ज्याअर्थी, महाराष्ट्र प्ादेशिक शनयोजन आशि नगररचना अशिशनयम, १९६६ (महा. अशिशनयम XXXVII, १९६६) (येर् ून पुढे उक्त अशिशनयम असे शनददेशि्त करण्या्त येईल), च्या कलम ४० च्या उप-कलम (१) मिील खंड (ब) द्ारा प्दान करण्या्त आलेल्या अशिकारांचा वापर करून महाराष्ट्र िासनाच्या नगरशवकास शवभाग (नशवशव) ने अशिसूचना क्रमांक टीपीएस-१७१२/४७५/ प्.क्र.-९८/१२/नशव-१२, शदनांक १० जानेवारी २०१३ व वेळोवेळी झालेल्या सुिारिा अन्वये त्या्त नमूद केल्याप्मािे, नवी मु ंबई शवमान्तळ प्भाशव्त अशिसूशच्त क्ेत्र (नैना), (येर्ून पुढे उक्त क्ेत्र असे शनददेशि्त करण्या्त येईल) साठी िहर आशि औद्ोशगक शवकास महामंडळ महाराष्ट्र मयायाशद्त (महाराष्ट्र िासनाच्या मालकीची व शनयंत्रिाखालील कंपनी) (येर्ून पुढे महामंडळ असे शनददेशि्त करण्या्त येईल) म्हिजे शसडकोची शविेष शनयोजन प्ाशिकरि (येर्ून पुढे शव.शन.प्ा.असे शनददेशि्त करण्या्त येईल) म्हिून नेमिूक केली आहे;
आशि ज्याअर्थी महाराष्ट्र िासनाने अशिसूचना क्र. टीपीएस-१२१५/२४५/ प्.क्र.-३३२/२०१६/एस.एम./यूडी -१२, शदनांक २७ एशप्ल २०१७ नुसार नैना्तील २३ गावांसाठी अं्तररम शवकास आराखडा मंजूर केला आहे, आशि अशिसूचना क्र. टीपीएस. १२१५/ २४५/प्.क्र. ३३२/१६/ई.पी./नशव-१२, शदनांक १ माचया २०१९ अन्वये अशिशनयमाच्या कलम ३१ च्या उप-कलम (१) नुसार अं्तररम शवकास आराखड्ाचा वगळलेले भाग मंजूर केले आहे;
आशि ज्याअर्थी महाराष्ट्र िासनाने अशिसूचना क्र. टीपीएस-१७१७/ एमआयएस २७५०/सीआर-९१ /२०१९/यूडी-१२, शदनांक १६ सप्टेंबर २०१९ नुसार नैना्तील १५१ गावांसाठी शवकास आराखडा मंजूर केला आहे आशि अशिसूचना क्र. टीपीएस. १२२१/१०४१/ प्.क्र. ७१/२१/नशव-१२, शदनांक २४ जून २०२२ अन्वये अशिशनयमाच्या कलम ३१ च्या उप-कलम (१) नुसार शवकास आराखड्ाचा वगळलेले भाग अंि्तः मंजूर केले आहे ;
आशि ज्याअर्थी शसडको संचालक मंडळाच्या ठराव क्र. १२३०७, शदनांक ३ माचया २०२० अन्वये पनवेल ्तालुक्या्तील रायगड शजल्ह्ा्तील शिवकर, शचखले, कोळखे, कोन आशि डेरवली यांच्या काही भागा्त नगररचना परीयोजना क्रमांक १० (येर्ून पुढे
(१) २ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, डिसेंबर २९, २०२२/पौर् ८, शके १९४४ टीपीएस-१० असे शनददेशि्त करण्या्त येईल) करण्याकरर्ता, उक्त अशिशनयमा्तील कलम ६० च्या उप-कलम (१) नुसार त्याचा उद्ेि घोशष्त केला आहे. आशि उक्त अशिशनयमाच्या कलम ६० च्या उप-कलम (२) मध्ये नमूद ्तर्तुदीनुसार टीपीएस-१० करण्याच्या उद्ेिाची घोषिा शदनांक १८ माचया २०२० रोजीच्या असािारि अशिकृ्त महाराष्ट्र शासकीय राजपत्रात (भाग -२) आशि स्र्ाशनक वृत्तपत्र "द फ्ी प्ेस जनयाल"आशि "आपले महानगर" यां्त शदनांक २ एशप्ल २०२० रोजी प्काशि्त करण्या्त आली आहे ;
