अधिसूचना
क्रमांक नियोजन/म्हाळुंगे-माण नरयो क्र. १/प्रथम ेरबदल-७५२/२०२२.--ज्याअर्थी, प्राथमिक नगर रचना योजना क्रमांक १, म्हाळुंगे-माण ही शासनाच्या नगर विकास विभागाने अधिसूचना क्रमांक टीपीएस-१८१८/१६७३/प्र.क्र. २५६/१८/नवि-१३, दिनांक २ डिसेंबर २०१९ अन्वये महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ च्या कलम ८६ (१) (क) (यापुढे उक्त अधिनियम असा उल्लेख केला आहे) नुसार मंजूर केली असून ती दिनांक १० ेब्रुवारी २०२० रोजी अमलात आलेली आहे (यापुढे उक्त मंजूर प्राथमिक योजना असा उल्लेख केला आहे );
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ४० (१) व ४० (१) (घ) अन्वये, शासन नगर विकास विभागाची अधिसूचना क्रमांक टीपीएस-१८२१/ ११६७/प्र.क्र. ९८/२०२१/नवि-१३, दिनांक १४ जुलै २०२१ नुसार पुणे महानगरपालिका हद्दीतील मौजे म्हाळुंगे व इतर एकूण २३ गावांचे क्षेत्र अधिसूचित करून त्याकरिता पुणे महानगर प्रदेश विकास प्राधिकरणाची विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्यात आली आहे ;
आणि ज्याअर्थी, पुणे महानगर प्रदेश विकास प्राधिकरणाने ठराव क्रमांक ०३, दिनांक १४ ऑक्टोबर २०२१ नुसार मंजूर प्राथमिक नगर रचना योजना क्रमांक १, म्हाळुंगे-माणमधील पूररेषेने बाधित होणारे अंतिम भूखंड हे बांधकामयोग्य राहण्यासाठी त्यांचे मुळा नदीच्या निया पूररेषेबाहेर इतरत्र स्थलांतर व पुनर्रचना करण्याकरिता महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ च्या कलम ९२ अन्वये उक्त मंजूर प्राथमिक योजनेत ेरबदल करणेचा निर्णय घेतलेला आहे ;
आणि ज्याअर्थी, पुणे महानगर प्रदेश विकास प्राधिकरणाने संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांच्याशी विचारविनिमय करून तयार केलेली आहे व संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांनी उक्त अधिनियमातील कलम ६१ (१) अन्वये प्रारूप प्रथम ेरबदल नगर रचना योजनेबाबत (यापुढे उक्त प्रारूप नगर रचना योजना असा उल्लेख केला आहे) अभिप्राय/मुद्दे पत्र क्रमांक ३८७२, दिनांक २७ जुलै २०२२ अन्वये कळविले आहे;
आणि ज्याअर्थी, उक्त अधिनियमाचे कलम ६१ (१) अन्वये उक्त प्रारूप नगर रचना योजना पुणे महानगर प्रदेश विकास प्राधिकरण ठराव क्रमांक १, दिनांक १० ऑगस्ट २०२२ अन्वये प्राधिकरण कार्यालयात प्रसिद्ध करण्यात आली असून त्या संबंधीची जाहीर सूचना दिनांक १० ऑगस्ट २०२२ च्या महाराष्ट्र शासन असाधारण राजपत्रात तसेच दैनिक इंडियन एक्स्प्रेस या वृत्तपत्रामध्ये दिनांक ११ ऑगस्ट २०२२ व दैनिक लोकमतमध्ये दिनांक ११ ऑगस्ट २०२२ रोजी अनुक्रमे इंग्रजी व मराठीमध्ये प्रसिद्ध झालेली आहे;
आणि ज्याअर्थी, उक्त प्रारूप नगर रचना योजना प्रसिद्ध झाल्यानंतर उक्त अधिनियमाच्या कलम ६७ अन्वये विहित मुदतीत नागरिकांनी हरकती/ सूचना दाखल केलेल्या आहेत;

(पु.वि.पु.)--- १३२ महाराष्ट्र शासन राजपत्र, भाग एक-असाधारण -- पुणे विभागीय पुरवणी, ३१ डिसेंबर २०२२ / पौष १०, शके १९४४ आणि ज्याअर्थी, पुणे महानगर प्रदेश विकास प्राधिकरणाने संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांच्याशी विचारविनिमय करण्याकरिता दिनांक १२ ऑक्टोबर २०२२ च्या पत्राने कळविलेले आहे व त्यावर नगर रचना संचालनालयाने पत्र क्र. ६१०८, दि. ९ डिसेंबर २०२२ अन्वये उक्त नगर रचना योजनेमध्ये योग्य त्या दुरुस्त्या करून पुढील योग्य ती वैधानिक कार्यवाही करण्याबाबत प्राधिकरणास कळविलेले आहे;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ६८ (२) अन्वये प्रारूप नगर रचना योजना मंजूर करण्याचे शासनाचे अधिकार, उक्त अधिनियमाच्या कलम १५१ अन्वये शासन नगर विकास विभागाची अधिसूचना क्र. टीपीएस-१८१७/९७३/प्र. क्र. १०३/१७/नवि-१३, दिनांक १३ सप्टेंबर २०१७ नुसार महानगर प्रदेश विकास प्राधिकरणाच्या महानगर आयुक्त यांना प्रदान केलेले आहेत.
