215 of the Motor Vehicles Act, 1988 (59 of 1988);
And whereas, the Government of Maharashtra considers it expedient to amend the said notification in view of the directions of the Supreme Court Committee on Road Safety;
Now, therefore, in exercise of the powers conferred by sub-sections (2) and (3) of section 215 of the Motor Vehicles Act, 1988 (59 of 1988), the Government of Maharashtra hereby amends the Government Notification, Home Department No. MVR. 0215/C.R.101/TR-2, dated the 13th May 2015, to reconstitute the District Road Safety Committee for each District, as follows, namely :—
In the said notification,
(i) clause "(A)" shall be re-numbered as sub-clause (a) thereof and after sub-clause (a) so renumbered the following shall be inserted, namely :—
"(b) The State Road Safety Council shall hold meeting in every six months to go through the plans of Road Safety measures, implementation strategy and the monitoring mechanism;";
(ii) for clause"(B) District Road Safety Committee" the following shall be substituted, namely :—
"(B) (a) District Road Safety Committee.—

(b) The District Road Safety Committee shall perform the following functions, namely :—
(i) To take periodic review of the road accidents in the District.
(ii) To monitor the implementation of State Road Safety policy and the targets set under it.
(iii) To implement directions of the Supreme Court Committee on Road Safety, the Government of India and the State Government as may be issued from time to time, on matters of road safety.
(iv) To implement decisions of the State Road Safety Council in the District. (v) To regularly track and update State Road Safety Council on details of Road crashes that took place in the District, which shall include:—
(1) Details of the vehicle;
(2) Cause of crash;
(3) Details of spot investigation, evidence if any;
(4) Details of offenders (if any);
(5) Details of Victim and victim's latest condition;
(6) Type of injury caused;
(7) FIR registered if any.
(vi) To publish road accident data on monthly basis on public domain on:
(1) The district website portal (to be widely publicised); and
(2) The Ministry of Road Transport and Highways Portal (http://morthroadsafety. nic.in/edisha/index.aspx).
(vii) To develop a district road safety plan.
(viii) To ensure forensic crash investigation u/s. 135A of the MVA for all mass fatality crashes in the District.
(ix) To ensure optimal placements of ambulances to help improve response time and handover time to hospitals.
(x) To ensure adequate availability of different ambulance types as per historic caseload in the District.
(xi) To prepare an Emergency Medical Plan for mass fatality accidents in the District. (xii) To ensure linkage between hospitals and ambulances through setting up a prior notification system. Ensure linkage between hospitals to find out the availability of beds in case of emergency.
६ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, डिसेंबर ५, २०२२/अग्रहायण १४, शके १९४४ (xiii) To act as the nodal body for placing requirements, and disbursal of road safetyfunds and interact with State Road Safety Council as and when required.
(xiv) To provide regular inputs to the State Road Safety Council/Lead Agency of State and recommend road safety measures especially with regard to identification of major accident-prone areas/ Black spots etc. and also in parts regarding the important of 4Es viz. Engineering, Education, Enforcement & Emergency.
(xv) To promote Good Samaritans to assist the road accident victims
(xvi) Top provide suggestions to the State Government as and when requested to formulate or amend,—
(1) Rules made under sections 107, 138, 176, 210D, and 215D of the said Act; and (2) Schemes under section 135 of the said Act.
(c) The District Road Safety Committee shall hold its meeting at least fortnightly, on a virtual platform and meet physically at least once a month at a venue prescribed by the Chairman. The minutes of the meeting shall be made public on the District website within forty- eight hours of the meeting and also be uploaded to web portal of Ministry of the Road Transport and Highways (http://morthroadsafety.nic.in/edisha/index.aspx) in the format designed and approved by Ministry of the Road Transport and Highways.".