आशि ज्याअर्थी, महाराष्ट्र प्ादेशिक शनयोजन रचना (सुिारिा) अशिशनयम, २०२० (सन २०२० चा महाराष्ट्र अशिशनयम क्र. १९) द्ारे, उक्त अशिशनयमाच्या कलम १४८(अ) मिील सुिारर्त ्तर्तुदीनुसार, अशिशनयमा्तील प्करिे दोन, ्तीन, चार व पाच मिील ्तर्तुदीप्मािे, कोित्याही शवकास योजना, प्ादेशिक योजना शकंवा योजनांसाठीचा कालाविी शवचारा्त घे्ताना, देिामध्ये शकंवा राज्यामध्ये उद्भविाऱ्या कोित्याही महामारीच्या शकंवा सार्ीच्यारोगाच्या फैलावास शकंवा आपत्ती जन्य पररस्स्र्तीस प्श्तबंि करण्याकरर्ता, भार्त सरकारने शकंवा, यर्ास्स्र्ती, राज्य िासनाने केलेल्या कोित्याही मागयादियाक ्त्वांच्या शकंवा टाळेबंदी उपाययोजनांच्या अंमलबजाविीमुळे, उक्त प्करिानुसारची कोि्तीही काययावाही पूिया होऊ िकली नसेल ्तर, असा कालाविी वगळिे आवश्यक आहे ;
आशि ज्याअर्थी, उक्त शवशह्त कालाविी, महाराष्ट्र राज्या्त शदनांक २३ माचया २०२० रोजी पासून कोव्हीड-१९ शवषािूच्या प्ादुभायावामुळे जाहीर केलेला टाळेबंदीचा कालाविी वगळ्ता अस्स्त्वा्त आहे ;
आशि ज्याअर्थी उपाध्यक् व व्यवस्र्ापकीय संचालक, शसडको यांनी, शसडको संचालक मंडळाच्या शदनांक २ एशप्ल २०२२ रोजीच्या ठराव क्र. १२५५१ अन्वये प्दान केलेल्या अशिकारांचा वापर करून क्र. शसडको/नैना/२०२२/ E-५६२२५ द्ारे शदनांक १२ आॅगस्ट २०२२ रोजी घोशष्त केलेल्या नगररचना परीयोजना क्रमांक १० मध्ये रायगड शजल्ह्ा्तील पनवेल ्तालुक्या्तील कोळखे, कोळखे पेठ, कोन, डेरवली आशि पळस्पे गावांच्या काही भागाच्या समावेिासाठी उक्त अशिशनयमा्तील कलम ६२ नुसार मंजुरी शदली आशि उक्त अशिशनयमा्तील कलम ६० च्या उप-कलम (१) नुसार सदर भागा्त, नगररचना परीयोजना करण्याच्या उद्ेिाची घोषिा शदनांक २५ ्ते ३१ आॅगस्ट २०२२ रोजीच्या अशिकृ्त महाराष्ट्र शासन राजपत्र (भाग -२) आशि स्र्ाशनक वृत्तपत्र 'फ्ी प्ेस जनयाल' आशि 'दैशनक शकल्ले रायगड' यां्त इंग्रजी व मराठी भाषे्त शदनांक २ सप्टेंबर २०२२ रोजी प्काशि्त करण्या्त आली आहे ;
आशि ज्याअर्थी, महाराष्ट्र िासन, महसूल व वन, आपत्ती व्यवस्र्ापन, मद्त व पुनवयासन शवभाग, मंत्रालय मु ंबई यांनी शदनांक ३१ माचया २०२२ रोजी शनगयाशम्त केलेल्या आदेिानुसार आपत्ती व्यवस्र्ापन कायदा, २००५ या कायद्ा अं्तगया्त यापूवथी कोव्हीड-१९ बाब्त लावण्या्त आलेले सवया शनबबंि हे शदनांक १ एशप्ल २०२२ पासून मागे घेण्या्त आले आहे्त;
आशि ज्याअर्थी, टीपीएस-१० ्तयार करण्याकरी्ता महाराष्ट्र िासनाच्या अशिकृ्त राजपत्र क्रमांक शसडको/ नैना/मु.शन./ टी.पी. एस.-१०/२०२० अन्वये शदनांक १८ माचया २०२० रोजी व क्र. शसडको/ नैना/ मु.शन./ टीपीएस-१०/ २०२२/५१५ अन्वये शदनांक २५ ्ते ३१ आॅगस्ट २०२२ रोजी प्शसद्ध झालेल्या घोषिा व्यपग्त झाल्या आहे्त आशि अिा घोषिा कोित्याही प्कारे व्यपग्त झाल्यास शनयोजन प्ाशिकरिास त्याच क्ेत्राच्या संदभाया्त कोित्याही वेळी नवीन घोषिा करण्यास उक्त अशिशनयमा्तील कलम ६१ च्या पोट-कलम (२) नुसार प्श्तरोि असिार नाही.