त्याअर्थी, उक्त नगर रचना योजना उक्त अधिनियमाच्या कलम ६१ (१) अन्वये महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्यानंतर उक्त अधिनियमाच्या कलम ६७ अन्वये प्राप्त हरकती/सूचना/आक्षेप विचारात घेऊन तसेच संचालक, नगर रचना महाराष्ट्र राज्य, पुणे यांनी दिलेल्या सूचना यांचा विचार करून आवश्यक तेथे दुरुस्ती करून उक्त अधिनियमाच्या कलम ६८ (२) अन्वये शासनाने प्रदान केलेल्या अधिकाराचा वापर करून उक्त नगर रचना योजना मंजूर करण्यात येत आहे. सदर अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अमलात येईल, तसेच उक्त अधिनियमाच्या कलम ६८ (क) मधील तरतुदी लागू होतील.
मंजूर प्राप्त प्रारूप नगर रचना योजना क्र. १, म्हाळुंगे-माणच्या अधिप्रमाणित प्रती व अहवाल पुणे महानगर प्रदेश विकास प्राधिकरणाच्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ खुले ठेवण्यात आले आहेत. तसेच नागरिकांना उक्त नगर रचना योजनेच्या नकाशाची किंवा अहवालाची प्रत किंवा त्यातील भागाची प्रत विहित मूल्य प्राधिकरण कार्यालयात जमा केल्यानंतर विक्रीसाठी उपलब्ध राहील.

Sanctioned Town Planning Scheme No. 1, Mhalunge-Maan (Draft First Varied)
Under Section 68 (2) of the Maharashtra Regional and Town Planning Act, 1966
Notification
No. Planning/Mhalunge-Maan TPS No. 1/first varied/752/2022.––Whereas, the Preliminary Town Planning Scheme No. 1 (Mhalunge-Maan) has been sanctioned by the Government under sub- section (1) (a) of Section 86 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter, referred to as "the said Act") vide Government in Urban Development Department Notification No. TPS-1818/1673/CR-256/18/UD-13, dated 2nd December 2019 and has come into force with effect from 10th February 2020 (hereinafter referred to as "the said Sanctioned Preliminary Scheme");
And whereas, Government of Maharashtra in Urban Development Department vide Notification No. TPS-1821/1167/CR-98/2021/UD-13, dated 14th July 2021 declared the Pune Metropolitan Area as notified area under sub-section (1) of Section 40 and sub-section (1), (d) of Section 40 of the said Act and appointed Pune Metropolitan Region Development Authority as the Special Planning Authority for the Mhalunge and other 23 total villages which included in the Pune Municipal Corporation ;
And whereas, Pune Metropolitan Region Development Authority, vide Resolution No. 03, dated 14th October 2021 has decided to vary the said Sanctioned Preliminary Scheme under Section 92 of the said Act, to shift and relocate such final plots elsewhere beyond the blue lines of Mula River in order to make them buildable by maintaining their potentiality and to make such modifications in the Preliminary Scheme, wherever necessary ;
महाराष्ट्र शासन राजपत्र, भाग एक-असाधारण -- पुणे विभागीय पुरवणी, ३१ डिसेंबर २०२२ / पौष १०, शके १९४४ ३And whereas, the Pune Metropolitan Region Development Authority after consulting the Director of Town Planning, Maharashtra State, Pune has prepared the said scheme in accordance with provisions of the said Act and rules thereunder and Director of Town Planning, Maharashtra State, Pune has communicated vide Letter No. 3872, dated 27th July 2022 some points / opinion to the publication of Draft First Varied Town Planning Scheme (hereinafter referred to as "the said Draft Town Planning Scheme) under Section 61 (1) of the said Act.
And whereas, vide Resolusation No. 1, dated 10th August 2022, Pune Metropolitan Region Development Authority has published the said Draft Town Planning Scheme under section 61 (1) of the said Act and the notice to that effect has been published in the Maharashtra Government Gazette, Extra-Ordinary, dated 10th August 2022 and also in the daily newspapers Indian Express on dated 11th August 2022 and Lokmat, dated 11th August 2022 in English and Marathi respectively;
And whereas, after publication of the Draft Town Planning Scheme, suggestions / objections where submitted by the persons within the prescribed limit as per Section 67 of the said Act; And whereas, Pune Metropolitan Region Development Authority sent a letter, dated 12th October 2022 to the Director of Town Planning, Maharashtra State, Pune for the consultation of the said scheme and Director of Town Planning vide letter No. 6108, dated 9th December 2022 given corrections in the Draft Scheme and communicated to sanction as per Section 68 (2) of the said Act;
And whereas, Government in Urban Development Department in exercise of the powers conferred under Section 151 of the said Act, have delegated the power to sanction the Draft Town Planning Scheme under Section 68 (2) of the said Act to the Metropolitan Commissioner of the Metropolitan Region Development Authority vide Notification No TPS-1817/973/CR-103/17/UD-13, dated 13th September 2017.
Now, therefore, after publication of the said Draft Town Planning Scheme in the Official Gazette under Section 61 (1) of the said Act and considering the suggestions / objections received under Section 67 of the said Act and considering the suggestions of the Director of the Town Planning, Maharashtra State, Pune and in exercise of the powers delegated under Section 151 (1) of the said Act, hereby accord sanction to the said Draft Town Planning Scheme under Section 68 (2) of the said Act. This Notification shall come into force from the date of its publication in the Maharashtra Government Gazette and the provisions of Section 68 (A) of the said Act shall apply.
The certified copies of the approved Draft Town Planning Scheme No.1, Mhalunge-Maan and plan thereof are kept open for inspection by the public during office hours on all working days in official time in the office of the Pune Metropolitan Region Development Authority. A copy of the plan and Scheme book of the said scheme or part thereof can be obtained after payment of prescribed fees.