आ्ता म्हिून, शसडको संचालक मंडळाने, प्ारूप पररयोजना ्तयार करिेकरर्ता पुरेसा कालाविी उपलब्ि नसल्याची दखल घेऊन उक्त अशिशनयमाच्या कलम ६१ च्या पोट-कलम (२) अन्वये आहे ्तेच सीमाक्ेत्र कायम ठेऊन नव्याने नगररचना परीयोजना क्रमांक १० ्तयार करण्याचा उद्ेि घोशष्त करण्यास संचालक मंडळाच्या शदनांक ९ शडसेंबर २०२२ रोजीच्या बैठकी्त ठराव क्र. १२६२९ अन्वये मान्य्ता शदली व त्यासोब्तच कलम ६० च्या पोट-कलम (१) अन्वये रायगड शजल्ह्ा्तील पनवेल ्तालुक्या्तील मौजे शिवकर, शचखले, कोळखे, कोळखे पेठ, कोन, डेरवली आशि पळस्पे गावांच्या काही भागा्त नगररचना परीयोजना क्रमांक १० करण्याचा इरादा घोशष्त केला आहे.
आ्ता, म्हिून, उक्त अशिशनयमाच्या कलम ६० च्या उप-कलम (२) द्ारा प्दान केलेल्या अशिकारांचा वापर करून, महामंडळ याद्ारे नकािा्त दियाशवल्याप्मािे गुलाबी रंगाच्या सीमे्त समाशवष्टट क्ेत्रा्तील सवया गावांच्या काही भागा्त म्हिजेच रायगड शजल्ह्ा्तील पनवेल ्तालुक्या्तील मौजे शिवकर, शचखले, कोळखे, कोळखे पेठ, कोन, डेरवली आशि पळस्पे येर्े नगररचना परीयोजना क्रमांक १० करण्याचा इरादा घोशष्त कर्त आहे.
प्स्ताशव्त टीपीएस नं. १० मध्ये नकािा्त दियाशवल्याप्मािे गुलाबी रंगाच्या सीमे्त समाशवष्टट क्ेत्रा्तील सवया गावांच्या काही भागा्त म्हिजेच रायगड शजल्ह्ा्तील पनवेल ्तालुक्या्तील मौजे शिवकर, शचखले, कोळखे, कोळखे पेठ, कोन, डेरवली आशि पळस्पे गावांच्या जशमनीवर सक्म प्ाशिकरिाकडून वैि बांिकाम परवानगी शमळाली असल्यास अिा परवानगीचा ्तपिील नैना कायायालयाकडे सादरमहाराष्ट्र शासन राजपत्र असाधारण भाग दोन, डिसेंबर २९, २०२२/पौर् ८, शके १९४४ ३ करण्याची जमीन मालकांना शवनं्ती करण्या्त ये्त आहे. योजने्त सहभागी असलेल्या जमीन मालकांची संयुक्तीकपिे शकंवा वैयस्क्तकररत्या जमीन असेल आशि असे जमीन मालक एकच अंश्तम भूखंड शमळशवण्यास इच्छछुक अस्तील ्तर त्याना उक्त अशिशनयमाच्या कलम ६५ नुसार एकच अंश्तम भूखंड शमळिेसाठी िक्य्तो १५ शदवसांच्या आ्त संम्ती देण्यास शवनं्ती आहे.
उक्त अशिशनयमाच्या कलम ६० च्या उप-कलम (३) च्या ्तर्तुदींनुसार, नगररचना परीयोजना क्रमांक १० मध्ये अं्तभू या्त करण्या्त येिारे क्ेत्र (गुलाबी रंगाच्या सीमेने) दियाशविाऱ्या नकािाची प्त जन्तेच्या ्तपासिीसाठी मुख्य शनयोजनकार (नैना), ८ वा मजला, टॉवर नं. १०, बेलापूर रेल्वे स्र्ानक संकुल, सी.बी.डी. बेलापूर, नवी मु ंबई ४०० ६१४ येर्े कायायालयीन वेळे्त उपलब्ि आहे्त.
शवषयांशक्त पररयोजनेचे शसमाक्ेत्र दियाशविारा नकािा संबशि्त गावांच्या ग्रामपंचाय्त कायायालया्त ्तपासिीसाठी उपलब्ि राह्तील. सदर सूचना व नकािा शसडकोच्या संके्तस्र्ळ http://cidco.maharashtra.gov.in/NAINA.aspx. येर्े सुद्धा उपलब्ि राह्तील.

UNDER SECTION 60(2) OF THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966
Town Planning Scheme No. 10

WHEREAS, the Government of Maharashtra in exercise of powers conferred under clause (b) of sub-section (1) of the Section 40 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") declared by Notification, No. TPS -1712/475/CR-98/12/ UD-12, dated 10th January 2013 and subsequent amendment (hereinafter referred to as "the said Notification") City and Industrial Development Corporation of Maharashtra Limited (being a company owned and controlled by the Government of Maharashtra) (hereinafter referred to as "the Corporation") as Special Planning Authority (hereinafter referred to as "the SPA") for Navi Mumbai Airport Influence Notified Area (NAINA) (hereinafter referred to as "said notified area") as specified therein ;
And whereas, the Government of Maharashtra vide Notification No. TPS-1215/245/CR-332/2016/ SM/UD-12, dated 27th April 2017 has Sanctioned the Interim Development Plan (IDP) for the 23 villages of NAINA, and also vide Notification No.TPS.1215/245/C.R.332/16/ EP/UD-12, dated 1st March 2019 has sanctioned the Excluded Parts of the IDP under sub-section (1) of Section 31of the said Act ;
And whereas, the Government of Maharashtra vide Notification No. TPS-1717/ MIS-2750/ C.R.91/ 2019/ UD-12, dated 16th September 2019 has sanctioned the Development Plan (DP) for 151 villages of NAINA and also vide Notification No. TPS. 1221/1041/C.R.71/21/UD-12, dated 24th June 2022 has partly sanctioned the Excluded Parts of the DP under Section 31(1) of the said Act ;
And whereas, the Board of CIDCO vide Resolution No 12307, dated 3rd March 2020, had declared its intention under sub-section (1) of section 60 of the said Act, for making Town Planning Scheme No. 10 (hereinafter referred to as "TPS-10") at part villages of Shivkar, Chikhale, Kolkhe, Kon and Derawali of Taluka Panvel, District Raigad and a notice about declaration of making Scheme no.10 has been published in the Extraordinary Maharashtra Government Official Gazette (part-II) dated 18th March 2020 as well as in the daily newspapers "The Free Press Journal" and "Aaple Mahanager" in English and Marathi dated 2nd April 2020 under sub-section (2) of section 60 of the said Act ;
And whereas, in accordance with the amended provisions of section 148(A) of the said Act, vide Maharashtra Regional and Town Planning (Amendment) Act, 2020 (Maharashtra Act No. XIX of 2020), in computing the period, in relation to any Development Plan, Regional Plan or Scheme under the provisions of Chapter II, III, IV and V of the said Act, the period of periods during which any action could not be completed under the said chapters, due to enforcement of any Guidelines or lockdown measures by the Government of India or the state Government, as the case may be, to prevent the spread of any pandemic or epidemic or disaster situation arising in the Country or State shall be excluded ;
And whereas, the prescribed time limit is in existence on excluding the period of lockdown declared due to spread of COVID-19 virus in the State of Maharashtra, by the Government from dated 23rd March 2020;
And whereas, VC&MD, CIDCO in accordance with the powers delegated by CIDCO Board vide Resolution No. 12551, dated 2nd April 2022, had accorded approval for inclusion of additional area in declared TPS-10 under section 62 of the said Act and declared its intention for making Town Planning Scheme at additional area at part villages of Kolkhe, Kolkhe Peth, Kon, Derawali and Palaspe of Taluka Panvel, District Raigad under sub-section (1) of section 60 of the Act and published a notice about declaration of making TPS-10 with additional area in the Maharashtra Government official Gazette (part-II) dated 25th-31st August 2022 as well as in the daily newspapers "The Free Press Journal" and "Dainik Kille Raigad" in English and Marathi dated 2nd September 2022 under sub-section (2) of Section 60 of the said Act;
महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, डिसेंबर २९, २०२२/पौर् ८, शके १९४४ ५And whereas, all the orders that are currently in force for the imposition of restriction related to COVID-19 under Disaster Management Act, 2005 are withdrawn and no longer be in force from 1st April 2022 by order of Department of Revenue and Forest, Disaster Management, Relief and Rehabilitation dated 31st March 2022;
And whereas, both the declarations of intention published in Maharashtra Government official gazette vide No. CIDCO/ NAINA/ CP/ TPS-10/ 2020, dated 18th March 2020 and vide CIDCO/ NAINA/ CP/ TPS-10/ 2022/ 515, dated 25th-31st August 2022 to prepare TPS-10 have lapsed and any such lapse in declaration does not debar the Planning Authority from making fresh declaration any time in respect of the same area as per sub-section (2) of section 61 of the said Act.
Now therefore, Board of CIDCO acknowledge the insufficient time left to prepare Draft scheme and accorded approval for fresh declaration of Town Planning Scheme No. 10 with same scheme boundary under sub-section (2) of with section 61 of the said Act, vide Resolution No. 12629, dated 9th December 2022, and at the same time declared its intention for making Town Planning Scheme No.10 at part villages of Shivkar, Chikhale, Kolkhe, Kolkhe Peth, Kon, Derawali and Palaspe of Taluka Panvel, District Raigad under sub-section (1) of section 60 of the said Act.
Now therefore, in exercise of the powers conferred by sub-section (2) of the section 60 of the said Act, the Corporation hereby publishes its declaration of making Town Planning Scheme No. 10 at part area of all villages bounded by PINK border as shown on declaration plan, namely; Shivkar, Chikhale, Kolkhe, Kolkhe Peth, Kon, Derawali and Palaspe of Taluka Panvel, District Raigad.
Land owners who are having valid building permission obtained from Competent Authority, falling within the boundary of proposed TPS-10 (shown by PINK border on plan) of part villages Shivkar, Chikhale, Kolkhe, Kolkhe Peth, Kon, Derawali and Palaspe are requested to submit details of the same to NAINA office preferably within 15 days. Participants having land ownership jointly or severally willing to obtain a single final plot are requested to submit their consent under section 65 of the said Act for providing single plot preferably within 15 days.
In accordance with the provisions of sub-section (3) of section 60 of the said Act, a copy of the declaration along with the plan showing the boundary of Town Planning Scheme No. 10 (shown by PINK border) is kept open for inspection by the public in the office of Chief Planner (NAINA), 8th Floor, Tower No. 10, Belapur Railway Station Complex, CBD Belapur, Navi Mumbai-400 614, during office hours.
Copies of the plan showing the area to be included in scheme are also kept for inspection in the Grampanchayat offices of the villages included in the said Town Planning Scheme. Copy of the notice and plans are also available on CIDCO's website http://cidco.maharashtra.gov.in/ NAINA.aspx. The area included in the Town Planning Scheme No. 10 is bounded as stated below :—
On the North— Mumbai-Pune expressway, boundary of scheme no. 7 and Old Mumbai Pune highway NH-48
On the East— boundary of TP scheme No. 9
On the South— boundary of village Kon and boundary of TP scheme No. 11.
